1 Attachment 'A' 1 of 3 THE CORPORATION OF DELTA BYLAW NO A bylaw to undertake certain sanitary sewer works as a Local Area Service in the area of Tsawwassen Beach Road. WHEREAS the Council of a city, town or district municipality may, on petition or on its own initiative, undertake certain works as a local area service; AND WHEREAS a petition has been presented to Council to construct certain works described herein as local area services for the sole benefit of the properties described herein; AND WHEREAS on September 14, 2010 the Municipal Clerk certified that the petition was sufficient; AND WHEREAS Council considers that the works hereinafter defined provide a particular benefit to the residents of the areas outlined in bold on Schedule 1 to this Bylaw; AND WHEREAS Council has adopted Local Improvement Cost Sharing policy to establish the proportion of charges to each taxable property to be charged for each class of work; NOW THEREFORE, the Council of the Corporation of Delta, in open meeting assembled, ENACTS AS FOLLOWS: 1. This Bylaw may be cited for all purposes as "DELTA LOCAL AREA SERVICE ( Tsawwassen Beach Road) CONSTRUCTION BYLAW NO. 6914, 2010." 2. The following works are hereby authorized to be undertaken as local area services: Installation of approximately 260 metres of sanitary sewer main, to also include service connections for each property, along the beach front of Tsawwassen Beach Road. These works shall comprise a local area service known as " Tsawwassen Beach Road - Sanitary Sewer Improvement Local Area Service". All above works ("the works") will be done in accordance with plans acceptable to the Director of Engineering.

The boundaries for the Tsawwassen Beach Road - Sanitary Sewer Improvement Local Area Service shall be as shown outlined in bold on Schedule 1 hereto (the " Tsawwassen Beach Road - Sanitary Sewer Improvement Local Area Service"). 4. Upon completion of the works, all parcels, within the Tsawwassen Beach Road - Sanitary Sewer Improvement Local Area Service will be specially charged in accordance with Corporation of Delta Policy and collected therefrom via a parcel tax imposed on each parcel of $24, Following completion of the works, the Municipal Collector is hereby directed to cause the preparation of a parcel tax roll for the Local Area Service referred to herein. 11 Attachment "e' 1 of Tsawwassen Beach Delta, BC V4M 4CB September 20,2010 Corporation of Delta, 4500 Clarence Taylor Crescent Delta, BC V4K3E2 Attn: Mr. Steven Lan, Director of Engineering Re: Tsawwassen Beach Sewer Petition It is my understanding that the Corporation of Delta may be proceeding with a local area initiative to put a sanitary sewer along Tsawwassen Beach to service homes between 402 and 522 inclusive. You may be in possession of Petition documents dated July 27, 2010 signed by a number of homeowners accepting the terms of your Petition. I am aware that 5 owners may not have agreed to the terms of the petition and have numerous concerns related to it and the way in which it was promulgated. The homeowners selected a group of 4 individuals to meet with Delta to determine if there were infrastructure funds available from government due to the recession stimulus funding which might help fund a sewer extension. Despite repeated asking to have a meeting to discuss this group's findings, we have not had a meeting. Some Signed believing all had signed which apparently is not the case. The households, I believe, that have not signed the petition have lived at the affected addresses for an average of 34 years. They have had septic systems all of that time and see no reason to spend tens of thousands of dollars for a sewer. If new owners wish to enlarge their houses for in-law suites or hope that a sewer will lead to possible increased capital gain, then they should fund the sewer. It should not be forced on everyone if large parts of the beach still are not required to be on it. There are a number of issues that come to mind that need clarification: 11 the petition states the cost is an estimated $24,307. Is this the result of a. tender? What happens if the actual amount is less? Do the owners get the benefit of the lower amount? The cost being quoted compared to the cost in 1988 amounts to a 7 % % cost increase for each and every year for the 22 year interval. Does sound rather high does it not? 21 with respect to deferment, the petition states that the owner may be able to defer the amount on ones taxes if they qualify. If one qualifies to defer taxes, can

12 Attachment 'e' 2 of 5 this cost be deferred, yes or no? 31 the homeowners to the south installed their portion of the sewer in I believe that the cost was shared quite differently than is now proposed. Why is this? If all of those residents did not hook up, do the same rules apply to our area? If not, why? 41 the elevation of the sewer at each house has not been identified. The sewer rises as it extends northward. This does not allow homeowners to evaluate the total cost to them if they have basements which may require additional lift pumps' to service their basement facilities. 51 the properties at 455 and 413 are on a bench about 60 verticaytt. above the beach. Where is the connection to these properties going to be?'1 believe that Delta is responsible to bring the connection to each private property line. To do this from the beach and not cross other private land would require crossing Lot 13, the jointly owners property that in essence is Tsawwassen Beach Road. Since this is jointly owned, an easement no doubt would be required and signed by all owners. Will that be granted? No mention of this can be found in the Petition. 61 if the sewer line crosses the road, it will cross the water main and gas line that runs down the center of the road. I would like to know if there are health issues or code problems with sanitary sewers crossing at right angles to gas and drinking water lines. A leaking sewer line coupled with a waterline pressure loss could cause cross contamination. How is this to be addressed?? What is the code requirement? 71 the individual connecuons no doubt are at the cost of the individual homeowner. As this is a steep slope area, what permitting would be required? How much would that cost? Will the First Nations nave to be present when the line is dug? How much are we lookina at for an averaae lot dig of say 60 ft.? 8/ Given that there has been a considerable tightening of everything environmental since 1988 and the hoops that Smallwoods (about 710 Tsawwassen Beach) went through with Fisheries and Oceans just to bring materials across the beach to build their house, have F&O been consulted about digging a major trench along the "sensitive" beach to bury the sewer line? 9/ you can appreciate that bring the line up 60 vertical ft. from the road to the bench houses up along a difficult bank will be extremely expensive for the owners. Therefore l you can appreciate that both owners are very reluctant to go this route when their existing systems have functioned for decades and continue to work very well. 10/ the homeowners along the beach recently applied to the Surveyor General to add the accreted land in front of their house to be added to their title. In BC, any

13 Attachment Ie' 3 of 5 accreted land on waterfront automatically is owned by the land owner whether or not it is noted on the title. If the sewer eventually ends up within the accreted area, what happens? Sewer services are not as I understand allowed to cross over one person's property to reach another. Does the sewer get relocated? Does the presence of the sewer preclude the owner from benefitting from the accreted land? The Surveyor General should be asked for regulations pertaining to this issue. Owners cannot make intelligent decisions until all the factors have been presented to them. Some owners may have signed this Petition without full knowledge of the ramifications of their doing so. With more complete information, they may wish to change their position. I respectfully request that Delta address these issues before any further work is done. A meeting of all homeowners should be scheduled by Delta for say November so that we are all clear on what the overall impact will be to us in agreeing to go ahead. There is absolutely no panic to get this project underway. Better the time is spent on full disclosure and understanding by all. It is not right to mail out a 1 % page letter with vague information and expect everyone to commit to or be dragged into a $35,000 to $60,000 expense within a few weeks of receipt.. 14 Attachment 'C' 4 of 5 File: G November 4, 2010 Mary Frances Donis 413 Tsawwassen Beach Road Delta, BC V4M 4C8 Dear Ms. Donis, Subject: local Area Service Petition - Sewer Extension Thank you for your letter dated September 20, 2010 which outlines several questions regarding the proposed Local Area Service petition in your area. Please accept my apologies for not responding to your queries sooner. This letter is intended to answer those questions related specifically to your neighborhood petition and is for information purposes only. I have summarized the questions, listed below, that are relevant to the petition followed by our response in italics: 1. Are the estimated costs the results of a tender? What happens if costs are lower? No, the costs presented are an estimate and represent the maximum values homeowners will pay to the Municipality for the sewer main installation. If, through the design and construction process costs are lower than estimated, residents will be charged less. If the actual costs are higher than the estimate, the costs to residents are limited to the estimated value. 2. Can the costs to Delta be deferred, similar to property tax deferral? Yes. If a resident qualifies for property tax deferral and is using this option, the Local Area Service costs can also be deferred based on the 15 year Payment option associated with the Local Area Service. 3. Where are the sewer service connections to be located? Service connections will be from the beach area and generally at 90 degree angles to each individual property line OR generally at 90 degrees to the common property line in the case of properties without direct beach frontage. 4. Can sewer lines cross gas and water lines and are there any health or safety concerns with the crossings? Yes, service connections and mains can cross one another and, if done to code, do not represent a health risk. Any work associated with the sewer installations for individual owners is their responsibility. Where the sewer pipes cross other utility companies infrastructure located in Rights of Ways, those utilities must be consulted in advance of any work. 6. Who pays for the service connection work and permits? Individual property owners are responsible for all costs of their service installation including permits. However, Delta staff are prepared to assist property owners with outlining the process to obtain the necessary Archeological permits, but the actual permit application and responsibility remains with the individual property owners. 7. Has the Department of Fisheries and Oceans approved the beach installation? Not at this time. Only after financial commitments are secured will the detailed design and permit process commence for this work, however, approvals were obtained. for previous similar installations. 8. If beach front lands are accreted, will the sewer line be relocated out of those lands? No. Design will utilize existing available lands. Should there be a desire to modify property boundaries in the future, Delta would require registered Rights of Ways to protect the sewer line. As you may be aware, the Local Area Service petition to extend the sanitary sewer system was circulated through your neighborhood earlier this year and submitted to Delta in early September. Delta did confirm, on September 14, 2010, that the petition has met the minimum requirements to proceed for further evaluation, which is currently underway. Once this process is completed staff will report to Council in the near future on the project merits and recommended direction.
