8 Qualified Person s Statements and Certifications As the qualified person, I certify that: A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. As of 2014/05/07, no phase two environmental site assessment is required by the regulation for the RSC property and based on the phase one environmental site assessment for the RSC property, in my opinion, it is not necessary for any other reason to conduct a phase two environmental site assessment for the RSC property. As of 2014/05/07, in my opinion, based on the phase one environmental site assessment, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that, if the RSC property were put to any of the types of property uses listed in subsection 1 (2) of the regulation, are likely to interfere with any of those types of property uses. I am a qualified person and have the qualifications required by section 5 of the regulation. I have in place an insurance policy that satisfies the requirements of section 7 of the regulation. I acknowledge that the RSC will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry. The opinions expressed in this RSC are engineering or scientific opinions made in accordance with generally accepted principles and practices as recognized by members of the environmental engineering or science profession or discipline practising at the same time and in the same or similar location. 20 PHASE ONE CONCEPTUAL SITE MODEL Discussion of the Conceptual Site Model (CSM) Drawings of the Phase One Study Area LVM Merlex Ltd. was retained to undertake a Phase One Environmental Site Assessment (ESA) for the entire property located at 1245 Village Road, Astorville, Ontario (the Site, Subject Site, or Property). The Site represents both the Phase One property and the Record of Site Condition (RSC) property. LVM Merlex Ltd. has created figures to help in understanding the current and historical conditions of the Subject Site and surrounding properties within 250 meters of the Site. These drawings make up the Conceptual Site Model (CSM) and are discussed below. I. A permanent washroom structure is located at the Subject Site. The Site supports a baseball field, tennis court, playground and associated parking areas. Select areas of the Site are forested. II. III. Adjacent properties support a mixed Community/Commercial Use arena and public library to the south of the Site, as well as a municipal volunteer fire hall to the west of the Site (see Drawing No. 5). Property abutting to the northwest and east is forested and wetlands. A few residential structures surround the Property. No areas of natural significance or water bodies are located wholly or partly within 250 m of the Subject Site, based on available information. A ditch with running water is present running along the west boundary of the Site. Some wetlands are present in the northeast corner of the Site and to the east of the Site. The wetlands eventually drain into Lake Nosbonsing located approximately 300 m to the east. IV. Drinking water wells are detailed in the ERIS report and locations are shown on Drawing No. s 4 and 5. V. Roadways within 250 m of the Site are labelled on Drawing No. 4. VI. VII. VIII. IX. Property uses are detailed on Drawing No. 4 and include a mix of vacant forestry, community use, commercial use, and residential use areas. No Potentially Contaminating Activities (PCAs) were identified on-site. Off-Site Potentially Contaminating Activities and accompanying Areas of Potential Environmental Concern (APECs), and storage tanks (UST or AST), within the Phase One Study Area are shown on Drawing No. s 4 and 5 and are discussed below. Areas of Potential Environmental Concern are not depicted on any drawings as the off-site PCAs/APECs identified were not considered to affect the Subject Site, as discussed below. In conclusion, LVM Merlex Ltd. is of the opinion that there are no PCAs located on the Phase One Site or in the Phase One Study Area that would result in an APEC at the Site. It should be noted that it is possible that PCAs, APECs, and/or previous land uses have not been identified during this Phase I ESA investigation. Information was gathered from a number of different sources, decreasing the chances that a PCA, APEC, and/or previous land use was not identified during this investigation. Historical and current information provided verbally was considered to be accurate unless otherwise contradicted by factual information. No current or historical PCAs were identified on Site. The PCAs identified at properties adjacent to the Subject Site did not result in APECs at the Phase One Property, as discussed in the following. The concerns present on the volunteer fire hall site present a low risk to the Subject Site due to its lower elevation compared to the majority of the Subject Site. The topography in the area of the fire hall is sloped downwards to the northwest, and is heavily bedrock controlled. Furthermore, the water in the ditch along the west boundary of the Subject Site exits the Site onto the fire hall property before leaving the fire hall property and crossing beneath Village Road, continuing northwest. The anticipated groundwater direction flow is towards the northwest in the area of the fire hall. Therefore, if any spills or potentially contaminating incidents occur at the fire hall, they should migrate away from the Subject Site. 13/08/13138-R3 PHASE ONE CONCEPTUAL SITE MODEL 1245 VILLAGE ROAD, ASTORVILLE, ONTARIO 5

25 The tank associated with the volunteer fire hall is located within the fire hall with vent and fill pipes leading to the building s exterior. The installation year of the tank could not be identified however, the tank appeared to be in good condition. The environmental risk associated with this tank is considered to be low as it is located indoors on a concrete slab and there is no visible staining. Minor cracking was present on the floor of the fire hall. It is reported that only minor repair operations to vehicles are carried out at the volunteer fire hall and that all major vehicular maintenance requirements are done off-site. Operations at the fire hall are not considered to result in an APEC on the Phase One Property. During the walkthrough, red-orange water was identified to be flowing from a property to the south. The ditch that runs along the east side of Village Road originates opposite Village Road and to the southwest of the Site. The ditch with the red-orange water is smaller, and joins the other ditch just to the south of the Site before it enters the property to the south of the Site at the southwest corner. The ditch with the red-orange water also had a visible sheen however the sheen was blue and flaky, typical of an organic sheen. There were no petroleum hydrocarbon odours detected and the water did not have a greasy feel. When the smaller ditch joined the larger ditch the sheen and red-orange characteristics of the water were diluted and no longer visible. There is no evidence to suggest that historical metal contamination is present on the Subject Site. It is possible that the red-orange water is a result of naturally occurring iron and iron bacteria. Therefore, the red-orange water observed in the ditch to the southwest of the Site does not present an APEC. According to title search records, Supertest Petroleum and BP Canada Ltd. leased portion of the Property until As noted, according to Mr. Denis Perron, owner of the gas station formerly present to the northwest of the Site from 1981, the station was a Supertest station. This former fueling station is located within the Phase One Study Area but does not abut the Phase One Property. It is anticipated that, based on local topography, the site of the former gas station is down gradient from the Phase One Property. Furthermore, Mr. Perron, a local to Astorville, does not recall any other gasoline service stations present on or near the Subject Site. Therefore, either the title search records overlap with the gas station property, or the gas station did lease a portion of the Subject Site, but did not use it for anything. The former presence of the gas station immediately to the northwest of the Site presents a low environmental risk due to the steep sloping of the area downward to the west, and the anticipated direction of groundwater flow to the north. As such, the PCAs which may have been present historically in this location have not resulted in an APEC at the Subject Site. TSSA records indicate that historically there was an underground storage tank (UST) at the area of the arena, off-site, that resulted in a fuel oil spill. A letter record provided by Knight Piesold indicates that the UST removal and fuel oil spill clean-up were successful and the spill was fully remediated. As such, this event does not pose an APEC to the Subject Site. Several current and historical potentially contaminating activities (PCAs) were identified on surrounding properties but did not result in areas of potential environmental concern (APECs) at the Subject Site. 26 storage tank (AST) containing furnace oil used for heating their respective buildings. No leaks or spills have been reported from any of the tanks however, their presence is still considered to be an environmental risk. The AST behind the arena was installed in 2003 and is supported on top of a concrete pad. Due to the relative recent installation date, and precautionary measures in place, the environmental risk associated with this tank is considered to be low. The AST in the library is located within the basement of the library with vent and fill pipes leading to outside. No date of installation could be identified however, the library was constructed in Due to the relatively recent installation date and the fact that the tank is located indoors with no signs of staining beneath it, this tank is considered to be a low environmental risk. These fuel storage operations do not result in APECS on the Phase One Property. Minor quantities of fuel and oils are kept in the garage at the arena however, the products are kept sealed in their original containers and are all stored neatly in a protective metal shelving unit. It is reported that only minor operations are carried out at the arena (such as oil changes) and that equipment is brought off-site for maintenance. Furthermore, the concrete floor in the garage and in the Zamboni room is in good condition with no cracking and no signs of staining. Each room also has a drain connected to an oil/water separator to collect any minor spills in either garage (the two rooms are beside each other and connected to the same oil/water separator). Current operations at the arena garage and Zamboni room present low environmental risk and do not result in APECS on the Phase One Property. The operation of the cooling system within the arena was also considered. The operation involves the use of ammonia, calcium chloride brine, glycols, and oil, all within a closed system. This system is relatively new as well (implemented in 2011) and therefore, the risk of a potentially contaminating incident to have occurred is low. However, several pails were present within the compressor room. Most of the pails were empty, however others had waste oil from the compressor in them and several were open. Staining was present on the floor within the compressor room and cracks between floor slabs were present. The compressor room has a floor drain, however its course is not known. Chemicals within the cooling system need to be replaced routinely, although reportedly not often. It is reported that contractors are hired to carry out these operations. During recent renovations, soil in this area was excavated and is now present to the east of the arena as a pile of fill. No signs of staining or odour were reported during the excavation or on the current surface of the pile during the Site walkthrough. As such, this activity is not considered to pose a significant environmental risk to the Subject Site. It should be noted that no intrusive investigation of the fill was carried out (i.e. no digging was carried out). During the site walkthrough several areas were observed to be supporting improperly disposed materials. A tire was present along the forest line to the north of the baseball diamond; several areas along the slope at the east property line were found to contain metal, plastics, and rubber among other inert fill (bricks, rock, concrete); and an old, rusted body of a car is present in the forest to the east of the library. These materials should be collected and properly disposed of off-site. 27 Based on a review of historical environmental reports, an EcoLog Environmental Risk Information Service (ERIS) database search, chain of title searches, City directories, aerial photographs, Fire Insurance Plans (FIPs), interviews, and a Site reconnaissance, no current or historical PCAs were identified at the Site, and PCAs identified at surrounding properties did not result in areas of environmental concern (APECs) on the Phase One Property. II. Potential for Underground Utilities to affect Contaminant Distribution and Transport All of the municipal addresses within 250 m of the Site are currently connected to overhead utilities (at least one) and are serviced by septic systems and water wells. Based on the suspected depth of the buried services, the corridors created by the services may act as channels of faster groundwater flow. III. Regional and Site Specific Geological and Hydrogeographical Information Based on available information obtained from a North Ontario Engineering Geology Terrain Study (NOEGTS) map, the surficial geology on the Site consists of a veneer of glaciolacustrine plains, comprised of sandy silts, overlying bedrock knobs. The topographic variety of the dominant landform is considered to be knobby and hummocky as well as undulating to rolling. Local relief is considered to be low and drainage is dry. The northeast corner of the Site (in the wetlands) has different surficial geology. It consists of bedrock knobs as the dominant landform with ground moraine comprised of till and organic terrain comprised of peat and muck as the subordinate landforms. The topographic variety of the dominant landform is considered to be undulating to rolling. Local relief is considered to be moderate and drainage of the dominant landform is dry. The drainage of the subordinate landforms is mixed wet and dry. Based on a Geological Highway Map of Northern Ontario, the bedrock in the area is considered to be from the late to middle Precambrian Era and is comprised of clastic metasediments, including conglomerate, greywacke, arkose, calcareous, sandstone, siltstone, shale, derived metamorphic rocks, and iron formation. The topography across the Subject Site slopes to the north and is split between a westerly direction and an easterly direction. The majority of the Site is sloped to the north and slightly to the west. Runoff is expected to join a stream flowing north along the west Site boundary, which eventually flows west and joins the Wasi River. The eastern limits of the Site are steeply sloped to the northeast and therefore runoff here is expected to flow into the wetlands and then into Lake Nosbonsing to the east. The topography of the surrounding area is generally undulating with hills and ridges throughout. Astorville is split between two sub-basins meaning that part of it is located in one watershed draining into the Ottawa River and St. Lawrence River, while the rest drains into Lake Nipissing and the Great Lakes, before joining the St. Lawrence River. The Subject Site is also split between these two sub-basins. Subsurface conditions at the Subject Site currently consist predominantly of sands overlying native silts and sands. Conclusions and Validity of the Conceptual Site Model Based on the findings of this Phase I ESA investigation, no Potentially Contaminating Activities (PCAs) were identified on the Subject Site. Potentially Contaminating Activities have been identified off-site that did not result in areas of potential environmental concern (APECs) to the Phase One Property. The potential environmental risk associated with all of the identified potentially contaminating activities off-site is considered to be low due to a combination of the low risk nature of the operations, good housekeeping practices, absence of known historical environmental incidents, as well as the Site topography, as detailed herein.
