This handbook is not intended to change or modify the agreement or such terms. Nonetheless, the guidelines, policies, rules and regulations set forth in this Resident's Handbook are binding upon all Benjamin N. Cardozo School of Law students residing at the above address, which is a University building. The law school reserves the right at any time to modify the housing policies, rules, regulations and procedures contained in this Handbook, at its sole discretion. Table of Contents I. 2 I. Important Telephone Numbers and Contacts The following is a list of important telephone numbers and contacts with which you should be familiar. 1. Emergency Situations: In the event of a police or fire emergency, please call 911 for the police and/or fire departments. II. House Rules We have worked hard to provide you with a clean, safe and convenient environment in order to assure you a pleasant and less pressured place to live while you pursue your law school studies. In order to maintain this environment for you and your fellow students, it is important that you follow these rules of conduct. Cardozo students who reside at 148 Lexington Avenue are subject to their license agreements and the terms and provisions of this Handbook, including but not limited to the following information, rules and regulations. A. General Guidelines While some renewal requests have been granted in the past, please note that housing assignments are for one academic year (approximately 10 months) only, with no guarantee of renewal. The license agreement permits the University to change students' room assignments at any time during the year. 2
3 Residents are expected to act with common sense, good judgment and courtesy towards other residents and surrounding neighbors at all times. Residents in shared suites are expected to respect the rights of their roommates. Common sense security precautions include making sure building doors are securely closed and allowing building access only to persons whom you are expecting. No bicycles, shopping carts or other items shall be placed in the lobby, public halls, passageways, stairways or other common areas of the building. No objects may be placed on windowsills or in the fire stairs, or discarded, thrown, pushed or dropped from the windows, windowsills or fire stairs. No sign, notice, advertisement or illumination shall be placed on or exposed at any window or other part of the building. Students can access the rooftop patio however all other areas of the roof are prohibited. All rooms are furnished by the University. University-owned furniture may not be removed from rooms. Furniture may not be taken into rooms from any other areas of the building. The use of extension cords is discouraged; power strips with surge protectors are preferable. Non-University space heaters and air conditioners, open-coiled appliances, and halogen lamps are NOT permitted in any room. Although efforts will be made to respect privacy in student rooms, the University reserves the right of entry for repairs, maintenance, and inspection; to show rooms to prospective residents; or to maintain the health, safety, and security of the property and its residents, as well as standards of conduct. Students will be charged for damage to their rooms, to the building or to its public areas, as well as to University-owned property and facilities located within the rooms and building. This also includes the property or rooms of other building occupants. In the event that a student s roommate moves out and a new roommate is assigned by the University, the remaining student is responsible for keeping the vacant space in broom clean and move-in condition for the new occupant. Subletting and assignments are not permitted. B. Guests All guests entering the building, whether overnight or otherwise, must sign in at the Security desk. Student hosts are responsible for the activities of their guests, who must conduct themselves in the same manner as is required of student hosts, and also in accordance with all rules and guidelines for the building. 3
4 Overnight guests are permitted to stay for a maximum of 48 hours, and only intermittently, not on a regular basis. In addition, in 2 or 3-bedroom suites, an overnight guest is only permitted with the prior express approval of ALL of the host student s suitemates. A student s privilege to have guests will be revoked if these rules and guidelines are not followed. C. Noise Residents should not make or permit any disturbing noises in or near the building that would interfere with the rights, comforts or convenience of other occupants. Please refrain from any loud noise or television, music or radio playing in or near the building between the hours of 10 pm and 8 am. Violators are subject to termination of their housing license. Congregating in front of the building is not permitted. D. Maintenance and Services For all maintenance or emergency requests, please refer to Section I - Important Telephone Numbers and Contacts. E. Laundry Facilities Card-operated laundry facilities in the building may be used any day of the week between the hours of 8 a.m. and 11 p.m. Cards will be distributed during move-in. See the Appendix of this Handbook for instructions on how to activate the card. Residents should bear in mind that there are other residents using the laundry facilities. Please be courteous and promptly retrieve clothing from all washer and dryer units when done. Washers and dryers are not permitted in individual rooms under any circumstances. Dishwashers may not be installed by students or someone selected or retained by students. F. Garbage and Recycling Residents should use the receptacles located in the hallway on each floor level to dispose of garbage. Please observe designations for recycling. Items that do not fit into receptacles (e.g. large boxes) can be placed neatly next to the containers. G. Pets Pets are not permitted in the building. If a resident is found to be housing a pet, the University will notify the resident that the pet must be removed. Failure to comply may result in eviction. H. Fire Safety Fire safety is an extremely serious concern. Residents are expected to act with extra care with regard to fire matters and observe the following rules. 4
5 o The lighting of candles is prohibited o Never leave the stove and/or oven on while unattended There are smoke detectors and fire extinguishers on each floor. In case of emergency, act in accordance with the instructions which are posted in your room, by the elevator and in the lobby. Tampering with, blocking or disabling a smoke detector in common areas and within each room is prohibited. It is against the New York City Fire Code to leave anything in the hallways as such items may block egress during an emergency. In the event of any fire emergency, please call 911. Full evacuation drills will be conducted periodically. You must evacuate the building immediately upon hearing the alarm. Residents who do not are subject to disciplinary action. I. Keys One set of keys will be provided to each resident during check-in. Each student will receive a frontdoor key, a room key and a mailbox key. These keys may NOT be duplicated. Locks may not be changed, and no new locks may be installed. Lost Keys: The following procedures are in place in the event of a lost key: J. Smoking i. A student who has lost a key should first visit the Cardozo Office of Student Finance, located on the 10th floor of 55 5th Avenue, on the corner of 12 th Street, to pay the required replacement fee. The charges are $35 for a lost room key and $10 for a lost mailbox key. If it is a room key that was lost, all the students within that room/suite will receive new keys but only the student who lost their key will be charged. The fee can be paid with cash or a credit card. ii. The student will receive a receipt of payment from the Office of Student Finance, which they should then take to the Beren Security Office, located on the first floor of Brookdale Residence Hall, 50 East 34th Street, between Park and Madison Avenues. Security will then order the new key(s). iii. Until the new keys are ready, the student can ask the Security guard at the desk in The Benjamin to let them into their room. iv. Once the keys are ready, they will be available for pick up from the Beren Housing Office, located at 245 Lexington Avenue. Smoking (cigarettes, e-cigarettes, cigars, pipes, hookahs, water pipes and the like) is prohibited in all student rooms and all common areas; these include the entrances to the building, the front steps, the lobby, the elevators, the hallways, the stairways, the exercise room and the laundry room. 5
6 Smoking beneath the entrance canopy is also prohibited. Students may only smoke outside of the building, and must be at least 25 feet from the entrances. K. Renter's Insurance; Personal Property Each resident is responsible for his or her own personal property. Therefore, residents are encouraged to consider purchasing renter's insurance in order to cover theft, water and fire damage and liabilities that may occur within, or emanate from, your room, other rooms or the building. Residents should not expect either the University or Cardozo School of Law to accept responsibility for loss or damage to a resident's personal property. Personal property left in a former resident's room or suite after he or she vacates will be disposed of immediately and the former resident will be charged for removal of said property. Students violating any of the above policies and rules may be subject to termination of their housing license and to eviction. III. Utilities The information provided below regarding cable TV and Internet access was included in the managing agent's most recent letter to all student residents. Internet Access: Wireless Internet access is available throughout the building through the SSID network. Students receive a user name and password when moving into the building. For questions on connecting to the network or FIOS troubleshooting, contact: Berenfios@yu.edu. TV: Rooms are equipped with Smart TVs for wireless reception. IV. Mail and Package Delivery Each person has their own mailbox. In order to facilitate your deliveries, all mail addressed to residents should include the suite and, if a 2 or 3-bedroom suite, the specific room assignment within that suite. The general mailing address is: 148 Lexington Avenue, Suite #, Room # New York, NY Be advised that Security will NOT sign for any packages. Therefore, if you are expecting a delivery that requires a signature, please be sure to be present during the delivery time window. In order for mail to be forwarded to your new address after you vacate, a form provided by the Post Office must be completed and submitted to the post office (either online or in person). The Post Office will only forward first-class mail. For all other classes of mail to be forwarded, you must file a change of address form with each publisher/sender. V. Moving Out -- Regulations and Procedures The following is a list of procedures for you for moving out. 6
7 Give ample advance notice (a minimum of 1 week) to the Housing Office, and the Cardozo Office of Student Finance of your requested move out date and time. The requested date and time may not be available, since your move out will involve participation by the housing staff. Move out dates are not firm until confirmed by the Housing Office. Make sure the room or suite is left in broom clean condition and the kitchen and common areas are clean and in move-in condition for the next occupant. Additional charges will be assessed for extra cleaning including the removal and disposal of furniture, furnishings or food left in the refrigerator and/or cleaning of carpets. All appliances must be left in working order and undamaged. This includes the Smart TV, refrigerator, stove and air conditioner. Ordinary wear and tear is understandable. Walls, floors, ceilings, electrical fixtures, and windows must be restored to their original condition; ordinary wear and tear is understandable. Shelving, brackets, curtains, etc. should be removed. Damaged walls are to be spackled and repainted by the departing resident, and charges will be assessed for this or any other damage to the space. University-owned furniture must remain in the room and be returned in acceptable condition. All student-owned or supplied rugs, appliances, furniture and furnishings must be removed. Once you have moved out, you may not return to the room for items left behind without prior permission and an appointment. There is no guarantee that permission will be granted or that charges will not be assessed. REMEMBER that it is your responsibility to reset the SSID and password if you changed the original SSID and password you were provided when you moved into the building. Please remember to do this so that the next occupant has Internet access. On your move-out day, the Housing Office will perform a final walk-through inspection of your room(s); you must be present. Residents should return all front door, room and mailbox keys at that time to the Security guard at the Security desk of The Benjamin. You will be charged for any keys not returned. DO NOT LEAVE YOUR KEYS WITH ANYONE ELSE. If a room is left in a condition which is consistent with your License Agreement and otherwise satisfactory to Cardozo and the University, and you are in full compliance with all of the above and all outstanding charges have been settled with the Office of Student Finance, your full security deposit will be returned. Otherwise, appropriate deductions will be applied before refunding the balance of your deposit. Please allow at least four (4) to six (6) weeks for the return of your deposit. Appendix A Laundry Cards There is a self-service laundry area with washing machines and dryers in the basement of the Residence Hall. Laundry Smart Cards 7
8 are distributed to every student upon move-in. If lost, a replacement laundry card can be picked up from the Brookdale RA office, located on the first floor of Brookdale Residence Hall. How To Activate and Re-Load Your Laundry Card: 1. Go to and click on the third turquoise tab on the top right of the home page labeled revalue card. 2. Click on the image of a Hercules card featuring a girl sitting on a washing machine. 3. Click on the red link New Customer? Click Here to Register! 4. Create an account with your personal information, following the directions on screen. When creating your account you can opt to be texted by Hercnet, in addition to being ed. 5. Open your and confirm your account by clicking on the link in the from Hercnet. 6. Log into your new account. 7. On the left hand side of the page, click on the second turquoise tab labeled cards. 8. To register a card, follow the prompts on the screen. Your serial number is located on the back of your laundry card at the very bottom. Carefully read the serial number and type it into the appropriate box on the screen. It is a VERY GOOD IDEA to take a permanent marker to your laundry card and in the white space, write your name. 9. Once the card is registered, information about your card will appear at the bottom of the screen. Click on revalue in black to the bottom right of the information. 10. Enter your CVA code, corresponding to your building. You will only need to do this once, when you first register the card. The CVA code for The Benjamin is Enter your credit card information. You can select to save this data so that you do not need to re-enter it every time you want to re-value (add money) to your card. Your billing address must exactly match the address listed with your credit card company, if it is different from your home address. Once you input your credit card information and the money is added, it will remain on your card until it is used in the washers and/or dryers. 12. You will be ed a code. Take your card and that code with you to the laundry room. On a wall near the door you will find a VTM box (looks very much like a pay phone without the phone). Place your card in the slot and punch in your code. 13. The card now has the dollar value you purchased online. The laundry card does not expire; the money will remain on the card until you use it up. You can add money as needed. You only need to use the VTM box when you want to add more money to your card. Otherwise, you can simply use the laundry card. To report any problems with the machines in the laundry room, please fill out a Work Order Form, which is available at the Security desk in every dormitory.
