The meeting was called to order at 6:00 p.m. by Ted Lewis. Motion made by Ted Lewis, seconded by Nancy Nachman to approve the Minutes of the October 19, 2015 Annual Meeting as written. Motion approved by the membership. Trisha Allan and Robin Townsend were appointed as the inspectors of election along with Karen Lindstrom and Alyssa Micciche. ELECTIONS: Result of Election: Mark Gregory 30 Ted Lewis 33 Nancy Nachman 17 Jim Sullivan 30 Mark Gregory, Ted Lewis and Jim Sullivan were elected to the Board. BUDGET MEETING MINUTES October 24, 2016 Board Members Present: Ted Lewis, President Nancy Nachman, Vice President/Secretary Mark Gregory, Treasurer via speaker phone Also Present: Karla L. Baumann, Alyssa Micciche and Karen Lindstrom, Association Managers The meeting was called to order by President Ted Lewis at the Clubhouse, Turnbull Lakes Drive, New Smyrna Beach, FL at 5:30 p.m. The minutes of October 19, 2015 were approved as written. Karla Baumann reviewed the 2017 budget with the board members. She noted insurance rates have been going down over the past few years and our insurance agent does not project a large increase in rates for 2017 even though we have just had a hurricane. Fiscally, we are in good shape with approximately $20,000 in surplus at the end of 2016 which will be placed into next year s budget. We are funding the reserves for next year at the rate of $133, Karla stated we have adjusted the roof life down to 17-1/2 years following the hurricane. The estimated replacement cost has been adjusted based on the roof assessment completed by our roofing vendor. Motion made by Ted Lewis, seconded by Mark Gregory to approve the 2017 budget as presented. Motion approved unanimously. BOARD MEETING MINUTES September 19, 2016 Board Members Present: Ted Lewis, President Nancy Nachman, Vice President/Secretary Mark Gregory, Treasurer via speaker phone Also Present: Karla L. Baumann, Alyssa Micciche and Karen Lindstrom, Association Managers The meeting was called to order by President Ted Lewis at the Clubhouse, Turnbull Lakes Drive, New Smyrna Beach, FL at 6:00 p.m. The Minutes of July 18, 2016 were approved as written Budget Review: Karla Baumann reported that the budget will be mailed to membership this Friday along with the Annual Election packet. Karla reported that the assessment is projected to remain the same for 2017 with an approximate surplus at the end of 2016 of $20,000. The majority of the surplus is due to delinquent assessment collection for past years. We are planning on putting $113,000 into the reserve funds for This is more than the current reserve schedule requires, however, this will allow for completion of needed repairs/projects. Ted Lewis stated that he did a walk through with management and discussed gutter cleaning. The current cleaning is completed two to three times per year. Some of the gutters, overhung by tree canopies, require a more aggressive cleaning schedule. Ted suggested 3-4 times/year. Alyssa will put together a spreadsheet relating which gutters need to be cleaned on various frequencies. Motion made by Nancy Nachman, seconded by Mark Gregory to approve the mailing of the 2017 proposed budget to the membership. Motion approved unanimously. Board Activity Report: Nancy Nachman reported: CABANA/GROUNDS MAINTENANCE Rocks added to fenced in pool equipment area Tom Becker $380.00

Everyone is very aware of the abundance of weeds. UPCOMING PROJECTS Tree replacement and landscaping around trees at turnabout with be done once weather cools off Terrific Turf Gutter Cleaning and removal of downspout screens Tom Becker; Project to start within the next week Patio approved 1981 Satellite Dish install approved ARC APPROVALS Reminder that the Budget approval meeting is scheduled for October 24 th 5:30 p.m. and Annual/Election Meeting is scheduled for October 24 th 6:00 p.m. Members Comments: An owner asked about the status of the units with window blinds that do not meet the requirements of the rules and regulations. Ted Lewis stated that notices will be sent to the owners requesting that they change out the window blinds to comply with the rules. An owner asked for an update of the contractor review of the roofs. Ted Lewis stated that a review has been completed and repairs made as needed. There are several units with stucco delamination that will also be repaired. Jim Sullivan asked about the oversight of the landscape company as the lawns are not looking healthy. Ted Lewis stated that both the board and management have been addressing the issues with Terrific Turf Landscaping. The landscaping vendor has just changed the weed control subcontractor due to complaints. Ted Lewis reported that the contract will not be renewed at the end of the year unless significant changes are observed. Alyssa will speak with Terrific Turf about blowing out behind the a/c units and the patios.

6 Jim reported that following the irrigation repairs, the sod is not being replaced nor are the contractors cleaning up the dirt from the driveways and sidewalks. Board Activity Report: Nany Nachman reported on the following: CABANA/GROUNDS MAINTENANCE Power Washing of all sidewalks completed 5/26/16 Steve s Pressure Washing. If owners would like to have their driveways or patio cleaned, please contact a board member for Steve s contact information. Gutter Cleaning completed 5/17/16 Tom Becker Leaking valve replaced at pool pump 6/8/16 Howell Plumbing New hook and pool shower cord installed 5/16/16 Tom Becker Reseal 1947 corner of gutter 5/18/16 Tom Becker Tree at turnabout removed 7/6/16; will replant in the fall Terrific Turf All new batteries in the smoke detectors at Cabana 7/1/16 Tom Becker / Ted Lewis The cabana was rented in June with no issues. We have met with the Utilities Commission on multiple occasion. There has been no positive resolution to the trimming of the bushes covering the meters. 8 1975 Paver Patio added Treasurer s Report: Mark Gregory, Treasurer, stated as of June 30, 2016, we did rent the cabana for $ We have collected $184, in income. On the expense side, $2,150 was spent for pressure washing, gutter cleaning of $ We were under budget for building expenses for the period. Administrative budget was $16,485 with expenses of $29, which is over budget for this period. We did have related legal and bad debt expenses which is the basis for the overage. Grounds and maintenance which includes landscaping, irrigation, pest/termite control was budgeted at $44, We spent $40,700 thru the end of June. The insurance expenses include property, crime (fidelity) and Directors and Officers. The general liability portion of the insurance renews in November. Cabana/pool budget for the first six months was $11, and the Association has spent only 49, For the first six months we had expense budget of $133, with actual expenses of $139, which includes $48, in funds transferred to the reserve fund. Status of Legal Actions/Delinquent accounts: Karla Baumann reported that one unit has been liened, one she is watching and one that is now owned (1907) by the Association. The board discussed suspending privileges of the unit owners who are delinquent and liened. Proposal for 1907 Turnbull: Karla Baumann reported that she received the following offer on Unit This unit has been foreclosed on by this Association due to unpaid assessment for over 5 years. Karla met with a representative of Ryestone on July 8, This is a foreclosure acquisition company who approached the Association. The offer is: Keep the Certificate of Title in the name of the Association due to the fact that the mortgagor is in the military and the bank has a foreclosure date set of January 4, Use Ryestone as a management agent as follows:

9 Ryestone will pay for all renovations up front - estimated cost of $10, Estimated renovation time is one month. Ryestone splits the rental income with the Association. Ryestone but does not pay the Assn any part of the rental income until the restoration cost is paid back to Ryestone thru the rental income. Ryestone splits the cost of the insurance on the unit. I do not know what this is at this time. Ryestone immediately pays monthly assessments upon the agreement being signed and keeps them up to date. I had suggested to Ryestone that the Board may want to do the following: Split the cost of the renovations and the insurance All rental income is split with no disbursement from the rental income. All assessments are paid in full each month (outside of the rental income). We have 18 months to generate income on this unit. All rental income received on this unit is not applied to the past due assessments but is ordinary income to the Association. The restoration cost is a write off to the Association which is good. The bank will foreclose on this unit and at that time, Ryestone is out of it and the Association will then negotiate for the past due assessment and/or a portion thereof. OR the Association can take this on themselves. It is worth splitting the rent with the managing agent as they have all of the resources in place which the Association does not. Ted stated that he is in agreement to splitting the renovations (capped at $5,000), insurance and rental income with Ryestone. Ted asked for a clarification on the payment of the utilities from a responsibility standpoint. Karla will clarify with Ryestone. Motion made by Ted Lewis, seconded by Mark Gregory to move forward with a counteroffer to Ryestone for 1907 Turnbull Drive to split the cost of the insurance and rent on a 50 50% basis and to cap the Association s renovation cost at $5, Any further repairs would be the expense of Ryestone over and above the $5, Motion approved unanimously. Karla will make the counter offer to Ryestone. Termite Bond Update: Wilkie Pest has treated and this past Wednesday.

10 Landscaping/Sprinkler repair & replacement status: Alyssa stated that nine out of eighteen areas have been upgraded or 50 percent. Alyssa does have the schedule for the remaining nine zones. Trellis/bushes in front of meters: Sue Harris of 1900 Turnbull Lakes Drive is asking the Board where her trellises can be relocated to on her property. Ted Lewis explained that the utilities commission has put the entire Association on notice concerning the removal of the shrubs blocking the utility meters. Ted Lewis stated that Sue Harris will have to send in an ARC request to the Board. Members Comments: A request to have the gutters looked at 1907/1909/1911 which were reported as clogged. Mr. Laidlaw (1950) reported that some of the stonework at their unit along sidewalk. Alyssa will investigate. Sue Harris reported that the landscapers are not blowing off the verandas every week. Sue also reported weeds growing in pool area. Alyssa will contact the landscaper. BOARD MEETING MINUTES APRIL 18, 2016 Board Members Present: Ted Lewis, President Nancy Nachman, Vice President/Secretary Mark Gregory, Treasurer via speaker phone Also Present: Karla L. Baumann and Karen Lindstrom, Association Managers The meeting was called to order by President Ted Lewis at the Clubhouse, Turnbull Lakes Drive, New Smyrna Beach, FL at 6:00 p.m. The Minutes of March 9, 2016 were approved as written. ACH: Assessment payments status/survey results: Karla Baumann reported that an went out to the entire membership asking who were interested in paying via ACH. Only five responses were returned, three no and two yes. At this point, we do not have the interest to proceed. Board Activity Report: Nany Nachman reported: 1) All board members walked the grounds on March 22, 2016 with AJ and Terrific Turf. We looked at sprinklers, shrubs, weeds, etc. We gave them our expectations. 2) Newly adopted Rules and Regulations go into effect April 1, 2016 (adopted 3/22/16). 3) The weeds are contracted out. Terrific Turf is aware of our displeasure and is working with Turner to take care of the weeds. 4) Mowing is back to once a week as summer is almost here. 5) AC was repaired in cabana. The cost was approximately $ for the repair. The settings are 77/80 degrees and a lock box is over the thermostat. 6) All bushes have been trimmed. 7) There is a pending real estate sales contract on 1910 and ) The Board also is working on a resolution to 1907.

12 Treasurer s Report: Mark Gregory, Treasurer, stated as of March 31, 2016 the total income was $92,400. The Association did write off bad debt on a unit which is in foreclosure totaling $10, Our golf course fees are paid for the first quarter based on collected income. Ground maintenance expenses was approximately $24,000 under budget by $1,000. We are within our budget for insurance. Our cabana expenses were up slightly due to the utility bill. Total expenses were $78,820 for the first quarter, but includes the bad debt and our contribution to the reserve fund. Karla Baumann stated the bad debt is not a cash expense this year but from prior years. Status of Legal Actions/Delinquent accounts: Karla Baumann reported 1907 went to a foreclosure sale on April 14, A third party bidder walked away from the property, so the Association has title subject to the mortgage holder. Once we have the Certificate of Title, we will go in and assess the unit. If it is rentable condition, that may be an option for revenue for the Association to consider or the Association can sell the title subject to the mortgage is under contract and Karla expects full collection is set for bank foreclosure sale, however, it is under contract and will close prior to the sale. We negotiated $4, as a condition of the sales contract. Two other accounts are behind and will be evaluated by the end of the month if they will be liened or not. Ted Lewis explained to the membership that prior to Karla Baumann taking over, no action had been taken by the prior management to collect assessments. Landscaping/Sprinkler repair & replacement status: Alyssa Micciche stated that the irrigation has been completed on , , , , Work to be completed on , , and Mark Gregory stated that the sprinkler is working on the cul-de-sac and is watering the new tree and sod. Ted Lewis is concerned that the tree is not getting enough water. Terrific Turf will replace the tree if this one does not survive.

13 Alyssa will check to see that AJ is checking the drip system especially the potted plants at the pool area. Cabana HVAC: Mark Gregory stated the filters were the incorrect size in the Cabana air conditioner. Four pounds of Freon was added to the unit and a leak repaired. A float switch was added to the unit. Mark is hoping the repairs help lower the utility bills. Capital Reserves: Ted Lewis reported that the capital reserves were being pooled when Karla Baumann took over as manager. Karla Baumann itemize the reserves and Ted has since revised the reserve schedule further after having the roofs re-assessed by a roofing contractor. Ted Lewis stated that prior years assessments were too low to allow for both funding the golf course fees and sufficient funding of the reserves. Ted estimates, based on the contractor s numbers, that the roofs will cost between $950,000 to $1 million for new roofs. We are reserving for painting, equipment replacement, and pool remarcite and pool deck. Karla Baumann will re-allocate some of the reserve items and bring back to the Board for consideration. Members Comments: Sue Harris reported that the old sprinkler debris has not been removed from the property. Sue stated that the weeds are still in the pool area has Oleander worm cocoons. Ted asked owner to contact Alyssa if he sees any further activity. Alyssa will also check out the question relating to the bonding issue on the Wilkies Pest Control contract and report back to the Board. BOARD MEETING MINUTES MARCH 9, 2016 Board Members Present: Ted Lewis, President Mark Gregory, Treasurer Nancy Nachman, Vice President/Secretary Also Present: Karla L. Baumann and Karen Lindstrom, Association Managers The meeting was called to order by President Ted Lewis at the Clubhouse, Turnbull Lakes Drive, New Smyrna Beach, FL at 10:00 a.m. The Minutes of January 18, 2016 were approved as written. This meeting was called for the purpose of reviewing and adopting a new set of rules and regulations. Ted Lewis stated that the process to revise the rules and regulations started with the previous Board and continued with this Board. Two drafts of the proposed rules were sent to owners for comment. We received very few responses back from owners. The language from the Association s original documents cannot be changed without an affirmative vote of the members, so the language for the rental period remains the same at three months. Ted Lewis stated that the new rules have been edited and condensed for clarity. Motion made by Ted Lewis, seconded by Nancy Nachman, to approve the adoption of the last draft set of rules and regulations dated February 22, 2016 with an effective date of April 1, Motion approved unanimously. Mark Gregory addressed an owner about the rental policy enforcement. Mark reported that owners can contact the management office if they believe a violation is occurring. The Board agreed that the Association needs to be self-policing on enforcement. An owner asked about the sales signage in the yards. Ted Lewis stated that the current rules allow for signs inside the unit, not on the outside. Ted Lewis reported that he spoke with several realtors who stated that signage is advertising for the agency. The realtors stated most perspective buyers shop online for units rather than driving through communities.

15 An owner stated that he has requested, and turned down, for a roll-down privacy screen door for his garage. Ted Lewis stated that the screens do not total shield the garage contents from view and adds an external feature to the garage door. The Board will look at specifications for interior mount, total shield type screen doors. Mark Gregory reported on his meeting with Terrific Turf. Terrific Turf has replaced two trees, one in the circle and one at They were not staked. One has blown over and has been reset, and the other tree appears to be dead. Terrific Turf quoted for repair of irrigation system. The quote came in at $ for two or three buildings. To date, Terrific Turf has charged for assessment of buildings 2001 and the three buildings to Mark Gregory has not seen evidence of any changes to the irrigation system. Mark Gregory stated that Terrific Turf has requested a walk-through of the property with the Board. Owners present reported that the edging in the back of the property is not being edged properly. An owner requested permission to plant a tri-branch Roebellini palm. Karla Baumann stated that he needs to complete an ARC application which is available on the website reported that 1902 has illegally planted a large shrub that is blocking her view of the golf course. Ted Lewis stated that owners are allowed to put in plants without Board permission, but no shrubs or trees without permission. Please bring concerns about plantings to the attention of the management company has a fire pit under window with wood, not a propane fire pit. BOARD MEETING MINUTES JANUARY 18, 2016 Board Members Present: Ted Lewis, President Mark Gregory, Treasurer Nancy Nachman, Vice President/Secretary Also Present: Karla L. Baumann, Karen Lindstrom and Alyssa Micciche, Association Managers The meeting was called to order by President Ted Lewis at the Clubhouse, Turnbull Lakes Drive, New Smyrna Beach, FL at 6:00 p.m. The Minutes of October 28, 2015 were approved as written. Board Activity Report: Nancy Nachman, Secretary, reported that there were 13 persons in attendance at the Town Hall Meeting. We had good comments/questions and feedback from the owners. To date, the Association had five requests to the Architectural Committee. Four approved, one denied. The mulching of the property has been completed for a cost of $11, The contract with the management company has been renewed for three years. We issued notices to residences regarding landscaping issue. Please put pots into the mulch bed so as not to impede the landscaping mowers as they cut the grass. The roofs of the Association have been inspected by a roofing contractor. There are some issues and the contractor will be providing proposals for repairs to the Board. Issues include clogged gutters, drains, dryer vents and insufficient past roof repairs. Wiginton Fire Systems will be making repairs to the fire suppression system to bring it up to code. Tuff Turf is working on the cul-de-sac, the mulching and will remove several trees. Some very positive comments were received from owners concerning the new landscaping vendor.

17 There will be one lane of traffic open while the bridge is replaced on Turnbull Bay Road which is scheduled to begin sometime in the spring. We have received a refund check from Massey Pest and the lawn spraying is being done by a new company. Management will check the rain gages on the sprinkler system to be sure they are working properly. They were disconnected as per a unit owner. The Association is going to spend approximately $ a month to bring the irrigation system up to date. The palm trees have been trimmed with multiple dead palms being removed and several have been replaced. Ted noted that the sidewalks are the Association s responsibility and not the homeowners. TREASURER S REPORT: Mark Gregory reported on the income and expenses for the year ending Mark stated that the legal fees exceeded the budget, however, we have moved toward collecting the delinquent fees on all the units. Mark also stated that the golf course fees were slightly less than budgeted. The grounds and maintenance expense was over budget due to the move to the new landscaping vendor and a month with double expense. Cabana expenses were under budget for Karla stated there were some significant collections of delinquent accounts early in 2015 and the Reserves were full funded for Mark stated that $373, was the income for 2015 and it will remain the same in the 2016 budget. We have reduced the bad debt expense, reduced grounds and maintenance, and expect to fund Reserves for approximately $96, in Ted Lewis stated that he would like to have the sidewalks cleaned and not pressurewash the building in The gutters, especially the homes near the Oak trees, will need to be cleaned out on a more regular basis. RULES & REGULATIONS: Ted Lewis reported that only two suggestions were received after the mailing of the Rules & Regulations to owners. Once the Rules & Regulations have been finalized and resent to owners, a meeting to adopt the new Rules will be rescheduled. BOARD OF DIRECTORS ELECTION PROCESS: Ted Lewis reported that the Board has outlined an election process that the Board would like to follow for owners

18 interested in running for the Board of Directors. The guidelines may change based on any legislative changes adopted by the State in July relative to Statute 720 for homeowners associations. ROOF REPORT: Ted Lewis stated that we have had an inspection of all the roofs completed. We will be soliciting bids for the recommended repairs and maintenance. ACCOUNT RECEIVABLE: Karla Baumann reported, that as of this date, $68, is due to the Association that includes four large delinquencies and one bank foreclosure (1921) which is scheduled for foreclosure sale on March 31, We have taken legal action on all the large delinquencies to push for collection. MANAGEMENT REPORT: MAINTENANCE/LANDSCAPING ISSUES RESOLVED 10/21/15 Annual Fire Sprinkler Inspection. Vendor: Wiginton o 1/2/16 - Inspection report came back with many deficiencies and were corrected and filed. Massey was sent termination letter. o 10/16/15-S/w Ashley at Massey in New Smyrna Beach. She verified that they did receive the termination letter as well as the request for reimbursement for the months not worked. She did not show where a check has been issued yet. Will look into it and get back with us. o 11/3/15-S/W Tina at Massey in New Smyrna Beach. She verified they are processing a refund to our account. She related once paperwork is done and sent to their corporate office it takes 4-6 weeks to issue a check. She estimated that we should have a check by beginning of December. o 12/10/15 Refund check in the amount of $2, was received. CABANA 11/20/15 New light sensor was installed by mailboxes and burnt out lights in cabana were changed. Vendor: Tom Becker 12/7/15 Women s toilet repaired. Ted Lewis stated that the situation will be assessed when the roofs are evaluated by the roofing contractor. Another owner reported that he has witnessed positive changes in the last year as he is not a full time resident. He also requested that electronic payments be an option for payment to the management company. An owner asked if the sidewalks might fall under the City of New Smyrna Beach rather than the Association s responsibility. The Board will check with the City. Discussion followed on the fees charged by the golf course and any upcoming increases which we can expect from the golf course. Ted Lewis stated that the fees are based on a formula tied to CPI with a clause for increases, however, he does not know of pending increases. The fees charged are mutually beneficial to both the course and our owner s whose units abut the course. Alyssa will check on the pool lights which are not coming on at dark. A question was raised about the stucco repairs. Ted Lewis stated that the documents do state the Association, not the individual owner, is responsible for the repairs although previous Board of Directors might have interpreted differently.
