3 City of Park Ridge AGREEMENT FOR TRAFFIC ENFORCEMENT ON PRIVATE PARKING AREAS AN STREETS 1. Pursuant to Chapter 625 of the lllinois Compiied Statutes, Act 5, Section 11, Article 209, the City of Park Ridge, a municipal corporation, hereby enters into the following agreement with PAR.lf J?lGE 2004LLC~. the legal owner of a private parking area or street located at 225 W. TOUHY AVE, in the City of Park Ridge, lllinois, and further described in Attachment A hereto. Real Estate Pin # J00.,037-00QO 2. Restrictions, regulations and controls on vehicular arid pedestrian movement and parking are hereby established on the subject property as described in and shown in attachment A hereto. As provided by law, authorized personnel of the City of Park Ridge may issue citations to any person found violating any such restrictions. Any fines collected shall be deposited to the City's, General Fund. 3. At the request of the property owner or his agent, the City may, but need not, remove and store or cause the removal and storage of any vehicle found violating the restrictions established in this agreement; any costs shall be paid by the property owner or the owner of the vehicle. 4. No restriction or regulation established by this agreement shall be effective unless the owner of the subject property has installed the proper and adequate signs or other control devices advising of such regulations and restrictions. The cost and maintenance of such signs or other control devices shall be the responsibility of the owner. 5. With the approval of the property owner or his agent, the City may, on its own initiative, immobilize (Boot) and tow any vehicle found on the subject property which is listed on the Police epartment "Boot List" for unpaid parking and licensing tickets. The property owner shall not be responsible for any towing costs in such cases. 6. The undertaking by the City of Park Ridge to enforce traffic regulations on the subject property shall not be construed to be a guarantee by the City that there shall be enforcement action taken in any particular case. The City shall utilize its best efforts to enforce these restrictions consistent with its other responsibilities and functions. 7. The owner of the suqject property shall indemnify and hold hannless the City of Park Ridge from any liability or loss resulting from the performance of this agreement.
4 8. The owner shall pay the City of Park Ridge a fee of$.0.00 per year to compensate for the cost of planning and enforcement of these regulations. The fee may be increased upon sixty (60) days notice to the owner~ whenever the City Council detennines that an increase is necessary to reasonably compensate the City for enforcement activities. 9. This agreement shall be effective upon its approval by the corporate authorities of the City ofpark Ridge and its recording with the Recorder of eeds of Cook County as required by law. 10. This Agreement shall terminate five years after the effective date hereof, or upon thirty (30) days notice by either party, whichever occurs first. ate Approved by Council
