ZONING ORDINANCE OUTLINE: Reviewed proposed outline. Article 6 will be called ite Development tandards, and Article 7 will be called General and pecific rovisions D. REGULATED UE TABLE Focused on the agriculture land use category Looked at Michigan Right to Farm Act (Act 93 of 1981) to understand the definitions used in the act. Use the definitions as uses allowed under the AG district, then reference the Act s definition in the Zoning Ordinance definitions article. Uses deemed to be covered by the Act and therefore not needing to be listed specifically: agricultural processing, agricultural warehousing, aquaculture, aquaponics, customary agricultural operations, farmer s market, farmer s roadside market, farmer s roadside stand, field crop and fruit farming, food research and development, food processing plants, food storage (bulk), game or hunting preserves for profit, greenhouse or nursery, historic parks, livestock processing, planned agricultural units, productions facilities for value added farm products, raising and keeping of small animals/livestock, raising fur bearing animals for profit, riding horses (needs to stay for Residential districts), special open space uses Uses that are currently allowed, but not covered under the Act that will need to remain listed individually: agricultural tourism (I and II), lumber/planning/saw mills, winery/small winery, brewery/microbrewery, distillery/small distillery to stay with current AG provisions and remove the U requirement for the larger operations, riding stables and livestock auction yards, tenant housing, winery w/food service Uses to stay but with modification: o community kitchen (second half of current definition does not fit in the AG district), add to C, CF and L-1 districts. Needs to be a licensed facility. Keep cooking classes in the definition o Livestock processing to remain listed separately but as an U use in the AG o Riding horses to stay in the FR district, but indicate there are special provisions roduction and processing to be moved under industrial land use category rather than agricultural If you are planning to attend and are physically challenged, requiring any special assistance, please notify Cathy Dye, Clerk, within 24 hours of the meeting at

DRAFT UNAROVED Winery, Brewery, Distillery to be added to C and CF as an U, in addition to the smaller operations by right. L-1 will retain this use still. o Look into Michigan Liquor Control Commission s definitions and categories Add another land use category for industrial and warehousing ADJOURN: If you are planning to attend and are physically challenged, requiring any special assistance, please notify Cathy Dye, Clerk, within 24 hours of the meeting at

To: Karly Wentzloff, Marcie Timmins, Dan Rosa, John Iacoangeli From: hawn Winter, Zoning Administrator CC: Date: January 5, 2017 Re: Regulated Use By District MEMORANDUM lanning and Zoning 6042 Acme Road Williamsburg, MI hone: (231) Fax: (231) Web: I have edited the land use table with the recommendations from our last meeting. Below are some notes and considerations for our January 10, 2017 meeting. AGRICULTURAL LAND UE This land use category has been trimmed down considerably since our last meeting. The agricultural uses listed under Farm Operations in the Michigan Right to Farm Act (Act 93 of 1981) have been removed, and Farm Operation has been added to the table. Farm Operation will need to be added to the definitions with a reference to the law. Further discussion and determination is needed for the variations of wineries, breweries, and distilleries. The definitions and provisions from the Michigan Liquor Control Commission will be reviewed. Minimum lot size 5 acres It was requested at the last meeting to review the Michigan Liquor Control Commission definitions on the various types of licensing they offer. Explanations are listed below, along with any Acme specific provisions: Breweries Brewer manufacture beer and sale to licensed wholesalers, allowed to: o Have multiple brewing facilities can serve for on-premises consumption at no more than two of their licensed facilities o Brew beer in one of their facilities, sell for consumption at their other facilities o Offer free tastings o ell for off-premise consumption o Cannot sell direct to retailers, must use a wholesaler o Must obtain a food establishment license o Acme Township AG provisions: pecial Use ermit Minimum 10 acres At least 5% of products grown in Acme, 75% grown in Michigan Micro Brewer same as Brewer, except indicated below: o No more than 60,000 barrels per year (combined production of all their facilities) o Micro brewers producing more than 30,000 combined barrels per year can serve for on-premises consumption at no more than three of their licensed facilities o Acme Township AG provisions: age 1 of 4

Allowed by-right Minimum 10 acres, with at least 5 acres used for growing items used in production At least 5% of products grown in Acme, 75% grown in Michigan Brewpubs allows the production and sale of beer o In conjunction with a Class C, Tavern, B-Hotel or A-Hotel license o o Limited to 18,000 barrels a year ales for on-premises and off-premises consumption (off-premises requires a pecially Designated Merchant License) Wineries Wine Maker manufacture and sale of wine, allowed to: o ell to wholesalers or retailers directly o Offer free or charged samples/tastings o ell for off-premises consumption, sell for on-premises consumption in conjunction with a restaurant at the winery o Operate a tasting room off the licensed winery premises, samples and off-premises consumption only (no wine by the glass) o Must obtain a food establishment license o Acme Township AG provisions: pecial Use ermit Minimum 10 acres At least 5% of products grown in Acme, 75% grown in Michigan mall Wine Maker same as wine maker, except as indicated below: o o Limited to 50,000 gallons per year Acme Township AG provisions: Allowed by-right Minimum 10 acres, with at least 3 acres used for growing wine fruit At least 5% of products grown in Acme, 75% grown in Michigan May operate a mall Distillery on the same property Tasting Rooms o Wine Maker and mall Wine Maker allowed to operate a tasting room off the winery premises o amples (free or for cost) and off-premises sales allowed o No sales by the glass for on-premises consumption o Acme Township AG provisions Tasting Rooms allowed by right Winery with Food ervice allowed through pecial Use ermit Winery kitchen, food preparation and production areas licensed by GT County Health Dept. arking lots shall be screened Outdoor lighting compliant with Township standards Distilleries Manufacturer of pirits licensed to manufacture spirits o Offer free on-premises samples o May not sell directly to consumers for on- or off-premises consumption o May not sell spirits directly to retailers o Must sell spirits to the MLCC, who acts as wholesaler o Must obtain a food establishment license o Acme Township AG provisions pecial Use ermit (references it as Distillery ) Minimum 10 acres At least 5% of products grown in Acme, 75% grown in Michigan age 2 of 4

Manufacturer of Brandy manufacture of brand o Must hold a wine maker or small wine maker license o Free samples on the manufacturing premises o ell to consumers for on-premises consumption in conjunction with a restaurant on site o ell direct to consumers for off-premises consumption o ell direct to MLCC Manufacturer of Mixed pirit Drink manufacture of spirit based beverages o Contain less than 10% alcohol by volume o Commonly known as spirit coolers o Hardly any information on this type of license mall Distiller manufacture of spirits and brandy o Not to exceed 60,000 gallons annually o Free samples on manufacturing premises o ell spirits for consumption on manufacturing premises o ell spirits for off-premises consumption (price set by MLCC) o May not sell directly to retailers, only to MLCC o Can operate a tasting room off-site from the distillery Free tastings and sales for off-premise consumption only o May sell to a restaurant for on- and off-premise consumption/sales if owned by the mall Distiller. If operated by another person, MLCC has to agree. o Acme Township AG provisions Allowed by-right Minimum 10 acres, with at least 5 acres used for growing items used in production At least 5% of products grown in Acme, 75% grown in Michigan Although not specifically stated, I assume its reciprocated that you can also operate a small winery at the same location REIDENTIAL LAND UE FR: ingle Family Rural has taken over the former R-1: One-Family Forest & Coastal District o Minimum lot size 1 acre o Expanded the district boundaries from the previous R-1 FN: ingle Family Neighborhood has taken over the former R-2: One-Family Urban Residential and R-3: Urban Residential districts o Minimum lot size 15,000 sq ft w/ sewer; 20,000 sq ft w/o sewer o I combined the R-2 and R-3 uses in the table into the new FN. The only difference was that R-3 allowed duplexes and multifamily dwellings through U. With the expanded CF and MHN, along with the name ingle Family Neighborhood, these uses may no longer be appropriate o We have a previously existing ingle Family Neighborhood from the form-based code district. Those uses have been added to the new FN and are indicated with quotation marks ( or ) Duplexes were allowed by right in the previous ingle Family Neighborhood o hould FN still incorporate form-based code. Now that FN encompasses a much larger area, with larger lots, owners will be required to adhere to a 30 built-to-line (just one example) o hould Manufactured Homes stay as uses allowed by right in the AG, FR and FN Districts For some reason, they are not listed as a use in R-1MH: Mobile Home age 3 of 4

INDUTRIAL AND WAREHOUING LAND UE This is a new land use category that has been added. Uses formerly listed under Commercial Land Uses that appear to fit this description have been moved to this category The category hasn t been reviewed yet so you will see a lot of redundancy. Opportunity exists to trim this category down by consolidating specific land uses into broader descriptions. B-3: lanned hopping Center This district is proposed to be removed. I ve left the district, and its uses, in the table for the time being. The uses should be reviewed to determine if they are accounted for elsewhere in the Township o Either in another district, or under another land use category If not, are they uses we want to even keep, and therefore add to another district? age 4 of 4
