At this time, very few comments remain, but it was the opinion of staff and consulting engineers, that the Plan is ready to be in front of the Planning Commission for their recommendation to the Board of Supervisors. Staff Recommendation: The Planning Commission review and recommend approval of the Thistlewood Lot 7 Land Development Plan, condition upon the remaining comments. IV. SCIENCE PARK PLAZA LAND DEVELOPMENT PLAN The Planning Commission initially reviewed this Land Development Plan at their August 27, 2018 Meeting at which time they provided initial comment. Since then, a Traffic Study has been prepared and Penn Terra Engineering, Inc. resubmitted the Plans in response to staff s comments. At this time, staff feels the comments have been addressed, other than a few remaining comments and the Plan can move forward to the Planning Commission and the Board of Supervisors for recommended approval. Staff Recommendation: The Planning Commission review and recommend approval of the Science Park Plaza Land Development Plan, condition upon the remaining comments. V. Stolinas, AICP, Planning & Zoning Director DATE: February 23, 2018 SUBJECT: Thistlewood Lot 7 Land Development Plan The Ferguson Township Planning Commission reviewed and made initial comment on this proposed Land Development Plan at their meeting on February 12. Staff prepared a revised comment letter and submitted to Penn Terra Engineering, Inc. At this time, very few comments remain, but it was the opinion of staff and consulting engineers, that the Plan is ready to be in front of the Planning Commission for their recommendation to the Board of Supervisors. We have attached, as part of this packet, the February 16, 2018 letter from Rob Kressler, Project Manager, in which he explains why the proposed driveway is so large, which was a comment from the Planning Commission. At the current time, the following conditions remain: C.1.l: Signed, notarized statement by the owner certifying ownership of the property. 2. Please provide proof that the Thistlewood Homeowner s Association has reviewed the proposal to perform any activity within the Drainage way or Conservation Easement. 3. A digital copy of the plan in accordance with Township requirements must be provided to the Township prior to final plan signature. (Chapter 22, Section 304.7) 4. The plan must be signed, all fees paid to the Township, and the plan recorded within the plan deadline. 5. Completed signature blocks must be included on the Record Plan. (Chapter 22, Section 401) 6. Provide calculations demonstrating that flows leaving the rear-yard channel as it enters the conservation easement will not be erosive. (Stormwater Consulting Engineer, Scott Brown s comment). Staff Recommendation: Staff recommends the Planning Commission review and recommend approval of the Thistlewood Lot 7 Land Development Plan, condition upon the conditions outlined in the memo dated February 23, 2018.

Stolinas, AICP, Planning & Zoning Director DATE: February 22, 2018 SUBJECT: Proposed Land Development Plan Science Park Plaza On August 16, 2017, Penn Terra Engineering, Inc. on behalf of Gulfstream Equity Partners, submitted a Preliminary/Final Land Development Plan for Science Park Plaza. The Plan has been reviewed by Ferguson Township Planning & Zoning Department, NTM Engineering (for Stormwater), County Planning Office, CRPA, CATA, COG Recycling and Refuse, Centre Region Fire Director, Township Solicitor, Township Engineer, Township Tree Commission, Township Arborist, and Ferguson Township Tree Commission. A Traffic Study was prepared, submitted and is currently in review. At the current time, the following conditions remain: : Prior to receiving final signature, all subdivision and land development plans must be submitted to the Township in digital format. Comment remains : Prior to final approval of a plan by the Board of Supervisors, the applicant shall pay all review fees, including fees for consultants and engineers for review and reports which were required by the Township, either in the normal course of review or as a result of a problem or issue arising out of the normal review. The review fees and consultant s fees to be paid shall be based upon a scheduled established by resolution by the Board of Supervisors. Comment Remains : After completion of the procedures required by this Part and after final approval of a plan by the Board of Supervisors, all endorsements shall be so indicated on the approved plan and on as many other copies of the plan as may be desired by the Township. Upon approval and signing of the plan by the Board of Supervisors, the record plan and the plan containing the approval signatures shall be recorded in the Office of the Recorder of Deeds of Centre County by the applicant within 90 days of such approval and signing. Such recording shall be otherwise in conformity with 513 of the Municipalities Planning Code, as amended. Within 10 days after the Recorder of Deeds has properly recorded the plan, a copy of such, including the endorsement of the Recorder of Deeds, shall be forwarded by the applicant to the Township Secretary. Note 20 should be updated to reference the correct final revision date of the plan. 9. Plan note 5g references a traffic impact study completed by Mr. David E. Wooster and Associates dated July The referenced traffic impact study was valid for the previously approved plan, but beyond its validity for this plan. The size of the building shown on the current land development plan is listed in plan note 7b as being 54,575 SF, but calculates to be 63,157 SF from the architectural plans. The previously completed study was for a building size of 54,400 SF. A traffic impact study needs to be completed for this project. A scoping meeting should be scheduled by the applicant. Depending upon the results of the study, plan notes 5g, 14 and 17, as well as the driveway designs may need to be altered. (Ch O (1)) The submitted TIS is currently in review. If the TIS conclusion is validated, Note 15 should probably be reworded to indicate that the referenced agreement is no longer applicable/valid. Elsewise additional comments will be forecoming. Staff Recommendation: Staff recommends the Planning Commission review and recommend approval of the Science Park Plaza Land Development Plan, condition upon the conditions outlined in the memo dated February 22, 2018.

Stolinas, AICP, Planning & Zoning Director DATE: February 23, 2018 SUBJECT: Active Plans in the Township In order to keep the Planning Commission and Board of Supervisors up-to-date on the current developments taking place, staff is providing a list of Active Plans in the Township. Currently, the Township has eight (8) Active Plans, seven (7) have not been heard by the Board and one (1) has been conditionally approved. They are as follows: Pine Hall Traditional Town Development General Master Plan: On February 21, Residential Housing Development, LLC submitted a General Master Plan for the Pine Hall TTD. The submission included the following: an application, by laws of the Pine Hall Community Association, Declaration of a Planned Community for Pine Hall, Declaration of Public Utility Easements, Pedestrian Walkway Easements, Stormwater Operations and Maintenance Agreement, Stormwater Management Plan Narrative, Utility Plan Narrative, Design Guidelines, Existing Conditions Plan, General Site Plan, Lot Layout Plan, General Grading and E&S Plan, Typical Street Sections, General Public Utility Plan, Lighting Plan, Conceptual Open Space Plan, Conceptual Landscape Plan, General Stormwater Management Plan, and a Phasing Plan which proposed 3 Phases. Staff is in the process of completing a technical review of the proposed Plan and the Plan has been sent out for review. Plan Expiration is May 28, Thistlewood Lot #7 Land Development: This Plan is on the February 26, 2018 Planning Commission Agenda for Review and Recommendation, condition upon the remaining conditions being met. Guenot Subdivision: Replot of Tax Parcel A into lots 1RRR, 2RR, 3R and 4R: This submission, made on December 8, 2017 by Penn Terra Engineers, Inc. on behalf of Ronald L. & Pearl P. Guenot is proposing the replot of property lines, which will make Lot 3 a conforming lot with regards to side and rear setbacks, adding approximately 3 acres to the Lot. Lot 1RR will be reduced by 3.4 acres, Lot 2R will gain.1 acres, and Lot 4 will gain.1 acre as well. This Plan has been resubmitted to the applicant for their consideration of staff s comments. The Planning Commission reviewed and commented on this plan at its meeting on January 8, 2018 and had no major comments. Plan Expiration is May 21, Plan has been resubmitted to staff for review. Accuweather Parking Lot Expansion Land Development Plan: This Plan, submitted on December 8, 2017, by Sweetland Engineering & Associates, Inc. on behalf of Accuweather, Inc. proposes the development of 79 additional parking spaces, which will make the total amount of parking on the property 285. The required amount of parking by Ordinance is 86 based upon the square footage of the building (21,498 ft. 2 ). The proposed parking lot is located entirely on tax parcel R, 385 Science Park Road, State College, PA and is zoned Light Industrial, Research and Development (IRD) and Corridor Overlay. Stormwater Plans and Erosion, and Sedimentation

13 Plans were also submitted as part of this Land Development. Accuweather requested a variance and will be on the February 27, 2018 Zoning Hearing Board Agenda, the majority of the remaining staff comments have been addressed and the Plan should be ready to move to the Planning Commission in March. Plan Expiration is March 5, Hummel Subdivision Plan: Penn Terra Engineering, Inc. on behalf of the applicant, Phillip Mandzik, has submitted a three-lot subdivision plan for review. This Plan is first proposing the consolidation of a portion of Tax Parcel E with C, which will create the revised Tax Parcels E (1.181 acres) and C (3.350 acres) and create the residual Lot 1 (1.208 acres). The Zoning Designation is Rural Residential (RR). Currently, the Plan is out for review. The Planning Commission made initial comments on the Plan at their meeting on Monday, November 13, PennTerra Engineering Inc. submitted a Sewage Facilities Planning Exemption Postcard for Proposed Lot#1. Plan Expiration April 21, Plan has been resubmitted to staff for review. The Landings Phase 3A Final Subdivision Plan: This Subdivision Plan, submitted by Penn Terra Engineering, Inc. on behalf of Johnson Farm Associates, submitted on September 11, 2017, is proposing 27 single-family lots on an extension of Park Centre Boulevard and Quail Run Road. The construction of Dovetail Drive and extension of Park Centre Boulevard are also proposed. The size of the homes will range between 900 and 1,600 square feet, this house size does not include basement areas or garage areas. On September 28; staff sent a plan review comment letter to Penn Terra, one of the major comments being the extension of Park Centre Boulevard to Blue Course Drive as part of Phase 3 of the PRD. This is a requirement of the approved Terms and Conditions for the PRD. Penn Terra submitted a letter requesting an amendment to the Terms and Conditions. Staff responded to the letter and the developer is currently considering the options. Plan Expiration is March 11, No Update. Science Park Plaza Land Development Plan: This Plan is on the February 26, 2018 Planning Commission Agenda for review and recommendation, condition upon the remaining conditions being met. The Cottages at State College Final PRD, located at the intersection of Whitehall Road and Blue Course Drive: This Final Planned Residential Development (PRD) Plan was submitted on March 3, 2015, Conditionally Approved by the Board of Supervisors on November 17, At the time of Conditional Approval, the Plan had 45 days to be recorded (December 31, 2015). A 90-day time extension was approved by the Board of Supervisors on December 14, 2015, allowing the conditions to be met and Plan to be recorded on or before March 31, An Appeal to the County Court of Common Pleas was filed on December 15, 2015 and Court Hearing held on March 6, 2017 where the County Court ruled in favor of the appellants. This decision was then appealed to the Pennsylvania Commonwealth Court, where the decision of the County Court was reversed and the Commonwealth ruled in favor of the developer. The decision by the Commonwealth Court was appealed. On November 8, 2017, The Supreme Court of Pennsylvania, Middle District denied the Petition for Allowance of Appeal. Therefore, the 90-day review timeframe begins the date of the decision and the applicant must fulfill terms and conditions before February 6, As per Section (8)(c) stipulates, at the time of approval, the Board of Supervisors shall pass a resolution to change the zoning of the final plan portion of the property from its underlying zoning district to planned residential development (PRD). This resolution was passed on November 16, The revised zoning map was signed by three out of the five members of the Board of Supervisors at the meeting on November 20, Penn Terra is moving forward with meeting all Terms and Conditions of the Plan. At the February 5, 2018 meeting of the Board of Township Supervisors, a motion to grant a time extension for 90-days expiring May 7, 2018 carried 4-1. Staff notified the applicant in writing in consideration of the continued work towards completion of Terms & Conditions.

14 FERGUSON TOWNSHIP PLANNING COMMISSION MEETING MINUTES MONDAY, FEBRUARY 12, :00 PM I. ATTENDANCE The Planning Commission held its regular meeting of the month on Monday, February 12, 2018 at the Ferguson Township Municipal Building. III. IV. CALL TO ORDER Ms. Strickland called the meeting to order at 6:00 p.m. CITIZEN INPUT There was no input. THISTLEWOOD LOT #7 LAND DEVELOPMENT PLAN Mr. Stolinas stated that the September 24, 2004 Final Thistlewood Subdivision Plan indicates that certain individual land development plans shall be prepared for approval by the Ferguson Township Board of Supervisors and must be in conformance with the provisions of Chapter 27, Section 702.c.1-7 of the Ferguson Township SALDO. Lot # 7 is identified as such a lot and contains acres at 300 Treetops Drive. A proposed single-family dwelling on the lot will contain a building area of 2,670 square feet with a 2,151 square feet parking area and driveway. Drainage easement areas and natural flow channels have been delineated on the record plan along with all utility connections. Mr. Stolinas showed maps of the lot in question on the projector. Mr. Stolinas then turned the floor over to Mrs. Schoch. Mrs. Schoch stated that staff has received comments back from Mr. Ressler and the Centre Regional Planning Agency. Mr. Seybert, the Township Engineer, reviewed the plan and had no comments. Scott Brown, the Township s stormwater engineer from NTM Engineering, is currently reviewing the plan for stormwater and lighting. Mrs. Schoch noted two comments. If anything is going to be constructed in the drainage way, the property owner has to get permission from the Homeowner s Association (HOA). If this

15 Ferguson Township Planning Commission February 12, 2018 Page 2 property owner plans on sharing a driveway with lot #8, the property owners must have a driveway agreement in place. In response to a question from Mr. Keough, Mrs. Schoch explained that if the property owner wants to build in the drainage way, the approval from the HOA must be included with the plan before it is recorded. Mr. Crassweller noted that there is almost 5,000 square feet of impervious coverage, which seems like a lot for that lot size. Mrs. Schoch stated that she had the same comments. Mrs. Schoch stated that comments for this plan are due to staff tomorrow. She will compile all comments and send them to the applicant. V. 120 BUCKHOUT STREET CONDITIONAL USE APPLICATION Mr. Stolinas stated that provided with the agenda is a copy of the Conditional Use application received from the State College Area School District (SCASD) for property located at 120 Buckhout Street currently owned by the Pennsylvania State University. SCASD entered into a lease agreement with the University from January 1, 2018, to August 31, 2019, to use the property for the storage of construction materials to be used in the Corl Street Elementary Renovation Project. Chapter 27, Section 7031.E. states that any use not specifically permitted with the TS District shall be reviewed through the Conditional Use approval process. Mr. Stolinas reviewed the self-imposed conditions that the SCASD must follow. Mr. Stolinas provided comments from residents Rhonda Stern and Nelson Hite that were made at the Board of Supervisor s meeting on February 5, Mr. Stolinas also provided comments from Web Glebe, resident of Butz Street. Ms. Stern, a property owner adjacent to the site, stated that the neighborhood surrounding the site is safe to live in. She went on to say that many students live in the neighborhood and they are always nice, polite, and respectful. She explained that she loves living in her neighborhood and does not want the laydown yard to change the characteristic of the neighborhood. The main discussion points on this agenda item revolved around an 80-foot buffer versus a 100-foot buffer, as well as the type of materials that will be used to divide the buffer area from the rest of the lot. Commission members also discussed the issue of the gate on the State College Borough side not being locked after hours. There was a lengthy discussion about the future of this specific property. Commission members wondered how long this site would be used for a laydown yard in general. Ms. Stern spoke to that issue and asked the Commission to consider saying no to this conditional use. She stated that it is disrespectful to allow this type of use to occur time and time again in a residential neighborhood. She stated that it is unsightly to look at and an inconvenience to the residents of the neighborhood. Mr. Watson, Director of Campus Planning at Penn State, stated that the University does not intend on allowing this property to be used as a laydown yard as a long term use. He stated that this is not a financial gain and eventually the use of this property will be consistent with the Terraced Streetscape District (TSD).

16 Ferguson Township Planning Commission February 12, 2018 Page 3 The Planning Commission provided the following comments: Keep 80-foot buffer area Provide a more substantial barrier of 80-foot buffer area like a fence or concrete curbs. Have a pre-use meeting with adjacent property owners Whether it is someone from the University of the school district, someone should be regularly responsible for locking and unlocking the gate Provide contact information for a representative at the school district that residents can contact with concerns or questions at all times of the day No construction should be done on the site No disturbing the stormwater landscaping A motion was made by Mr. Wheland and seconded by Mr. Scott to recommend to the Board of Supervisors the approval of the conditional use for the Houtz property, taking into consideration the Planning Commission comments. The motion carried 6-0. VI. CONSENT AGENDA 100 West College Avenue Plan Withdrawal CRPA Selected Demographic Data for the Centre Region CRPA Pennsylvania Medical Marijuana There was a lengthy discussion regarding the CRPA Selected Demographic Data for the Centre Region. The discussion centered around the numbers and percentages for the median household income. There was concern regarding the data that CRPA used to create the demographic data versus the US Census data. Many Commissioners had concern about the numbers and percentages on the provided data sheet as it relates to the Legacy Program regarding affordable housing. Mr. Stolinas stated that he will verify information with Missy Schoonover of the Centre County Housing and Land Trust Program to bring back to the Planning Commission. A motion was made by Mr. McMaster and seconded by Mr. Keough to approve the remaining two items on the Consent Agenda. The motion carried 6-0. VII. PLANNING DIRECTOR S REPORT Mr. Stolinas reviewed his report. On January 23, 2018, the Planning & Zoning Director, Community Planner, and Zoning Administrator met with Jane Liszak, a resident of State College Borough, regarding the Pine Hall TTD Master Plan, specifically the previously approved Specific Implementation Plan for 10 townhouses. Also on January 23, 2018, the Planning & Zoning Director met with Maureen Safko, Senior Planner with State College Borough and Missy Schoonover, Executive Director of the Centre County Housing and Land Trust to discuss the update process for the CCHLT Strategic Plan.

17 Ferguson Township Planning Commission February 12, 2018 Page 4 On January 23, 2018, the Planning & Zoning Director, Zoning Administrator, and Community Planner attended the Zoning Hearing Board s 2nd hearing related to the TTD Validity Challenge. On January 24, 2018, the Planning & Zoning Director, Zoning Administrator, and Community Planner met with Michael Pratt, Derek Anderson and representatives of the design team for the Pine Hall Master Plan anticipated submission. On January 29, 2018, the Planning & Zoning Director attended an Executive Session with the Board of Supervisors. In addition, Planning & Zoning staff attended a special meeting of the Planning Commission that included a discussion with Ron Seybert, Township Engineer, regarding Section 5 Design Standards within the SALDO, and a discussion with Carolyn Yeagle, EPD, regarding, parking standards along with potential uses within the Rural Residential and Rural Agricultural zoning districts. On February 5, 2018, Planning & Zoning Director and Community Planner met with Colleen Barrett, Sustainability Planner with the Centre Regional Planning Agency to summarize community trends and land use within Ferguson Township, in addition to, her goals related to the preparation and implementation of climate action and how it relates to the region and its municipalities. Also on February 5, 2018, the Planning & Zoning Director met with Jennifer Zangrilli at 1305 W. College Ave. (HiWay Pizza) to discuss possible outdoor seating expansion under the current zoning regulations. On February 8, 2018, the Planning & Zoning Director, Community Planner and Township Engineer met with John Sepp, PennTerra Engineering, Inc. to conduct a review of the Cottages Terms & Conditions progress. Mr. Stolinas reviewed the recent Board of Supervisor items from the February 5, 2018 meeting: Closing of Source Water Public Hearing: Chairman officially closed Consideration of Ad Hoc Committee for Zoning/ZALDO: Staff compile a list of recommended appointments for the 3/5/18 regular meeting The Cottages: 90-day time extension granted until May 7, 2018 Variance Requests: Accuweather (Neutral), Edisto Partners, LP (Neutral) & Loesch (Neutral) Wheland/Cooper Replot: Conditionally Approved Mr. Stolinas reviewed the upcoming Zoning Hearing Board Actions for the January 23, 2018 hearing: Substantive Validity Challenge on the TTD Ordinance Amendment: Continued for Township Solicitor and Staff testimony

ACTIVE PLANS UPDATE Ms. Schoch provided the active plans update, which included the following active plans: Thistlewood Lot #7 Land Development, Guenot Subdivision Replot of Tax Parcel A-0000 into lots 1RRR, 2RR, 3R, and 4R; Accuweather Parking Lot Expansion Land Development Plan; Ralph F. Wheland and Pauline E. Cooper Estate Report & Property Line Realignment Plan; Hummel Subdivision Plan; The Landings Phase 3A Final Subdivision Plan; Science Park Plaza Land Development Plan; and the Cottages at State College Final PRD. CENTRE REGION PLANNING COMMISSION (CRPC) REPORT Ms. Mitchell was not able to attend, so Mr. Wheland provided the report. He stated that there was a discussion regarding the Rutgers Nease partial rezoning from residential to industrial in College Township. The site had a covenant after the cleanup that it all remain industrial, but some of it remained residential. The CRPC acted on a PennDOT agreement and also discussed some of the REDCAP report. X. SOURCEWATER PROTECTION WORK GROUP UPDATE Mr. Stolinas stated that staff has a list of representatives for the Ad Hoc Committee for the Board of Supervisors to consider at a future meeting. Mr. Scott was recommended to be the representative for the Planning Commission. Mr. Keough has been recommended to represent the Agriculture community. A representative from the business community and the State College Borough Water Authority will also be recommended. XI.
