1 HOUSE RULES 160 RIVERSIDE DRIVE COOPERATIVE 160 Riverside Drive, New York, NY The purpose of House Rules in a cooperative is to set out guidelines for the operation of our building. The House Rules are not intended nor can they cover every conceivable aspect of shareholder activity in the building. They are to be used in conjunction with the existing Alteration Agreement and your Proprietary Lease. As with other apartment buildings in New York City, we live under close circumstances with our neighbors in the building; the safety and proper maintenance of each apartment affects the rest of us. Our residences are our homes and, in many cases, our most valuable financial asset. We all share in the desire to keep 160 Riverside Drive safe, comfortable, and well maintained. Each shareholder, in signing the Proprietary Lease, has agreed to abide by the house rules. The board of directors ( co-op board ), the managing agent, and the staff of the building have the responsibility for maintaining and upholding the House Rules. A list of Co-op board members and contact information is available from the office of the managing agent, Orsid Realty, (212) Complaints about violations of these rules or any comments about how the building is run should be made to the managing agent or the co-op board and not to any staff members; complaints about the rules themselves should be made only to the co-op board. These House Rules should be considered a "living document" that may be further updated or changed by the co-op board from time to time as new issues arise, pursuant to Article 1.8 of the Proprietary 1
2 Lease. To help us in this task, shareholder feedback (positive or negative) and recommendations are necessary. Accordingly, the House Rules set forth on pages 25 through 29 of the Proprietary Lease are hereby deleted in their entirety and replaced with the following: HOUSE RULES 1. USE OF BUILDING AND COMMON OWNERSHIP SPACES Entrance Vestibule and Lobby Area Rollerblading, scootering, or bicycling in the lobby, building hallways or elevators are prohibited. Young children are to be accompanied in public spaces. No children of any age are permitted to use these spaces as play areas. Pets must be leashed with the pet owner holding the leash tightly at all times in the public hallways and elevators of the building and on the immediate outside street area adjacent to the building. Packages, boxes, bicycles, or any other articles may not be left (stored) in the lobby area. Shared Vestibules Vestibules (hallways) are the property of the Cooperative and not individual shareholders. However, any decoration and furnishing of shared vestibules is the responsibility of the sharing residents. Shared vestibules shall not be decorated or furnished by any shareholder in any manner without the prior written consent of the co- 2
3 op board and all of the shareholders to whose apartments such vestibule customarily serves as a means of ingress and egress. Any work requiring any structural changes to the vestibule can only be performed after the execution of an Alteration Agreement and in accordance with the terms of the Alteration Agreement in effect at the time such work is done, with the appropriate advanced notification provided to those shareholders affected by the changes as set forth in Article 5 below. All decorations and furnishings in vestibules must comply with applicable fire laws. The Co-Op board will have the final say on any disputes that might arise among neighboring shareholders with respect to vestibule decorations. Public and Service Halls and Stairways Unsupervised children shall not be permitted in the service elevator and shall not be permitted to play in the public halls, stairways, basement, fire towers or elevators. Nor shall they be permitted on the roof unless accompanied by a responsible adult. Service halls and stairways must be maintained free of obstructions (such as storage boxes, baby strollers, and bicycles). The NYC Fire Department conducts periodic inspections of the building, and any fines levied for materials obstructing service hallways will be passed on to the owners of the materials. Fire stairs are to be kept free of any objects placed on stairs or on landings. Terraces Use of the terraces is reserved for the residents of the penthouse apartments. Shareholders (including penthouse shareholders) they are prohibited from installing 3
4 fences, structures, lattices, flower boxes, or planters without prior written approval of the co-op board. Any such work if approved, must be performed in accordance with the Alteration Agreement in effect at the time the work is done. Any such approved installations may also be moved (at the expense of the Shareholder) for the purposes of repairs or upkeep of the roof. No cooking or grilling is permitted on the terraces. Laundry Facilities The building maintains a laundry room for the convenience of the residents. Consideration of other users of this facility is appreciated. Problems with the operation of the washers or dryers should be reported to the superintendent or the doorman. Storage Bins The cooperative maintains storage bins in the basement that may be rented for a nominal fee. Each apartment is entitled to one such bin and more than one bin for each apartment is discouraged. The managing agent maintains a list of shareholders desiring bins. New shareholders will be automatically placed on the list on the date the new shareholders close on their apartments. Other shareholders who are in need of bins or additional bins and request them, shall be accommodated on a first come, first served basis. Multiple bins used by shareholders who sell their apartments shall not be "grandfathered" and will become available to fill the then current list maintained by the managing agent. Any shareholder with multiple bins may be required to surrender extra bins to allow other shareholders without the use of any bins to utilize a bin. No items of an inflammable 4
5 nature may be stored inside a bin, nor any items be stored outside of the storage bins. All such items will be subject to removal and appropriately disposed of. Storage of Bicycles The corporation also provides racks for the storage of bicycles, use of which also requires a nominal fee. Each stored bicycle shall be identified with a tag identifying the name of the owner and apartment number. Bicycles may not be placed in the area unless a rack has been arranged for. The cooperative is not responsible for damage to or theft of bicycles left in the basement storage area. Passenger Elevators Shareholders are requested to use care with luggage carts, bicycles, strollers, or other objects that can damage the walls of the elevators. Dogs must be tightly leashed in the elevators. Also, consideration of neighbors is appreciated in not holding elevator doors when the elevator is on their floor. 2. AT THE DOOR Doormen s Duties/Requests The doormen s primary responsibility is ensuring the security of the building and its residents by greeting all visitors, announcing them, and admitting only those visitors who have been announced and given permission to enter. In addition, doormen accept deliveries on behalf of residents, assist residents and visitors with entering and leaving 5
6 taxis and those who are handicapped, and assist with the loading and unloading of luggage. However, the doormen must always be close enough to the front door to maintain security and to hear the intercom. Shareholders should not expect a doorman to leave his post in order to assist a resident with loading a car parked away from the front of the building. Doormen have been instructed not to leave their posts to assist in the loading or unloading of vehicles that are parked on the corner adjacent to the hydrant. Shareholders who require such assistance can request it in advance from the superintendent. It is also not the doorman's job to park cars that have been left doubleparked by the shareholder. They will assume no responsibility if any double-parked car is ticketed by the police. Complaints regarding the service of the building shall be made in writing to the managing agent or the co-op board. At no time is any member of the staff to be directly contacted by a shareholder with a complaint regarding services of the building s staff. Requests by shareholders to see the superintendent shall be made by notifying the doorman. Visitors The doorman must announce all visitors. However, individuals who regularly provide services to the shareholders such as babysitters, dogwalkers, nurses, instructors and other regular visitors do not need to be announced provided that prior written authorization has been given to the doorman. It is the shareholder s responsibility to update the authorization if changes are needed. In addition, if a shareholder is expecting a large contingent of guests, a party list should be provided to the doorman in advance to allow 6
7 for a more congenial welcome at the door with minimum delay. Open Houses with unlimited access are not permitted in the building. Arrangements must be made between the real estate agent and the prospective seller to permit escorted access of visitors to the apartment. 3. BEHIND THE SCENES Use of the Service Entrance During regular weekday hours, people making service calls and deliveries or those working on apartment renovations must use the service entrance and will be directed there by the doorman. Use of the passenger elevators will not be permitted. Babysitters, dogwalkers, nurses, instructors, and other regular visitors should use the passenger elevators. Use of the Service Elevator The service elevator can only be operated by the staff of the building and is in operation on weekdays between the hours of 8:00 a.m. and 4:00 p.m. Furniture, appliances, and large objects should be moved only on the service elevator and not on the passenger elevators. A move of an entire household should be scheduled with the superintendent and managing agent at least one week in advance and requires a security deposit and elevator use fee as will be determined by the co-op board. No household moves will be allowed on weekends or holidays. 7
8 Deliveries Deliveries must be made through the service entrance using the service elevator, between the hours of 8:00 a.m. and 4:00 p.m. only on Monday through Friday. No deliveries of furniture, appliances, or other large items may be made after 4:00 p.m. After 4:00 p.m. small deliveries such as from restaurants or messengers must be collected by the shareholders at the front door of the building; delivery persons are never allowed unaccompanied in the building. Trash Disposal and Recycling Shareholders are responsible for bagging trash neatly and placing it in the containers in the service hallways. Trash should be sorted in accordance with New York City s recycling law and other State and City regulations as will be posted in the building from time to time. Large objects (e.g. furniture, appliances) should not be left for pick-up by the porter. Shareholders should discuss with the superintendent what the best method and timing is for disposal of such items. Debris left over from renovation work must be removed by the contractor. Fire Precautions 160 Riverside Drive is a fireproof construction building, but certain procedures must be followed to improve safety: In the event of fire, call 911 immediately Notify the doorman through the intercom Leave the apartment as quickly as possible, closing all doors behind you 8
9 Notify your neighbors Make sure the fire doors between the vestibules and the service hallways are closed Use the stairs, not the elevators, to exit the building Shareholders are expected to maintain smoke detectors and carbon monoxide detectors inside their apartments in good working condition. Apartment Emergency Access It is essential for the superintendent of the building to have access to each apartment in the event of an emergency, such as a leak or fire. To avoid extensive break-in damage, each shareholder will leave an extra set of keys to the front and back doors of the apartment with the doorman. Contact information such as the phone numbers for the apartment, office, cell phone, and vacation home, if applicable, should also be left with the doorman. 4. QUALITY OF LIFE ISSUES Noise Please be aware of the comfort of your neighbors in keeping noise to a minimum. Heavy traffic areas of each apartment should be carpeted in order to reduce overhead noise. It is expected that a minimum of 80% of floor areas will be carpeted. Noise creating activities such as drilling, hammering, clothes washing and drying, exercise equipment, etc. may not commence until 9:00 a.m. Music should be played at a moderate level and should not be audible from another apartment after 10:00 PM or before 9:00 AM. The same guidelines apply for television speakers and instrumental or vocal practice. If you are having a gathering in your apartment that may encroach upon a neighbor s privacy, common courtesy requires that you notify your neighbor in advance of the event. 9
10 Aggressive Pets The presence of aggressive dogs in the building such as pit bulls, rottweillers, attack dogs and the like are strongly discouraged by the co-op board. Apartment Cleanliness All apartments must be maintained in a reasonable state of cleanliness to avoid creating a fire hazard or attracting bugs. Apartment windows must be kept clean. In case of refusal or neglect of the shareholder during ten days after notice in writing from the management or the co-op board to clean the windows, such cleaning may be done by the cooperative, who shall have the right by its officers or authorized agents, to enter the apartment for that purpose and to charge the cost of such cleaning to the shareholder. Absences from the Building Please notify the superintendent of any planned extended absence from the building and leave a contact number where you can be reached in case of emergency. It would also be helpful to leave the name of a contact other than yourself in the event of an emergency. If applicable, please arrange for the collection of mail and newspapers during absences. Vandalism Any acts of vandalism or theft affecting apartments or common ownership spaces should be reported to the police and the superintendent should be notified immediately. 10
11 Shareholders also have the duty to report any suspicious behavior that they observe in the building to the managing agent or a member of the co-op board. Use of Common Roof Area The roof (common area) may not be used for recreational activities including, but not limited to, sunbathing. 5. RENOVATIONS AND REPAIRS Repairs The cooperative is obligated to maintain those parts or utility systems of the building that are used in common by all shareholders. Shareholders bear full responsibility for the maintenance of the interior of their apartments, including all fixtures, improvements and alterations. Shareholders are responsible for damage to the Building and other apartments caused by leakage or overflow of water, toilets or gas from their apartments to other apartments. The cooperative reserves the right to make repairs to the common areas (including plastering walls and ceilings) and to backcharge the shareholder responsible for the damage. However, when water damage not stemming from a resident s apartment occurs, the cooperative will assume responsibility for repairing damage to walls and ceilings up to and including plastering and painting. If paint is not supplied on a timely basis by the shareholder, the cooperative may choose the paint and color. Wallpapering, damage to wood or tile floors, and damage to personal property of any kind are not the cooperative s responsibility under any circumstances. If a 11
12 shareholder needs a repair that clearly falls under the responsibility of the cooperative, a repair slip, which can be obtained from the doorman, must be filled out and presented to the superintendent. The co-op board reserves the right to inspect the damage. Where there is doubt as to whether a particular repair is an individual's or cooperative's responsibility, the co-op board will make the final determination in consultation with the superintendent and the managing agent. Renovations All renovations must be performed in accordance with a signed Alteration Agreement in effect at the time the renovation commences. Any proposed renovation work requires that all shareholders who may in any direct way be affected by the work be notified of the specific nature of the renovation two weeks prior to the commencement of such work. No work may begin until the expiration of that two (2) week period. Renovation work can only be performed during the hours of 8:00 a.m. to 4:00 p.m. and no work shall be performed on Saturdays, Sundays, and legal or major religious holidays. Upon request, the superintendent will provide shareholders with a list of these holidays. Windows Maintenance and cleanliness of windows is the responsibility of shareholders, as is complying with the law pertaining to window guards. No signs or advertisements may be displayed in building windows, nor can objects other than air conditioners protrude from windows. No planters, flowerboxes or flowerpots may be placed on windowsills. 12
13 Luggage Carts Luggage carts are kept in the mailroom and are available to assist shareholders in unloading vehicles and transporting luggage and other items to their apartments. If a shareholder needs to use a cart to temporarily store these items on the ground floor, the doorman shall have the discretion to remove these items in order to make the cart available when actually needed by another shareholder to transport items upstairs. 6. APARTMENT TRANSACTIONS Selling Your Apartment The managing agent will provide written guidelines (Purchase Agreement) outlining the process and requirements for the sale of an apartment. The co-op board will interview prospective buyers and provide approval on a case-by-case basis. Subletting Your Apartment Shareholders are allowed to sublet for a total period of two years during their period of ownership of the apartment after an interview by the co-op board of the prospective sublettors. Approval may be provided by the co-op board for one-year extension periods on a case-by-case basis. There is a fee due to the corporation for subletting, payable by the shareholder. The managing agent will provide written guidelines outlining the process and requirements for arranging a sublet. Apartment Rentals Generally speaking, 160 Riverside Drive is an owner-occupied building and does not allow paid rentals of apartments or portions of apartments other than the sublet provision 13
14 mentioned above. Of course, roommates, partners, family members, and the like may reside with the shareholder. Such arrangements are not considered rentals and require no permission from the board. 7. OTHER RULES Vehicles No vehicle belonging to a shareholder or guest should be left standing in front of the building beyond the time needed to drop off or pick up persons or material. Promptly moving vehicles eases access to the building for other residents and reduces the incidence of honking horns on our narrow street. Under no circumstances can a doorman be expected to take responsibility for moving a vehicle parked in front of the building. Engaging the Services of Building Employees No shareholder or occupant of an apartment shall engage any employee of the cooperative on any private business of the shareholder without the consent of the co-op board. Shareholders may, however, request assistance from the staff in performing routine household tasks such as bulb replacement in ceiling fixtures, unclogging drains and toilets, replacing circuit breakers and fuses, and the like. Under no circumstances will any private efforts be accomplished by an employee of the cooperative during his or hers working hours. 14
15 Pest Control The co-op board, and any contractor or workman authorized by the cooperative, may enter any apartment at any reasonable hour of the day for the purpose of inspecting such apartment to ascertain whether measures are necessary or desirable to control or exterminate any vermin, insects or other pests and for the purpose of taking such measures as may be necessary to control or exterminate any such vermin, insects or other pests. Reasonable efforts will be made to contact the shareholder prior to such entry except in an emergency. 15
