ADDITIONAL AGENDA ITEMS MOTION A-66/16 moved: J. Scholten seconded: L. Bartlett THAT the LPRCA Board of Directors add an item dealing with litigation or potential litigation under the in-camera session as item 1 (a) to the May 4 th, 2016 agenda. Haydt THAT the minutes of the LPRCA Board of Directors Regular Meeting held April 6 th, 2016 be adopted as circulated. CARRIED T. Southwick informed the Board that the East Beach Restoration Project funded by the Great Lakes Guardian Community Fund is not proceeding as per resolution by Bayham Council. 4 BUSINESS ARISING a) LPRCA Conservation Stewardship Award Staff developed and presented an application process and terms of reference for the new LPRCA Conservation Stewardship Award to be presented annually at the Annual General Meeting. The initial start-up costs would be approximately $800 to $1000 and $200 to $400 annually. There were no questions or comments MOTION A-68/16 moved: L. Bartlett seconded: N. Haydt THAT the LPRCA Board of Directors approves the nomination form and terms of reference for the new Long Point Region Conservation Stewardship Award. CARRIED REVIEW OF COMMITTEE MINUTES MOTION A-69/16 moved: N. Haydt seconded: L. Bartlett THAT the minutes from the Backus Museum Committee meeting of February 8 th, 2016 and the Lee Brown Marsh Management Committee meeting of December 18 th, 2015 be received as information. CARRIED It was noted that a volunteer member of the Backus Museum Committee has resigned and the Committee has since discussed reducing membership. CORRESPONDENCE In reference to the letter re: Conservation Authorities Act Review from the Ministry of Natural Resources and Forestry (MNRF), the GM has been invited to participate in a Conservation Authorities Act Review Working Group this month. 5 DEVELOPMENT APPLICATIONS a) Staff Approved applications Planning staff approved 20 applications over the past month. MOTION A-71/16 moved: R. Chambers seconded: N. Haydt That the LPRCA Board of Directors receives the Staff Approved Section 28 Regulation Applications report dated May 4 th, 2016 as information. CARRIED b) New Applications The Planning Department recommended the approval of three applications. L. Minshall reviewed the applications detailing the reasons for recommendation. MOTION A-72/16 moved: D. Hayes seconded: R. Geysens THAT the LPRCA Board of Directors approves the following Development Applications contained within the background section of the report: A. For Work under Section 28 Regulations, Development, Interference with Wetlands & Alterations to Shorelines and Watercourses Regulations (R.R.O Reg. 178/06), LPRCA-59/16 LPRCA-60/16 LPRCA-62/16 B. That the designated officers of LPRCA be authorized to complete the approval process for this Development Application, as far as it relates to LPRCA s mandate and related Regulations. CARRIED NEW BUSINESS a) CALENDAR REVIEW Staff will be participating in two children s water festivals this month, the first is Brantford/Brant at Mohawk Park May and the second is Haldimand at Taquanyah CA May J. Robertson presented the park information/brochure distribution list and requested suggestions for further distribution locations from the Board. 6 MOTION A-73/16 moved: D. Brunton seconded: R. Geysens THAT the LPRCA Board of Directors receives the May Calendar Review Report as information. CARRIED b) GENERAL MANAGER S REPORT The GM reported that seasonal campers have begun to move into the parks and park staff have been asked to become actively engaged in their respective campers associations. The recent fundraising events held at both Backus and Camp Trillium were deemed great successes. MOTION A-74/16 moved: D. Hayes seconded: R. Geysens THAT the LPRCA Board of Directors receives the General Manager s Report for April 2016 as information. CARRIED c) VITTORIA EA PROCESS REPORT As per the Dam Safety Review, a Class Environmental Assessment (EA) is required for the Vittoria Dam. The Class EA will evaluate and identify options for the dam including: 1) do nothing, 2) rebuild, 3) repair, 4) modify or 5) decommission the structure. Staff proposed to do much of the Class EA work in-house except where additional expertise is required. LPRCA has recently been notified that the Water and Erosion Control Infrastructure Program (WECI) has granted $50,000 to match funds approved in the 2016 budget for the Class EA study of Vittoria Dam. The project must be completed by March 31, MOTION A-75/16 moved: J. Scholten seconded: N. Haydt That the LPRCA Board of Directors directs staff to proceed with the Vittoria Dam Environmental Assessment project based on the in-house approach outlined in the staff report. CARRIED d) REGULATIONS OFFICER APPOINTMENT L. Bower recently completed the Basic Law Enforcement/Conservation Authority Compliance Training organized by the MNRF and Conservation Ontario, and is now eligible to be appointed as a Regulations Officer to enforce the regulations under Section 28. L Bower will be replacing J. Miller who has left the organization; she will work with B. Hodi who is also a current Regulations Officer. 7 MOTION A-76/16 moved: R. Geysens seconded: D. Hayes THAT the LPRCA Board of Directors appoints Leigh-Anne Bower, Planning Technician, as an LPRCA Regulations Officer to enforce any regulation made under Section 28 of the Conservation Authorities Act. CARRIED e) PROVINCIAL OFFENCES OFFICER APPOINTMENT P. Walther-Mabee recently completed the Basic Law Enforcement/Conservation Authority Compliance Training Level 1 organized by the MNRF and Conservation Ontario, and is now eligible to be appointed as a Provincial Offences Officer under Section 29 of the Conservation Authorities Act. The addition of Ms. Walther-Mabee brings the total of Provincial Offences Officers at LPRCA to four including D. Holmes. MOTION A-77/16 moved: D. Brunton seconded: Roger Geysens THAT the LPRCA Board of Directors designates Pamela Walther-Mabee as a Provincial Offences Officer in accordance with the Provincial Offences Act for the purpose of enforcing Section 29 of the Conservation Authorities Act, plus all the applicable legislation. f) FIRST QUARTER FINANCIAL REPORT CARRIED There were no adjustments required to the budget during the first quarter but since April 1 st a couple of items require adjusting. 1) Septic charges to the parks will be higher than anticipated based on the recent tendering process; and 2) the capital budget has been adjusted to remove the shoreline mapping project for Norfolk County. Staff reviewed the report and responded to questions. It was requested that the purchased services at the parks be detailed further. The Chair and GM met with Norfolk County staff to discuss options for the Waterford North CA gatehouse. The discussions are ongoing. MOTION A-78/16 moved: L. Bartlett seconded: J. Scholten THAT the LPRCA Board of Directors receives the 1 st Quarter, 2016 Budget Performance Report as information. g) APPENDIX PUBLIC FORESTRY INCOME STATEMENT CARRIED A report had been brought to the Board at the last meeting regarding the revenue and expenses of the Public Forestry Department. 8 expenses within the department and staff was directed to research cost-savings options. Staff noted that the costs for ecological studies have been trending down due to increased staff knowledge/training. MOTION A-79/16 moved: N. Haydt seconded: L. Bartlett That the LPRCA Board of Directors does now enter into an In Camera session to discuss: litigation or potential litigation, including matters affecting the Conservation Authority CARRIED MOTION A-80/16 moved: D. STRATEGIC PLAN Goal #1 - To develop and maintain programs that will protect life and property from natural hazards such as flooding and erosion. BACKGROUND Application# LPRCA-27/16 Plan 500, Lot 718, 70 Concession Street, Oxford Tillsonburg The proposed work to install erosion protection works to protect a sanitary manhole; A satisfactory design was submitted in support of this application; The application is an alteration to a watercourse and it will not negatively affect the watercourse; The application is within the regulated flood and erosion hazard of Big Otter Creek and the control of flooding and erosion should not be affected by the proposed development. Application# LPRCA-58/16 Lot 14, Con 1, 1280 Lakeshore Road, Haldimand Walpole The proposed work demolish and replace 33m 2 deck; There is no opportunity for conversion into habitable space; The application is within the regulated erosion hazard of Lake Erie and the control of erosion should not be affected by the proposed development. 9

The hydrologic function of the wetland will not be negatively impacted by this development. Application# LPRCA-78/16 Concession 2 NTR, Lot 21, 114 County Road 13, Norfolk Middleton The proposed work - to construct a 241 m 2 single-family dwelling and septic system approximately 65 metres from a wetland; The application is within the regulated area adjacent to a wetland. The hydrologic function of the wetland will not be negatively impacted by this development. Application# LPRCA-79/16 Lot 1, Conc 8, 276 Mechanic Street, Waterford Norfolk The proposed work construct a 103m 2 garage and 16.3m 2 entry way; The application is approximately 58 metres from a wetland; The application is within the regulated area adjacent to a wetland. Application# LPRCA-73/16 Plan 251, Lot 19, 87 Hastings Drive, Norfolk County - Charlotteville The proposed work to reconstruct a deck to reduce the size to 7.8m 2, replace stairs and railings and to construct a fence 3.7m in length. There is no opportunity for conversion into habitable space; A satisfactory site plan and construction plans were submitted in support of this application; The application is within the erosion hazard associated with Lake Erie and this proposal will not negatively affect the control of erosion. The application is within the flooding hazard associated with Lake Erie and this proposal will not negatively affect the control of flooding. Both Committees will be meeting again on June 13 th. On the 12 th, the GM was in Burlington as part of a Conservation Ontario working group to prepare for the upcoming Conservation Authorities Act Review Advisory Group Session that the GM attended on May 16 and 17 in Toronto. Other meetings for the month included the Haldimand Children s Water Festival with the Chair on the 26 th, the CA Volunteer Working Group at Ball s Falls on the 27 th and the Ruffed Grouse Dinner in Courtland on the 28 th. Evanitski) RECOMMENDATION That the Board of Directors receives the Conservation Authorities Act Review Update as information. STRATEGIC GOAL Goal #4 Work collaboratively with watershed stakeholders to deliver high-value, efficient and innovative solutions. BACKGROUND LPRCA s General Manager was one of 15 stakeholders selected last month from across Ontario to participate on the Conservation Authorities Act Review Stakeholder Advisory Group. The two-day session held in Toronto on May 16 and 17 included representatives from the agricultural, development, municipal, environmental, Métis and non-government sectors. The Review has been spearheaded by Parliamentary Assistant Eleanor McMahon who attended the sessions. MNRF Minister Bill Mauro also attended. As Members are aware, the Province has completed the first phase of its Review. Based on the input received, including from municipalities within LPRCA s watershed, the Government has established five priorities for updating the Conservation Authorities Act 1. Strengthening oversight and accountability in decision-making. 2. Increasing clarity and consistency in roles and responsibilities, processes and requirements. 3. Improving collaboration and engagement among all parties involved in resource management. 4. Modernizing funding mechanisms to support conservation authority operations. 5. Enhancing flexibility for the province to update the Conservation Authorities Act framework in the future. 23

26 Board members have been notified of MNRF s report Conserving our future proposed priorities for renewal that has been posted on the Environmental Registry (EBR) for comment by September 9, The Province has scheduled a number of stakeholder engagement sessions with LPRCA representatives planning to attend the London session on June 9 th. The main points that came out of the two-day Stakeholder session are as follows: 1. Conservation authorities need to dispel the myth of core mandate being restricted to hazard lands i.e. the Act calls upon CAs to provide a lot more than just planning reviews; 2. There needs to be a multi-ministerial buy-in/support for CAs i.e. CAs serve more than just MNRF; 3. Integrated watershed management needs to continue to be the basis for conservation authorities; 4. Multiple options (including shared services/amalgamation/etc.) should be looked at to improve the capacity and capabilities of CAs; and 5. CAs are committed to improving service delivery standards (with the appropriate resources). There was strong support for conservation authorities from all sectors especially representatives from the development and municipal groups. The development sector argued that the Province needs to properly resource CAs in order for developers to meet their deadlines on time. Municipalities recognized the costeffectiveness of CAs in the services they provide to watershed constituents. It was stressed to the Province that the municipal sector has lived up to its obligations under the original partnership with the Province and that further downloading was both unacceptable and not an option. As for strengthening oversight, the pros and cons of Board composition were discussed; the GM on behalf of LPRCA stated that if other sectors wanted a seat at the CA table, those sectors would have to provide funding. BUDGET IMPLICATION LPRCA currently receives approximately $68,500 annually from the Province in transfer payment. Travel costs for the GM to attend the two-say session were paid for by the Province. STRATEGIC PLAN Goal #1 - To develop and maintain programs that will protect life and property from natural hazards such as flooding and erosion. Goal #5 Work collaboratively with watershed stakeholders to deliver high-value, efficient and innovative solutions. BACKGROUND Southwestern Ontario Orthophotography (SWOOP) is a collaborative, cost-sharing effort of 69 municipalities, conservation authorities, utilities and others, led by the Ontario Ministry of Natural Resources and Forestry (MNRF) to procure orthorectified (horizontally accurate) multi-spectral imagery of southwestern Ontario. Light Detection and Ranging (LiDAR) is a surveying technique that measures distances by illuminating a remote target. By attaching LiDAR equipment to an aircraft, measurements are made that produce high-resolution maps of topographic features. Elevation data collected by LiDAR is raw data and requires further processing, corrections, quality control and quality assurance before it can be used. As with all types of technology, there are advantages and disadvantages to orthophotography and LiDAR, and it is important to leverage the benefits of both methods together. Orthophotography can develop accurate planimetric mapping and breaklines that show changes in topography and, when these are combined with LiDAR, can produce a higher accuracy product. SWOOP imagery and LiDAR data is not floodplain mapping or hazard mapping but are very important tools for producing such mapping. 25

28 Accurate and defendable floodplain mapping requires detailed elevation data that is typically obtained through on the ground surveying and a digital elevation model. Digital elevation models are typically produced by processing SWOOP imagery and can be potentially supplemented by LiDAR data. The shoreline of Lake Erie is subject to flooding and its hazards with over 1663 residences alone in Norfolk County. The floodplain mapping within the shoreline areas would utilize elevation data from SWOOP and potentially LiDAR to produce detailed uprush and loading conditions to help residents properly flood proof their buildings, aid Fire & EMS to prepare evacuation plans during flooding, and reduce the overall cost and risk to life associated with a flood event. LPRCA staff is aware of only one project that has acquired LiDAR data within the watershed; unfortunately staff is unable to obtain the data due to licensing issues. The Ontario Ministry of Agriculture, Food and Rural Affairs has given a notice of intent to issue a Request for Proposal to obtain LiDAR data within portions of Southern and Northern Ontario over two years. The primary goal in collecting the data is to update soil maps; however, there will be additional data collected that will likely include elevation data that could be utilized to aid in floodplain mapping. Currently the only orthophotography available to LPRCA is the SWOOP product. SWOOP provides up-to-date aerial imagery and is frequently used by the Watershed Services Department to provide accurate and vital information for plan review; SWOOP is also utilized to build digital elevation models, assess natural hazards (flooding, erosion, etc), monitor dams, and provide hydraulic and hydrological information. SWOOP is also used for property management to monitor woodlots and potential encroachment issues. BUDGET IMPLICATIONS LPRCA s cost to obtain SWOOP coverage of the LPRCA watershed in 2015 was $6,835. STRATEGIC PLAN Goal #1 - To develop and maintain programs that will protect life and property from natural hazards such as flooding and erosion. Goal #5 Work collaboratively with watershed stakeholders to deliver high-value, efficient and innovative solutions. BACKGROUND In 1996, municipalities were delegated Municipal Plan Review responsibility by the Province of Ontario. A Memorandum was entered into in 1998 between the Regional Municipality of Haldimand-Norfolk and its three constituent Conservation Authorities to coordinate responsibilities with respect to natural heritage and hazard land protection. The agreement means that a delegated municipality does not have to acquire expertise that is available in its Conservation Authorities, a significant cost saving measure for the municipality. The Province of Ontario formalized the process in 2001 by entering into a Memorandum of Understanding with Conservation Ontario on behalf of all Conservation Authorities to provide technical comments to the Upper and Lower Tier Municipalities with respect to Natural Hazards as outlined in the Provincial Policy Statement. This agreement (attached) is an update to the 1998 agreement and a reflection of the 2001 Memorandum of Understanding with the Province. For streamlining and efficiency purposes, Conservation Authorities have three roles in 27

30 the municipal plan review process: 1) Planning and technical review services to municipalities as part of the municipal plan review process (so the municipalities do not have to acquire technical expertise that their Conservation Authorities have); 2) Delegated responsibility to provide municipal plan input and review comments to municipalities on matters of flood, erosion and hazardous lands on behalf of MNRF and the Province of Ontario (so there is only one agency providing comments on these matters). 3) Comments related to the administration of LPRCA s Section 28 regulations. The attached draft MOU gives LPRCA the lead responsibility for providing planning and technical review and comments to Haldimand County in the areas of flood hazards, erosion hazards, lakeshore hazards, hazardous lands, water as it relates to natural features, stormwater management as it relates to natural hazrds and natural heritage, and subwatershed plans. LPRCA has the technical expertise in-house to fulfill these listed responsibilities. BUDGET IMPLICATIONS The work outlined in the agreement is the same plan review work as LPRCA staff is currently doing (under an expired MOU). There is no additional work load implied in the agreement. LPRCA recovers the cost of plan review through applicant fees. Haldimand County will pre-screen applications that it will circulate for comment to LPRCA and will notify applicants about the review fees due to LPRCA. Under the agreement, LPRCA staff will attend at Ontario Municipal Board and Court hearings at Haldimand County s request. Haldimand County will provide the necessary legal and technical support; the requirement for LPRCA s attendance does not commit LPRCA to lawyer or consultant expenses. A Memorandum was entered into in 1998 between the Regional Municipality of Haldimand- Norfolk and its three constituent Conservation Authorities to coordinate responsibilities with respect to natural heritage and hazard land protection. In 2001 Conservation Ontario on behalf of all Conservation Authorities entered into a Memorandum of Understanding with the Province of Ontario to provide technical comments to the Upper and Lower Tier Municipalities with respect to Natural Hazards as outlined in the Provincial Policy Statement. This agreement is an update to the 1998 agreement and a reflection of the 2001 Memorandum of Understanding with the Province. 1. PURPOSE The purpose of this Memorandum of Understanding is to update the January 15, 1998 Memorandum of Agreement between the County and Conservation Authorities for the provision of specified plan review and technical clearance services to the County. 2. ROLES AND RESPONSIBILITIES a The County and the Conservation Authority mutually agree that: I. this Memorandum of Understanding applies to each of the Conservation Authorities referred to above and the area under each of their respective jurisdictions which is located within the County of Haldimand; II. III. IV. the Conservation Authority has the expertise to provide the plan review and technical clearance services to the County identified in this Memorandum of Understanding and that the County is relying on said expertise. The parties acknowledge that the County remains the approval authority for those planning applications for which the County is so designated by statute and which authority has not been otherwise delegated by the County; nothing in this Memorandum of Understanding precludes the Conservation Authority from commenting to the County from a Conservation Authority perspective, as it normally would on an application circulated by the County under the Planning Act; application types listed in Schedule 1 will still be circulated to the appropriate Conservation Authority for comment from the Conservation Authority perspective except as noted in Schedule 3; V. a protocol has been developed, included as Schedule 3, whereby the County will prescreen applications in order to further streamline the process; 29

VIII. this Memorandum of Understanding may be amended by mutual agreement, in writing, from time to time to reflect changes in the programs of parties to this Memorandum of Understanding, or as a result of changes in provincial policies, or as a result of subsequent discussions between the parties hereto; all parties agree to periodically review this Memorandum of Understanding at 5 year intervals; and, any party to this Memorandum of Understanding may terminate the agreement, as it pertains to its involvement, at any time, in writing to the other parties to the agreement, with a minimum of 120 calendar days notice. b The County commits to: I. circulate to the appropriate Conservation Authority those applications listed in Schedule 1 for comment as per the items in Schedules 2 and in accordance with a prescreening protocol included as Schedule 3; II. III. IV. transfer appropriate policy statement, guidelines, manuals, maps, information, data and criteria from the County to the Conservation Authority, and transfer said material to the Conservation Authority as it is received from the Province of Ontario, or make arrangements to have said material transferred directly from the Province to the Conservation Authority; retain consultants other than the Conservation Authority to provide the plan review and technical clearance services identified in this Memorandum of Understanding, when in the opinion of the County, and where applicable, the County, or the Conservation Authority, utilizing the Conservation Authority as specified in this agreement could result in a conflict of interest for the Conservation Authority or where otherwise agreed that it would be in the best interest of the planning process; and, notify the applicant of the required Conservation Authority fee and attach payment to circulated applications when available. c The Conservation Authority commits to: I. provide the County with those services listed in Schedule 2 at no cost to the County on a fee for service basis by the applicant; II. III. IV. provide its comments to the County on receipt of an application from the County or request an extension with reasons, for applications identified on Schedule 1 and within the specified County review timeframe, unless an alternative timeframe is agreed upon; comment on whether the application complies with the Provincially approved Haldimand County Official Plan in the plan review services it provides the County (as identified in Schedule 2); participate in pre-consultation meetings for potential planning applications upon the request of the County; V. consider all relevant guidelines in the plan review and technical clearance services it provides the County; VI. VII. not disseminate any data, maps, information or other documents either received directly from the Province or identified as "Provincial data" by the County, except as otherwise licensed or agreed upon by the licensing party/owner of the data; not disseminate any data, maps, information or other documents either received directly from the County or identified as "County data" by the County, except as otherwise licensed or agreed upon by the licensing party/owner of the data; 30
