Conforms to the Intent of the Official Plan The subject lands are located within the Agricultural designation In accordance with Schedule" A" Land Use Plan to the Municipality of Central Elgin Official Plan. 3 The Consent policies of the Official Plan provide that In addition to the specific land division and/ or consent policies associated with the applicable land use designation a consent for technical or legal purposes, such as a boundary adjustment, easement or right- of-way is permitted. The lots that are the subject of the application and any retained lands will comply with the zoning by- law, or the consent will be conditional on a successful zoning by-law amendment or minor variance. The proposed variances may be considered to be in conformity with the general intent of the Official Plan. 2. Conforms to the Intent of the Zoning By- Law The subject lands are located within the Open Space Zone 1( OS1) of the Township of Yarmouth Zoning By- Law o. 1998, as amended. Permitted uses of the Open Space Zone 1( OS1) include farm uses, rural- residential uses, institutional uses, home occupations and accessory uses. The proposed variances may be considered to be in conformity with the general intent of the Zoning By-Law, 3. Desirable for the Appropriate Development of the Land The applicant has filed a consent application( E84/ 17) concurrently with the Elgin County Land Division Committee for a lot addition. The applicant has submitted the subject application to bring the deficient setbacks for the residential dwelling and frame building that are located on the retained lot into conformity with the Zoning By-law. The proposed variances may be considered desirable for the appropriate development of the subject lands. 4. Minor in ature The assessment of whether a variance is or is not minor does not necessarily relate simply to the measured differences between what the Zoning By- Law permits and what the applicant is requesting. S. O. 1990, as amended, the Council of the Corporation of the Municipality of Central Elgin will hold a Public Meeting on the 18' day of December, 2017, at 7: 20 P.M. in the Council Chambers of the County Administration Building, located at 450 Sunset Drive, St. Thomas to consider an amendment to the Township of Yarmouth Zoning By -Law The purpose of the Public Meeting is to afford any person that attends an opportunity to make representation with respect to the Zoning Proposal. The subject lands, which are located at the southeast corner of the intersection of Truman Line and Yarmouth Centre Road, have approximately 600 metres of frontage on Truman Line and are approximately hectares ( 67 acres) in lot area ( see Location Plan). Municipally known as Truman Line, they may be legally described as being Part of Lot 13, Concession 12, geographic Township of Yarmouth, now Municipality of Central Elgin. The applicant is proposing a temporary zoning by-law for a period of 20 years to allow the existing house to remain on the property as a " garden suite". The applicant is proposing to construct a new house on the subject lands and use the existing home as the garden suite for family members. The applicants have stated that they will remove the existing house from the property when it is no longer required. The subject lands are located within the Open Space Zone 1 ( OS 1) of the Township of Yarmouth Zoning By-law o. 1998, as amended. The OS 1 zone permits farm uses, rural -residential use, institutional use, home occupations and accessory uses. A zoning by-law amendment is required in order to permit the existing house to be used as a garden suite as a temporary use for a period not to exceed twenty years, pursuant to Section 39. 1( 3) of the Planning Act, R.S. O. 1990, as amended. AY PERSO OR PUBLIC BODY may attend the Public Meeting and/ or make written or verbal representation either in support of, or in opposition to the proposed Zoning By-law Amendment. If a person or public body does not make oral submissions at a public meeting or make written submissions to the Municipality of Central Elgin before the by- law is passed, the person or public body is not entitled to appeal the decision of the Municipality of Central Elgin to the Ontario Municipal Board. If a person or public body does not make oral submissions at a public meeting, or make written submissions to the Municipality of Central before the by- law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so.
