1 CEDAR TERRACE TOWNE HOMEOWNERS ASSOCIATION P.O. Box 3011 Grand Junction, Colorado RULES AND REGULATIONS DEFINITIONS (Ref: Covenants Articles I & II) 1. Association - Cedar Terrace Towne Homeowners Association a not-for-profit Colorado Corporation responsible (among other things) for establishing these Rules & Regulations for the purpose of the mutual enjoyment of individual properties and the Common Area of Cedar Terrace Towne ( Covenants, Article VIII) 2. Owner - the legal owner of any individual townhome unit at Cedar Terrace. 3. Resident - anyone who permanently resides at a unit in Cedar Terrace Towne this includes an owner or a renter and/or family 4. Covenants - the official Declaration of Covenants, Conditions, and Restrictions of Cedar Terrace Towne 5. Common Area - Cedar Terrace property apart from individual townhome units mutually owned by all unit owners controlled, operated, and maintained by the Association 6. Manager - the person charged by the Association to carry out the requests of the Board of Directors, and enforce all rules and regulations MONTHLY DUES (Ref: Covenants Article IV) 1. Monthly Association fees are due and payable by the first day of each month by the unit owner (s) 2. Checks are to be mailed to the above P.O. Box 3011, Grand Junction, CO May checks payable to: Cedar Terrace Towne Homeowners Association 4. No billing statements are sent 5. If not paid within thirty (30) days, penalties will be assessed and you will be turned to collections. GENERAL RULES (For non-referenced rules, see Covenants, Article VIII, Section 2) Renters at any unit in Cedar Terrace are residents and are therefore expected to abide by these Rules and Regulations along with resident owners Owner/landlords are expected to communicate these Rules and Regulations to any current and prospective tenants 1. No unit shall be used for any purpose other than single family dwelling ( Covenants, Article 4 (q)) 2. Only appropriate For Sale or For Rent signs are permitted on the exterior building walls or Common Area ( Covenants Section 4 (d)) any other commercial signs, advertisements, notices or other lettering is not permitted 3. Residents/owners are liable and responsible for any damages to the Common Area or properties caused by residents, children, guests, or visits of that resident s Unit damages shall be repaired at the expense of the responsible resident parents or legal guardians are responsible for the supervision of their children and children in their care

2 Page 2 4. Children are not allowed to play in or around the trash dumpsters, parking lots, around cars, recreational vehicle storage area, or mailbox areas. They are not allowed to play with the water in the common areas. Children are allowed to play in the common areas and areas in front of their unit. 5. Loud and disturbing noises/music, screaming children, as well as profanity are not acceptable, and responsible efforts are expected by all residents not to disturb other residents: please be considerate of your neighbors evening quiet hour begins at 10:00 p.m. on Sundays and weekdays, and 11:00 p.m. on Fridays and Saturdays 6. Cardboard, sheets, flags, foil, etc. are not to be used as window coverings for a Unit. Only appropriate window coverings are allowed. 7. Only lawn furniture is allowed on upper decks. Planters and hanging pots are allowed on stoops and upper decks. 8. Laundry is not to be hung in front of units or where visible to other Cedar Terrace tenants. 9. Fireworks are strictly prohibited at all times. 10. Any changes or additions desired by homeowner/renter on the outside of any unit (building and property) must be first approved by the Architectural Committee. Failure to get proper approval could result in having to remove the offending item, being issued a fine, and a bill for removal and repair. This includes changes in windows, doors, electrical, etc. 11. Swamp coolers/air conditioners are the responsibility of the homeowner for repairs and maintenance. PARKING/AUTO MAINTENANCE/RECREATIONAL VEHICLES Any parked or abandoned vehicle in violation of the following regulations may be towed at the owner s expense. The Association assumes no liability for any loss or damage to articles or vehicles stored in any common storage area. A. PARKING (Ref: Covenants Article II, Section 3) 12. Residents are provided with two (2) automobile parking stalls per unit 13. Residents may not park in the designated Visitor Parking stalls (see Addendum unassigned parking) 14. Visitors must park in the designated Visitor Parking stalls, unless expressly permitted to park at the visiting residence 15. Parking in such a manner that impedes or blocks access to any road, driveway, building entrance, grass, or parking space is not permitted. 16. Double parking is not permitted 17. Cars in violation of Rules and Regulations will be towed by Liberty Towing immediately. B. AUTO MAINTENANCE (Ref Covenants Article II, Section 4 (r)) 18. Routine maintenance may be conducted on vehicles parked in resident s parking spaces clean-up should be done with care to ensure the parking space remains clear and clean in appearance 19. Major repairs, painting, or other major automotive work is not permitted on any parking space or common area 20. Washing cars is not permitted in any parking space or common area 21. All automobiles must be maintained in good working order with current tags. Wrecked or Junk vehicles or vehicles with unrepaired flat tires are not permitted on the premises.

3 C. RECREATIONAL VEHICLES (RVs) (Ref Covenants Article II, Section 4 (r)) 22. No house trailers, camping trailers, hauling trailers, running gear, boats, snowmobiles, or vehicles in excess of 3/4 ton may be parked or stored in any parking space exception: this restriction shall not apply to commercial or other vehicles making service or business calls or deliveries to residents, Association, or contractors within the properties 23. A fenced area is provided by the Association for the purpose of storing RVs for residents one (1) RV may be stored per unit each vehicle in the storage lot must be registered with the Association manager 24. Requests to store RVs in the storage lot are subject to approval by the Board of Directors PETS (Ref: Covenants, Article II, Section 4 (c)) 25. Each resident is fully responsible for his/her pet(s) and keeping it (them) under control for the mutual safety of all residents and enjoyment of properties and common areas 26. No animal of any kind shall be raised, bred, or kept for any commercial purposes 27. A maximum of two (2) household pets is permitted per unit, except for small permanent indoor pets such as fish, small birds, rodents, etc. 28. Dogs are to be kept on a leash and accompanied by a human at all times while in the common areas. Tethering of animals to roam in the common area is strictly prohibited. Excrement is not to be left in the common areas: they are to be retrieved and discarded appropriately (see TRASH, #3) 29. Vicious animals are prohibited Animal Control ( ) should be notified immediately to restrain and/or remove any animal on private property or on public common area that: Commits an unprovoked attack on a person or another animal Threatens to attack or terrorize a person or another animal Vicious animals are strictly prohibited at Cedar Terrace Towne. Failure to remove the offending animal per Cedar Terrace Towne s request will result in fines assessed to renters/owners. The animal will be removed by animal control. 30. Excessive barking or other loud noises are not permitted 31. Provoking another resident s pet(s) to be noisy and/or vicious is not permitted 32. Outdoor cats that are pets need to be collared and tagged with proof of vaccination.. Failure to vaccinate the cats will result in City of Grand Junction code enforcement being informed as all animals have to be vaccinated or the pet owner can be fined. Cat owners who are in noncompliance will received a $100 fine and/or the cat could be trapped and taken to Mesa County Animal Control or other organization. TRASH (Ref: Covenants Article II, Section 4(g)) Non-resident use and misuse of the trash dumpsters occurs with some frequency (i.e. dumping of furniture beside the dumpsters, etc.). Please report such incidences to the Association manager. If a non-resident is observed violating these regulations, please record the license number of the offending vehicle and report the incident immediately to the Association manager. 33. Two (2) centralized trash dumpsters, located on Brittany Drive, furnished by the Association are provided for the common use of all residents 34. Each resident is responsible for his/her own unit s trash 35. All trash is to be properly secured and deposited within the trash dumpsters

4 please refrain from discarding small loose items (particularly those with foul odors, such as pet droppings) in the trash dumpsters without first being properly secured in plastic bags trash is not permitted on the ground beside the dumpsters: if trash is too heavy or awkward to handle, request assistance to have it placed within the trash dumpsters trash, rubbish or storage unit items are not allowed to collect or be stored inside of automobiles or the back of pick-up trucks. trash is not to be left outside of unit (unless it is in a trash can with a secured lid in back of unit.) Deposit trash immediately into trash dumpsters parking lots, decks, and stoops are to be kept clean and free of debris and storage area items at all times 36. Large items of furniture, tires, or debris from remodeling of a Unit (windows, carpet, cabinets, air conditioners, etc.) are not permitted in the trash dumpsters. - residents need to arrange for proper disposal or removal of these items 37. Trash is scheduled to be picked up and removed twice per week: trash pick-up days are Mondays and Fridays. GRIEVANCES 1. Resident - Neighbor grievances between residents and neighbors are to be dealt with locally (between the offended resident and offending neighbor), resolving problems in a peaceful manner if possible Unresolved problems need to be addressed with a higher level of intervention utilizing local law enforcement as necessary please advise the Association by notifying a Board Member or the Association Manager of unresolved incidences 2. Resident - Association Manager grievances between any resident and the Association Manager are to be dealt with locally (between the offended resident and the offending Manager), resolving problems in a peaceful manner if possible unresolved problems need to be directed immediately to a Board Member all Resident-Manager grievances need to be reported to the Association by notifying any Board member 3. Resident - Association (including Board members) grievances between any resident and the Association or any Board member need to be addressed at the next monthly Board meeting (contact any Board member for the time and location of any Board meeting) or at a special grievance meeting called as necessary by the Board VIOLATION OF THE RULES AND REGULATIONS CONSTITUTES ENACTMENT OF OUR ENFORCEMENT POLICY Revised 07/25/07, 04/02/09, 01/13/11
