Chairman Nylen stated that the meeting has been properly noticed and posted. Chairman Nylen asked if there were any persons present in the audience wishing to be heard on any items on the agenda. The Petitioner's representative addressed the Board in protest to the valuation; advised that another sentative previously appeared before the Board in March and requested a value of $5,087,463; from that hearing two numbers were transposed to $5,807,463; from the commen~s and transcript of that hearing the intent was to reduce the value to the $5,087,463. continued- Minutes Dole: Poge: 3 4

DIFEDERICO Absent: Campa, Dugan continued - Page 2 LETICA CORP NV (PETITION NO. 6878) The Petitioner's representative further stated that the case was appealed to the state Board of Equalization to correct the matter, but remanded back to the County Board for review and to take into consideration any supplemental evidence presented by the Petitioner; the State Board of Equalization also expressed concern regarding the allocation of value between the improved and vacant portion of the propertyi and referenced an appraisal that was submitted to the Assessor's Office. Member Nylen advised that she mistakenly transposed the numbers after an eleven-hour meeting and the Board was very confused and frustrated after the Petitioner's representative and the Assessor's Office presented their cases due to the extreme length of the meeting. Member Nylen further stated that she recalled one of the main issues with the case was discrepancy between the 0.35 or 0.38 acres of excess land. Discussion was held between the Board and Legal Counsel regarding the supplemental information submitted by the Petitioner. Legal Counsel further stated that the Petitioner should not be allowed to create a new argument regarding the case. Upon questioning regarding the appraisal, the Petitioner's representative stated that the Petitioner appealed the case in March 2012 for a value of $5,087,000 and the appraisal is consistent with that value and provides the allocation between the excess land and the improved property. -continued- Minules Dole: 12/20/12 Page: 5 4

OIFEDE.'(lCO Absent: Campa, Dugan Continued - Page 3 LETICA CORP N\l (PETITION NO. 6878) The Peti 's representative further stated that the State Board of Equalization remanded the case so that further evidence can be taken into consideration; the Board asked the Petitioner's representative at the hearing in March if his value included excess land and the Petitioner's, response was; \\Ours inc ludes everything, the acres, the two buildings, everything"; at the County Board the $5,087,000 included both; and the appraisal helps define how much is allocated to the improved and excess land. Staff advised that the case was remanded due to the error of t ing the numbers and that the Board needs to clarify; the remand statute states, "If the State Board finds that there is an inadequate record because an act of omission by the County Assessor, the District Attorney, or the County Board of zation, the State Board of Equalization may remand the case to the County Board with the directions to develop an adequate record within thirty days". Gpon questioning by the Board, the Petitioner's representative stated a value of $5.1 million. DIFEDERICO Absent: Campa, Dugan Continued - Page 4 LETICA CORP NV (PETITION NO. 6878) Further discussion was held among the Board members regarding using a $0.23 rental rate on $174,827, with 3% vacancy, 5% expenses which equated to $4,680,468 minus the $5,087,463 is a difference of $406,995 which equated to $11,369 per acre for the excess land which is less than the Assessor's value. Upon questioning by the Board, staff advised that the Assessor's Office recommended a value of $6,065,227 for all of the land and improvements. Staff further stated that the Assessor's Office recommended a new value using a lease rate of $0.25 instead of $0.28; there was one parcel of excess land admitted so the calculation should include 43.3 acres of excess land and 46 acres of excess land was used in the appraisal that was submitted. Following discussion, Member Nylen accepted the Petitioner's appraisal and allowed the County Assessor's Office to present new evidence. Staff referenced the capitalization summary; advised that $0.25 lease rate was used, with 3% vacancy, 5% expenses, and a 9.5% cap rate; and added $700,000 for excess land; and recommended a value of $5,826,838. Upon questioning, staff advised that the excess land is in line with what is in the appraisal. The Petitioner's appraiser discussed the appraisal report and estimated a value of $25.00 per square foot on the developed portion of land; looked at three sales of vacant sites in determining the estimated value for excess land -continued- Minutes Date: 12120/12 Page: 7 6

DIFEDERICO Absent: Campa, Dugan Continued - Page 5 LETICA CORP NV (PETITION NO. 6878) at $15,000 per acre or $700,000; on the developed portion of land at $25.00 per square foot equated to $4.4 million; estimated a rental rate of $0.25 per square foot, 15% vacancy, 6.1% expenses, and a 9.25% cap rate which indicated a value of $4,440,000; and concluded a market value opinion of $4.4 million for the developed portion and $700,000 for the excess land for a total of $5.1 million. Staff then commented on the vacancy rate and that the same methodology was used in the direct capitalization as in the Poly-West Plant located in Henderson; referenced six comparable sales and the sales ranged from $29.13 to $58.54 per square foot; the lowest comparable at $29.13 per square foot was equivalent to the value recommended by the Assessor's Officei the average of the six comparable sales is $47.41 per square foot the $25.00 per square selected by the Petitioner's appraiser is a 47.4% discount from the average and in his opinion that degree of a discount is unsupported in the appraisal; and recommended a value of $5,826,838. Member Cheshire commented on various issues, including the vacancy and cap rate. FINAL ACTION: It was moved by Member DiFederico that the Board accept the Appellant's recommended value of $5.1 million which allocates $700,000 for the land and $4.4 million to the improved portion of the property. -continued- Minutes Date: 12/20/12 Page: 8 7
