3 CITY OF PLANT CITY PLANNING ZONING DIVISION PO BOX C PLANT CITY FL Telephone ext 4125 Fax planning@plantcitygov com PLANNING CASE SUBJECT OWNER OWNERS AGENT REQUEST TYPE ZONING DIVISION STAFF REPORT PB Area Requirement Text Amendment A text amendment to the Plant City Zoning Code Chapter 102 Article IV Division 2367 NA NA Land Development Regulation Amendment PB MEETING DATE 13 NOV 08 STAFF RECOMMENDATION PLANNING BOARD RECOMMENDATION APPROVAL APPROVAL 70on November 13 PROPOSED AMENDMENT An amendment to the Plant City Zoning Code Chapter 102 Article IV Districts Divisions and 7 is proposed to remove the lot percentage building area standards for the residential zoning districts R1 R1A R2 and R3 respectively Currently each residential district contains a maximum building area as a percentage of the lot For example Section Height and Area Requirements of the R1 district states Not more than 25 percent ofthe area ofan interior lot and no more than 30 percent of the area of a corner lot shall be occupied by the main structure and its accessory buildings The removal of the building area percentage limitation is proposed because the building area of a residential lot is ultimately determined by building yard setback standards For example within the R1 district the typical lot is 60 wide with a depth of x 110 or 600 sq ft Based on the building yard setback envelope the area of the lot remaining after setbacks are applied the maximum building area is 2400 square feet which is approximately 36 of the lot area Instead of increasing the building area removing this requirement from each residential zoning district and allowing each district building yard setback envelope determine the maximum building proposed area is Page 1 of2

7 square feet and shall have aminimum lot width of 100 feet at the front building line provided there is aminimum of 1500 square feet of gross area for each dwelling unit 4 Unless otherwise specified in this division all other uses permitted shall have aminimum lot size of 6000 square feet and aminimum lot width of60 feet at the front building line Section 4 Section Plant City Code is hereby amended to read as follows Sec Building site area In the R3 multiple family dwelling district the minimum lot area for asingle family dwelling shall be 6000 square feet for atwo family dwelling 6000 square feet and for four family dwellings7500 square feet For each additional unit over four 800 square feet of lot area per dwelling unit shall be added The minimum lot width shall be 60 feet for asingle family dwelling and for dwellings for more than one family T nn r Section 5 In accordance with Section 14 Plant City Code any person violating any of the provisions of this ordinance shall upon conviction thereof be punished by a fine not to exceed500 or by imprisonment not to exceed 60 days or by both such fine and imprisonment Furthermore the provisions of this ordinance may be enforced in accordance with Chapter 2 Article V Division 2 Plant City Code or any other remedy available under the ordinances ofthe City ofplant City or the laws of the State offlorida provisions Section 6 In the event ofaconflict with any other ordinances or parts of ordinances the ofthis ordinance shall control Section 7 If any section sentence clause part or provision be invalid by acourt of competent jurisdiction ofthis Ordinance is held to the remainder ofthis ordinance shall not be affected thereby but shall remain in full force and effect Section 8 This ordinance shall take effect immediately upon its passage Read for first reading on December CODING Underlines indicate additions c indicate deletions
