2 DEVELOPMENT FACILITATORS INC ENGINEERS-SURVEYORS-PLANNERS CONSTRUCTION MANAGERS 1-97 BUSINESS PARK 1127 BENFIELD BLVD, SUITE K MILLERSVILLE MD WWWDFIENGINEERINGCOM FAX S October 17, 2017 AnneArundel County Department of Planning and Zoning 2664 Riva Road Annapolis, MD RE: Variance Application - Explanatory Letter 2026, Poplar Road, MD Poplar Ridge, Lots Tax Map 18 Block 16 Parcel 192 To whom it may concern; Please find submitted herewith the variance application and associated required submittal materials requesting a variance to Article (b)(l) to permit new lot coverage nearer to the shoreline than the closest facade of the existing principal structure in the Chesapeake Bay Critical Area (LDA and Buffer Modified), and to lot coverage limits in the Chesapeake Bay Critical Area (Article ) The site is identified as 2026 Poplar Ridge Road, Pasadena, Maryland, 21122, also as Lots , on the Poplar Ridge plat It's a 40, 097-square foot lot zoned R2 The site is located within the Chesapeake Bay Critical Area (LDA / Limited Development Area) and is Buffer Modified The property fronts a public 30' foot improved right-of-way, known as Poplar Ridge Road This site is currently developed with two existing single-family dwellings, an existing driveway, multiple existing sheds, and two existing covered patios on the water side The owner constructed a pool without the benefit of a permit, which created new lot coverage closer to the shoreline than the principle structure and an increase in lot coverage; the owner is currently under violation as the work is complete and is being required to submit a permit and variance for the new lot coverage The owner also would like to expand the existing deck on the rear of the home to lead over to the pool The site is served by private well and an onsite sewage disposal system Calculations for existing and proposed lot coverage are provided on the site plans, and there is a brief description below: The lot coverage as it exists today is 10,911 square foot, which equates to 2721% of the site; the existing lot coverage prior to the construction of the pool had a lot coverage of 10, 361 square feet, which equates to 25 84% of the site Which exceeds the allowed lot coverage, of 6, 014 square foot (LDA = 15 00% of the site)

3 The applicant is seeking a variance to Article (b)(l) to permit new lot coverage nearer to the shoreline than the closet fagade of the existing principal structure in the Chesapeake Bay Critical Area (Buffer Modified) The owner of this waterfront home was unaware that construction of an 18'x33' above ground pool along the frontage of his home required a permit at the time he constructed it The applicant is under contract with DFI for the preparation of a building permit for the pool in conjunction with this variance The pool is approx 68 19' at the closest point from the shoreline, the existing home is as close as 50 28', and therefore the pool is further from the shoreline than the closest point of the home But due to the definition of "facade" being any portion of the exterior wall, portions of the front fagade of the existing home are further from the shoreline than the pool is, making the pool closer to the shoreline than all portions of the front facade of the home The addition of the pool increased the lot coverage by 550 square feet The owner will be submitting a building permit to cover for the new lot coverage and will be addressing stormwater management, by way of plantings Also, please note that if the Variance is granted Mitigation plantings will be planted onsite at a 3:1 ratio for the new lot coverage with in the buffer Please take into consideration that pools and decks on waterfront homes, and in most cases between the home and the shoreline, is an amenity that many homeowners along Poplar Ridge Road as well as many other waterfront homeowners enjoy There are multiple homes along Poplar Ridge Road, as shown on the "Exhibit A" aerial photo, that enjoy a waterside pool We feel this is the minimum relief necessary to considering the circumstances in this case and we ask that you please consider granting the variance as requested above The pool is a common amenity for the neighborhood as well as the deck is an amenity that many waterfront home owners have and is not out of character for the neighborhood The applicant is also seeking a variance to lot coverage limits in the Chesapeake Bay Critical Area (Article ) The required lot coverage for a site of this size in the Chesapeake Bay critical area (LDA) is 6, 014 square feet We are requesting a variance of 4,897 square feet to the allowable lot coverage Please take into consideration that the lot coverage of the site was 10, 361 square feet or 25 84% prior to the construction of the pool, the pool increased the lot coverage by 550 square feet We would also like to bring to your attention that the neighboring property to the east, located at 2030 Poplar Ridge Road is also over the allowable lot coverage for a Lot of this size in the Critical area LDA, the lot coverage for this site is approx 31 69% of the site area The neighboring property to the west, located at 2022 Poplar Ridge Road is also over the allowable lot coverage for a Lot of this size in the Critical area LDA, the lot coverage for this site is approx 49 58% of the site area We feel this is the minimum relief necessary to considering the circumstances in this case and we ask that you please consider granting the variance as requested above The pool is a common amenity for the neighborhood as well as the deck is an amenity that many waterfront home owners have and is not out of character for the neighborhood Calculations for critical area clearing and lot coverage are provided on the site plan
