LEGISLATIVE COUNSEL S DIGEST AB 1063, as amended, Eggman. Record of survey: additional information. Surveyors and engineers. Existing law provides for the licensing and regulation of professional engineers and land surveyors by the Board of Professional Engineers and Land Surveyors in the Department of Consumer Affairs. Existing Existing law prohibits a person from representing themself as an engineer or surveyor, as described by various titles, unless the person is licensed as an engineer or surveyor, as specified. Other existing law makes a violation of those prohibitions a misdemeanor. This bill would additionally prohibit a person from using the title city engineer, county engineer, city surveyor, or county surveyor, unless the person is licensed as an engineer or surveyor, respectively, as specified. By expanding the scope of existing law, the violation of which is a crime, this bill would impose a state-mandated local program. He is licensed as a Land Surveyor in the State of California and is a Certified Photogrammetrist through the American Society of Photogrammetry and Remote Sensing. He holds a BS and MS from California State University, Fresno. He started out his career teaching, and then spent the next 15 years with HJW in Oakland involved in a full range of geospatial endeavors. In 2007 he shifted focus towards Land Surveying with a primary focus on boundary resolution. In September of 2011 he joined Photo Science, a coast to coast geospatial solutions firm where he is now the Senior Program Manager for the West Coast Office in Emeryville, Ca. I ve found it to be a valuable tool for solidifying monument conservation procedures. Anne Hoppe, chair of the monument conservation committee, and City Surveyor for the City of San Diego, has been the driving force for compiling this information. Personally, I have begun preparing a procedure for my local agency to improve understanding and work to construct new monuments in Central Contra Costa County. We currently have an opening for a Survey Software Application Tester for Topcon's Construction products. The Ideal candidate will have previous Surveying experience using Topcon products in the field. The Software Application Tester will provide end-user level testing of software applications and systems, provide written reports of test results, work with support teams and communicate with product and program management in regular meeting. Responsibilities included end-user testing of integrated software and hardware systems, and the validation that the current systems meet functional requirements and performance expectations. The development of software applications results in the deployment of new code and fixes to existing code several times a year. The scope of the workload will include testing every deployment. In addition, the workload will also include creating and maintaining test plans and testing support tasks for the systems. State Board Update (submitted by Janine Hampton) (Continued from page 1) Sections 475, 476, and 3065 of Title 16 of the California Code of Regulations relating to the Code of Professional Conduct. Eliminates the possibility for agency-employed Geologists to review their own work, code already dis-allows this practice for engineers and surveyors. Sections and to Title 16 of the California Code of Regulations relating to the Applicant Fingerprint Program. Gives Board the authority to use licensing exam applicant fingerprints for a criminal records search; puts responsibility of costs incurred for fingerprinting and searches onto applicant. Sections 442 and 3035 of Title 16 of the California Code of Regulations relating to Examination Subversion. Updates exam subversion language for consistency and uniformity across engineering, surveying and geologist testing; adds language pertaining to advent of electronic testing; allows for Board discretion on determination on behavior, on a case-by-case basis, of Exam Subversion, and includes examples of behavior that the Board may determine to constitute exam subversion Sections 411, 412, 3008, and 3009 of Title 16 of California Code of Regulations relating to Seal, Signature, and Address Change. Removes the word opaque from the description of the ink required for stamping; requires all address change notification to the Board be in writing and changes the time period from within 60 days to within 30 days; changes stamp/seal requirements for geologists to consistency with stamp/seal requirements for engineers and land surveyors. *Comments on the changes were accepted up until April 15 th, so perhaps instead the Board is proposing to amend it is really the Board will be amending.

This position manages the Survey Section of the Public Works Department, consisting of approximately 15 employees. Duties and responsibilities The incumbent will be in charge of providing professional land surveying services to the City of San José. Such services include the following: Preliminary engineering surveying and topographies for capital improvement projects Legal description and plat preparation for City property and right-of-way acquisition Construction staking for capital improvement projects Boundary surveys of City lands Computerized mapping and data reduction Subdivision map review for technical correctness per Municipal Code requirements and the Subdivision Map Act Review of capital improvement project plans/specifications and survey maps for conformance with local and state ordinances Review, evaluation, and approval of land surveying work performed by consultants Survey monument preservation. Development and maintenance of citywide horizontal and vertical surveying control systems. Establishment of guidelines to maintain professional, technical, and legal standards mandated by State law. Desirable Competencies Experience supervising employees performing surveying activities within a public agency Knowledge and experience with the private development review process by a public agency Experience in workload and budget forecasting Experience performing conventional and GPS surveys Experience working with GIS MINIMUM QUALIFICATIONS Any combination of training and experience equivalent to the following: 1. Education: A Bachelor s degree in Land Surveying or Civil Engineering from an accredited College or University. 2. Experience: Five (5) years of progressively responsible professional land surveying experience including three (3) years of experience supervising one or more survey crews. 3. Licenses or Certificates: Possession of a valid Certificate of Registration by the State of California authorizing the practice of Land Surveying in accordance with the Land Surveyor s Act. Possession of a valid California Driver s License. Acceptable Substitutions: Possession of a Land Surveyor-in-Training (L.S.I.T.) or Engineering-in-Training (EIT) Certificate may be substituted for the required education. 9 Page 9 Assembly Bill No (Continued from page 1) Existing law provides for the filing of a record of survey by licensed surveyor or licensed civil engineer with the county surveyor. This bill would authorize a licensed surveyor to include additional information to be filed simultaneously, as a separate document, as specified, with a record of survey. Existing law requires any monument set by a licensed land surveyor or registered civil engineer to mark or reference a point on a property or land line shall be permanently and visibly marked or tagged with the certificate number of the surveyor or civil engineer setting it, as specified, or if the monument is set by a public agency, to be marked with the name of the agency and the political subdivision it serves. This bill would require the monument to be marked by the surveyor or civil engineer, as specified, and to be marked with the name of the agency and the political subdivision it serves, if the monument is set by a public agency. By imposing additional duties on public agencies, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions. 11 Public Works Agency Office of the City Land Surveyor Design & Construction Services Dept Memorandum April 2, 2013 Changes in Subdivision Map Processes On April 1 st Mr. Ray Derania retired from the City of Oakland as Building Official / City Engineer. Mr. Derania is a Civil Engineer also licensed to practice surveying so, in the past only his statement was required. To accommodate his departure new procedures have been put in place: 1) Mr. David Harlan, PE will be acting City Engineer and Building Official until a permanent appointment has been made. Mr. Harlan will be signing those subdivision maps which require dedications or public improvements as the City Engineer. 2) I will be signing maps as the City Surveyor. 3) Copies of the revised and required statements are available via Mr. Harlan s office. 4) An electronic copy of my seal is also available for application to the mylars to avoid the classic ink smear that the rubber stamps on Mylar create. Please contact me for a copy and a limited authorization to use it. Mr. Harlan may make one available also (his option). 5) There is a minor change in the final submission process. We will now require TWO duplicate mylars bearing original signatures. One will be processed as a conforming copy for filing in my offices. Also, a pdf copy of the filed map is required (the title company can routinely handle that).
