Daniels, 2477 Skyview Circle, Fairfield, CA REQUEST: A request for a Time Extension to a portion of a previously approved project, Z4027, to extend the time allowed for a Preservation Site Plan and Design Review with deviations approval to construct a proposed singleunit dwelling, on a recently subdivided lot, on approximately 0.05 acres in the in the Residential Office Zone, within the Central City Special Planning District (ROSPD). ANALYSS: The subject site is a small vacant lot that is located on the north side of W Street, north of 3rd Street, northeast of the nterstate 5 and Highway 50 (Business 80) interchange, within the Central City and in the South Side Historic District. W Street was rerouted on this block in the 960 s to accommodate the freeway development. Until recently this lot was part of the adjacent lot to the north. t was through lot with that had street frontage on both V and W Streets. The lot to the north contains a duplex at 34 V Street which was originally constructed as a singleunit dwelling prior to the 930 s. 34 V Street is not an individual historic landmark structure of the historic district. n 204, an application was submitted to subdivide the former through lot into two lots and also to construct a new singleunit dwelling on the new W Street lot (Z4027). This project required a Tentative Parcel Map to divide one lot into two lots, Preservation Site Plan & Design Review for the V Street lot with the existing duplex and Preservation Site Plan & Design Review for the proposed new home on the W Street lot. The Site Plan & Design Review process for the lots reviewed conformance with development standards, such as lot size requirements and setbacks and lot coverage for existing and proposed structures on the new lots, as well as design review of proposed new structures. The lots proposed at the time were small, but they conformed to all requirements of the RO zone including the minimum 2,000 square foot lot size. The existing V Street duplex conformed to maximum lot coverage (60%) the minimum rear yard setback requirement (5 PB803 Page of 3

2 300 Richards Boulevard, Sacramento, CA 958 feet) from the new rear property line. No deviations were required for the existing duplex on the north lot. The proposed new home on the proposed south lot conformed to lot coverage but it did not meet required rear yard (5 feet) setback or the required west (left) side yard (5 feet) setback. The proposed home on the W Street lot required deviations for the requested setback reductions. On May 2, 205, a public hearing was held for Z4027, the Zoning Administrator approved with conditions the Tentative Parcel Map to divide one lot into two lots, and the Preservation Director Approved Preservation Site Plan and Design Review for the existing duplex on the proposed north lot and Preservation Site Plan and Design Review with deviations for a new home on the south lot. The project approval was valid for three years from the hearing date. The applicant was required to both finalize the tentative map and also to be issued a building permit for the new home on W Street, by May 2, 208. The tentative parcel map was finalized with the Public Works Department on December, 207 (FPM60055). The lots were created with the existing duplex on the north lot and a vacant south lot. All entitlements relating to the parcel map and existing duplex are considered activated. No extension of time is needed for these items. However, there has not yet been a submittal for a building permit for the proposed new home on the W Street lot, so a time extension entitlement for the proposed new home project is required to continue with development. The applicant requests additional time for the expiration of the Site Plan & Design Review entitlement to submit for a building permit to construct the new home. The applicant submitted for a requested time extension prior to the May 2, 208, expiration date. Staff has reviewed the Site Plan and Design Review time extension request. Staff has determined that the granting of this Site Plan and Design Review time extension is an appropriate request based on findings of fact and subject to conditions of approval. Staff has determined that the time extension request can be granted for a period of two additional years until May 2, ENVRONMENTAL: Exempt per CEQA Guidelines, Section 5332; lnfill Development Projects. The project is consistent with the Secretary of the nterior s Rehabilitation Standards and the goals and policies of the Planning & Development Code in that the new home on the proposed lot was found at the time of original approval to be in compliance with the Central City design guidelines and compatible with the South Side historic district. This approval merely extends the timeline to begin construction of the new home; PB803 Page 2 of 3

3 300 Richards Boulevard, Sacramento, CA The proposed project is also generally consistent with the General Plan including General Plan policy HCR 2.., Compatibility with Historic Context, with appropriate scale, massing, and relationship of the proposed new development to surrounding historic resources, and the purpose and intent of the Central City Neighborhood Design Guidelines and development standards; and 3. The local flood management agency has made adequate progress (as defined in California Government Code section 65007) on the construction of a flood protection system that will result in flood protection equal to or greater than the urban level of flood protection in urban or urbanizing areas or the national Federal Emergency Management Agency standard of flood protection in nonurbanized areas for property located within a flood hazard zone, intended to be protected by the system. As evidenced by Resolution , adopted by the city council on June 2, 206, the City has accepted SAFCA s evidence of adequate progress. CONDTONS: Planning and Preservation:. This time extension is valid for two additional years and shall expire on May 2, This time extension is only for the Preservation Site Plan and Design Review for the proposed home on the W Street lot. 3. The proposed project shall comply with all conditions of approval of Z4027. Advisory Notes:. PLANNNG AND PRESERVATON: Conditions of approval for Z4027 include the requirement to flip (mirror image) the house plan before submittal for building permits. 2. PLANNNG AND PRESERVATON: An application to the extend the time to begin construction on the new home can be submitted prior to the May 2, 2020 expiration date. An application for an extension of time is discretionary. Any future time extension applications cannot be granted past May 2, PLANNNG AND PRESERVATON: Any changes from the approved building design and conditions of approval of Z4027 will require an additional Preservation Site Plan and Design Review application and approval. A revised new site plan and design review application does not automatically extend the time of any prior approvals of Z4027, without the specific time extension request and approval.
