Current Legal Use: The properties are currently used as Provo City s Energy complex, a one-family dwelling homee and park/openn space areas. Relevant History: None Neighborhood Issues: Staff has not been contacted regarding neighborhood concerns. Summary of Key Issues: The proposed plat encompasses five lots which have been utilized as Provo City s Energy Complex. The proposed plat will containn five lots but the lot boundaries are changing. Staff Recommendation: 1. Approve the requested Plat, with conditions. Staff has provided recommended conditions of approval in the event that the Planning Commission approves the plat 3. Deny the requested Plat. This action would not be consistent with the recommendations of the Staff Report. The Planning Commission should state new findings.

2 Planning Commission Staff Report Item 1 Page 2 OVERVIEW Currently, the City s Energy complex contains five lots. The city is redefining the lot lines but not increasing or decreasing the number of lots. FINDINGS OF FACT 1. The City s Energy Complex currently encompasses five lots. 2. The proposed plat will have five lots but the arrangement of the lots will be changed. 3. All of the lots, except Lot 3, comply with the requirements for the PF (Public Facilities) zone and Title Lot 3 is currently zoned as PF but the legal use is as a one-family dwelling. Because it is a nonconforming use and the lot is not being altered, Lot 3 will not be required to comply with the lot requirements for the PF zone. 5. The Coordinators Review Committee has reviewed the plat and has some remaining technical issues which must be resolved prior to final approval and plat recordation. 6. The properties are located in the PF (Public Facilities) zone which is governed by Chapter and in the R1.6A (One-Familyy Dwellings with Accessory Apartment Overlay) zone which are governedd by Chapters and No bonding or fees are being required by thee Engineering Department at this time.

6 Planning Commission Staff Report Item 1 Page 6 STAFF ANALYSIS Staff has no concerns with the proposed plat. The proposed plat will not create any zoning violations for the existing structures or any lot standard violations for the proposed lots. CONCLUSIONS The proposed plat is in compliance with Provo City code, provided remaining technical requirements identified by the Coordinators Review Committee are addressed. The plat should be conditionally approved subject to compliance with Staff s recommended conditions of approval. CONDITIONS OF APPROVAL 1. That all remaining technical requirements of the Coordinators Review Committee Analysis, dated April 24, 2013, be complied with prior to final plat approval and recording, inasmuch as it complies with Provo City Code. 2. That at such time as Lot 3 is no longer utilized as a one-family dwelling, an amended plat will be required. APPEAL Decisions of the Administrative Hearing Officer may be appealed to the Provo City Board of Adjustment by filing a written appeal with the Community Development Department within fourteen (14) days following the date of the hearing per the requirements of Section 14.05, Provo City Code.
