PREAMBLE: The Office of Community Planning is in receipt of an application to amend the Town s Zoning By-law , as amended, affecting the property known municipally as 41 Simcoe Road (see Attachment Location Map). 5 DES Recommendation Report Application for Zoning By-law Amendment, Request for Amendment to Cash-in-Lieu of Parking By-law, and Request to Enter into a Cash in Lieu of Parking Agreement Owner/Applicant: Charles and Antoniette Mossman Address: 41 Simcoe Road File No. D , The subject property is located in the Bradford Urban Area and is designated "Residential" in the Town's Official Plan, and it is currently zoned "Residential Two" (R2-1) in the Town's Zoning By-law. The applicant has proposed to rezone the property in order to permit neighbourhood commercial-type uses (e.g., a Personal Service Establishment ), in addition to a residential use. Further, in recognition of the property's limitation in providing sufficient on-site parking to accommodate the proposed commercial use, the applicant has also requested to enter into a cash-in-lieu of parking agreement with the Town as part of directing vehicular traffic for the proposed commercial use to the nearest municipal parking lot(s). The purpose of this report is to provide a recommendation to the Committee of the Whole in regards to the prospective disposition of the subject application, as well as the applicant's request for the subject property to be included in the area subject to the Cash in Lieu of Parking By-law, and to enter into a Cash in Lieu of Parking Agreement with the Town. 3. BASIC DATA PERTAINING TO THE MATTER: Site Details The subject property is located at the southeast corner of the intersection of Simcoe Road and Centre Street. It has a lot frontage along Simcoe Road of approximately metres (36.15 feet), has a lot area of approximately 245 square metres (0.06 acres), and is occupied by an existing two-storey building. Please see Attachment 5.2 to this report for a copy of a Surveyor's Real Property Report. Further to the above, it is noted that: a) a right-of-way exists over the property to the south of the subject property (i.e., 47/49 Simcoe Road), in favour of the subject property; and b) the subject property at 41 Simcoe Road is listed in the Town's Heritage Registry, as referenced in Report DES Proposal The subject property is currently zoned Residential Two (R2-1), and the applicant is proposing to rezone the subject property from the Residential Two (R2-1) Zone, to a Residential Two Exception (R2-1*#) Zone, in order to include permission for a Personal Service Establishment (e.g., laser hair removal and skin resurfacing, vein removal, acne treatments) to be operated on the property by a person who does not reside on the property. In particular, in the approximate 1,200 square foot building (excluding the basement), approximately 36 per cent is to be exclusively devoted to the proposed "Personal Service Establishment" (e.g., client rooms, office), approximately 22 per cent is to be exclusively Page 5 of 53 Recommendation Report Application for Zoning By-law Amendmen...

6 DES Recommendation Report Application for Zoning By-law Amendment, Request for Amendment to Cash-in-Lieu of Parking By-law, and Request to Enter into a Cash in Lieu of Parking Agreement Owner/Applicant: Charles and Antoniette Mossman Address: 41 Simcoe Road File No. D devoted to the proposed Accessory Dwelling (e.g., kitchen, bedroom), and the remaining approximate 42 per cent is proposed to be shared space (e.g., entrance/foyer, living/waiting room, hallways, bathroom). The applicant has acknowledged that the property is unable to accommodate the required onsite parking in order to serve the proposed neighbourhood commercial-type uses (based on Zoning By-law requirements), and as such has requested that the Town s Cash-in-Lieu of Parking by-law (i.e., By-law ) be amended to include the subject property within Schedule A thereof, and that they enter into a cash-in-lieu of parking agreement with the Town in recognition of the non-compliant on-site parking supply. In particular, only two (2) offstreet/on-site parking spaces exist on the property; whereas the proposed conversion of existing floor space would require a total of four (4) parking spaces to serve the development's overall parking requirement. In their submission, the applicant has indicated that the Personal Service Establishment (i.e., the "Bradford Lazer Centre") "has been in operation for seven (7) years and has experienced year over year growth thereby necessitating a move to a larger premises." In this regard, it is noted that the proposed rezoning of 41 Simcoe Road to permit such a use as a Personal Service Establishment represents the growth of the business into a larger space than its prior location. Additionally, it is noted that the applicant's submission indicates that "[approximately] 80% of the business's clientele is derived from neighbouring Bradford residents within biking and walking distance ( 1.0 KM) of the property". Review of Provincial Planning Policies Provincial Policy Statement, 2014 The Provincial Policy Statement, 2014 ("PPS, 2014") guides decisions on development applications in order to achieve appropriate patterns of development and to protect cultural and natural resources. The Planning Act requires that municipal decisions on land use planning matters be consistent with the policies of the PPS, The Bradford Urban Area, within which the subject property is located, is identified as a settlement area under provincial policies, and the PPS, 2014 promotes such settlement areas to be the focus of growth while providing opportunities for intensification that allow land to be used efficiently, with such uses being served by existing infrastructure and facilities. (Policy 1.1.3) The PPS, 2014 also requires that "[land] use patterns within settlement areas... be based on... densities and a mix of land uses [that]... efficiently use land and resources... [and that] a range of uses and opportunities for intensification and redevelopment... be accommodated." 7 DES Recommendation Report Application for Zoning By-law Amendment, Request for Amendment to Cash-in-Lieu of Parking By-law, and Request to Enter into a Cash in Lieu of Parking Agreement Owner/Applicant: Charles and Antoniette Mossman Address: 41 Simcoe Road File No. D The Growth Plan for the Greater Golden Horseshoe (Office Consolidation, 2013) ("Growth Plan") is established as a long-term plan outlining the Province s vision for building complete communities, and is intended to guide decisions relating to population and employment growth in order to, amongst other objectives, optimize the use of existing and future infrastructure. The Places to Grow Act requires that decisions on this form of development conform with the policies of the Growth Plan. The Bradford Urban Area is identified as a "Primary Settlement Area" in the Growth Plan, and the Growth Plan directs such "development" to occur within settlement areas. Lake Simcoe Protection Plan The subject property is located within the watershed of Lake Simcoe and, therefore, the proposed amendment to the Town's Zoning By-law is subject to the provisions of the Lake Simcoe Protection Plan, 2009 ("LSPP"). The LSPP is intended to protect, improve, and restore the ecological health of Lake Simcoe by mitigating adverse impacts on the environment within its watershed and promoting environmentally sustainable development practices. The LSPP regulates such activities as the development of new private and municipal sewage treatment facilities, storm water management, and proposed changes to land uses from what is currently permitted. The Lake Simcoe Protection Act requires that decisions on this form of development conform with the policies of the LSPP. As it relates to the proposed amendment to the Town's Zoning By-law, it is noted that the subject property is not located within an area regulated by the Lake Simcoe Region Conservation Authority ("LSRCA"); however, the LSRCA was circulated on the subject application, from whom comments are summarized below. Review of Municipal Planning Policies and Regulations County of Simcoe Official Plan The subject blocks are located within the Bradford Urban Area in the Town's Official Plan, which is one of many designated "Settlements" in the Simcoe County Official Plan ("SCOP"), dated May 9, Accordingly, the objectives of such "Settlements" include "[to] focus population and employment growth and development [therein]" (Objective 3.5.1), "[to] develop a compact urban form that promotes the efficient use of land and provision of water, sewer, transportation, and other services" (Objective 3.5.2), and its policies include that "[settlement] areas shall be the focus of population and employment growth and their vitality and regeneration shall be promoted... Residential, commercial, industrial... land uses shall be developed within settlement area boundaries..." (Policy 3.5.7). 8 DES Recommendation Report Application for Zoning By-law Amendment, Request for Amendment to Cash-in-Lieu of Parking By-law, and Request to Enter into a Cash in Lieu of Parking Agreement Owner/Applicant: Charles and Antoniette Mossman Address: 41 Simcoe Road File No. D Page 8 of 53 The subject property is located within the Bradford Urban Area and is designated Residential in the Town s 2002 Official Plan. The Residential land use designation permits such uses as a mix of residential densities and dwelling types (Section ), [home] based business and accessory uses that are appropriate to a residential neighbourhood (Section ), and [neighbourhood] commercial facilities (Section ). With respect to providing support for such uses as "neighbourhood commercial facilities", it is noted that applicable policies also note that "[such] facilities will be located with direct access to collector or arterial streets, and will be designed to be compatible with the surrounding residential area [and that a] residential component within the neighbourhood commercial facility is encouraged." (Section ) Existing Zoning The subject property is currently zoned Residential Two (R2-1), which permits a range of uses, including a "Detached Dwelling", an "Accessory Dwelling", and a "Home Occupation" (subject to compliance with Section 4.12 of the Zoning By-law). By way of Section 4.12 of the Zoning By-law, regulations applicable to a "Home Occupation" include that it must "be conducted as an indoor accessory use within a permitted dwelling unit... [and] shall be occupied as a residence by the operator of the business...". As such, the applicant's proposal to establish a "Personal Service Establishment" on the property, operated by a person who does not reside on the property would not qualify as a "Home Occupation". Based on the material submitted by the applicant, with the proposed division or common use of the respective floor areas therein, the proposed development of the existing building on the property would result in the need for a total of four (4) off-street/on-site parking spaces (i.e., one (1) for the Accessory Dwelling, and three (3) for the "Personal Service Establishment"), in accordance with the Parking and Loading Provisions of the Town's Zoning By-law , as amended. Request for Zoning By-law Amendment and Cash-in-Lieu of Parking Consideration The applicant has acknowledged that the required on-site parking would not be provided to serve the proposed Accessory Dwelling and Personal Service Establishment uses (based on Zoning By-law requirements) and, as such, has also requested that the Town s Cash-in-Lieu of Parking by-law (i.e., By-law ) be amended to include the subject property within Schedule A thereof, and that they enter into a cash-in-lieu of parking agreement with the Town in recognition of the insufficient on-site parking supply. Based on the Cash-in-Lieu of Parking By-law, the applicant would be required to enter into a Cash-in-Lieu of Parking Agreement with the Town and pay $3,000 for each additional required parking space which they could not provide on-site. Accordingly, based on the total parking requirements outlined in the subsection above, the applicant would be required to enter into Recommendation Report Application for Zoning By-law Amendmen...

9 DES Recommendation Report Application for Zoning By-law Amendment, Request for Amendment to Cash-in-Lieu of Parking By-law, and Request to Enter into a Cash in Lieu of Parking Agreement Owner/Applicant: Charles and Antoniette Mossman Address: 41 Simcoe Road File No. D an agreement to pay $6,000 (i.e., making up for a deficiency of two (2) parking spaces) towards the use of spaces in municipal parking lots for the purpose of the desired commercial use. Public Consultation The subject application was received by the Office of Community Planning on May 24, In its original form, the application was incomplete and additional information was required in order to satisfy the requirements of the Planning Act. Following the receipt of additional information, the application was deemed complete as of August 22, On September 1, 2016, a joint Notice of Complete Application and Notice of Public Meeting was issued by way of publication in the Bradford West Gwillimbury Times and by mailing Notice to all property owners within 120 metres of the subject property. A Public Meeting was held on October 18, 2016, and the applicants (i.e., Antoinette and Charles Mossman) attended the Public Meeting and provided a brief overview of the purpose for their application. Other than the applicants, no other member(s) of the public made oral presentations at the Public Meeting; however, one member of the public made a written submission dated October 16, 2016 (see Attachment 5.3). In those comments, the author expressed concerns over the increase in traffic caused by a "Personal Service Establishment" use on the subject property and how existing dangerous/unsafe conditions would be worsened by the operation of such a use on the subject property. Internal Committees, Departments/Divisions and External Agency Consultation As indicated in Report No. DES , the application was circulated to internal Committees, Departments and Divisions, and to external commenting agencies in September of 2016, for their review and comment. As of the Public Meeting on October 18, 2016, the following had provided correspondence indicating that they have no concerns with, or objections to, the application: Page 9 of 53 Enbridge Gas Distribution Lake Simcoe Region Conservation Authority PowerStream Simcoe County District School Board Southlake Regional Health Centre Further to the above, it is noted that substantive comments received in regards to the subject application consist of the following: the Building Division and the Fire Department both identified the applicant's need to complete a change of use permit for the proposed development, through the Building Division, addressing the requirements of the Ontario Building Code and the Ontario Recommendation Report Application for Zoning By-law Amendmen...

10 DES Recommendation Report Application for Zoning By-law Amendment, Request for Amendment to Cash-in-Lieu of Parking By-law, and Request to Enter into a Cash in Lieu of Parking Agreement Owner/Applicant: Charles and Antoniette Mossman Address: 41 Simcoe Road File No. D Page 10 of 53 Fire Code. the Capital Projects Division expressed concern about the prospect that patrons of the commercial operation parking along Simcoe Road, noting that initiatives must be incorporated on the property to prevent vehicles from parking along Simcoe Road, and about whether the services to the building are sufficiently sized to accommodate the proposed range of uses, and noted that it is the property owners' responsibility to address both matters. o With respect to the comments above relating to prohibiting parking along Simcoe Road adjacent to the property, it is noted that subsection 2.4 d) of the Town's Traffic Regulation By-law (i.e., By-law ) currently prohibits parking "within an intersection or within 15 metres of an intersection", which is enforceable with or without corresponding signage, as confirmed by the Town's Enforcement Division. o With respect to the comments above relating to the services to the building being sufficiently sized to accommodate the proposed range of uses, it is noted that the Town's Building Division has confirmed that satisfying the Town's requirements in this regard will form part of the change of use permit process, which would follow Town Council's consideration of the requests and application that are the subject of this report. the Development Engineering Division indicated that they "have no objections for the amendment to include the additional... permitted use... for the subject lands. It should be noted that the two parking spaces located at the southeast corner of the property should not be considered parking spaces as they are not accessible and are undersized." the Heritage Committee indicated that "This property is currently listed on the Town's Heritage Register and an application for zoning by-law amendment has recently been received by the Town. Planning Staff noted that the nature of the rezoning is to allow for a personal service establishment within the existing building and the need for structural changes to the exterior of the building are not anticipated at this time. This proposal was well received by the committee members, as they consider this building to be a good example of building restoration and heritage preservation." (Minutes from Meeting of October 3, 2016) Response to Public Comments Further to the Town's receipt of comments from a member of the public, dated October 16, 2016, and Town's staff's consideration of such comments in consultation with colleagues with subject matter expertise in the area of concern expressed, it is the opinion of Community Planning Division staff that the comments received have no effect on Council's disposition of the application. Although the concerns expressed were well received, Town staff submits that the Town's Traffic Regulation By-law (i.e., By-law ) currently prohibits vehicular parking "Within an intersection or within 15 metres of an intersection" (subsection 2.4 d), as a general prohibition, while also prohibiting vehicular parking along Centre Street, for the first 40 Recommendation Report Application for Zoning By-law Amendmen...

11 DES Recommendation Report Application for Zoning By-law Amendment, Request for Amendment to Cash-in-Lieu of Parking By-law, and Request to Enter into a Cash in Lieu of Parking Agreement Owner/Applicant: Charles and Antoniette Mossman Address: 41 Simcoe Road File No. D metres eastbound from Simcoe Road along the south side, and through to its intersection with Morris Road along the north side. In that regard, it is noted that if any vehicular parking is observed in the areas noted, such parking is subject to enforcement and ticketing by the Town's Enforcement Division, either by way of proactive enforcement (i.e., observation by Town staff) or reactive enforcement (i.e., in response to complaint(s)). Conclusions Through review and consideration of the applicant's current proposal in the context of all applicable policies and regulations, and consideration of comments received from the public, agencies, Town Committees, Departments and Divisions, it is the opinion of Town staff that the applicant's proposal: Page 11 of 53 is consistent with the Provincial Policy Statement, 2014, as it would contribute to the range of land uses serviced by municipal infrastructure within a designated settlement area; conforms to the Growth Plan for the Greater Golden Horseshoe, the Lake Simcoe Protection Plan, and the Official Plans of the County of Simcoe; conforms to the Town's Official Plan; complies with applicable regulations of the Town's Zoning By-law, subject to the the applicant entering into a Cash-in-Lieu of Parking Agreement with the Town, in acknowledgement of the deficient supply of on-site parking and reliance on the nearby municipal parking lot(s); and enables the preservation and restoration of a heritage building near Downtown Bradford. Accordingly, Town staff recommends that Council approve Zoning By-law Amendment application D at the first available meeting after: a) Council passes a by-law amending the Town's Cash in Lieu of Parking By-law to include the property at 41 Simcoe Road in the area subject to that by-law, b) Council authorizes the Mayor and Clerk to execute a Cash in Lieu of Parking Agreement with the owners of 41 Simcoe Road, and c) a Cash in Lieu of Parking Agreement is executed, applicable monies are payed, and such agreement is registered on title for the subject property. In that regard, subject to Council's disposition of the requests relating to the Cash in Lieu of Parking By-law, and the Committee of the Whole's direction regarding the application for Zoning By-law Amendment, Town staff will present the zoning amendment by-law at the next available Council Meeting thereafter. 4. EFFECT ON TOWN FINANCES: The Office of Community Planning does not anticipate any adverse effect on the Town's finances as a result of Council's consideration and disposition of the request that is the subject of this report. WHEREAS the Council for the Corporation of the Town of Bradford West Gwillimbury passed By-law on the 22 nd day of August, 1994, to provide for cash payments in lieu of providing parking facilities; AND WHEREAS the Council for the Corporation of the Town of Bradford West Gwillimbury deems it appropriate to amend By-law to include the lands municipally known as 41 Simcoe Road, Bradford, in the area to which the payment-inlieu of parking policy applies; NOW THEREFORE the Council of The Corporation of the Town of Bradford West Gwillimbury enacts as follows: 1. Section 1 of Cash in Lieu of Parking By-law , as amended, is hereby further amended by adding the following subsection thereto: 1.2 Notwithstanding the provisions of Section 1, this by-law shall also apply to the lands municipally known as 41 Simcoe Road. 2. BETWEEN: ANTONIETTE AND CHARLES MOSSMAN (hereinafter collectively called "the Owner") OF THE FIRST PART - and - THE CORPORATION OF THE TOWN OF BRADFORD WEST GWILLIMBURY (hereinafter called "the Town") OF THE SECOND PART WHEREAS the Owner represents that it is the registered owner of the lands described in Schedule "A" attached hereto, which lands are hereinafter referred to as the "Lands"; AND WHEREAS the Lands are unable to accommodate the number of off-street parking spaces required by Zoning By-law , as amended; AND WHEREAS through Resolution [##]-[###] passed on January 24, 2017, Council directed that a Cash-in-Lieu of Parking Agreement between the Town and the Owner be prepared for two (2) parking spaces, with the cash-in-lieu to be of a full amount for said two (2) parking spaces; AND WHEREAS the Town is satisfied that its parking requirement with respect to the Lands will be satisfied pursuant to the terms of this Agreement; AND WHEREAS this Agreement has been entered into pursuant to Section 40(1) of the Planning Act, R.S.O. 1990, c.p.13, and By-law , as amended; NOW THEREFORE THIS AGREEMENT WITNESSETH that in consideration of the mutual covenants and agreements and conditions hereinafter contained and the sum of Two Dollars ($2.00) now paid by the Owner to the Town, the receipt and sufficiency of which is hereby acknowledged, the Parties hereto covenant and agree as follows: 1. In accordance with By-law , as amended, the Town hereby exempts the Owner from providing and maintaining parking facilities of two (2) parking spaces on the Lands as required by the provisions of Part 5 of Zoning By-law , as amended, for the Town of Bradford West Gwillimbury. 2. For the exemption granted by the Town to the Owner in paragraph numbered one (1) of this Agreement, the Owner shall make payment to the Town in the sum of Six Thousand Dollars ($6,000.00) which sum is calculated at the rate of Three Thousand Dollars ($3,000.00) per parking space for the two (2) required parking spaces exempted. 3. This Agreement and the relief from parking requirements granted hereunder shall cease and be at an end upon the demolition of the building on the Lands. 4. This Agreement and everything herein contained shall respectively endure to the benefit of and be binding upon the parties hereto, their successors and assigns. 5. RECOMMENDATIONS: That Report COR regarding "Downtown Heavy Truck Regulations: be received; and That the Committee of the Whole endorse Option [#1/#2] as detailed in Report COR for heavy truck routes; and That Traffic By-law be amended to give effect to this option. 2. PREAMBLE: In January 2009 the Director of Engineering Services presented a report to Council investigating the implementation of "no heavy truck traffic in residential areas". Report 002- ENG-2009 was presented to Council and the following recommendation was approved: "That the Town of Bradford West Gwillimbury adopt a permissive system of heavy truck traffic control; That staff be directed to prepare an amendment to By-law to implement the permissive system of heavy traffic routes; and That a study of truck turning movements be conducted at the intersections of Barrie Street and Fletcher Street/Britannia Avenue and Holland Street East and Colborne Street to determine the need for additional signage to encourage compliance along these routes." Following this recommendation, By-law was approved by Council formally adopting the permissive system of heavy traffic routes (by-law attached). Downtown Heavy Truck Regulations

24 COR Downtown Heavy Truck Regulations 2 In September 2015, Report COM entitled "Holland Street Truck Prohibition" (attached) was presented to the Traffic Committee. This report was requested by the committee in response to several requests from downtown businesses having concerns with traffic congestion, noise and pedestrian safety. The report made several recommendations: 1) prohibit heavy truck turning at the intersection of Holland Street and Barrie/Simcoe Road, except for local delivery; 2) establish a permissive truck route on Dissette Street, Line 8, and Sideroad 10; and 3) create defined terms within the Traffic By-law of commercial motor vehicle,heavy truck and local delivery. In January 2016, Council adopted the Traffic By-law amendment which formally created regulations that restrict heavy truck turning at the intersection of Holland Street and Barrie/Simcoe Road. Regulatory signs were installed at four (4) major collector roads leading into the downtown area of County Road 4/Line 8, Bridge St/Dissette St, Highway 88/Sideroad 10 and Line 6/Simcoe Road. These signs (attached Figure 1) included a warning of "No Heavy Truck turning at Holland St/Simcoe Road" and provided a permissive heavy truck detour sign on Line 8/Sideroad 10/Dissette Street. Despite these efforts, business owners in the downtown area continue to express concerns with heavy trucks along Holland Street East/West. At the August 23, 2016 meeting of Council, a request for staff report was received to "restrict heavy trucks downtown". This report outlines the authority that municipalities have to implement such restrictions and proposes two options for Council's consideration. 3. BASIC DATA PERTAINING TO THE MATTER: Authority Under the Municipal Act Section 11 of the Municipal Act, 2001, S.O. 2001, c. 25 establishes the authority for municipalities to pass by-laws relating to any service or thing that the municipality considers necessary or desirable for the public. Subsection (3) allows a lower-tier municipality to pass by-laws within the sphere of jurisdiction of "highways, including parking and traffic by-laws". Under this provision, Council has the legal authority to implement a by-law which would prohibit the use of defined roadways by heavy trucks. Regulatory signs placed on roadways or highways in accordance with the by-law are established under the Highway Traffic Act R.R.O. 1990, Regulation 615. Ontario Traffic Manual The Ontario Traffic Manual (OTM) is the predominant document of traffic-related best practices that are adopted by municipalities in Ontario. This document is prepared by traffic engineers in co-operation with the Ministry of Transportation to establish uniform practices to encourage safe driving behaviour by ensuring predictable road environments that are consistent across all jurisdictions and compliant with the Highway Traffic Act. The regulations and signs required for heavy truck routes are found within the OTM. Page 24 of 53 Downtown Heavy Truck Regulations

25 COR Downtown Heavy Truck Regulations 3 The purpose of heavy truck regulations are to indicate roads on which heavy trucks are prohibited. Heavy truck regulations should be used to restrict movements or specify required actions of trucks from travelling on certain roads where it is necessary to protect road infrastructure that cannot bear the weight of heavy trucks, or that are otherwise unsuitable for truck traffic (residential streets, road with narrow lanes, roads where trucks are incompatible with other road users). A time restriction is permitted to be used in conjunction with the heavy truck regulations to prohibit trucks from travelling on certain roads when they would most likely adversely affect other road users. Truck routes are typically identified in two (2) approaches outlined by the OTM - permissive or restrictive. The permissive approach indicates a continuous route preferred for heavy truck use. When established under a municipal by-law, the permissive signs can be given a mandatory function where signs can prohibit heavy trucks from travelling anywhere except on a truck route identified by a permissive sign. Permissive heavy truck routes are established by using the following signs under Section 11.1 of the OTM: Page 25 of 53 Under the restrictive approach, specific streets are identified by a municipal by-law where heavy trucks are prohibited from traversing. These streets are signed with prohibitive no heavy trucks signs below: The prohibitive no heavy trucks may be used to supplement a permissive signing system for continuous truck routes. To legally establish heavy truck regulations the municipality is required to: 1) Specify that heavy trucks are prohibited from all roads other than truck routes indicated by the permissive truck route signing system; and 2) Specify a schedule of roads on which trucks are permitted, corresponding to the roads included in the permissive truck route signing system; or 3) Specify a schedule of roads on which trucks are prohibited, corresponding to the roads excluded from the permissive truck route signing system. Current Status Following report 002-ENG-2009 presented by Engineering Services in 2009, By-law was enacted by Council. This by-law amended the former Traffic By-law to establish a permissive schedule of truck routes. Following the adoption of the truck route restrictions, permissive truck route signs were installed along the noted portions of Town roads. When the current version of the Traffic By-law was enacted in 2014, the permissive truck routes established under By-law were repealed and not reenacted. Staff believe that this was an oversight. In September 2015, when report COM was presented to the Traffic Committee, the committee opted to create "No Left/Right Turn" regulations for heavy trucks at the intersection of Holland Street and Barrie/Simcoe Roads. The report included a traffic study of Holland Street which measured the total number of vehicles, the 85th percentile rate of speed and the number of axles on the vehicle. The report made the following conclusions: 85th percentile of speed on Holland Street East is 59 km/hr with 14,054 Average Daily Trips (ADT); 85th percentile of speed on Holland Street West is 63 km/hr with 15,534 ADT; trucks less than 5 axles - 79 total - 0.7% of ADT; trucks with 5 axles - 20 total - 0.2% of ADT; trucks with 6 axles or more - 39 total % of ADT The report also made several recommended amendments to the Traffic by-law, including: the definition of a Heavy Truck - section 1.1 (p): means any commercial motor vehicle having a registered gross weight or actual gross weight in excess of four thousand, six hundred (4,600) kilograms, but does not include ambulances, transit buses, school buses, police service vehicles, fire apparatus, or vehicles owner by or operated for the Corporation of the Town of Bradford West Gwillimbury, the County of Simcoe, the Downtown Heavy Truck Regulations

27 COR Downtown Heavy Truck Regulations 5 Page 27 of 53 Ministry of Transportation, or any utility vehicle, farm plated equipment and vehicles, and vehicles making local delivery; the definition of Local Delivery - section 1.1 (bbb): means any commercial motor vehicle making delivery to or collection from a specific address that is prohibited to heavy truck traffic; creation of No Left/Right Turns restriction - section 8.8: When signs are erected and on display, no driver or operator of a Heavy Truck shall turn left or right from any highway at the intersection of Holland Street and Barrie/Simcoe Road, unless making a Local Delivery. Following the enactment of the noted amendments, signs were installed on Holland Street at the intersection of Barrie/Simcoe Roads. While these regulations have been effective in preventing vehicles from turning at the noted intersection, Holland Street remains an active route for trucks to traverse through Town. This results in greater traffic congestion, higher volumes of noise and a general unsafe perception by pedestrian traffic. Given the efforts to promote greater pedestrian activity and reduce traffic congestion along Holland Street, two (2) proposals are brought forward for consideration. Enforcement There is no reference in the Highway Traffic Act to establish a heavy truck specific offence. However, Section 182 (2) of the Highway Traffic Act states: "Signs to be obeyed (2) Every driver or operator of a vehicle or street car shall obey the instructions or direction indicated on any sign so erected." This restriction would be the appropriate charge issued under the Highway Traffic Act. Due to the nature of this offence, Town Enforcement Division staff are not legally authorized to issue a ticket for a moving offence. The responsibility of enforcement for this restriction would lie with South Simcoe Police Service (SSPS). SSPS are aware of the content of this report and the requests made at the Traffic Committee. SSPS will respond to complaints of heavy truck traffic on a priority basis and cannot ensure immediate response. Through their traffic unit, if approved, this regulation will be proactively enforced by officers. Options for Consideration Staff brings forward two (2) options to Council for consideration (see attached maps Figures 2 & 3): Option #1: Prohibit heavy trucks on Holland Street (Figure 2). Under this option the permissive truck route already in place on Dissette Street, Line 8 and Sideroad 10 would be complemented by establishing a restrictive heavy truck route on Holland Street East/West from Bridge Street to Sideroad 10. Under this option there are several considerations to be aware of: Establishing a single truck detour route may pose complications in the event of road closures. Trucks will have no alternative route in the event a portion of the detour route is closed, resulting in heavy trucks diverting onto collector/local roads. Downtown Heavy Truck Regulations

28 COR Downtown Heavy Truck Regulations 6 Page 28 of 53 Line 8 urbanization is tentatively scheduled for year While through lanes of traffic will remain open during the construction of Line 8, it is likely that heavy trucks will have to use Holland Street East/West during this project. The intersection of Sideroad 10 and Line 8 is steadily increasing in traffic counts, often making it difficult to turn southbound on Sideroad 10 when approaching westbound on Line 8. This could cause greater back-ups in traffic cuing at this intersection. Reagens Industrial Parkway has been identified as an alternative to this problem as there is a signalized intersection at Sideroad 10 and Reagens Industrial Parkway. This will make use of the left-turn lane on Line 8 at Reagens Industrial Parkway and allow heavy trucks to traverse onto Sideroad 10 by using the signalized intersection. Option #2: Permit heavy trucks on Holland Street and various other collector roads and would prohibit trucks on Barrie Street (Figure 3). This option essentially replicates the restrictions that were in place following the report in 2009 except for Barrie Street which will now be a restricted heavy truck route. The goal behind this option is to divert heavy trucks that may opt to use Barrie Street to access Holland Street East/West. Under this option, these vehicles will be forced onto Line 8 and Marshview Boulevard as alternate routes. Holland Street East/West would remain a permissive truck route, along with roadways previously approved in Under this option there are several considerations to be aware of: The Marshview Boulevard/Simcoe Road/Line 6 route has limited turning radius' at the intersections of Simcoe Road and Bridge Street, Simcoe Road and Line 6 and Line 6 and Sideroad 10. It is likely that large vehicles will not have the required turning radius to safely traverse this route without damaging curbs, medians and signs. These larger vehicles will be forced to use Dissette Street/Line 8/Sideroad 10 and/or Holland Street. Smaller sized heavy trucks (cube trucks, two axle dump trucks) would likely have sufficient space to traverse the route. While Simcoe Road was previously identified in the 2009 heavy truck by-law as a permissive heavy truck route, consideration must be given to the residential nature of this street. A significant portion of Simcoe Road has residential dwellings and driveways abutting the street, as well as a crossing guard stationed at Simcoe Road and Catania Avenue servicing pedestrians of W.H. Day elementary school. * Please note that under both options heavy trucks making local deliveries are exempt. Restrictive and permissive routes only impose restrictions on 'through traffic'. The result of either option will not be a complete eradication of all heavy trucks but will put in place measures to minimize the amount of 'through traffic'. Future Considerations Acknowledging future projects such as Line 8 Urbanization and Holland Street Revitalization, consideration should be given to the timing of these projects so there always remains a detour option available to heavy truck traffic. The Capital Projects Division has advised that Line 8 Urbanization is proposed to take place prior to Holland Street Revitalization. During Line 8 Urbanization, alternate routes of Holland Street and/or Marshview Boulevard will need to be granted to keep traffic moving without undue delay. Downtown Heavy Truck Regulations

29 COR Downtown Heavy Truck Regulations 7 It is also recommended that the future needs of heavy trucks, including detour routes, heavy truck routes, and a restrictive or permission truck route regime be included within the development of the next comprehensive transportation master plan for the Town. 4. EFFECT ON TOWN FINANCES: The purchasing of restricted heavy truck signs along Holland Street from Bridge to Sideroad 10 would cost an approximate $5, in materials. PREAMBLE: Staff were requested through traffic committee to investigate methods of restricting truck traffic from turning at the intersection of Barrie Street/Holland Street. The following data reports the findings of that investigation. 3. BASIC DATA PERTAINING TO THE MATTER: Staff where directed to investigate Truck Traffic in the down corridor. Traffic data was collected at key locations along Holland Street and was provided to the Traffic Committee on August 22, There is an existing permissive truck detour route signed to encourage heavy trucks to use Line 8 via Dissette Street and Sideroad 10 as a means of avoiding the downtown area. Attachment #1 is the existing permissive truck detour. Signage for the permissive detours exists at all entrances to the town. 31 Page 31 of 53 COM Holland Street Truck Prohibition 2 Staff reviewed options including flashing beacons and additional signs. A flashing beacon is not recommended as this should be reserved primarily for hazards and other special traffic situations. Staff recommend the installation of an additional truck route sign to compliment the existing sign. The new sign will have a new "sunburst" symbol as a way of increasing visibility for the first 60 days. Staff can also explore the use of a variable message sign that can be rotated to each approach and include more messages for the public. The variable message sign could also be used by staff for planned road closures related to festivals in Town. The approximate cost to purchase a variable message sign is $15,000 to $20,000. Should Committee members wish to pursue this, this matter should be discussed as part of the 2016 budget process. Based on the data collected, staff recommend restricting "Heavy" truck turning movements at the intersection of Barrie Street and Holland Street. This restriction will encourage trucks to use the existing permissive truck route. To establish limitations of truck traffic, travelling through the downtown, it is recommended that Traffic By-law definitions are reworded. The definitions of "Commercial Motor Vehicle" and "Heavy Trucks" shall be amended to expand their interpretation. The amendments establish the classification of what a heavy truck and commercial motor vehicle is, and what is defined as a local delivery. The definitions of Heavy Trucks and Commercial Motor Vehicles for the prohibition on vehicles turning within the intersection will include all vehicles over 4,600 kilograms. This weight class restriction includes any vehicle larger than a light-duty truck (pick-up). Understanding that many vehicles will unnecessarily fall within these turning restrictions, the definition of Heavy Trucks below includes a list of exemptions for vehicles that are not the target of the restriction. The following amendments to the "Commercial Motor Vehicle" and "Heavy Trucks" definitions are as follows: "Heavy Trucks" Any commercial motor vehicle having a registered gross weight or actual gross weight in excess of four thousand, six hundred (4,600) kilograms, but does not include ambulances, transit buses, school buses, police services vehicles, fire apparatus, or vehicles owned by or operated for the Corporation of the Town Bradford West Gwillimbury, the County of Simcoe, the Ministry of Transportation (Ontario), or any utility vehicle, farm plated equipment and vehicles, vehicles making a local delivery; "Commercial Motor Vehicle" A motor vehicle having permanently attached thereto a truck or commercial delivery body operating with a valid commercial license plate and includes ambulances, hearses, casket wagons, fire apparatus, buses and tractors used for hauling purposes on the highways, and any vehicle with farm plates; "Local Delivery" Any commercial motor vehicle having a registered gross weight or actual gross weight in excess of four thousand, six hundred (4,600) kilograms making a delivery to or a collection Downtown Heavy Truck Regulations

44 Page 44 of 53 THE CORPORATION OF THE TOWN OF BRADFORD WEST GWILLIMBURY BY-LAW TRAFFIC REGULATION AMENDMENT BY-LAW TRUCK ROUTES Being a by-law of the Corporation of the Town of Bradford West Gwillimbury to amend the Traffic Regulation By-law, By-law , as amended, to regulate truck traffic and provide for a permissible truck route within the Town of Bradford West Gwillimbury. WHEREAS pursuant to the Municipal Act, 2001, Chapter 25, Section 11 (3) provides that a lower-tier municipality may pass by-laws respecting matters within spheres of jurisdiction. AND WHEREAS pursuant to the Municipal Act, 2001, Chapter 25, Section 35 provides that a municipality may pass by-laws removing and restricting the common law right of passage by the public over a highway. AND WHEREAS pursuant to the Municipal Act, 2001, Chapter 25, Section 425, as amended, provides that municipalities may pass by-laws for providing that any person, who contravenes any by-law passed under the authority of the Municipal Act; is guilty of an offence. AND WHEREAS the Town of Bradford West Gwillimbury enacted by-laws , A, , , , , , , , , , , , , , , , , , , , , and to amend By-law AND WHEREAS the Council of the Corporation of the Town of Bradford West Gwillimbury deems it necessary and expedient to regulate truck traffic along portions of the highways as set out below. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF BRADFORD WEST GWILLIMBURY HEREBY ENACTS AS FOLLOWS: 1. ADMINISTRATION 1.1 That the attached Schedule "0", Truck Routes, be hereby added as a Schedule to the By-Law , as amended. 1.2 That the Truck Routes be identified on the attached Appendix "1" to this By-law. 2. CONFLICTING LEGISLATION 2.1 If this by-law conflicts with the provisions of any Act, other than the Municipal Act, the provisions of the Municipal Act shall prevail to the extent of the conflict. 3. VALIDITY AND SEVERABILITY 3.1 It is hereby declared that notwithstanding any section, subsections, clause, paragraph or provision of the by-law or parts thereof, may be declared by a court of competent jurisdiction to be invalid, unenforceable, illegal or beyond the powers of Council to enact, such section or sections or parts thereof shall be deemed to be severable and that all other sections or parts of this by-law are separate and independent there from and enacted as such as a whole. Same shall not affect the validity or enforceability of any other provisions of this by-law or of the by-law as a whole. 3.2 Whenever anyreference is made in this by-law to a statute of the Legislature of the Province of Ontario, such reference shall be deemed to include all subsequent amendments to such statute and all successor legislation to such statute. OFFENCES AND PENALTIES 4.1 Every person who contravenes any of the provisions of the Highway Traffic Act or the Regulations or an order made under this Act, or this by-law is guilty of an offence and upon conviction is liable to a penalty not exceeding $5, exclusive of costs. The provisions of the penalty is as provided for and recoverable under the Highway Traffic Act, Revised Statutes of Ontario 1990, Chapter H.8, as amended and the Provincial Offences Act, Revised Statutes of Ontario 1990, Chapter P.33, as amended, and shall apply to the said fine. 5. ENFORCEMENT 5.1 This by-law shall be administered and enforced by persons duly appointed by the Town of Bradford West Gwillimbury under the provisions of this by-law. 6. SHORT TITLE 6.1 This by-law shall be cited as the TRAFFIC REGULATION AMENDMENT BY-LAW, TRUCK ROUTES. 7. FORCE AND EFFECT 7.1 This by-law shall take effect and become in full force and effect upon the date of the third reading and passage thereof.
