4 PART E - APPLICATION FOR FARMSTEAD SPLIT SUBMITTAL CHECKLIST Conditional approval: To receive conditional approval, applicant must submit a complete application and meet the farmstead split requirements outlined in Part C. Completed farmstead split application Copy of recorded deed Plat of survey (to scale) from a professional land surveyor showing existing structures on a paper size not to exceed 11 x 17. The plan must include the following: Scale, north arrow Dimensions and acreage of the parent parcel and proposed farmstead split Legal description of parent parcel and proposed farmstead split Setbacks from all existing structures to all property lines Affidavit of owner s consent (if applicable) Disclosure of beneficiaries (if applicable) Final approval: To receive final approval, applicant must return a copy of the recorded covenant to the Will County Land Use Department. DECLARATION OF RESTRICTIVE COVENANT THIS AGREEMENT IS ENTERED INTO ON, 20, by, hereinafter referred to as the Owner and between the County of Will, Illinois hereinafter County. WITNESSETH: WHEREAS, the undersigned, is the Owner of the parent parcel located at in Will County, and being more particularly described on Exhibit A attached hereto and incorporated herein by reference. WHEREAS, the Owner executed a one-time split of a farmstead lot out of a qualifying A-1 zoned parcel. Further, as a condition of the farmstead split provisions of the Will County Zoning Ordinance effective October 1, 2012, a covenant to restrict further division of the parent parcel without full platting of the remainder of the parent parcel and rezoning to the appropriate zoning district, when required by zoning ordinance, shall be recorded. Additionally, the restrictive covenant shall be and is binding on all owners, heirs, devisees and legatees, applicable to both the parent parcel and the farmstead split lot, and is intended to fully run with the land and not simply be personal to the applicant. NOW, THEREFORE, in consideration of the farmstead split and the mutual benefits to be derived by all parties concerned, the Owner does hereby covenant and agree with all subsequent owners, heirs, devisees, and legatees, that the following restrictive covenant shall and hereby does run with the land and is not simply personal to the applicant, and shall be applicable in full force and effect to all subsequent owners, heirs, devisees, and legatees to both the parent parcel and the farmstead split lot. ARTICLE I: DIVISION OF LOTS Further division of the parent parcel shall be prohibited without full platting of the remainder parent parcel and rezoning to the appropriate zoning district, when required by the Will County Zoning Ordinance and/or 765 ILCS 205/1. IN WITNESS WHEREOF, the undersigned, being the Owner of the real estate herein described, has caused this Declaration of Restrictive Covenant to be executed as of the day, month, and year first above written.
