1 AGENDA ITEM - PC CITY OF LA CROSSE, WISCONSIN CITY PLAN COMMISSION REPORT December 2, 2013 Application of Turtle Stack Brewery LLC for a Conditional Use Permit allowing for a craft brewery and tasting room at Pearl Street. ROUTING: JA& Committee BACKGROUND INFORMATION: The applicant is requesting a Conditional Use Permit (CUP) to allow for a brewery and tasting room on the property depicted on attached MAP PC [It should be noted that this application is not seeking a CUP for a Combination Class B beer and liquor license.] The applicant would like to produce specialty beers for distribution to local bars and restaurants and provide a tasting room for sampling. The applicant intends have the majority of all the incoming and outgoing deliveries occur through the rear alley entrance/exit. All of the beer produced will only be packaged in kegs. No bottling of beer will be permitted. The tasting room will be open 5-6 days a week from late afternoon to 9-10pm. The applicant has stated that earlier and later hours may occur on weekends. A letter from the applicant and a proposed floor plan are attached as Exhibit A. GENERAL LOCATION: Pearl Street RECOMMENDATION OF OTHER BOARDS AND COMMISSIONS: N/A CONSISTENCY WITH ADOPTED COMPREHENSIVE PLAN: This proposed CUP is consistent with the City Vision 2020 Master Plan which states that: "Promote a balance of nightime activities to provide an alternative to the college bar scene. A more diversified mix of attractions would include art and cultural attractions, fine restaurants, bars appealing to an older (after college) crowd." PLANNING RECOMMENDATION: The proposed use for this location is for a brewery and tasting room, which is a vastly different use than most other Conditional Use Permit applications for liquor licenses in the Downtown. It is not intended to be a bar or provide a bar-like atmosphere. Only beer will be allowed to be served here and the applicant does not intend to be open until 2:00 a.m. every day of the week. This location has been vacant for a number of years and, while this location has not been used for this type of establishment in the past, it is staff s opinion that it will not produce the same type of concerns or issues that occur at typical bars and is a great location for this type of use. This application is recommended for approval with the following conditions:
2 1. Establishment is open no more than six days per week; 2. Operating hours are from 3:00 p.m. to 9:00 p.m. Monday through Thursday (or Sunday); 3. Operating hours are from 3:00 p.m. to midnight on Friday and Saturday night; and 4. Operator to specify which day of the week they are to remain closed. PC

8 AGENDA ITEM - PC CITY OF LA CROSSE, WISCONSIN CITY PLAN COMMISSION REPORT November 4, 2013 AN ORDINANCE to create Subsection 15.26(AA) of the Code of Ordinances of the City of La Crosse to add approval criteria for conditional use permits. ROUTING: J&A Committee BACKGROUND INFORMATION: The Subject Ordinance is taken from the draft Zoning and Subdivision Code update (Unified Development Code Project). It is intended as a stop-gap measure to ensure that specific criteria for approval are stated in the Code before the Zoning and Subdivision Code is updated. A copy of the Ordinance is attached as Exhibit B. GENERAL LOCATION: Citywide RECOMMENDATION OF OTHER BOARDS AND COMMISSIONS: N/A CONSISTENCY WITH ADOPTED COMPREHENSIVE PLAN: The Subject Ordinance is consistent with the adopted Comprehensive Plan. Clear approval criteria are intended to improve land use compatibility. PLANNING RECOMMENDATION: This Ordinance is recommended for approval. The inclusion of approval criteria for conditional use permits should aid the City Plan Commission s and Planning Department s decision making process during the transition to the new Code. PC
9 ORDINANCE NO.: AN ORDINANCE to create Subsection 15.26(AA) of the Code of Ordinances of the City of La Crosse to add approval criteria for conditional use permits. THE COMMON COUNCIL of the City of La Crosse do ordain as follows: SECTION I: Subsection 15.26(AA) is hereby created to read as follows: (AA) APPROVAL CRITERIA. No application for a conditional use shall be recommended, approved, or granted by the City Plan Commission unless the Commission shall find all of the following: (1) Use is consistent with adopted plans of the City; (2) Use complies with all applicable standards of this Ordinance, including any applicable standards of Conditional Uses; (3) Use will not result in significant adverse impacts to other property in the vicinity of the subject tract or on the natural environment, including air, water, wetlands, floodprone areas, wildlife or significant vegetation; (4) Use will not have significant adverse impacts on the livability of nearby residential-zoned lands due to: (a) noise, glare from lights, late-night operations, odors, and litter; and (b) privacy and safety issues (5) Any differences in appearance or scale (from the surrounding area) will be mitigated through setbacks, screening, landscaping, or other design features. (6) Compliance with this entire Ordinance, such as lot width and area, yards, height, parking, traffic, highway access, and performance standards shall be required of all conditional uses. (7) That the establishment, maintenance or operation of the conditional use will not be detrimental to or endanger the public health, safety or welfare; (8) That the City will be able to provide municipal services to the property where the conditional use is proposed, given due consideration of the costs of providing such services; (9) That the uses, values, and enjoyment of other property in the neighborhood for purposes already established shall be in no foreseeable manner substantially impaired or diminished by the establishment, maintenance or operation of the conditional use; (10) That the establishment of the conditional use will not impede normal and orderly development and improvement of the surrounding property for uses permitted in the district; (11) That adequate utilities, access roads, drainage, parking supply, internal circulation improvements, including but not limited to vehicular, pedestrian, bicycle, public transit, and other necessary site improvements have been or are being provided;
10 (12) That appropriate measures to address transportation demand have been or will be taken to provide adequate ingress and egress, including all off-site improvements, so designed as to minimize traffic congestion and to ensure public safety and adequate traffic flow, both on-site and on the public streets; and (13) That the conditional use shall conform to all applicable regulations of the district in which it is located. 11 AGENDA ITEM - PC CITY OF LA CROSSE, WISCONSIN CITY PLAN COMMISSION REPORT November 4, 2013 AN ORDINANCE to amend Subsection 15.03(H) and 15.03(K)(42) of the Code of Ordinances of the City of La Crosse to include the Engineering Department as a Zoning Administrator, and to delete Subsection 15.03(K)(42). ROUTING: J&A Committee BACKGROUND INFORMATION: The Subject Ordinance would modify the Zoning Administration section of the Floodplain Zoning Regulations (currently Section of the zoning code) to include the Engineering Department as a zoning administrator. The Engineering Department, in addition to the Building and Inspection Department, will be enforcing the regulations of The Mayor has directed that certain functions of Floodplain Administration now be transferred from the Planning and Development Department to the Engineering Department and this ordinance amendment is necessary to carry out this directive. A copy of the Ordinance is attached as Exhibit C. GENERAL LOCATION: Citywide RECOMMENDATION OF OTHER BOARDS AND COMMISSIONS: N/A CONSISTENCY WITH ADOPTED COMPREHENSIVE PLAN: Floodplain Zoning Regulations administration is not covered in the Comprehensive Plan. PLANNING RECOMMENDATION: This Ordinance is recommended for approval. The Engineering Department has the technical expertise and capability to assist in the enforcement of the Floodplain Zoning Regulations. PC
12 ORDINANCE NO.: AN ORDINANCE to amend Subsection 15.03(H)(1)(a) and to remove 15.03(K)(42) of the Code of Ordinances of the City of La Crosse to include the Engineering Department as a Zoning Administrator. THE COMMON COUNCIL of the City of La Crosse do ordain as follows: SECTION I: Subsection 15.03(H)(1)(a) is hereby amended to read as follows: (a) SECTION II: The Building and Inspections Department and City Engineering Department are hereby is authorized to administer this ordinance and shall have the following duties and powers: Subsection 15.03(K)(42) be removed as follows: (42) Removed. INSPECTIONS DEPARTMENT : The City Department primarily responsible for administration of this floodplain ordinance. 13 AGENDA ITEM - PC CITY OF LA CROSSE, WISCONSIN CITY PLAN COMMISSION REPORT November 4, 2013 AN ORDINANCE to amend Section 15.02(B) of the Code of Ordinance of the City of La Crosse by transferring certain property from the Traditional Neighborhood District - General to the Traditional Neighborhood District - specific to allow for a 5-car garage to be built on the south end of the property at 714 Cass Street. ROUTING: J&A Committee BACKGROUND INFORMATION: The Subject Ordinance would transfer the property depicted on attached MAP PC from the Traditional Neighborhood District - General to the Traditional Neighborhood District - Specific. The applicant is proposing to construct a 5-car garage for their tenants living in the duplex located on the same parcel. The applicant has stated that the proposed garage will include white vinyl siding and a roof with a forest green tone to match the primary structure. There are four skylights planned for the roof to provide for some natural light as there are no windows proposed due to security reasons. The garage will include outside lighting and security cameras. A letter from the applicant and plans for the proposed garage are attached as Exhibit D. GENERAL LOCATION: 714 Cass Street RECOMMENDATION OF OTHER BOARDS AND COMMISSIONS: N/A CONSISTENCY WITH ADOPTED COMPREHENSIVE PLAN: This property is zoned Traditional Neighborhood Development which is not consistent with the Future Land Use Map in the Comprehensive Plan. PLANNING RECOMMENDATION: The proposed garage will add value to the existing property and added security for its tenants. In order to remain consistent with design review for multi-family projects, staff has reviewed the proposed plans per the Multi-Family Design Standards as well as the intent of the Traditional Neighborhood Design principles. The duplex is one of the oldest homes in the City and therefore should be more architecturally compatible with the main principal structure. This Ordinance is recommended for approval with the following conditions: 1) The shingles must match the color of the duplex. 2) The ridgeline must be broken up by an architectural feature such as a dormer, cupola, or another projecting gable end, etc. Ridgelines may not exceed 40 feet in length without such a feature.
14 3) Gable ends must have eyebrows and a freeze board with a different width of siding or vinyl shakes up in the gable ends. 4) Two windows shall be placed on the north side of the garage, they can non-operable and a painted piece of plywood can be placed on the inside to prevent entry for security reasons. 5) The rake shall be one foot and the overhang shall be at least one foot. 6) Vinyl siding must be at least.044 thick. 7) Provide bicycle parking for the tenants to accommodate at least 2 bicycles.
