The Chair gave his opening remarks and reviewed the guidelines and process to be followed for the hearing. Staff introduced Ms. Susan Belair, Mr. Sam Bunting, home designer, and Mr. Paul Careswell then proceeded to present the staff report. This application was received June 22, 2018 to construct a new vacation home. The area requested for the construction is in the Lake Erie shoreline flood hazard and is contrary to the LPRCA shoreline policies. The construction of the structure affects the control of flooding in the flood hazard area and does not have safe access/egress for evacuation or emergency assistance. Therefore, staff recommended refusal. Mr. Bunting spoke on behalf of Ms. Belair stated through research it was discovered Lot 116 was an original lot of subdivision from Staff and the proponent responded to questions from the Board. There were no further comments or questions. The Board moved into a closed session to discuss the matter further. CARRIED Ms. Belair was advised that application LPRCA-115/18 was approved. b) Hearing LPRCA 108/18 Jacob Kolomaya The Chair gave his opening remarks and reviewed the guidelines and process to be followed for the hearing. Staff introduced Mr. Jacob Kolomaya, Mr. Ryan Elliott, Engineer and Mr. Nathan Kolomaya, agent of the applicant, and then proceeded to present the staff report. This application was received August 13, 2018 to demolish and construct a residential dwelling in the Lake Erie shoreline erosion hazard on Brown Street and is contrary to the LPRCA policies and standards. The construction of the structure affects the control of erosion increasing the potential for damage from slope instability and erosion. Therefore, staff recommended refusal. Mr. Nathan Kolomaya spoke on behalf of the applicant providing background information regarding the process that had begun in 2017and Mr. Elliott spoke to the erosion hazard. Staff and the proponent responded to questions from the Board. There were no comments from other interested parties and no further questions. CARRIED NEW BUSINESS a) GENERAL MANAGER S REPORT The GM reviewed the current staffing situation regarding filling vacant positions. Staff is still negotiating with the Nature Conservancy of Canada (NCC) for access to the Rowan Mills Conservation Area for harvesting. MOTION A-149/18 moved: W. Casier seconded: R. CARRIED b) 2 ND QUARTER FINANCIAL REPORT Expenditures have been tracking to budget and although camping revenue shows behind to the end of June, it has jumped in July and August. There has been very positive feedback concerning the extended season at Deer Creek. Outstanding capital projects were discussed. MOTION A-150/18 moved: R. Geysens seconded: D. Board members to advise by the morning of September 11, 2018 of their interest. CARRIED d) LPRCA PARKS UPDATE Staff reported that the season has been going well although not without its challenges in terms of the weather. Revenues have been steady or very slightly up from last year. The water supply at Norfolk CA is improving but progress is still ongoing. Dead ash trees continue to be a problem and will be dealt with as required. MOTION A-152/18 moved: W. Casier seconded: R. Geysens THAT the LPRCA Board of Directors receives the Parks Update report as information. e) WATERFORD NORTH CA PROPOSAL CARRIED There have been numerous attempts to bring hydro into Waterford North but there have been many challenges. With input from Hydro One, the most logical entry would be from the northwest side of the park. To facilitate the installation of the hydro and water lines as well as remove the many dead ash, staff recommended the most cost effective method would be to remove all trailers over a multi-phased project. A letter will be drafted and sent to campers that are affected by Phase 1. MOTION A-153/18 moved: D. Hayes seconded: R. Chambers THAT the LPRCA Board of Directors instructs staff to contact affected seasonal campers on sites 1 through 41 to remove their trailers from Waterford North Conservation by October 26, 2018 to allow LPRCA to commence Phase 1 of the water and electrical upgrades to the park. CARRIED f) GYPSY MOTH REPORT The gypsy moth populations have been building over the last couple of years and heavy defoliation is expected in the coming years. 9 g) PRESCRIPTION/OPERATING PLAN SMITH TRACT The Prescription/Operating Plan was presented for the Smith Tract. The property consists of 50 acres that will be marked and tendered by the end of October. MOTION A-155/18 moved: R. Geysens seconded: D. Hayes THAT the LPRCA Board of Directors receives the Gypsy Moth report as information. h) NEW ADMINISTRATIVE BY-LAW CARRIED The draft Long Point Region Conservation Authority Administrative By-Law presented addresses the requirements specified in the new Conservation Authorities Act. Staff reviewed the changes and noted that it will now be a stand-alone document and no longer part of the LPRCA Personnel Policy. Requested amendments included a suspension of rules clause and a change in the wording to vote abstention. MOTION A-156/18 moved: D. Hayes seconded: W. Casier THAT the LPRCA Board of Directors repeal the LPRCA Personnel Policy approved December 20 th, 2017; AND THAT the LPRCA Board of Directors adopts the new LPRCA Administrative By- Law as amended; AND THAT the LPRCA Board of Directors adopts the LPRCA Personnel Policy. 12 LONG POINT REGION CONSERVATION AUTHORITY BACKUS MUSEUM COMMITTEE - MINUTES September 11, Deputations: None 6. Business Arising: a. Homestead Window Project: This summer, volunteers sorted through all of the storm windows on the Homestead and identified 19 that need to be replaced. A Scope of Work was created and a quote was obtained from a firm specializing in wood windows. The quote has been received and is currently under review by senior management. The goal is to have all original windows puttied, painted and fitted with new/repaired storm windows by Christmas. b. Summer Events Report: Sheila reported on another successful Summer season. After three years of testing, the new events are popular, successful and the right fit for the Historic Site. c. New members for Backus Museum Committee: This committee will meet after the meeting. 7. New Business: a. Summer Stats: Sheila presented the July and August statistics for this season. b. Permission by Owner to Designate the Homestead under the Ontario Heritage Act: The Norfolk Heritage Committee did a tour of the Backhouse Historic Site on August 13 th. They informed us that although 99% of the process to designate the Homestead under the Ontario Heritage Act was completed, the designation was not finalized. To complete this process, permission from the owner is required. The committee discussed the importance of designation of the Homestead in recognition of its significant history. MOTION: BMC Moved by: Julie Stone Seconded by: Roger Geysens That the LPRCA Backus Museum Committee recommend that the Backus Homestead be designated under the Ontario Heritage Act; AND THAT; This recommendation be forwarded to the LPRCA Board for approval. These policies will be considered for approval at the next meeting of the Backus Museum Committee. Next meeting: Tuesday October 2, 2018 at 9:00 am Recruitment Committee Minutes A meeting of the Recruitment Committee followed the regular meeting of the Backus Museum Committee. Members present: Julie Stone, Betty Chanyi and Madaline Wilson The committee discussed three possible new members of the Backus Museum Committee. Members will approach these potential members to assess their interest. Sheila presented a one page description of the Role of Committee members to provide information on the committee to potential new members. Sheila will make a few corrections and forward to the Recruitment Committee. The Committee will meet again after the October meeting. 15 LONG POINT REGION CONSERVATION UTHORITY STAFF REPORT Date: September 26, 2018 File:1.6.2 To: From: Chair and Members, LPRCA Board of Directors General Manager, LPRCA Re: 2018 Christmas Operating Schedule (J. Maxwell) RECOMMENDATION THAT the LPRCA Board of Directors closes operations (except for emergency response) from December 24/18 to January 1/19 inclusive, and THAT staff working at that time be granted one complimentary day off with pay; and THAT staff be required to utilize three (3) vacation days during the closure period or take unpaid leave - along with three statutory holidays. BACKGROUND The LPRCA has for a number of years closed down operations (except for emergency response) over the Christmas-New Year s period. LPRCA staff is proposing the same process for The proposed closure period would be from Monday, December 24, 2018 to Tuesday, January 1, 2019 inclusive. This period would normally be four working days and three statutory holidays falling within this period. The Board has traditionally granted a complimentary day off with pay for those staff working that time of year. If the Board chooses to do so again this year, LPRCA staff will be required to utilize three (3) vacation days for this shutdown period or take unpaid leave. BUDGET IMPLICATION The projected value of one paid vacation day in December is $5,600. Colman) RECOMMENDATIONS THAT the LPRCA Board of Directors waives the purchasing and tendering policy and approves the use of the services of Classic Wood for the Backhouse Homestead window restoration project as outlined in the staff report of September 25 th, AND the LPRCA Board of Directors approves the use of deferred donated funds in the amount of $4, for the Backhouse Homestead window restoration project to cover the budget estimate shortfall. STRATEGIC PLAN Goal #1 Link people to the environment through outdoor, education and cultural heritage experiences. Goal #2 Protect and maintain the heritage assets of the Backhouse Historic Site to meet the mandate of the Backhouse Historic Site. BACKGROUND In 2018, the Long Point Region Conservation Authority is working towards the conservation of the 1852 Backhouse Homestead. The first project towards this goal is the repair of the windows. In June, Janet Gehring documented the original condition of the windows and storms. Staff confirmed that the original double hung windows are in good shape with some sill replacement/repair needed. However, the storm windows are in significant need of repair. Following an exhaustive search by staff, it was concluded that Classic Wood of Burgessville is the only company in the area able to perform the custom wood work required for the accurate recreation of the period storm windows for the homestead (to meet our heritage designation requirements). Classic Wood has provided a quote (attached) and is capable of producing and installing the custom storm windows for the Backhouse Homestead. As per the purchasing policy of the LPRCA, Board of Directors approval is required for a single source quote. The quoted work is as follows: storm windows need to be constructed after an examination of the condition of the windows of the Backhouse Homestead it was determined that 19 storm windows need to be newly constructed to ensure the protection of the building. 14

17 2. 11 storm windows need to be installed by contractor due to the height and layout of the windows on the second floor of the Backhouse Homestead the installation of the 11 storm windows on this level require professional installation. Installation will require equipment and training that permits working at heights. The vendor, Classic Wood is able to complete the task of installation of the 11 storm windows on the second level of the Backhouse Homestead. BUDGET IMPLICATION: The total cost of this project will be $14,225 + HST. In the 2018 capital budget, $10,000 was allocated to this project. In order to complete the Backhouse Homestead window restoration project, the use of donated funds in the amount of $4, is required. Colman) RECOMMENDATION THAT the LPRCA Board of Directors support the changes to the Seasonal Handbook as recommended. STRATEGIC GOAL Goal #3 Link people to the environment through outdoor, education and cultural heritage experiences. BACKGROUND LPRCA each year publishes the Seasonal Camper Handbook that clearly lays out the rules regulations campers are expected follow during their stay in one of our parks. When signing their seasonal agreements, campers must check off that they have read and understood the rules of the park. As industry standards change over time, it is good business practice to revisit these rules and make adjustments as required so LPRCA can remain competitive and minimize our exposure to liability. THE PROPOSAL The LPRCA Strategic Plan identifies in the Strategic Priorities that LPRCA Create a business plan for sustainable operation of active conservation areas as profit centres. LPRCA staff believes that changes to the seasonal agreement will help us meet the strategic priority identified above. The proposed additions and changes to the seasonal agreement rules are as follows: 1) (New addition to the rules.) Beginning 2019, for any new seasonal camping inquiries to be considered, their trailer must be 20 years or newer and must meet the approval of the Park Supervisor. (This additional rule will help to refresh and revitalize the parks while matching the industry standard.) 18

21 2) (New addition to the rules.) For safety concerns, any trailers 25 years or older currently in the park (grandfathered in) will be subject to a propane recertification/inspection every two years. (This is to protect LPRCA from potential liability issues in the future) 3) No trailers are to be sold in the park except at the discretion of the Park Supervisor and Manager of Conservation Land Services. Permission must be given in written form prior to the sale concluding. (Same as 2018 rules only written in plain language. There has been inconsistency between parks ) 4) (New addition to the rules.) Seasonal campers will be responsible for cutting and trimming their own sites beginning Sites must be maintained to a standard set by LPRCA. Currently, LPRCA cuts (or partially cuts) sites occupied by seasonal trailers increasing LPRCA liability for potential damage of private property plus savings on the workload associated with this service/activity. 5) There will be zero tolerance for verbal and/or physical abuse of Park Staff or other campers. There will be no warnings, only immediate eviction. (Same as 2018 rules only written in plain language. This is to protect staff from aggressive and belligerent clients.) 6) Payment for returning seasonal campers will be due by May 15 th. Late payments incur an automatic $ late fee. If payment is still delinquent by May 31 st, trailers will be removed at the owner s expense. (Formerly May 31 st but otherwise the same as 2018.) 7) (New addition to the rules.) All campers must provide a photocopy of their insurance policy or provide a formal letter from their insurance providers to show proof of insurance (including liability) at the start of the camping season (May 1 st ) before a seasonal agreement can be signed. (This will once again help to minimize LPRCA liability.) 8) (New addition to the rules.) At the time of signing a seasonal agreement, photo- ID must be produced by the primary permit holder to confirm their legal address. A camper s legal address on their ID cannot be the campground address (As many retirees might use their trailer as a summer home and therefore could be using LPRCA properties as their home address. We have also had campers falsify their forms as to the legal address). 9) (New addition to the rules.) Golf carts will no longer be permitted in any park for any circumstances. If a camper has mobility issues, they will be permitted a proper medical device such as a single rider scooter (as prescribed by a doctor) or alternatively they can use their personal vehicle. (Golf carts were previously allowed with a Doctor s note but they are becoming a nuisance, there is safety and liability issues and they are not a true medical device like a scooter). 10) (New addition to the rules.) Cannabis policy: Cannabis use is permitted inside your trailer only. Under provincial rules Ontarians will not be able to use 19

22 recreational cannabis in any public places, workplaces, motor vehicles or boats. Obvious impaired operation of any motorized vehicle will result in an immediate call to OPP and could result in an eviction from LPRCA parks. (Open cannabis use in LPRCA parks is not supportive to efforts marketing to young families.) 11) All sheds must be commercially designed (plastic or metal only), not larger than 8 X8, and approved for size and location by the Conservation Area Supervisor with a completed site application form. No DIY sheds will be allowed and any currently in the parks should be removed immediately. (Old rule was 8 X6 which are getting harder to find/purchase and enforcement on DIY has been somewhat lax in the past. Also clarification on the approval process.) 12) Maximum deck dimension limits are as follows: not larger than eight feet wide X the length trailer X twelve inches (1.0 feet) high at its highest point. Decks must be built in sections with no single section measuring more than 4 x8 (1.2m x 2.4m) to allow for easy disassembly and removal after a camper forfeits their site. All decks must be approved for size and location by the Conservation Area Supervisor with a completed site application form. (Minor changes including a height provision and approval process.) 13) Any campers requested by LPRCA to remove their trailers and personal belongings to accommodate park infrastructure upgrades shall have first right of refusal for the campsite (or approximate campsite) they vacated once the work is completed and the sites are ready to reopen to seasonal camping. Returning campers/trailers will be subject to any other new rules adopted by the LPRCA Board (e.g. age of trailer). (New addition to the rules to accommodate concerns raised by the WNCA on-going project.) The above items are not all the rules for the seasonal campsites just suggested changes and additions. The current Seasonal Handbook is attached and would be amended for the 2019 season. BUDGET IMPLICATION None. 25 General Rules and Regulations Opening and Closing Dates for 2018 Backus Heritage, Deer Creek, Haldimand, Norfolk, and Waterford North Conservation Areas will open May 1 and will close at 2:00 pm on October 15, To make everyone s stay more enjoyable, and for your safety, regulations are in place at all LPRCA Conservation Areas. The complete set of regulations is posted at the gate house. Note: Failure to comply with the regulations may result in a fine and/or eviction from the park. Consider Your Fellow Campers Hours of Use Visiting hours are posted at the gate. Quiet hours are from 11:00 pm 8:00 am. No radios, televisions, musical instruments or loud conversation, etc. during quiet hours. No excessive noise permitted at any time. Campsites Maximum of 2 pieces of shelter equipment (only one can be a tent trailer, motor home, selfpropelled camping unit) plus one dining tent/tarp per campsite where space permits, upon approval from Conservation Area Supervisor. Maximum 6 campers per site. Camping permits or season passes must be displayed on vehicle dashboards at all times. One vehicle is allowed per campsite. Any additional vehicles must park in designated areas and pay additional fee. Campsites must be cleaned before leaving the site; all garbage and recycle material bagged and put into containers provided. Fires are to be built in designated areas only and must be contained within the designated fire pit. Fire pit rings are not to be moved. Alcohol Drinking or possessing alcohol off of your registered campsite or as prohibited by a total alcohol ban is not permitted. Alcohol is not permitted in day use or other public areas. Fireworks Fireworks are not permitted on LPRCA property. 23 Pets Pets are not allowed on the beach, in swimming areas, or in buildings unless service animals. All owners must pick up after their pets. All pets are to be on a leash not exceeding six feet (2 metres). Driving Speed limits must be observed. Speed limits are posted throughout the conservation areas. Operating motor vehicles in violation of the Highway Traffic Act or the Conservation Authorities Act is not permitted. Passengers are not permitted to ride in the bed of a truck. Conduct Threatening behaviour by campers or their pets is unacceptable. No profanity, excessive noise or other unsuitable behaviour is permitted at any time. No person shall willfully damage any public or private property, buildings, or other facilities. Swimming Areas No glass, food or beverages are allowed in the swimming pool or beach areas. Beach and swimming areas are unsupervised. Use at your own risk. Parents/Guardians, you are responsible for supervising your children. Boats are not permitted in swimming areas. Visitors & Vehicles 1. All visitors to the campground are to park in designated parking areas and have a valid day use admission pass. 2. If visitors leave within 20 minutes of arriving their entry fee will be refunded. 3. Visitors are admitted from 8:00 am to 9:00 pm daily. Visitors must vacate the property by 11:00 pm nightly. 4. Campground and day use hours may be restricted at other times and at the discretion of the Conservation Area Supervisor. 5. Overnight guest passes for seasonal sites are to be purchased at the gatehouse (site must not exceed maximum 6 campers, visitors included).

26 General Rules Campers should make every effort to conserve electricity and water. Tapwater should be conserved to assist with water supply. Lawn watering and washing of trailers and cars are not permitted. Collecting, cutting, removing, or destroying any plant, tree, or other living object is strictly prohibited. LPRCA is not responsible for any lost, stolen, or damaged property. Should Conservation Area Supervisor be unavailable, requests for police, fire, and ambulance services should be made by calling 911. Park staff should be notified and someone should be sent to the entrance of the park to guide emergency vehicles to the scene. Inform the park staff of any disturbances or emergencies. Season pass must be displayed on your vehicle s dash at all times and the license plate number clearly marked. You must bring your vehicle to a complete stop at all conservation area entrances. Camping Fees Payment can be made by Visa, MasterCard, debit, cash, money order, or certified cheque. Personal cheques will not be accepted. HST included where applicable. Winter storage fee can be paid any time during the camping season. The on-site winter storage fee is $205 for the 2018/2019 off season. Storage Off-Site Storage 1. A fee of $355 including HST is charged for both winter and summer off-site storage. The fee covers a period of six consecutive months. 2. Boats on trailers and campers can be stored in the designated area off a campsite provided the storage fee is paid. 3. The $355 fee is non-refundable and will not be pro-rated.

27 On-Site Winter Trailer Storage Your Winter Storage Fee must be received by the Conservation Area Supervisor on or before September 30, Winter storage payments can be made by Visa, MasterCard, debit, money order, certified cheque, or cash. No personal cheques will be accepted. 2. Payments to be made at the Conservation Area. This storage payment will permit your trailer, shed, and patio only to be left on the site over the winter. All other items such as bicycles, barbecues, toys, etc., must be removed or stored inside the trailer at owner s own risk. 3. Payment of the winter trailer storage fee will not be credited towards next season s seasonal camping fee. 4. Winter storage fee of $205 non-refundable, is to be paid by September 30, If payment has not been made by September 30, 2018, a penalty of $6.00 per day (HST included) will be charged up to October 15, Trailer to be removed from conservation area on October 15, 2018 should winter storage fee and penalty not be paid. If trailer is not removed on October 15, it will be moved by LPRCA at the camper s expense. Campsite Standards General 1. Sites must be kept clean and tidy at all times. Maximum of 2 pieces of shelter equipment (only one can be a tent trailer, trailer, motor home, self- propelled camping unit etc.) plus one dining tent/ tarp per campsite where space permits, upon approval from Conservation Area Supervisor. 2. Trailers must be road worthy and licensed. Removal may be requested at any time due to maintenance and/or safety concerns. 3. The seasonal trailer is not a mobile home and cannot be used as a permanent or principal residence. Park models not permitted. 4. Patio lights are allowed but must be turned off by midnight. All lights must be physically attached to the camping unit or enclosure. 5. Firewood is allowed provided quantities of one cord or less are stored in an outside shed or neatly piled on site. No skids, pallets, lumber, construction debris, etc. are allowed. 6. Use of a campsite is non-transferable. If an owner of a trailer sells the trailer, it must be removed from the site immediately, unless arrangements have been made with and approved by LPRCA A seasonal camper must not attempt to sell, transfer, lease, sublet, or assign the campsite, in total or in part, to another person. 8. If all personal property is not removed from the campsite by October 15, it will be cleared by LPRCA at the camper s expense. 9. LPRCA asks all campers to help conserve water. Repair faulty plumbing to avoid holding tanks filling up prematurely as well as flooding of the campground. 10. Lawn ornaments of any kind are not permitted on campsites. 11. Swimming pools, wading pools, hot tubs, and outdoor spas are not allowed. 12. Campers must not attempt to deny access to the campsite by LPRCA or its designated representatives for the purpose of campground maintenance, operations, servicing, development, and security. 13. Roof installations and/or alterations not part of the original trailer design are not permitted. 14. Boats on trailers must be stored in the designated area and the appropriate storage fee paid. Decks, Patios & Docks 1. All decks and walkways must be in full contact with the ground, including sleepers on which they are constructed. 2. Decks will be allowed provided they are not longer or wider than your trailer, can be removed if required and no single section measures more than 4 x8 (1.2m x 2.4m). 3. Further, the deck and outside shed combined cannot have a footprint any larger than the size of the trailer itself. No additions are allowed to be built on top of the deck. 4. No other accessory building or structure is to be located on the site. 5. Any improvements to campsites (decks, patios, sheds, etc.) must be approved in advance by the Conservation Area Supervisor. 6. Patio stone can be used in place of a deck and must be kept clean.

28 Sheds One storage shed permitted per campsite subject to the following conditions: Maximum dimensions 6 x 6 x 8 high (1.8m x 1.8m x 2.4m). Moulded plastic design with brown finish or colour approved by Conservation Area Supervisor prior to being placed on the site. All exterior fridges and firewood must be stored in the shed. Location of shed is to be approved in advance by Conservation Area Supervisor. Shed may substituted for a tent pad, subject to approval of Conservation Area Supervisor. Shed plus combined deck, if constructed, must not be any larger than the footprint of the camping unit. Contact your Conservation Area Supervisor to discuss plans in advance of construction to ensure that the project conforms to Conservation Area Standards. Exterior Fridges 1. All exterior fridges must be securely contained within a storage shed. 2. All exterior fridges are to be locked and secured on the site at all times. 3. Existing fridges will be allowed to stay, but when they are no longer in working condition, can only be replaced by an energy-efficient model no older than 5 years of age. 4. Disposal of the broken unit is the responsibility of the camper. 5. Only one exterior fridge is allowed per campsite. Satellite Dishes Satellite dishes are only permitted if attached to the camping unit. Campground Reminders Smoke & Carbon Monoxide Detectors 1. Seasonal campers are reminded to comply with Ontario Fire Code smoke and carbon monoxide alarm requirements All alarms should be tested before sleeping in a camping unit and then monthly and after any absence of more than a few days. Replace alarms as required by legislation. It is the law to have working alarms in your RV, trailer, or mobile home. Campfire Safety 1. Fires are permitted in designated spots only. 2. Do not move fire pit ring or make additional fire pits at your campsite. 3. Respect fire bans when issued by local municipalities. 4. During a fire ban, cooking fires only are permitted during designated hours. 5. Campfire flames should not reach more than 1.5 feet (0.4 m) off the ground. 6. Never leave a campfire unattended. 7. Put out fire completely when you leave the site or retire for the evening. Pets 1. Pets are not allowed on the beach, in swimming areas, or in buildings unless service animals. 2. All owners must pick up after their pets. 3. All pets are to be on a leash not exceeding six feet (2 metres). 4. Do not permit your pet to make excessive noise or disturb other campers. 5. Your pet should not be left unattended or without adequate food, water, and shelter. Golf Carts Golf carts are not allowed unless a physician s note is provided and an official handicapped sticker is attached to the cart. Only the permitted individual may drive. Golf carts must be registered and approved and a $51.00 fee is required for electric powered golf carts. Privacy Policy Consent must be given to allow LPRCA staff to direct visitors to your campsite, with the exception of emergency and police services. Please check box on seasonal camping application form to provide consent.

29 Respect Your Environment Propane Cylinder Drop-Off Single use (non-refillable) propane cylinders should be deposited in collection area found in the park. Because of risks to people and the environment. Do not put cylinder in the garbage. Do not deposit any propane cylinder into blue box. Do not discharge leftover propane into atmosphere, even if the cylinder comes with a device to do this. Battery Recycling Batteries dead? Recycle Instead! LPRCA has teamed up with Raw Materials Company Inc. to provide all visitors with convenient battery recycling services. Ask Conservation Area staff for battery collection locations. Hydro & Water Conservation 1. Tap water shall be conserved to assist with water supply. 2. Campers will make every effort to conserve electricity. When the site is not being used, campers are asked to turn off indoor and outdoor lights and air conditioners. 3. Campers are to turn off water taps to their trailers when they are leaving the park for any period of time. Firewood LPRCA restricts firewood being brought to or used on our lands. Firewood restrictions help limit the spread of invasive species and diseases. 1. Do not bring firewood. Buy firewood at the park or from local firewood vendors. 2. Buy and burn local firewood only. Firewood can be purchased at your conservation area. 3. Any unused firewood is to remain at the conservation area. 4. Firewood must be cut to length (max. 18 ) before entering the conservation area. Buy it locally. 5. A maximum of one cord may be stored and shall be stacked neatly on the campsite or in an outside shed. 6. No skids or pallets are permitted. 27 Grey Water Grey water is the wastewater from your sink, shower, or washtub. It may contain food particles, grease, soap, or dirt. It is very unhealthy for plants and animals and people, and produces an unpleasant odour, especially on a hot summer day. Grey water may be collected in a suitable container and disposed of at the trailer dumping station. Do NOT dispose of grey water on or off your campsite. Sewer Lines 1. Burying sewer lines in the ground or emptying into a ditch is prohibited. 2. Any trailers with unapproved hook-ups are required to remove them immediately. This action will be enforced by the County Health Department and LPRCA staff will lay charges if necessary. 3. All effluents, including grey water are to be dispersed through an approved sewage system. 4. All effluents are to be stored in a portable container and dumped into the holding tank. Seasonal Camping Families 1. Families who wish to be seasonal campers at LPRCA Conservation Areas should be aware and familiar with the following rule: A family for the purpose of seasonal camping is defined as all children whoa re living at home with their families and are dependent on their parent s income are allowed to camp under the seasonal permit, as long as they are named on the permit when registering for the season. 2. Overnight guest passes for seasonal sites are to be purchased at the gatehouse (site must not exceed maximum 6 campers, visitors included). Additional vehicles to be parked off-site in designated parking areas with valid permit displayed. Discover LPRCA Parks This summer take time to visit LPRCA s conservation areas. The construction of a structure affects the control of flooding in that it increases the potential for flood damage. 4. The construction of a structure affects the control of dynamic beaches in that it interferes with dynamic beach processes. 5. The proposal is not unique; therefore the granting of an exemption to policy could be seen as setting precedent. Similar applications may have to be permitted as a consequence. The construction of new structures will have a cumulative effect that would greatly affect dynamic beach processes and the control of dynamic beaches. BACKGROUND The subject land is located at 205 Hastings Drive in Long Point (Figure 1). In this location, the property and associated development is subject to flood and dynamic beach related hazards from Lake Erie and is fully regulated under Long Point Region Conservation Authority s Ontario Regulation 178/06 (Figure 2). In May 2006, O. Reg. 178/06, Long Point Region Conservation Authority Regulation of Development, Interference with Wetlands and Alterations to Shorelines and Watercourses, came into effect. Through this regulation, LPRCA may permit, restrict or refuse development and activities in or adjacent to river or stream valleys, Great Lakes shorelines, watercourses, hazardous lands and 38

41 wetlands. More specifically, as it relates to this application, O. Reg. 178/06 states that: 2. (1) Subject to section 3, no person shall undertake development or permit another person to undertake development in or on the areas within the jurisdiction of the Authority that are, a) adjacent or close to the shoreline of the Great Lakes-St. Lawrence River System or to inland lakes that may be affected by flooding, erosion or dynamic beaches, including the area from the furthest offshore extent of the Authority s boundary to the furthest landward extent of the aggregate of the following distances: (i) the 100 year flood level as shown in the most recent document entitled Great Lakes System Flood Levels and Water Related Hazards available at the head office of the Authority, plus the appropriate allowance for wave uprush, (ii) the predicted long term stable slope projected from the existing stable toe of the slope or from the predicted location of the toe of the slope as that location may have shifted as a result of shoreline erosion over a 100 year period, (iii) where a dynamic beach is associated with the waterfront lands, an allowance of 30 metres inland to accommodate dynamic beach movement, and (iv) an allowance of 15 metres inland; 3. (1) The Authority may grant permission for development in or on the areas described in subsection 2 (1) if, in its opinion, the control of flooding, erosion, dynamic beaches, pollution or the conservation of land will not be affected by the development. On May 16, 2018, LPRCA staff noticed the construction of an unauthorized deck at 205 Hastings Drive. On August 3, 2018, LPRCA staff received a permit application under O. Reg. 178/06 to recognize the construction of a 47.5m 2 (512 ft 2 ) deck on the property. LPRCA relies on the LPRCA Shoreline Management Plan (Philpott, 1989) to guide decisions on development in its lakeshore jurisdiction. The Long Point Hastings Drive reach (DZ1-Reach 1, Hastings Drive) is a narrow sand spit at the western end of the Long Point spit. Hastings Drive is well below the design wave uprush level along its length and is subject to frequent flooding including washover. The Shoreline Management Plan recommends a no re-build policy for existing development based on the severity of damage to which those areas are subject, and the imminent danger that exists. It further recommends no reinforcement of existing shoreline protection structures because these structures cause much of the erosion problems, and removal of the shore protection structures and cottages that come into public ownership to minimize the potential for littering of downdrift shores and to minimize reflection and therefore nearshore scouring. The latter step will likely result in greater beach build up. The Hastings Drive area has experienced significant flooding, washover and wave action frequently in the past, most notably in 1954/1955, 1958, 1969, , 1975, On a nearly annual frequency, travelled portions of the Hastings Drive roadway becomes flooded during fall storm events. The 100-year instantaneous water level for Hastings Drive as documented in the Long Point Region Shoreline Management Plan (Philpott, 1989) is m GSC and the recommended design flood level is 176.8m GSC. Similarly, the 25-year design flood level is and the 10-year flood level is 176.3m GSC. 39

42 The following relevant elevation data was determined from LPRCA s digital elevation model and from Dietrich Engineering Ltd survey information dated June 27, 2016: Elevation 100-year Depth of Flooding 100-year design flood level m GSC 25-year design flood level m GSC Site grade m GSC 1.6 m 5.2 ft Centre line Hastings Drive at site m GSC 1.2 m 3.9 ft Underside of deck m GSC 0.7 m 2.3 ft Elevation Elevation below 100-year wave uprush level 100-year wave uprush level m GSC Underside of deck m GSC 1.9 m 6.2 ft Philpott (1989) further estimates the 100-year near shore wave height to be 3.0 metres and the resultant wave uprush elevation to be 178.0m GSC. Under these conditions, the potential for severe flood damage or displacement is very high. The underside of the constructed deck is 1.9 m below the 100-year wave uprush flood elevation making the deck susceptible to flood damage in the event of a 100-year flood as well as lesser floods. The deck may be lifted and swept by waves and debris into the cottage causing significant damage to the cottage. There is also the potential for this and like structures to be swept into existing nearby cottages causing increased flood damage to the subject property and neighbouring properties. The Hastings Drive area, including the subject lands, also meets the criteria for a dynamic beach as defined in the Great Lakes St. Lawrence River System and Large Inland Lakes Technical Guides for Flooding, Erosion and Dynamic Beaches issued by the Ontario Ministry of Natural Resources in Dynamic beaches are areas along the Lake Erie shoreline where accumulated, unconsolidated sediment continuously or intermittently moves as a result of naturally occurring processes associated with wind, water and changes in the rate of sediment supply. These processes can be interrupted by the construction of a structure on the beach or foredune. In particular, wave action against vertical barriers (walls) increases scour and erosion, and increases sand removal from the beach. There are 22 privately owned cottages on Hastings Drive. Should approval of this application set a precedent, the potential for subsequent applications for similar structures is quite high, resulting in increased risk of damage to existing cottages and a cumulative effect on the dynamic beach processes. The proposed development does not conform to the LPRCA s policies for development in the flood hazard and dynamic beach hazard in Long Point. In LPRCA staff s opinion, the control of flooding and dynamic beaches will be affected by the proposed development and, therefore, staff recommends that the application be refused. 40

The subject lands are located in Long Point within the flood hazard limit of Lake Erie and are regulated under LPRCA's Ontario Regulation (0. Reg) 178/06. 55 a) adjacent or close to the shoreline of the Great Lakes-St. Lawrence River System or to inland lakes that may be affected by flooding, erosion or dynamic beaches, including the area from the furthest offshore extent of the Authority s boundary to the furthest landward extent of the aggregate of the following distances: (i) (iv) the 100 year flood level as shown in the most recent document entitled Great Lakes System Flood Levels and Water Related Hazards available at the head office of the Authority, plus the appropriate allowance for wave uprush, an allowance of 15 metres inland; 3. (1) The Authority may grant permission for development in or on the areas described in subsection 2 (1) if, in its opinion, the control of flooding, erosion, dynamic beaches, pollution or the conservation of land will not be affected by the development. The proposal to construct a new cottage is considered to be new development that adds a new dwelling unit in an area where safe access/egress is not available. Access/egress for either evacuation from or emergency assistance to the subject property during times of flooding is flooded to depths reaching 1.1 metres for a distance of 1.1 km. This depth of flooding on the access is unsafe, putting both residents and emergency responders lives at risk. The proposed development does not conform to the LPRCA s policies for new development in the flood hazard in Long Point. In LPRCA staff s opinion, the control of flooding will be affected by the proposed development and, therefore, staff is recommending that the application be refused. Pursuant to Ontario Regulation 178/06, Proposed Construction of a new vacation home at South Walsingham Plan 436, Lot 6, 816 Highway 59, Long Point. RECOMMENDATION THAT the LPRCA Board of Directors refuses to grant a Development, Interference with Wetlands, and Alterations to Shorelines and Watercourses Permit for Permit Application No. 194/18 (Danielle Pierce) for the following reasons: 1. The construction of a new vacation home in the Lake Erie shoreline flood hazard is contrary to Long Point Region Conservation Authority shoreline policies for development in the Lake Erie flood hazard area. These policies have been implemented to reduce or eliminate preventable risk to life and property damage from flooding. 2. The control of flooding is affected by development that adds a new dwelling unit and substantially increases the investment in a flood hazard area that does not have safe access/egress for evacuation or emergency assistance. 3. The proposal is not unique; therefore the granting of an exemption to policy could be seen as setting precedent. Similar applications may have to be permitted as a consequence. BACKGROUND The subject land is located at 816 Highway 59 in Long Point (Figure 1). The subject land is a vacant lot (Figure 2). A previous cottage on the site was demolished sometime between 2006 and At this location, the property and associated development is subject to flood-related hazards from Lake Erie and is fully regulated under Long Point Region Conservation Authority s Ontario Regulation 178/06 (Figure 3). In May 2006, O. Reg. 178/06, Long Point Region Conservation Authority Regulation of Development, Interference with Wetlands and Alterations to Shorelines and Watercourses, came into effect. Through this regulation, LPRCA may permit, restrict or refuse development and activities in or adjacent to river or stream valleys, Great Lakes shorelines, watercourses, hazardous lands and wetlands. 54

57 More specifically, as it relates to this application, O. Reg. 178/06 states that: 2. The lakeshore resort community of Long Point is subject to frequent flooding from Lake Erie. Widespread flooding has been documented in at least 1954, 1955, 1975 and As they relate to this application, LPRCA s objectives in administrating the Regulation are to: Prevent loss of life Minimize property damage and social disruption Reduce public and private expenditure for emergency operations, evacuation, restoration and protection measures Minimize the hazardous and unnecessary development of flood and erosion susceptible shoreline areas which in future years may require expensive protection measures. The Application On June 22, 2018, LPRCA staff received a permit application under O. Reg. 178/06 to construct a new vacation home and septic system on an existing lot of record that is vacant. The applicant has submitted a conceptual site plan, attached as Figure 5. To facilitate the sale of the property, the applicant is asking that the application be approved conditional on detailed plans and drawings showing that the LPRCA s floodproofing standards and requirements have been met. The conceptual site plan shows a 9.9 m by 17.7 m building foot print for a new vacation home, a preliminary septic system location, a bay-side deck and a floating dock. Applicable Policy LPRCA policy does not allow for new residential development or the addition of new dwelling units in flood hazard areas, particularly where safe access/egress for evacuation and emergency response is not available. In July 2017, the LPRCA Board accepted the Norfolk County Lakeshore Safety Strategy as providing the equivalent of safe access/egress for the purposes of administering O.Reg. 178/06 in Long Point 55

58 and Turkey Point because they felt that incorporating floodproofing as the old cottages are renovated and replaced could reduce the potential for flood damage over the long term. However, construction that adds new dwelling units increases the risk to life and property in the flood prone resort communities and does not reduce it. New construction that adds new dwelling units requires, at the very least, dry passive floodproofing and safe access/egress in an effort to reduce and not increase the risk to life and property in the flood prone resort communities over the long term. Floodproofing The applicant has put forward a conceptual site plan and has asked for approval conditional on submission of details plans and drawings showing, to LPRCA s satisfaction, that the LPRCA s floodproofing standards and requirements have been met. Safe Access/Egress The following relevant elevation data was determined from LPRCA flood hazard mapping information: Elevation 100-year Depth of Flooding 100-year design flood level m GSC 25-year design flood level m GSC Site grade m GSC 1.1 m 3.6 ft Highway 59 at the site m GSC 1.1 m 3.6 ft Access to safety max. depth m GSC 1.10 m 4.3 ft During times of flooding, the path for pedestrian or vehicular access/egress for either evacuation or emergency assistance is flooded to depths up to 1.1 metres for a distance of 1.1 km. These flood depths are significantly greater than the 0.8 metres depth that is considered the upper limit for safe access in calm, still water conditions. This depth of flooding on the access is unsafe, putting both residents and emergency responders lives at risk. Staff Recommendation The proposed development does not conform to the LPRCA s policies for development in the floodplain in Long Point and is contrary to LPRCA s objectives for the administration of O.Reg. 178/06. In LPRCA staff s opinion, the control of flooding will be affected by the proposed development and, therefore, staff recommends that the application be refused.
