1 Provo City Planning Commission Report of Action January 14, 2015 ITEM 3 Andy Kirby, an agent for the LDS Church, requests Project Plan Approval for new training facilities on approximately 5 acres, generally located at 2005 North 900 East in the TF (Training Facilities) zone. University Neighborhood PPA The following action was taken by the Planning Commission on the above described item at its regular meeting of January 14, 2015: APPROVED WITH CONDITIONS On a vote of 5:0, the Planning Commission approved the above noted application, with the following conditions: Conditions of Approval: 1. That all remaining technical requirements listed by the Coordinators Review Committee by complied with before any building permits are approved. 2. That parking be provided off-site with satellites and that it will not infringe negatively on the neighbors or through residential streets. 3. That there will be regular monitoring of vibrations and inspections that may include placement of monitors on various property owners properties to monitor for degree of vibration. 4. That there is appropriate ingress and egress, particularly located on the University Parkway entrance to the facility. 5. That Staff Recommendation #1, regarding the removal of the fence along the buildings, be dismissed. STAFF PRESENTATION The Staff Report to the Planning Commission provides details of the facts of the case and the Staff's analysis, conclusions, and recommendations. CITY DEPARTMENTAL ISSUES $ Traffic study required and at this stage of project review or approval. $ Important issues raised by other departments addressed in Staff Report to Planning Commission. NEIGHBORHOOD MEETING DATE $ A neighborhood open house was held on November 18 th, 2014.
2 NEIGHBORHOOD AND PUBLIC COMMENT $ The Neighborhood Chair was not present or did not address the Planning Commission during the hearing. $ The Pleasant View Neighborhood Chair, Paul Evans, was present and addressed the Planning Commission during the public hearing. CONCERNS RAISED BY PUBLIC Any comments received prior to completion of the Staff Report are addressed in the Staff Report to the Planning Commission. Key issues raised in written comments received subsequent to the Staff Report or public comment during the public hearing included the following: $ Paul Evans stated that the plan is going to be a benefit for all involved, but has the following concerns: - Vibrations from construction activities have been causing discomfort and concern for neighbors, and would like to see that that concern be addressed as a condition in the decision. - That there has been no official neighborhood meeting to address more specific concerns. - That the timing of construction has been a concern for the neighbors, and they would like to see a 7 am to 5 pm time for construction activities. - That the construction traffic and parking will be disrupting for the neighborhood streets and residents, and suggested that construction parking be located off of 900 East in available parking lots and that language in the approval reflect that traffic be directed away from neighborhood streets. APPLICANT RESPONSE Key points addressed in the applicant's presentation to the Planning Commission included the following: $ Applicant stated that the MTC and BYU security strongly directed that a boundary fence be on the property for safety reasons, as it is a closed campus that needed visible and physical separation from the public. $ John Thompson (project architect) stated that the fence will be a black picket fence that will be fairly open and that it will be setback from the sidewalk. $ Applicant stated that the plan is to have a carded entrance for employees on the southern entrance. $ Applicant stated that he has talked to the stake presidents of the church parking lots that they plan to use for construction parking. $ Applicant stated that they are prepared to monitor vibration for surrounding residences and use the standard hours for construction work, as allowed by City Code. PLANNING COMMISSION DISCUSSION Key points discussed by the Planning Commission included the following: $ Jamin Rowan shared his concerns of a fence being included on the boundary of the property and that it may not have been reviewed fully by the Design Review Committee. $ Jamin Rowan also asked the applicant what type of access is planned for the southern entrance of the campus off of University Parkway, stating that it is important that it be allowed for private ingress and egress and should be listed as a condition. $ Fred Bandley stated that he has no concern with the fencing as planned. $ Ed Jones stated that he has no concern with the fencing as planned, that he trusts the security professionals. FINDINGS / BASIS OF PLANNING COMMISSION DETERMINATION The Planning Commission identified the following findings as the basis of this decision or recommendation: $ That there is merit in including the added conditions brought up by Jamin Rowan and Paul Evans, but that the staff condition of disallowing a fence did not seem like a reasonable condition. Administrative decisions of the Planning Commission (items not marked with an asterisk) may be appealed by submitting an application/notice of appeal, with the required application and noticing fees, to the Community Development Department, 330 West 100 South, Provo, Utah, within fourteen (14) calendar days of the Planning Commission's decision (Provo City office hours are Monday through Thursday, 7:00 a.m. to 6:00 p.m.). Property Owner: Brigham Young University Parcel ID#: 20:071:0037 Current Zone: TF Proposed Zone: TF General Plan Des.: PF Acreage: 5 Number of Properties: 1 Number of Lots: N/A Council Action Required: No ALTERNATIVE ACTIONS 1. Continue to a future date to obtain additional information or to further consider information presented. The next available meeting date is February 11, 2015, 5:00 p.m. 2. Deny the requested Project Plan. This action would not be consistent with the recommendations of the Staff Report. Relevant History: The Missionary Training Center (MTC) has been looking for space to expand since The current laundry and maintenance facilities on the site are being moved to the opposite corner of 900 East and University Parkway to provide room for the MTC to expand. The DRC approved the plans on December 4 th. Neighborhood Issues: The applicant met with the neighborhood in an open house on November 18 th and received positive feedback. Summary of Key Issues: The current uses on the subject property are being moved and the buildings are set to be demolished. The MTC needs to expand, and the adjacent property to the south fits that need. The plan fits the Zoning and General Plan for the property. Staff Recommendation: Staff recommends approval of the project plan.
5 Planning Commission Staff Report Item 3 January 14, 2015 Page 2 OVERVIEW Andy Kirby, an agent for the LDS Church, is requesting approval for new MTC buildings to be built at the northwest corner of 900 East and University Parkway, as an extension of the current training facilities at 2005 North 900 East. The current facilities need to be expanded due to increased number of LDS missionaries. The zoning was changed in 2013 to enable the training facilities to expand. Since that time the laundry and maintenance facilities for BYU have been approved to be built at the southeast corner of 900 East and University Parkway, in order to clear the subject property in anticipation of new MTC buildings. The proposed project consists of two, six-story buildings with classrooms and study halls, underground parking for approximately 340 cars, as well as a large landscaped courtyard. The plans meet all the design requirements for the zone and were approved by the Design Review Committee at a hearing on December 4 th, FINDINGS OF FACT 1. Table one summarizes existing and land use and zoning characteristics. The only difference staff has noticed from earlier discussions and plans regards fencing. Previous plans and discussions with staff did not include fencing along University Parkway or along 900 East where the new buildings will be located. The buildings, themselves, were to act as fencing. Current plans now show actual fencing between the new buildings and the roadway. Staff prefers for former plan.
7 Planning Commission Staff Report Item 3 January 14, 2015 Page 4 CONCLUSIONS The proposed plan is anticipated to comply with all applicable code requirements prior to the issuance of a building permit. STAFF RECOMMENDATION Staff recommends that the proposed project plan be approved, subject to the following conditions: 1. That the MTC follow previous discussions and plans that did not include fencing along University Parkway or 900 East where the new buildings will and located, and 2.
