2 offered the following resolution, seconded by WHEREAS, N.J.S.A. 40A: 4-58 provides that transfers may be made between appropriations during the last two months of the fiscal year, and WHEREAS, N.J.S.A. 40A: 4-59 provides that transfers may be made between appropriations during the first three months of the subsequent fiscal year, and WHEREAS, the Council of the Township of Howell has determined that such transfer is prudent and necessary; NOW, THEREFORE, BE IT RESOLVED by the Council of the Township of Howell (not less the two-thirds of.the full Council voting in the affirmative) that the transfers in the amounts and totals listed on the attached sheet be made in the Appropriations. Box 580 Howell, NJ Fax No. (732) Township of Howell Resolution No. R WHEREAS, the New Jersey Department of Transportation (NJDOT) recently completed a traffic investigation on Route 33 in Howell Township; and WHEREAS, NJDOT recommends a revision to the centerline pavement markings on Route 33 to create a "No Passing Zone" in the vicinity of M.P (East San Marco Boulevard) for safety reasons; and WHEREAS, this project will create safer driving conditions in this area of Route 33; NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Howell, County of Monrnouth, in the State of New Jersey, that it supports the use of a "No Passing Zone" on Route 33 in Howell Township as recommended by NJDOT. 12 Mr. seconded by Mr R-I offered the following resolution for adoption: RESOLUTION WHEREAS, there are small tax and sewer balances and credits outstanding for 201 3, which are economically unfeasible to collect or refund: NOW THEREFORE, BE IT RESOLVED by the Township Council of the Township of Howell that the Tax Collector and Utility Department are hereby authorized to cancel 2013 balances and credits of less than $5.00 (FIVE DOLLARS) except where total levied taxes or sewer fees per quarter are less than said amount. 18 Mr-(s) offered the following Resolution for adoption seconded by Mr. (s) Resolution No. R A RESOULTION OF THE TOWNSHIP OF HOWELL AUTHORIZING A PAYMENT PLAN FOR A SEWER UTILITY CUSTOMER WHEREAS, Michael Feldman, 2 Alec Drive, Howell, NJ , Lot 62, Block Qualifier C 1,000 is in arrears with respect to Sewer Utility charges and WHEREAS, the property owner and Township officials have negotiated a payment plan to assist in satisfying this municipal charge and both parties are desirous of resolving the matter amicably; and WHEREAS, the arrears are subject to Tax Title Lien sale; and NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the Township of Howell as follows: 1. Douglas Hoglund is hereby granted the request for release of the aforesaid Guarantee in accordance with the letter of recommendation aforesaid. 2. The developer submitted Check Number 2564 ($950.98) when added to the 10% cash portion of the guarantee ($1,901.94) equals the maintenance guarantee ($2,852.92). The Township hereby accepts this CASH maintenance guarantee

Resolution No. R A RESOLUTION OF THE TOWNSHIP OF HOWELL AUTHORIZING THE SALE OF SURPLUS PERSONAL PROPERTY NO LONGER NEEDED FOR PUBLIC USE ON AN ONLINE AUCTION WEBSITE WHEREAS, the Township of Howell has determined that the property described on Schedule A attached hereto and incorporated herein is no longer needed for public use; and WHEREAS, these items include vehicles and miscellaneous equipment for which it would be difficult to establish a fair market value prior to advertisement and public sale, and WHEREAS, the State of New Jersey, Department of Community Affairs has authorized and approved the on-line sale of surplus property which will comply with N.J.S.A. 40A:14-157; and, WHEREAS, the Local Unit Technology Pilot Program and Study Act (P.L. 2001, c. 30) authorizes the sale of surplus personal property no longer needed for public use through the use of an online action service; and WHEREAS, it is the desire of the Township Council of the Township of Howell to use USGovBid (Auction Liquidation Services), located at USGovBid.com to conduct the auctions, which company has been approved by the Department of Community Affairs; WHEREAS, the sales are being conducted pursuant to the Division of Local Government Services' Local Finance Notice ; WHEREAS, the Township of Howell has contracted with USGovBids (Auction Liquidation Services), located at USGovBid.com to bring surplus vehicle(s) and miscellaneous equipment to auction on Saturday, December 7, 2013 at 9:00 AM and close on Monday, December 16, 2013 at 7:00 PM and that the terms and conditions of the agreement entered into with the vendor are available on the vendor's website and available in the Township Clerk's Office; Vehicles and Equipment may be viewed on Friday, December 6,2013 from 9:00 AM to 2:00 PM at the Department of Public Works, 300 Old Tavern Road, Howell Township, New Jersey or online at NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Howell, County of Monmouth, State of New Jersey as follows: 1. The Township of Howell is authorized to dispose of surplus vehicle(s) and miscellaneous equipment through the process of public auction; and

62 2. The Public Works Department is hereby authorized to forward the attached list of surplus vehicle(s) and miscellaneous equipment to USGovBid.com, for an on-line auction. 3. That notice of the sale shall be published at least once in a newspaper circulating in the Township of Howell not less than 7 or more than 14 days prior to the sale. 4.
