1 SAN TAN HEIGHTS HOA- PARKING ENFORCEMENT POLICY EFFECTIVE JUNE 1, 2017 Due to an ever-increasing number of complaints from homeowners about on-street parking, your HOA Board has spent several months taking a more in-depth look at the problem. On-street parking is a hard issue to enforce, but it s a necessary one. Problems include neighbors and their guests blocking other neighbors driveways; parking close to corners so visibility is dangerous; neighbors taking up the space in front of other homes so that those owners guests have nowhere to park; no room for trashcans, which are then placed on the sidewalk, causing school children and others to walk in the street; and diminished ability of emergency vehicles to get down some of the streets in our HOA. State law says that if parking restrictions exist in CC&Rs, Community Associations are obligated to enforce those restrictions and owners are obligated to comply with them. Although some homeowners might feel there is no problem in their area, restrictions must be applied equally throughout the HOA. This new policy will be in effect starting June 1, The enclosed policy explains the definitions of and general parking restrictions for vehicles parked within San Tan Heights Homeowners Association. Please read this document very carefully. Noncompliance will result in fines. The policy will require that all vehicles associated with a property within San Tan Heights be registered with Invictus Patrol Services. This can be done through their website, Please note that if you have visitors/guests that plan to stay overnight, a parking permit must be requested through this site. On-street parking will not be permitted between the hours of 11:00pm and 6:00am except for guests who have a parking pass issued through Invictus. The Board realizes that some may need time to make arrangements for their vehicles and to also get their vehicles registered with the patrol company. Therefore, enforcement will start with courtesy notices for the first 30 days of this policy. The following month, full enforcement of the policy will begin. Aside from on street parking enforcement, there are some issues where the Association cannot enforce and thus they will have to be dealt with by the Pinal County Sheriff s Office. Please see the box below. If you witness and/or experience any of these referenced issues, please report it directly to the Pinal County Sheriff at
2 Situations where the PCSO may tow a vehicle include: Abandoned vehicle not moved after red-tagged for 72 hours and not identified as a homeowner s vehicle. Vehicle is blocking a homeowner s driveway. Homeowner needs to call the Pinal County Sheriff Office and be present to verify they are the homeowner of the residence being blocked. Vehicle is parked further than 18 from the curb and impeding traffic flow. Vehicle is blocking a roadway. In addition, Arizona Revised State Statute says that no vehicles may be parked within: 15 feet on either side of a mailbox 20 feet from a marked crosswalk at an intersection 15 feet from a fire hydrant 30 feet from a Stop sign. 3 ACTION BY WRITTEN CONSENT OF THE BOARD OF DIRECTORS OF SAN TAN HEIGHTS HOMEOWNERS ASSOCIATION We, the undersigned, being a majority of the members of the Board of Directors of San Tan Heights Homeowners Association, an Arizona non profit corporation (the "Corporation"), do hereby consent to adoption of and do hereby adopt the following resolution at this Public Session meeting of the San Tan Heights Homeowners Association Board of Directors this 27 th day of April, Whereas, the Board of Directors adopts the following Parking Enforcement Resolution: Parking Enforcement Summary If parking restrictions exist in the CC&Rs, Community Associations are obligated to enforce those restrictions and owners are obligated to comply with them. The purpose of this San Tan Heights Homeowners Association policy is to: Clarify section 4.16, Vehicles of the Declaration of Covenants, Conditions and Restrictions (CC&Rs); and Serve as a single reference for Resident Owned/Operated vehicles regarding vehicle parking restrictions in San Tan Heights; and In this document, enclosed garage means garage with doors closed. The policy explains the definitions of and general parking restrictions for vehicles parked within San Tan Heights Homeowners Association. The Association is contracted with a third party Patrol Company that performs nightly inspections of the association. The Patrol Company, in conjunction with San Tan Heights Compliance Coordinator, will issue letters, escalate Actions (first notice, second notice, etc.) and administer fines per this adopted policy. The following general restrictions apply to all vehicles at all times: No vehicle shall be parked on any portion of the property other than on areas designated by the San Tan Heights Architectural Review Committee and subject to the San Tan Heights fine policy. No vehicle shall be parked in a manner which blocks pedestrians ability to walk on paved sidewalks. No vehicle shall be parked within: o 15 feet of a fire hydrant. o 15 feet of a mailbox o 30 feet of a stop sign o 20 feet of a marked crosswalk at an intersection Parking Regulations and Restrictions Violations shall have a five (5) day correction period.
4 Homeowners and/or Residents who have registered their vehicles will be bound by the regulations and restrictions in the governing documents, any resolutions made by the Board of Directors and/or amendments to the fine policy pertaining to parking on the street and property. All vehicles associated with a property in San Tan Heights must be registered with the Patrol Company. o Failure to register will be a violation and subject to the San Tan Heights fine policy. There will be no parking on any street in San Tan Heights from the hours of 11:00pm and 6:00am without a parking pass being issued through the Patrol Company website or HOA website, where a link will be provided. o Parking on the street between the designated No Parking Times will be a violation and subject to the San Tan Heights fine policy. Exceptions: Public service vehicles that are on active duty when parked and public safety vehicles as set forth in the Arizona revised State Statute Guest vehicles may be parked on the streets on a temporary, non recurring basis. If guests plan to park overnight, a parking permit must be requested. Violation Fine Policy Structure San Tan Heights Fine Policy has a six(6) month open violation amendment. Once a violation is issued it stays open for six months. If no further reoccurrence of the same violation happens within six months the violation is closed. If violations of the same nature occur within the sixmonth window then the fine amounts escalate. Homeowners who park on the street in violation of the Declaration, Governing Documents or Resolution, will be cited a first violation, then five (5) days later, if not in compliance, will be issued a second notice with an opportunity for a hearing with the Board of Directors and may be assessed a $25.00 fine. Every five (5) days, the violation will be escalated and fines assessed per the structure provided below. The Board of Directors has the right to deviate from this policy at any time due to extenuating circumstances based on the specific violation. Citations will be left on the vehicle as well as a written copy mailed to the property address(es) on file with the Management Company. Courtesy Notice 2 nd Notice = $25 3 rd Notice = $50 4 th Notice = $75
