1 Region of Waterloo Job Description Title: Legal Assistant (Property) Job Code: Department/Division: Planning, Development & Legislative Services/Legal Services Union: Management/Management Support Reports to: Solicitor (Development & Property) Revised: October 11, 2007 General Purpose: Provides clerical and administrative support to Legal Services, specifically in the area of real estate, transactions and services, title searching, development agreements, and releases. Duties/Responsibilities: Obtains and assembles title information. Prepares and registers legal documents through the land registry system. Reviews surveys and reference plans. Attends the Land Registry Office and responds to inquiries from same. Conducts searches through land registry system/office to determine ownership and encumbrances on title, as requested. Supports the Solicitor (Property) to maintain carriage of real estate files. Drafts documents. Composes correspondence for the Solicitor (Property). Prepares correspondence, Council Reports, and Memoranda of Agreements for the Solicitor (Property); Real Estate Services Administrator; and Property Agent. Receives inquiries regarding the status of development agreements. Collects administrative fees and responds to requests for compliance letters. Prepares release of agreement, if available. Acts as Commissioner for taking Affidavits. Maintains a tracking system for development agreements, easements, real estate transactions, expropriation proceedings, and encroachment agreements. Reconciles funds against Statement of Adjustments on real estate transaction and ensures completion of related cheque requisitions. Collects cash and cheques, and maintains/records revenue from development and encroachment agreements and release of development agreements. Forwards to Finance. Exchanges information with divisional staff/management on real estate and development issues. Exchanges information with lawyers, law firms, developers, consultants, public organizations, other government agencies, special interest groups, the public, and the Land Registry Office. Responds to inquiries from the public. Performs related duties, as required.
2 Knowledge, Skills, & Abilities: Knowledge of procedures related to title searches, document registration, real estate transactions, and legal documentation (e.g., transfers/deeds, releases), normally acquired through a 2-year Law Clerk's Certificate, plus practical experience in a legal environment specializing in real estate. Knowledge and ability to comply with policies, procedures, and related legislation. Organizational, problem solving, and analytical skills to work independently and prioritize work to meet deadlines; and coordinate materials/information/responses (liaising with Solicitor on matters requiring input/review). Communication and human relations skills to explain legal documentation to staff and the public; respond to inquiries from staff, solicitors, consultants, and the public related to legal documents and transactions and policies and procedures; and participate as an effective team member. Ability to read, understand, and interpret legal documents. Ability to draft and assist in drafting legal documents, including transfers/deeds, easements, notices, development agreements, encroachment agreements, land transfer tax affidavits, and correspondence regarding real estate transactions and expropriation proceedings. Computer skills with the ability to use software such as Microsoft Office, Teraview, Municipal Connect, and GIS. Ability to maintain tracking systems and monitor files/transactions by deadlines. Ability to travel within Waterloo Region. Ability to support and demonstrate the Region s values. Sensory/Mental/Physical Effort: Uses a computer approximately XX% of the time. Reviews files approximately XX% of the time. Bends, stoops, lifts, and reaches overhead to retrieve files. Carries files weighing up to 15kgs. Working Conditions: Works in a standard office. Travels to the Land Registry Office. Work is subject to deadlines and interruptions. Some contacts are difficult/upset.
