Motion carried 5 to 0 by voice vote. 8) NEW BUSINESS: NONE 9) COMPREHENSIVE PLAN 2040 WORKSESSION: a) Eric Fowle, Trish Nau and Kathy Thunes from East Central Wisconsin Regional Plan Commission were present and facilitated discussion regarding the Town of Buchanan s Comprehensive Plan 2040 update. Fowle & Thunes provided a brief overview of the Wisconsin State Comprehensive Planning requirements, the planning process and the responsibilities and expectations of the Plan Commission. Demographic highlights will be presented and a brief visioning session was undertaken. Nau presented information regarding the Town s Comprehensive Outdoor Recreation Plan Plan Commission Minutes February 13, 2017 Page 1 of 2
4 (CORP) update. This activity will occur concurrently with the Comp Plan process. Nau introduced the CORP process and community survey. The Commission agreed to hold the Comprehensive Plan Vision Workshop & Open House on Thursday, March from 5:00-7:00 p.m. at the Buchanan Town Hall. Staff will be responsible for setting up notifications and publicity for the event. 10) PROJECT UPDATES/CORRESPONDENCE: a) Application of Wisconsin Public Service Corporation for Authority to Purchase and Place in Operation a Natural Gas Lateral and Associated Facilities in the Town of Buchanan: Gregozeski provided a brief overview of the WPS Corporation application for operation of a natural gas lateral proposal through the Wisconsin Public Service Commission. 11) FUTURE AGENDA ITEMS: Ordinance and Comprehensive Plan ) ADJOURN: Motion by Van Wychen/Erdmann to adjourn at 8:01 p.m. Motion carried 5 to 0 by voice vote. 10 Special Exception Statement For a Proposed Climate Controlled Storage Development A special exception is being requested for property ID , located at the northeast quadrant of the State Park Road-CTH KK intersection. Applicant: VL Storage LLC Special Exception Request: Reduce the building setback along State Park Road from 35 to 20. The reduction in the building setback has been studied by both the client and Town staff. Staff supports the special exception. The following summarize the conclusions reached: The change in the building setback will not adversely affect the routine operation and maintenance, or enjoyment, of neighboring properties. The immediately adjacent properties are owned by the applicant. The closest property not owned by the applicant is a vacant parcel located west of the subject property, across State Park Road. This property owner has submitted a statement supporting the special exception. The next closest buildings are multifamily structures located approximately 225 from the proposed storage buildings, north of Gentry Drive (see attached aerial photo). The change in the building setback will not cause traffic hazards. The setback reduction will not reduce motorist s lines of sight along State Park Road or at the State Park Road-CTH KK intersection. An adequate vision triangle approved by Outagamie County Highway Department will remain at the intersection. The special exception will allow for the removal of an existing driveway on CTH KK, which is favored by the County Highway Department and would reduce potential safety hazards close to the intersection. Access to the property is achieved by utilizing an existing driveway entrance on State Park Road, which is located an appropriate distance from all nearby intersections. The setback will not affect fundamental site design requirements. All other site design and zoning requirements will still be met. Town stormwater requirements are exceeded. No additional driveways are required. Traffic patterns on the adjacent properties, and on State Park Road, are not impeded. Building appearance and landscaping will exceed Town aesthetic requirements. Adequate off-street parking is still provided. The reduction in the building setback should not impede future improvements to public infrastructure. Currently, the road is adequately designed to meet current and future traffic demands. Should State Park Road be widened and urbanized in the future, the existing right of way is sufficient to provide for additional turn lanes, and potential pedestrian/bicycle trails. Consequently, acquisition of private property should not be required if State Park Road is widened, and the additional 15 of building setback should not be necessary.
11 Granting the reduced building setback allows the applicant to submit a more aesthetically pleasing site design at a very visible intersection. The two most common appearance issues associated with mini storage developments are the rows of unattractive garage doors, and the large areas of asphalt pavement. With the reduced building setback, the applicant is proposing NO garage doors or asphalt pavement along the west and southwest walls that face State Park Road. These walls will instead be characterized with a masonry skirting, accented with a manicured lawn and lush landscaping. By locating the less desirable features on the interior of the site, the development will be much more aesthetically pleasing to motorists and the general public. If the building setback is not reduced, the design will need to be revised, and consequently its aesthetics downgraded, in order to maintain the site s financial solvency. The western building will be redesigned to have garage doors facing both east into the site, and west towards State Park Road. Aesthetic building and landscaping values will be replaced with asphalt and overhead doors. The community will no longer have a well-designed, high demand climate controlled facility that has been proven to be a model in neighboring communities.

26 TOWN OF BUCHANAN ORDINANCE NO F. Performance Standards; Industrial Developments. The Town Board of the Town of Buchanan does hereby ordain as follows: Section F. Performance Standards; Industrial Developments of the Code of the Town of Buchanan is hereby created to read: Section F. Performance Standards; Industrial Developments. It is the intent to use performance standards for the regulation of industrial uses to facilitate a more objective and equitable basis for control and to insure that the community is adequately protected from potential hazardous and nuisance-like effects. (1) Noise. a. No activity in an Industrial District shall produce a sound level outside the district boundary that exceeds the following sound level measured by a sound level meter and associated octave band filter: Octave Band Frequency (cycles per second) Sound Level (decibels) 0 to to to to to 1, ,200 to 2, ,400 to 4, Above 4, b. All noise shall be so muffled or otherwise controlled as not to become objectionable due to intermittence, duration, beat frequency, impulse character, periodic character or shrillness. (2) Vibration. a. No operation or activity shall transmit any physical vibration perception threshold of an individual at or beyond the property line of the source. "Vibration perception threshold" means the minimum ground- or structureborne vibrational motion necessary to cause a normal person to be aware of the vibration by such direct means as, but not limited to, sensation by touch or visual observation of moving objects. b. Vibrations not directly under the control of the property user and vibrations from temporary construction or maintenance activities shall be exempt from the above standard. (3) External lighting. No operation or activity shall produce any intense glare or lighting with the source directly visible beyond an Industrial District's boundaries.
27 (4) Odor. No operation or activity shall emit any substance or combination of substances in such quantities that create an objectionable odor as defined in NR , Wis. Admin. Code. (5) Particulate emissions. No operation or activity shall emit into the ambient air from any direct or portable source any matter that will affect visibility in excess of the limitations established in Ch. NR 415, Wis. Admin. Code. (6) Visible emissions. No operation of activity shall emit into the ambient air from any direct or portable source any matter that will affect visibility in excess of the limitations established in Chapter NR 431, Wis. Admin. Code. (7) Hazardous pollutants. No operation or activity shall emit any hazardous substances in such a quantity, concentration or duration as to be injurious to human health or property, and all emissions of hazardous substances shall not exceed the limitations established in Chapter NR 445, Wisconsin Administrative Code.
