1 Page 1 of 10 Page 1 of 10 STAFF REPORT TO: AMADOR COUNTY PLANNING COMMISSION FOR MEETING OF: APRIL 8, 2014 ITEM 2- PUBLIC HEARING REQUEST FOR ZONE CHANGE FROM THE R1A, SINGLE FAMILY RESIDENTIAL & AGRICULTURAL DISTRICT TO THE C-1, RETAIL, COMMERCIAL & OFFICE DISTRICT (APN: & ). APPLICANT: Page Family Trust SUPERVISORIAL DISTRICT V LOCATION: Shenandoah Road and Horseshoe Lane, River Pines, approximately 0.3 miles from the Amador County line. A. DESCRIPTION: This application is a request for a Zone Change to allow for the occupancy of a currently non-conforming building. The 0.51-acre site is the location of the former River Pines Club, but has not been occupied for commercial use in approximately 12 years. Additionally, the building contains two residential apartments, one of which is occupied. A zone change to C1 will subsequently require substantial building upgrades and a Use Permit if the building is to be used for dual occupancy (residential/commercial). The proposed zoning district is supported by the current General Plan designation of C Commercial, as well as the proposed General Plan designation as a mixed-use Town Center. The request includes an adjacent vacant parcel to the north, containing approximately 0.11 acres. The second parcel has a current General Plan designation of R-L, Residential Low Density and a proposed General Plan designation of mixed-use Town Center. B. STAFF REVIEW: This project was reviewed by County departments which found no technical objections to the Planning Commission recommending approval of the Zone Change for the parcel fronting Shenandoah Road (APN ) to the Board of Supervisors along with the adoption of a Notice of Exemption. C. PLANNING COMMISSION ACTION: The first action of the Planning Commission should be a decision on the adequacy of the environmental document, proposed to be a Notice of Exemption (Categorically Exempt per Section 15183) because the zone change for APN is consistent with the current and proposed General Plan designations for the area. Next, the Commission must make a recommendation on the requested Zone Change to the Board of Supervisors. D. FINDINGS: If the Planning Commission recommends approval of this project, the following findings are recommended for adoption: 1. The Zone Change for APN is consistent with the surrounding land uses and the Amador County General Plan, Land Use Element at this location; and, 2. A review of the proposal was conducted by staff who, through their own research, found that the Zone Change will not have a significant effect on the environment and is Categorically Exempt from CEQA per Section Therefore, a Notice of Exemption will be adopted and filed with the County Recorder. IIhas always been used that way. AKA "The River Pines Club". At the time we had purchased this property it was not in Operation at the time. Has been approximately 12 years, and have had many inquires about opening a Restaurant, Sports bar, deli, etc. But have been overwhelmed with the cost, or such a project. So A lot oftime has pas and so the Grand Father Law has expired. We would like to zone it Commercial as it has always been used that way. As a property owner in River Pines I only want the best for this little town, and think the neighbors would like a Retail Space, Consignment. Antique office space, or just a thrift shop something along these lines. IfWould be great for a new business in town.
