8 1975 SEWER SERVICE AGREEMENT City of Wadsworth and Medina County 50-year Agreement for Sewer Service within FPA Modification Area Can be Terminated at an Earlier Date Medina County Intends to Terminate or Modify Agreement for the FPA Modification Area Agreement does not Address the Service of City Parcel by Medina County after Termination Medina County must Determine how to Continue Sewer Service to City Parcels after Termination

15 MEDINA COUNTY WADSWORTH NEGOTIATIONS Multiple Meetings and Discussions City of Wadsworth Counter Proposal Feb Medina County Declined March 2018 Medina County Offered Support Efforts by City of Wadsworth to Retain Customers within the City Negotiations Reached an Impasse Medina County Requested NOACA Proceed with the FPA Modification Request

16 Policy 4-6b OUTSTANDING ISSUES Medina County s Legal Authority to Act Upon termination of the existing sewer service agreement with the City of Wadsworth, Medina County must show legal authority to provide sewer service to customers within the City of Wadsworth Medina County can decide how to accomplish this task Needed before Ohio EPA can issue a Permit-to-Install

17 STAFF RECOMMENDED APPROVAL CONDITIONS 1. Medina County Supports Future Efforts by Wadsworth to Retain Medina County s Sewer Customers within the City 2. Medina County Provides Documentation of their Legal Authority to Serve Customers within the City

18 NEXT STEPS With Board approval, NOACA will submit the FPA update to the Ohio EPA for certification by the Governor Following Board approval, staff will transmit copies of this resolution to appropriate federal, state and local agencies
