Harner, submitted a new Application for Rezoning on March 20, 2018 with a modified map request for Tax Parcel ,067-,0000- of 71.9 acres, currently zoned RA (Rural Agricultural). Aspen Whitehall Partners submitted the original request on May 10, 2017, however, at the public hearing held on September 18, 2017, the Board of Supervisors made a motion to approve the rezoning request, but it failed to carry 1-4. Since that time, the prospective developer met with the surrounding residents and revised the application to rezone the property in accordance with the feedback from the surrounding property owners. Specifically, the application has removed the request for two-family residential (R-2), reduced the size of the area designated General Commercial (C), and illustrated a projected street design for the development at the intersection of Cato Avenue. Staff Recommendation: The Planning Commission provide initial review and comment on the rezoning proposal and request that staff provide a revised land use analysis for consideration. IV. Schoch, Community Planner DATE: April 4, 2018 SUBJECT: 2191 West Whitehall Road Rezoning Request Resubmittal Harner Farms Ferguson Township Department of Planning & Zoning received a copy of the Rezoning Application and Rezoning Request Map from Aspen Whitehall Partners, LLC, on behalf of Danny R. and Pamela M. Harner and Thompson P. Harner and Nancy P. Harner on March 20, The Application and Map request involves Tax Parcel ,067-,0000- of 71.9 acres, currently zoned RA (Rural Agricultural). Aspen Whitehall Partners submitted a similar request on May 10, 2017, however, at the public hearing held on September 18, 2017, the Board of Supervisors made a motion to approve the rezoning request, but it failed to carry 1-4. The Rezoning Request Map, as resubmitted, illustrates a change from RA (Rural Agricultural) to Commercial (C) (27.3 ac.) and Single-Family Residential (R-1) (44.1 ac.). The current application differs from the original submitted in 2017 as the applicant removed the request for two-family residential (R-2), reduced the size of the area designated General Commercial (C), and illustrated a projected street design for the development at the intersection of Cato Avenue. The Harner Farm property abuts the following zoning district designations: General Commercial (C) to the east, Two-Family Residential (R2) to the north (Golden Orchard Estates), Single-Family Residential (R1) to the west (Corl Acres), Light Industry, Research and Development (IRD) to the northeast and Rural Agriculture (RA) to the south. Upon further inspection of environmental features, the property contains the following soil groups, Hublersburg silt loam (HuA, HuB), Hagerstown silt loam (HaA, HaB) and Opequaon-Hagerstown complex (OhB). No Floodway/Floodplain or wetlands are associated with the property based on examination of Township GIS Map layers. The Ferguson Township Agricultural Security Area list of property owners currently includes Tax Parcel ,067-,0000- as part of the Township Agricultural Security Area, however, not a purchased Agricultural Easement. Lastly, the property is identified on the 2013 Centre Region Comprehensive Plan, Future Land Use Map of Ferguson Township as a Mixed Use land use category. Staff Recommendation: The Planning Commission provide initial review and comment on the rezoning proposal and request that staff provide a revised land use analysis for consideration. - A Home Rule Municipality -

8 TOWNSHIP OF FERGUSON 3147 Research Drive State College, Pennsylvania Telephone: Fax: Planning & Zoning Director s Report April 9, On March 26, 2018, the Planning & Zoning Director and Zoning Administrator met with Connie Passmore, Dr. Deborah Smart and Dr. Renee Calvert regarding the Centre Animal Hospital at 1518 W. College Ave. and a possible expansion of the facility. The property is designated as Terraced Streetscape District. 2. On March 29, 2018, the Planning & Zoning Director, Township Executive Assistance and Chief of Police interviewed candidates for the Ordinance Enforcement Officer position. Serina Weaver has been hired as the new OEO and take over the position from Lori Sowash who is leaving April 13, On March 29, 2018, the Zoning Administrator attended a hearing at the Magisterial District Justice , Judge Casey McClain in regard to a violation of Abandon/Nuisance Vehicles at 2467 Saratoga Drive. 4. On April 2, 2018, the Community Planner attended the joint meeting of the Transportation/Land Use Committee and Centre Regional Planning Commission. 5. On April 5, 2018, the Planning & Zoning staff met with the Agricultural Ad Hoc Committee to discuss the proposed revisions to the Rural Agricultural, Rural Residential and Agricultural Research zoning districts and collect general comment on the proposed ordinance changes. Rezoning Application Harner Farms: Motion to refer the application to the Township Planning Commission for review and recommendation carried unanimously. Guenot Subdivision Replot: Motion to conditionally approve replot carried unanimously. The Cottages: Approval of settlements in lieu of condemnation for ROW for Bristol Avenue and Blue Course Drive traffic signal. Motion to authorize settlements in amounts of $7,800 for Washington Place and $7,400 for Thoroughbred Crossing carried unanimously. Recent Zoning Hearing Board Actions (3/27/18): Request for Variance 2245 W. Gatesburg Road (Guenot): A variance request Chapter 27, Zoning, Section which requires a comprehensive study of the floodplain on the subject property when subdivision or development is proposed was unanimously passed (4-0).

Stolinas, AICP, Planning & Zoning Director DATE: April 5, 2018 SUBJECT: Active Plans in the Township In order to keep the Planning Commission and Board of Supervisors up-to-date on the current developments and proposed rezoning requests, staff is providing a list of Active Plans in the Township. Currently, the Township has eight (8) Active Plans, four (4) have not been heard by the Board, four (4) have been conditionally approved also, a proposed rezoning of approximately 71 acres is being reviewed. They are as follows: Thistlewood Lot 20 Land Development: This submission, made on February 23, 2018 by Penn Terra Engineers, Inc., on behalf of David C. and Laura A. Gibbons proposes the development of Lot 20 at 170 Treetops Drive in the Thistlewood Subdivision. The proposal includes a new single-family dwelling containing a building area of 2,405 ft. 2 with a 2,810 ft. 2 parking area and driveway. Drainage easement areas and an existing wetland have been delineated on the record plan along with all utility connections. Along the front lot line, a 10 Shade Tree easement runs parallel with a 10 Utility easement. The Planning Commission reviewed and made initial comment on the Plan at their March 12, 2018 meeting and showed concern for the steep slope behind the house along with a proposed 30 and 60 retaining walls. Their comments were included in the plan review letter that was sent to Penn Terra on March 13. Plan was resubmitted to staff on March 29 and sent out for review, the comments are due back on or before April 11. On April 4, a Request for Modification of the requirements of the Subdivision and Land Development Ordinance was submitted. This request is to be on the Board of Supervisor s Agenda on April 16 for consideration. The request is for relief of Section B, No excavation shall be made resulting in a steeper slope than one to three vertical-horizontal, except the following circumstances: 1. such excavation and/or fill is for street grading governed in section ; 2. The excavation is located so that a line having a slope of 1:3 and passing through any portion of the cut face will be entirely inside the property lines of the property on which the excavation was made; 3. The fill is located so that settlement, sliding or erosion will not result in fill being deposited on adjoining property by any means; 4. The materials and methods used to finish such grading is sufficiently stable to sustain a slope of steeper than 1:1; and 5. The township engineer shall review all methods and materials used for such cut and fill operations and shall affirm that such deviation from the slope standard will not result in erosion, sedimentation or injury to persons or damage to adjacent property. Pine Hall Traditional Town Development General Master Plan: On February 21, Residential Housing Development, LLC submitted a General Master Plan for the Pine Hall TTD. A Master Plan currently exists for Pine Hall, but Residential Housing Development, LLC has a different vision, therefore is proposing a new General Master Plan. The submission included the following: an application, bylaws of the Pine Hall Community Association, Declaration of a Planned Community for Pine Hall, Declaration of Public Utility Easements, Pedestrian Walkway Easements, Stormwater Operations and

10 Maintenance Agreement, Stormwater Management Plan Narrative, Utility Plan Narrative, Design Guidelines, Existing Conditions Plan, General Site Plan, Lot Layout Plan, General Grading and E&S Plan, Typical Street Sections, General Public Utility Plan, Lighting Plan, Conceptual Open Space Plan, Conceptual Landscape Plan, General Stormwater Management Plan, and a Phasing Plan which proposed 3 Phases. Staff is in the process of completing a technical review of the proposed Plan and the Plan has been sent out for review. The Plan is at a stay from any approval until the Zoning Hearing Board makes a decision on the Validity Challenge. Staff submitted initial plan comments to the developer on Friday, March 30. Guenot Subdivision: Replot of Tax Parcel A into lots 1RRR, 2RR, 3R and 4R: Mylar has been submitted for signatures. Plan must be recorded by May 17, 2018 Accuweather Parking Lot Expansion Land Development Plan: Plan has been submitted for signatures. Plan must be recorded by May 3, Hummel Subdivision Plan: Penn Terra Engineering, Inc. on behalf of the applicant, Phillip Mandzik, has submitted a three-lot subdivision plan for review. This Plan is first proposing the consolidation of a portion of Tax Parcel E with C, which will create the revised Tax Parcels E (1.181 acres) and C (3.350 acres) and create the residual Lot 1 (1.208 acres). The Zoning Designation is Rural Residential (RR). The Planning Commission made initial comments on the Plan at their meeting on Monday, November 13, DEP recently denied the Sewage Planning Exemption request for proposed lot 1. Plan was resubmitted on April 4 for staff review. Three (3) requests for modifications from requirements of the Subdivision and Land Development Ordinance has been made. They are as follows: 1. Chapter Sidewalks: In the RR zoning district, the Board of Supervisors will determine whether sidewalks are required or not; 2. Chapter I.2 Public Use and Service Areas: If it is determined that there is not land suitable for dedication, or that the subdivision is too small to allow for a suitable amount of land for dedication, or that it is not practical to dedicate land, or that there already exits an adequate amount of parkland, recreational facilities, or the location or parkland within the proposed subdivision is not consistent with the adopted Ferguson Township Recreation Parks and Open Space Plan, a fee-in-lieu shall be considered by the developer; and Chapter B: the paved cartway width for all public streets shall meet municipal standards. Minimum paved cartway width for all public streets shall meet municipal standards. Minimum paved cartway width for fire apparatus access roads that are curbed shall be 20 feet. The minimum paved cartway width for fire apparatus access roads that are non-curbed shall be 18 feet and the adjacent berms must be stabilized and mud-free. Plan Comments are due back by April 19. Plan Expiration is July 16, The Landings Phase 3A Final Subdivision Plan: This Subdivision Plan, submitted by Penn Terra Engineering, Inc. on behalf of Johnson Farm Associates, submitted on September 11, 2017, is proposing 27 single-family lots on an extension of Park Centre Boulevard and Quail Run Road. The construction of Dovetail Drive and extension of Park Centre Boulevard are also proposed. The size of the homes will range between 900 and 1,600 square feet, this house size does not include basement areas or garage areas. On September 28; staff sent a plan review comment letter to Penn Terra, one of the major comments being the extension of Park Centre Boulevard to Blue Course Drive as part of Phase 3 of the PRD. This is a requirement of the approved Terms and Conditions for the PRD. Penn Terra submitted a letter requesting an amendment to the Terms and Conditions. Staff responded to the letter and the developer is currently considering the options. Plan Expiration is June 9, No Update. Science Park Plaza Land Development Plan: Deadline to have the Plan recorded is April 19, Mylar has been submitted and staff is in the process of obtaining signatures.

11 The Cottages at State College Final PRD, located at the intersection of Whitehall Road and Blue Course Drive: This Final Planned Residential Development (PRD) Plan was submitted on March 3, 2015, Conditionally Approved by the Board of Supervisors on November 17, At the time of Conditional Approval, the Plan had 45 days to be recorded (December 31, 2015). A 90-day time extension was approved by the Board of Supervisors on December 14, 2015, allowing the conditions to be met and Plan to be recorded on or before March 31, An Appeal to the County Court of Common Pleas was filed on December 15, 2015 and Court Hearing held on March 6, 2017 where the County Court ruled in favor of the appellants. This decision was then appealed to the Pennsylvania Commonwealth Court, where the decision of the County Court was reversed and the Commonwealth ruled in favor of the developer. The decision by the Commonwealth Court was appealed. On November 8, 2017, The Supreme Court of Pennsylvania, Middle District denied the Petition for Allowance of Appeal. Therefore, the 90-day review timeframe begins the date of the decision and the applicant must fulfill terms and conditions before February 6, As per Section (8)(c) stipulates, at the time of approval, the Board of Supervisors shall pass a resolution to change the zoning of the final plan portion of the property from its underlying zoning district to planned residential development (PRD). This resolution was passed on November 16, The revised zoning map was signed by three out of the five members of the Board of Supervisors at their meeting on November 20, Penn Terra is moving forward with meeting all Terms and Conditions of the Plan. At the February 5, 2018 meeting of the Board of Township Supervisors, a motion to grant a time extension for 90-days expiring May 7, 2018 carried 4-1. Staff notified the applicant in writing in consideration of the continued work towards completion of Terms & Conditions. The Final PRD Plan was resubmitted for review. Staff is in the process of reviewing the remaining conditions of approval to ensure they are met prior to moving forward with signatures and recording of the Plan. Staff has been working with Toll Brothers and Penn Terra to ensure the Conditions of Approval/Terms and Conditions of the PRD Plan are being satisfied prior to recording of the Plan. Record by date is May 7, 2018/ Harner Farm Proposed Rezoning: Aspen Whitehall Partners, LLC, on behalf of Danny R. and Pamela M. Harner and Thompson P. Harner and Nancy B. Harner submitted a proposal to rezone approximately 71 acres of land located at 2191 West Whitehall Road. The property is currently zoned Rural Agriculture with Corridor Overlay. The proposal is to rezone 27.3 acres to Commercial (C)/Corridor Overlay and 44.1 acres to Single Family Residential (R-1). Significant differences in this proposal from the original include the elimination of the R-2 zoning district and decrease in commercial acreage (17.3 acres). The Harner Farm Rezoning was first proposed in 2017, but was denied by the Board of Supervisors at the time. Since the denial of the Plan, Aspen Whitehall Partners, LLC met with local residents and received feedback. The proposed rezoning request was revised and resubmitted based upon that feedback. On Monday, April 2, 2018, the Board of Supervisors voted to move the proposed rezoning to the Planning Commission for review, comment and recommendation. Staff is preparing an analysis and sending the Plan to Centre County, Centre Regional Planning Agency, SCBWA, UAJA, SCASD, and the Township Solicitor for initial review and comment. The Planning Commission will have an opportunity to review and comment on the proposal at the meeting on April 9, 2018.

12 FERGUSON TOWNSHIP PLANNING COMMISSION MEETING MINUTES MONDAY, MARCH 26, :00 PM I. ATTENDANCE The Planning Commission held its 2 nd regular meeting of the month on Monday, March 26, 2018 at the Ferguson Township Municipal Building. In attendance were: Commission: Staff: Lisa Strickland, Chairperson, Ray Stolinas, Director of Planning & Zoning Bill Keough, Vice Chairperson Lindsay Schoch, Community Planner Ralph Wheland Jeff Ressler, Zoning Administrator Marc McMaster Rob Crassweller Eric Scott Cristin Mitchell Jeremie Thompson, alternate Others in attendance were: Marcella Bell, Recording Secretary; Thomas Quinteos Amat, student; Ahmed Al Hosm, student; Khalefoh Alshayji, student; Tony Fruchtl, PennTerra Engineering; Richard Guenot, Guenot Replot; Edward Guenot, Guenot Replot II. CALL TO ORDER Ms. Strickland called the meeting to order at 6:00 p.m. As a consensus, the Guenot Replot agenda item was moved to the first item on the agenda with the American Community Survey Presentation being moved to the second item. III. IV. CITIZEN INPUT There was no input. GUENOT SUBDIVISION REPLOT OF TAX PARCELS ,018M,0000- INTO LOTS 1RRR, 2RR, AND 3R Mr. Stolinas stated that the proposed subdivision is a replot of a previously approved subdivision for Edward G. & Ronald L. Guenot at tax parcel M-0000 of acres on W. Gatesburg Road, now proposed as Lot 1RRR at acres. All acreage exists within the Rural Agricultural (RA) district. A portion of the acreage extends into Halfmoon Township. The replot includes change to Lot 2RR proposing acres from acres and Lot 3R proposing acres from acres. Lot 3R has been adjusted since the Planning Commission s initial review as per the lot size requirements within the RA District. Floodplain Zone A exists on a portion of the remaining Lot 1 RRR along with a 50 floodplain buffer. At this time, staff considers key comments have been addressed, other than a few remaining conditions and the plan can move forward to the Board of Supervisors for approval. Mr. Stolinas went on to explain that this plan is also going before the Zoning Hearing Board tomorrow night. The applicant is requesting a

13 Ferguson Township Planning Commission March 26, 2018 Page 2 variance from Zoning Ordinance Chapter that requires that the applicant determine the flood plain elevation. There was a short discussion among the Planning Commission members regarding clean and green status and whether or not this subdivision would trigger a parkland feein-lieu. A motion was made by Mr. Wheland and seconded by Mr. McMaster to recommend approval of the Guenot Subdivision Replot conditioned upon the Zoning Hearing Board decision and the remaining comments. The motion carried unanimously. V. AMERICAN COMMUNITY SURVEY PRESENTATION MARK BOECKEL, PRINCIPAL LAND USE PLANNER, CRPA Mr. Stolinas stated that at the February 12 meeting, staff provided Selected Demographic Data for the Centre Region from the American Community Survey 5-Year Estimates. Planning Commission members reviewed the Ferguson Township data and raised questions related to means of collection and source. Mr. Mark Boeckel will present information on the American Community Survey and provide an overview of how the CRPA collects and utilizes this demographic data. Mr. Boeckel s presentation revolved around demographics of the Centre Region that included socioeconomic and population data. CRPA collects and analyzes data in relation to total population and total growth, population age and structure, housing, median income, commuting characteristics, educational attainment or enrollment, and occupation. CRPA uses demographic, socioeconomic, and housing sources that include the US Decennial Census, the American Community Survey (ACS), the Population Estimates Program (PEP), the PA Department of Health, and Centre Region Code Administration (CRCA) permit data. Mr. Boeckel spoke to the differences in data between the different sources, how it is collected, and the kind of data that is collected. Mr. Boeckel stated that moving forward, CRPA will report less ACS data related to housing and occupancy, while continuing to provide ACS and comparisons for other values. CRPA would like to use as much local data as possible. In response to questions from Mr. Keough, Mr. Boeckel explained that natural simply means birth versus death and immigration reflects people moving into the Township from other areas. Mr. Boeckel stated that there is no way to factor out Penn State University s data or a certain age group. Mr. Keough stated that it may be beneficial to address on the report with an asterisk that the data may be skewed due to the student population. Mr. McMaster stated that the Centre County Association of Realtors has data regarding property resources and would be willing to share that data with CRPA so that the data regarding housing is accurate. Mr. McMaster went on to state that the data collected is based on real numbers via house sales. In response to a question from Mr. Crassweller, Mr. Boeckel stated that CRPA will be looking into comparing the Centre Region data to other college towns when the 2020 US Census data comes out.

14 Ferguson Township Planning Commission March 26, 2018 Page 3 In response to a question from Ms. Mitchell, Mr. Boeckel stated that the CRPA is doing research on better population projections for each of the municipalities in the Centre Region. He went on to explain that current the Census Bureau Program is verifying addresses for the 2020 data gathering. The Population Estimates Program will come out with a new estimate in June of this year, and the American Community Survey will come out with new data in December. There was a brief discussion regarding how students fill out the census forms. Ms. Strickland wondered if the students are supposed to fill them out with data where they currently live or with data from their permanent address. Mr. Boeckel stated that there is no standard, so some students may be filling the data out with current addresses, whereas some student may be using their permanent addresses. VI. VII. CONSENT AGENDA There was no consent agenda. PLANNING DIRECTOR S REPORT Mr. Stolinas reviewed his report. On March 12, 2018, the Planning & Zoning Director, Zoning Administrator, Community Planner, and Township Manager met with Justin Mandel of Aspen Hill Partners to review the preliminary Harner Farm rezoning map. On March 14, 2018, the Planning & Zoning Director attended the monthly Board of Director s meeting of the Centre County Housing and Land Trust at the College Township Building. On March 15, 2018, the Planning & Zoning Director and Zoning Administrator attended a hearing at the Magisterial District Justice , Judge Casey McClain in regard to a violation of the Domestic Chicken Ordinance at 170 Circleville Road. On March 16, 2018, the Planning & Zoning Director had been requested by Teaching Assistant Zachary Goldberg to attend two Geography 301 classes at Walker Building for a second year. Professionals, who are previous graduates of the Penn State Geography program, have been asked to come back and discuss the transition from the world of college to the worlds of work and life. Also on March 16, 2018, the Planning & Zoning Director and Community Planner met with Jim May, CRPA Planning Director, and Michael Patroski, CRPA Senior Planner, regarding the scoping and development of a Small Area Plan for Pine Grove Mills. At this point, staff will be responsible for gathering interested parties to initially meet and discuss the scope of the plan. On March 20th & 21st, 2018, the Planning & Zoning staff conducted a review of the Pine Hall General Master Plan and generated preliminary comments for the applicant s engineering and design team. On March 22, 2018, the Planning & Zoning Director attended a meeting with Centre Regional Planners, Bob Jacobs, Centre County Planning Director, Adam Brumbaugh, College Township Manager and Missy Schoonover, CCHLT and discussed the research and development of an affordable housing fee-in-lieu model ordinance.

15 Ferguson Township Planning Commission March 26, 2018 Page 4 On March 23, 2018, the Planning & Zoning Director and Zoning Administrator met with Mark Kline regarding a proposed subdivision/lot line adjustment of tax parcel A-184A-0000 at 180 South Water St. in Pine Grove Mills. Mr. Stolinas reviewed the recent Board of Supervisor actions: Removal of Andrea Harman from the Ferguson Township Planning Commission Appointment to Ad Hoc Board for Source Water Protection Overlay: Motion to appoint Erik Scott, Larry Harpster, Ron Connelly, Charles Driscoll, Bard Christ, James Hynes, David Hughes, Gary Peterson, and Todd Giddings, passed unanimously. Staff will set up and schedule initial kick-off meeting. Accuweather Land Development Plan: Motion to conditionally approve carried unanimously. Request for Variance 2245 W. Gatesburg Road: Motion to remain neutral carried unanimously. Ms. Mitchell stated that the Millbrook Marsh Committee is meeting this Wednesday March 28, Mr. Stolinas added that the CRPC and the Transportation and Land Use (TLU) Committee will be having a joint meeting April 2, 2018 at 12:00 p.m. X. SOURCEWATER PROTECTION WORK GROUP UPDATE Mr. Stolinas stated that staff is in the process of putting together a schedule for the Sourcewater Ad Hoc Committee.

ZONING/SALDO STEERING COMMITTEE UPDATE Mr. Stolinas stated that the Ag Ad Hoc Committee will meet on April 5 to discuss the Agricultural Research, Rural Agricultural, and Rural Residential zoning districts. XII. APPROVAL OF THE REGULAR MEETING MINUTES MARCH 12, 2018 Mr. McMaster stated that on page 2, the price of a new CNG bus is 500,000 dollars, instead of 5 million. It was also pointed out that Mr. Crassweller and Mr. Scott were present at the March 12 meeting. A motion was made by Mr. Crassweller and seconded by Mr. Wheland to approve the corrected March 12, 2018 meeting minutes. The motion carried unanimously XIII. ADJOURNMENT Ms. Mitchell offered Everyone s Park for a park name for Owens Drive Park. She stated that the park could have passive and active activities.
