1 City of Janesville Alcohol License Advisory Committee Meeting Minutes June 3, 2014 No. 612 The regular meeting of the Alcohol License Advisory Committee (ALAC) held in the Municipal Building was called to order at 8:05 a.m. by Committee Chair Schreier Present: Committee Members Badertscher, Fitzgerald (arrived at 8:30 a.m.), Kimball, and Schreier. Administration: Deputy Chief Dan Davis. Absent: Committee Member Kulinski. Approval of Minutes. The May 6, 2014 minutes were unanimously approved. Request and Comments from the Public regarding items on the agenda not requiring a Public Hearing. Sara Johnson of JM4C appeared. On behalf of her committee, she stated they were happy with the quota ordinance except would like a cap on the number of licenses allowed by exception. JM4C would like the separation ordinance to remain the same except allow home brew stores with patrons over 21. They would like organizations that hold a temporary class B license to use sober servers. Original Application and Public Hearing for a Class B Intoxicating Liquor and Fermented Malt Beverage License for D Casey LLC d/b/a Charlie s Place, 2020 E. Racine St. Dennis Casey and Kelly Byford appeared on behalf of said license. Committee Member Kimball moved to forward a positive recommendation for said license, seconded by Committee Chair Schreier and passed 2-1 with Committee Member Badertscher voting no. Original Application and Public Hearing for a Class B Beer License for Edgardo Garrido Mateos, d/b/a Azteca 2, 2010 Beloit Av. Edgardo Garrido Mateos appreared on behalf of said license. The committee wanted to insure Mr. Garrido was familiar with all state statues and city ordinances related to staffing. Committee Chair Schreier postponed action on this application for 30 days. Review proposed ordinance amending the limitation quota on the number of Class A Alcohol Licenses in the City of Janesville. Ryan Garcia, Economic Development Coordinator, presented the proposed changes for the City s quota. Committee Chair Schreier moved to forward a positive recommendation to the City Council, seconded by Committee Member Kimball and passed unanimously. By consensus, the ALAC requested that they review the petition application if the ordinance is adopted by the Council. Review proposed ordinance modifying the separation provision of the Class A Alcohol License premises in the city of Janesville. Ryan Garcia, Economic Development Coordinator, presented the proposed changes for separation provisions and provided three options. By consensus, the committee requested that the ordinance remain the same but allow for a few exceptions. The exceptions will be added at the next meeting. In addition, the ALAC requested legal advice on whether they could have flexibility in the ordinance to allow for any exceptions that they deem appropriate.

2 Review proposed ordinance modifying the Class B Temporary special event license to exempt special events held in the downtown from the single 4 ft. fencing requirement for alcohol serving areas. Maxwell Gagin, Management Analyst, presented the proposed changes in the ordinance. Committee Member Badertscher moved to forward a positive recommendation to the City Council, seconded by Committee Member Kimball and passed unanimously. Request and Comments from the Public on Matters which can be affected by Committee Action. There were none. Matters not on the Agenda. The committee reviewed the Incident Report, License Quota and Temporary Licenses Issued reports. Deputy Chief Davis noted that East Point owners are working with the Police Department for solutions to some recent issues. There has been a loitering problem around the downtown bars and the Police department and bar owners are working on solutions to the problem. Renewal Application and Public Hearing for a Class A Intoxicating Liquor and Fermented Malt Beverage and Class B Intoxicating Liquor and Fermented Malt Beverage for Hotel/Motel License for Premier Bank d/b/a American Equity d/b/a Ramada, 3900 Milton Av. No one appeared on behalf of said license. Committee Member Badertscher moved to forward a positive recommendation for said license, seconded by Committee Member Kimball and passed unanimously. Adjournment. Committee Member Kimball moved to adjourn at 9:38 a.m., seconded by Committee Member Badertscher and passed unanimously.
