1 MINUTES PLANNING & SUBDIVISIONS COMMITTEE OCTOBER 25, 1984 Aubrey Glass - Chairman \Vayne Lippert George Hankin Rick Conway Patricia Malone - DELEGATIONS - Mr. Don Hare attended the meeting, discussing with the Committee his proposal for a motel and restaurant development on Part of Lot 24, Concession 7, Macaulay \Vard. The property fronts on Highway lill? and contains approximately 15 acres. Mr. Hare plans a 12 unit motel, plus a restaurant to seat eighty people, and his residence would be on the property also. The total area of the building,jould be 7,144 square feet, the motel containing 3,496 square feet, the dining area 1,140 square feet, the kitchen area 1,444 square feet and the residence 1,064 square feet. There is an entrance to serve the property now from Highway #117 and Mr. Hare has discussed his proposal with the Ministry of Transportation and Communications and they would require the entrance be upgraded to accommodate the additional traffic. He has also discussed his proposal with the Ministry of the Environment elho have advised that he would require teio Class "A" systems. He has also investigated the financing for the project and the financing would be available. An amendment to Section 8.13 and 5.49 of the Official Plan elould be required as would also a rezoning to Commercial Tourist. THE COMMITTEE SUGGESTED HE SUBMIT HIS APPLICATION FOR AN AMENDMENT TO THE DISTRICT OFFICIAL PLAN AND, IN DUE COURSE, HIS APPLICATION FOR AN AMENDI~ENT TO THE RESTRICTED AREA BY-LA\v. Mr. Doug Morrison attended the meeting with Mr. Frank Brown of Muskoka Office Supply, to discuss with the Committee Severance Application #B/349/350/84/BR for September Industries on Part of Lot 1, Concession 2, Monck Ward. Mr. Brown has an offer to purchase on part of the land lying east of the \,ellington Street diversion, and containing the old farm house and what was originally the old dairy. Mr. Brown plans to demolish the old farm house and in due course, the old dairy, which now contains two apartments, and build a building fcr Muskoka Office Supply on the site. The westerly portion of the property Mr. Richard vjallace of Hallace Real Estate would like to purchase and build a real estate office there. Mr. Brol,Jn would like to eliminate the existing entrance at the bottom of Monck Hill and construct a neel entrance either from Highway or off the former ldellington Street. The COffiilli ttee asked Mr. Morrison if these severances were granted, if there were any plans for the balance of the property. Mr. Morrison felt that some type of multiple housing might be planned for the balance of that corner. OCTOBER 25/84 PAGE 1

2 MR. MORRISON WAS ADVISED THE COMMITTEE I'JOULD LIKE TO SEE SOME TYPE OF PLAN FOR THAT TOTAL PIECE OF PROPERTY, RATHER THAN JUST THE FRONT SECTION. MR. MORRISON IS TO HAVE A PLAN READY FOR OUR NEXT MEETING. Mr. N.B. Roche attended the meeting to present to the Committee a coloured conceptual drawing of the finished apartment building proposed by Ontario Limited in their application for rezoning for Lots 21 and 23 on Plan 23, Bracebridge vlard. The drawing sho,)ed what the finished building would look like and a further dra,)ing advised the Committee of the interior layout of the building. Mr. Roche was asked if they intended to renovate the two top apartments at this time and he advised that they could do that but he would prefer to renovate the entire building at one time as it would be probably a little less costly and would be a better job if they could 'JOrk on the total building at the same time. He also advised the Committee that a small manufacturing business ltjould be ready to move into the lower part of the building in about two weeks. The Committee suggested the drawings and a floor layout should be presented at the next Council meeting and those who objected to the proposal at the public meeting should be in attendance. SEE ITEM NO CORRESPONDENCE - Muskoka Land Division Committee requesting to be advised as to whether or not we had changed our policy on requesting a lot levy on developed lots. In 1983, they were advised that we would be requesting a lot levy on lots created that were not developed but would not be requesting a lot levy on lots created which had been developed. They noted in recent months the lot levy is being requested on developed lots as well as on undeveloped lots. They would like to have their information accurate in order to pass it on to applicants. A COPY OF BY-LAlli NO PLUS A COPY OF THE LETTER TO LAND DIVISION COMMITTEE IS TO BE PROVIDED FOR OUR ~IEETING OF NOVEMBER 6/84. Mr. S. Kelly requesting to be advised of the status of the application for rezoning for Ontario Limited on Lot 34, Plan 2, north-east Manitoba Street. All of the required information has been received. SEE ITEM NO Ontario Municipal Board advising that Land Divison Committee File #B/137/84/BR, Brimarkin Enterprises Ltd., the application having been withdrawn, the Board orders the application is hereby dismissed. 3 District Municipality of Muskoka advising that File #44CDM-84001, Ontario Limited, had been granted Draft Approval, subject to conditions and amendments as attached. Within thirty days of the date of the letter, being October 9th, 1984, a copy of the plan will be date stamped, signed and forwarded to us. Muskoka Land Division Committee advising that thirteen files had been endorsed with consent during the month of September, five in Muskoka, one in Monck, four in Bracebridge and three in Draper. ACIION: Ontario Municipal Board, a copy of a Notice of Decision on the appeal of Mary Ann Kelly against the decision of Muskoka Land Division Committee for File #B/264/81/BR. The Board orders the appeal of Mary Ann Kelly is hereby allowed. Committee of Adjustment, four Notices of Public Hearing: Ontario Limited on part of Block "B", Plan 8, south side of Muskoka River in Bracebridge Ward. The applicant proposes to put an addition on the rear of the building 3.96 metres wide, leaving a rear yard of 4.72 metres. A variance of 3.35 metres as to the rear yard setback is being requested. 2. Roland and Agatha Filzmaier on part of Lots 8 and 9, Conc. 13, Muskoka Ward. A Rural Residential lot is required to have frontage of metres. The Filzmaier lot has frontage of metres. A variance of 8.70 metres as to frontage is requested. The hearing date on both applications is November 1st, 1984, at 7:30 p.m. 3. James H. Boyes with respect to Lot 10, Plan 3, McMurray Street, Bracebridge Ward. The applicant proposes a garage in the rear yard with a setback of.61 metres from the south side yard lot line. A variance of 1.22 metres as to the south side yard setback is requested. 4. Judith A. Blay on part of Lot 29, Conc. 6, Draper Ward. A lot in a residential zone is required to have frontage of metres and an area of.4 hectares. The proposed lots have a frontage of 30 metres & an area of.31 hectares. A variance of metres as to frontage and.09 hectares as to area is requested, on one proposed lot and a variance of metres as to frontage and.12 hectares in area on the second proposed lot. 4 Ministry of Natural Resources, a news release regarding changes to Provincial Flood Protection Criteria. The Ministry of the Environment enclosing Notice 4/84 regarding fees under Section 71, Part 7 of the Environmental Protection Act. District Municipality of Muskoka advising that Subdivison File No. 44T-83001, Bracebridge Industrial Park, had been registered in the Land Registry Office as Registered Plan No. 35M-578. District Municipality of Muskoka advising that Condominium File 1144CDM-83001, Riverwoods, had been registered in the Land Registry Office under l"luskoka Condominium Plan No.6. SEE ITEM NO Mr. Sean Kelly confirming that the fourteen foot easement shown on the Site Plan for Ontario Limited on Lot 34, on Manitoba Street,,,,as an easement for sewer drains and water pipes and that his client, Mr. Josef Gleich, had arranged to purchase a strip of property 15' by 14' from Janet Vlhalen in order to have access to the Municipal Parking Lot on James Street. The transaction is conditional upon the rezoning of Mr. Gleich's property. SEE ITEM NO Building Inspector Randy Gardner discussed with the Committee a proposal by Mr. Larry Giaschi for renovation of his property on Kimberley Avenue for office space. The property is presently being used for apartments. A SITE PLAN AND A SITE PLAN AGREEMENT VlITH MR. GIASCHI VlOULD BE REQUIRED. THE SITE PLAN SHOULD SHOVI THE PARKING AREA EITHER PAVED OR MADE OF COMPACTED LIMESTONE. The application is DEFERRED until our meeting of Nov. 6th, 1984, in order to permit September Industries to provide us with an overall plan for the entire property. B/312/84/BR - Donald J. HcVittie BIl85/84/BR - James BOI"ers B/353/84/BR - Elwin & Patricia Stephenson a part of Lots 115 and 116 on Plan 517, Muskoka Ward. The retained property would have frontage on Lake Huskoka and the severed would have frontage on Al port Bay. Both severed and retained would comply with the Restricted Area By-Law. APPROVED subject to the Standard Municipal Agreement on the severed parcel. Part of Lot 12 on Concession 3, Monck Ward, into two parcels. Both parcels would comply with the Monck Restricted Area By-law. The application was APPROVED subject to the Standard 1'lunicipal Agreement on the severed parcel. The application is to sever approximately the back 38 acres of Lot 32, Conc. 1 and add it to the property immediately to the east on the same lot. The application was APPROVED. 6 B/362/363/ 84/BR - Boyes Construction Ltd. a part of Lots 16, 17, 18 and 19, Conc. 10, and a part of Lot 20, Cone. 11, from Lot 20, Conc. 11, Lot 17, Cone. 11 and a part of Lot 16, Conc. 10. One of the retained parcels would be served by an old log road but Lot 20, Conc. 11, would have only water access after the severances. The applications were DEFERRED to November 6th, 1984, in order to let the Building Inspectors obtain more information on the application. B/3l5/83/BR - Frank, Lloyd, Cecil and Clarence Moore a part of Lot 3, Cone. 10, Macaulay \'iard. Included in the application is a lot shown as the T'Church'! lot on the old Plan 1 for Falkenburg. This lot is, in fact, an old cemetery presently under the care and jurisdiction of the Bracebridge Cemetery Board. The application was APPROVED subject to the lot shown as the "Church" lot being deeded to the Town of Bracebridge. Should an up to date survey show that the remaining property is short in frontage, the application would still be APPROVED subject to a minor variance. The Standard Municipal Agreement would be required on the severed parcel. REZONINGS: Daniel Morgan requesting a change in zoning from M2 for 6,000 square feet at the 532 Industrial Mall in order for one unit in the mall to be used for the holding of bingo games. ACTTON: THE COMMITTEE REQUESTED THAT MR. DANIEL MORGAN BE REQUESTED TO ATTEND OUR NEXT COMMITTEE MEETING TO EXPLAIN EXACTLY WHAT THE APPLICATION IS ABOUT. OCTOBER 25/84 PAGE 6

A registerable description of the severed lot be submitted to the Secretary-Treasurer along with a registered copy of the reference plan. 2. Itemll 874: Ontario Limited Rezoning The Committee recommend the people who were in attendance at the public meeting be notified that plans will be presented at the next Council meeting and Mr. Roche will attend the meeting to present the plans. REPEAT. Item : Gleich Rezoning - Manitoba Street All the required plans and information have now been filed. A resolution will be presented at the next Council meeting to proceed with a Site Plan Agreement.
