4 INTRODUCTION In accordance with Section 19 of the Declaration of Covenants, Conditions and Restrictions of Kingsfield, a Planned Community (the Covenants) and Article III of the Bylaws of the Association, the Board of Directors revised the Kingsfield Homeowner Manual in this format in 2016 as a convenient summary of the policies, rules and regulations that govern Kingsfield. It replaced all previous homeowner manuals. Rules and regulations of the community consist of the Covenants, Bylaws and any resolutions passed by the Board of Directors. Tbe creation, approval and enforcement of the rules and regulations are the responsibility of the Board. In the event of any conflict with the provisions provided in this Homeowner Manual, the Covenants, Bylaws, guidelines and resolutions will prevail. When homes are purchased in Kingsfield, the purchasers become members of the Kingsfield Community Association and agree to abide by the rules and regulations that govern the community. The Kingsfield Homeowner Manual is designed for the protection, safety, and enhancement of all homeowners property value. All changes to this Manual and any additional or revised administrative resolutions, guidelines or forms will be posted on the Kingsfield website (kingsfieldhoa.org) and mailed to homeowners. [Revisions will be identified by a revision date on each page]. Reference to the Covenants and Bylaws Most of the routine topics that govern the Kingsfield community are covered in this Manual. In addition to that content, other topics are covered in the Covenants and Bylaws. The Reference to Covenants and Bylaws describes a Maintenance and Responsibility Chart. It also refers to a list of selected topics that provide a quick reference to the respective sections or pages in the official documents. Revised August 31,

5 Architectural Review Committee and Landscape Committee The Board appoints these committees. The responsibility of these committees is to recommend to the Board changes to the external design and appearance of the community, to recommend improvements that promote qualities that bring value to homeowners properties and to foster the attractiveness and functional utility of the community. Members of the Architectural Review Committee and Landscape Committee are listed on the HOA Leaders page of the Kingsfield website (kingsfieldhoa.org). Function of the Architectural Review Committee The function of the Architectural Review Committee is to review architectural and site license proposals for exterior changes submitted by homeowners, to ensure that plans recommended to the Board for approval are in accordance with the Covenants, Bylaws and this Homeowner Manual. The committee then submits to the Board its recommendations for action (either rejection or approval). Function of the Landscape Committee The function of the Landscape Committee is to review landscape and site license proposals submitted by homeowners, to ensure that plans recommended to the Board for approval are in accordance with the Covenants, Bylaws and this Homeowner Manual. The committee then submits to the Board its recommendations for action (either rejection or approval). The Landscape Committee also has the responsibility for recommending horticultural additions to the common areas in order to enhance our community for the benefit of all residents. Alteration Request Procedures 1. The applicant must submit an Alteration Request Form, with appropriate attachments, and any required Common Space Site License Agreement to the appropriate committee, in order for the proposed modification to be considered. 2. After consideration by the appropriate committee, the form will be forwarded to the Board with a recommendation. 3. If the Board fails to approve or disapprove an application in writing within 45 days after written plans and specifications are submitted, approval will be deemed denied. Revised August 31,

6 4. The Board will forward the approved or disapproved application to the management company, which will respond to the applicant in writing. 5. The applicant may appeal an adverse decision of the Board by reapplying to the appropriate committee. Homeowners Maintenance Responsibilities It is the responsibility of each homeowner to maintain the condition of his/her home and dwelling area. In addition, all residents of Kingsfield, as they are able, are encouraged to assist in the care of the common ground areas by watering the grass, trees and bushes surrounding their home. This will prevent unnecessary expense for the replacement of neglected landscaping. In the event a homeowner fails to maintain his or her unit in accordance with community standards, a notice will be sent to the homeowner requesting him/her to bring the unit up to standards. In the event the homeowner fails to do so, the Board has the authority to cause corrective action to be taken at the expense of the homeowner, according to Section 19 of the Covenants. 7 ALTERATIONS WITHIN THE SIX-FOOT PERIMETER OF HOMES Homeowners are encouraged to add to the beauty of the community by installing planting beds and adding flowers and shrubbery within the six-foot perimeter of their homes. An Alteration Request Form is not needed to replace landscaping in the Basic Landscaping Packages planted by the builder. An Alteration Request Form must be submitted and approved prior to beginning any other major change within the six-foot property line (e.g. trash can corrals, generators, new planting beds, pavers, patios, etc.). Following approval by the Board of Directors, the resident will be responsible for the cost of the plantings and the maintenance of such plantings. Those costs include mulching, edging weeding, trimming, spring and fall cleanup and maintenance Debris (clippings, etc.) must be disposed of in a proper manner. Debris is NOT to be deposited on common ground or in the woods adjacent to the walking path behind houses along Kingsfield Drive. Plantings in the builder-supplied Basic Landscaping Package for each home include bushes that will be trimmed periodically by the community s landscape contractor. If a homeowner wants the contractor to avoid trimming those bushes, a small red flag must be placed in the planting beds to be avoided. The red flags are available at no charge from the Board. The Barclay and Durham models have one planting bed (including an ornamental tree) and the Coventry model has three planting beds that will be trimmed unless the red flags are displayed (place at least one flag in each bed). Homeowners will be alerted before bush trimming occurs. Revised August 31,

8 ADDRESS NUMBERS FOR MAILBOXES AND HOUSE PLAQUES Address numbers on replacement mailboxes should match the style and color the builder (Quade Homes) placed on the original mailboxes. Three numbers must be placed on each side of the mailbox. The numbers must be gold in color and be approximately 3 inches high. If a homeowner wishes to replace mailbox numbers with the original style, the Bright Goldleaf Pattern is available from Design and Sign Center, 5 New Galena Road, Line Lexington, PA (Phone: ). Replacement mailbox numbers do not need Board approval as long as the above requirement is followed. Homeowners who wish to replace their mailboxes should read the mailbox specifications on another page in this Manual. An address-number plaque may be installed only on the wall on either side of the garage door at eye level. Approved background colors are burgundy, green, tan and black. All numbers and letters must be raised polished brass. The size of the sign shall be no more than 9.5 inches by 16.5 inches. House address signs do not need Board approval as long as the above policy is followed. See Administrative Resolution H for more information on this topic. Any deviation from the above policy must be submitted to the Architectural Review Committee on an Alteration Request Form. AWNINGS Awnings can only be installed at the rear of houses over decks and patios and must be retractable cloth. When the awning is fully extended, the perimeter of the patio or deck can be covered but the awning cannot extend past the perimeter. Solid colors are preferred. Requests for the installation of an awning or any other type of exterior sunscreen must be submitted to the Architectural Review Committee on an Alteration Request Form. See Administrative Resolution H for more information on this topic. Revised August 31,

9 APPEARANCE OUTSIDE OF HOMES According to the Covenants (Section 17), it is the responsibility of all homeowners to maintain the area surrounding their houses in a safe, clean and sanitary manner and condition. The following are some examples of how to maintain the outside appearance of each residence: - Trashcans must be kept in garages or approved trashcan enclosures/corrals located beside garages. - Trashcans may be placed at the end of driveways after Noon the day before the collection and must be returned to garages or corrals no later than Noon the day after the collection, as per Administrative Resolution D of this manual. - No trashcans, containers or other items (e.g. empty flower pots, building materials, hoses not coiled up on hose reels, lawn sprinklers, bags of topsoil, chairs, etc.) may be kept outside of the house when not in use, unless they are placed inside trashcan corrals, or on patios or decks. - Owner-installed planting beds and plantings must be well maintained (e.g. edged, mulched, weeded and trimmed). Mulch must be similar to the color of the mulch installed by the community s landscape contractor. - No non-operating vehicle may be located on the property unless it is entirely enclosed in the resident s garage. - It is recommended that garage doors remain closed, except when the homeowner is driving in and out of the garage or is actively involved in yard work or other projects. - No outdoor clotheslines may be erected, installed or permitted outside any dwelling. The examples listed above are not intended as a complete list of restrictions, but only as illustrations of how the outside of residences must be maintained in order to preserve the look of the community as a whole. In the event a homeowner fails to maintain his or her unit according to community standards, a notice will be sent to the homeowner requesting that she/he bring the unit up to standards. The Board has the authority to cause corrective action to be taken at the expense of the homeowner. Revised August 31,

10 COMMUNITY-OWNED COMMON GROUND The Board is responsible for maintaining all common-ground areas (community-owned property) outside of the six-foot perimeter surrounding each of the houses in Kingsfield. Those common facilities include roads, driveways, walking paths and all turf and field areas. See the page on walking paths in this Manual. The Kingsfield Community Association contracts with licensed and insured professional service providers to provide a uniformly maintained property, to ensure that all homeowners receive the same level of services and to protect property values. The fertilization of trees, bushes and turf, the cutting of grass, trimming bushes, and the application of insecticides are to be performed only by board-approved contractors. The roads are built to handle trucks of reasonable weight and the driveways are of more modest construction material suitable for cars and most suburban utility vehicles. A site license must be obtained to use the common ground for landscaping or other changes outside the six-foot property line of homes (e.g. generators, pavers leading to trash can corrals). See the Common Space Site License Agreement and Site License Procedures in this Manual. Homeowners are responsible for all underground lateral water and sewer lines leading to their homes and should be aware that there are other utility lines in the ground within their six-foot property lines. Homeowners may wish to purchase private insurance to cover repairs to the lateral water and sewer lines to and from their homes. Any digging or planting in the common ground must receive advance permission, including a site license issued at the discretion of the Board. Revised August 11, 2017, and August 31,

11 COMMON GROUND TREE AND SHRUBBERY REPLACEMENT The Board has the responsibility for deciding what trees and shrubbery are planted and exist in the common ground. A resident should report dead landscaping to the management company ( ). The management company will request verification, a recommendation and pricing from the community s landscaping contractor or arborist. Homeowners in close proximity to dead landscaping will be asked if they feel the landscaping should be replaced. It will be necessary for a homeowner to verbally commit to a watering plan for any newly planted landscaping. This commitment is necessary for the process to continue. The Association will attempt to maintain all tree lines and replace dead trees. There may be a number of unusual situations in Kingsfield. For example, some trees planted too close to streetlight poles will need replacement eventually. Homeowners may contact a board member to report potential problems. The Landscape Committee will be involved in these situations. Revised August 31,

12 DECKS The maintenance or installation of decks and deck railings must be done with pressure-treated wood, vinyl or composite deck materials. Staining decks and railings the same color as the house siding or stucco is pre-approved. Any deviation from the above policy must be submitted to the Architectural Review Committee on an Alteration Request Form. If a deck is replaced or modified, an Alteration Request Form is required. The homeowner must contact Franconia Township to determine if a building permit is required and then secure a permit if it is required. See Administrative Resolution H for more information on this topic. DRIVEWAYS The Kingsfield Community Association has the responsibility for maintenance and necessary repairs to all private driveways. That includes driveways leading from the street to, but not including, the concrete apron beneath the garage door of all homes. Homeowners must contact the Management Company or a board member as soon as a problem occurs. Revised August 31,

13 FLAGS Homeowners shall have the right to display American flags within their six-foot property line. A flag may be flown from a pole attached to the dwelling, not to exceed a height greater than the front eave of the roof. Flags may be a maximum of 3-by-5 feet. All standards for U.S. flag display must be followed (including retiring the flag from dusk to dawn, unless lighted). Seasonal or holiday flags are permitted, but no banner or windsock is allowed. A limit of two flags per home is allowed. Freestanding flagpoles are not allowed. Flag display does not need Board approval, as long as the above policy is followed. See Administrative Resolution H for more information on this topic. GARAGE SALES Homeowners must have approval of the Board to operate garage sales and yard sales in the community. These guidelines were outlined in the Minutes of the November 2005 and the April 2007 meetings of the Kingsfield Community Association: - Individual garage sales or yard sales will be approved only for homeowners moving out of the community. - Sales must be limited to Saturdays, between the hours of 9 a.m. and Noon. - Sale items must stay on the driveway or in the garage and be kept off of the turf in the common ground. - Signs and sale items must be removed by 1 p.m. the day of the sale. - Immediate neighbors must be notified of the sale in advance. Homeowners voted in September 2016 not to allow community-wide garage sales. Revised August 31,

14 HOLIDAY AND SEASONAL DECORATIONS Homeowners who wish to decorate their homes for a holiday may do so up to 30 days before and 14 days after a holiday. For the December holidays, windows may be decorated with solid, clear or colored lights on the inside of the home. Front or main doors may be decorated with lighted wreaths and/or lighted garland. Front windows, main doors and window areas over walks leading to main doors may be lighted with temporary ground-mounted floodlights of solid, clear or appropriate colors. All lights in displays must be constant burning; flashing or blinking lights are not permitted. Electric window candles may be displayed all year. Holiday decorations do not need Board approval as long as the above policy and guidelines are followed. See Administrative Resolution H for more information on this topic. Revised August 31,

15 ORNAMENTAL TREES Homeowners are responsible for the care and maintenance of ornamental trees located within the six-foot perimeter of homes and in the circular beds where the sidewalk turns on the Coventry model. The Association will not care for these trees. Each residence in Kingsfield came with a basic landscaping package that included shrubs and one 6-to-7 foot tall ornamental tree. See Basic Landscaping Packages pages for diagrams illustrating the placement of the ornamental trees near Kingsfield homes. The landscaping packages vary, depending on the model of the house. There is quite an assortment of ornamental trees, some of which have grown to create problems. For many homeowners, these trees have started rubbing the house structure and some of these trees are inappropriate for the locations where they were planted. The Board asks each homeowner to consider the voluntary replacement of a problem tree with something more appropriate for the provided space. The Board considers the landscaping packages that came with residences as the property of each homeowner. While some of the initial planted beds containing the ornamental tree extend into common ground (specifically the Coventry Model house), those trees are not owned by the Association. The Covenants call for the Association to trim the initially installed bushes, but do not address the ornamental tree. The Board thanks those homeowners who have already replaced a problem ornamental tree. We encourage others to look into replacements before the existing ornamental tree gets too large and expensive to deal with. An Alteration Request Form is not required to remove or replace the ornamental tree within the model s landscaping package with something appropriate for the space. Revised August 31,

16 OUTSIDE LIGHTING AND HOME SECURITY AN ALTERATION REQUEST FORM IS NOT REQUIRED FOR ITEMS ON THIS PAGE, AS LONG AS THE FOLLOWNG GUIDELINES ARE FOLLOWED. Security Lighting Security lights may be mounted on the rear of the house in locations that do not cause annoyance to the neighbors. Any flood type of lighting should be equipped with a motion detector to preclude the necessity of all night lighting Walkway Safety Lighting Homeowners may feel a need to light their walkways for safety. Low level, low voltage systems or solar lights can be used along the inside edge of the walkway. Spacing should be at least 5 feet apart. That spacing will allow good lighting without being obtrusive to others. The lighting is permitted only in the six-foot perimeter around homes. Replacing the Original Outdoor Lighting Many homeowners have replaced the original outdoor lighting fixtures. Other homeowners may be anticipating this change. The following guidelines must be followed: - The size of the replacement fixture is within reason for the space involved. - The replacement mounting plate behind the fixture is no larger than the original mounting plate on the house. Security Cameras Homeowners may install security cameras around the perimeter of their homes, as long as the cameras are attached to the house. Revised August 31,

17 PAINT, STUCCO AND ALL OTHER EXTERIOR COLORS Homeowners who wish to paint or replace the stucco on their homes may do so, with the following provisions: - The color of stucco should come close to matching the color of the stucco and siding that the builder installed in the community. CertainTeed no longer makes some of the siding installed by the builder and there is no way to match siding and stucco colors that have faded over time. - Any other change in the color of siding, trim, shutters, garage doors, exterior doors, roofs or stucco must be requested on an Alteration Request Form. See Administrative Resolution H for more information on this topic. PRIVACY FENCES AND TRASHCAN ENCLOSURES Homeowners may erect trashcan/corral enclosures adjacent to garages and privacy fences that are adjacent to patios and decks, only with the written consent of the Board. They must submit proposals on an Alteration Request Form. The following must be observed: - Fences and trashcan enclosures must be within the homeowner s six-foot property line. - They must be constructed of vinyl material in colors that closely match the color of the vinyl siding or stucco on their homes. - Effective January 2017, proposed trashcan enclosures/corrals must include a solid gate, and the gate must be clearly shown on an Alteration Request Form. - The enclosures/corrals must be no higher than six feet and be no longer than eight feet. Specific dimensions must be provided on an Alteration Request Form and submitted to the Architectural Review Committee. - Natural privacy fences of evergreens may be installed adjacent to patios. Plans must be submitted to the Landscape Committee on an Alteration Request Form. Revised August 31,

18 SATELLITE DISHES Kingsfield residents are welcome to install satellite dishes on the exterior of their homes in order to subscribe to a satellite television or Internet service. The size of any satellite dish must be approximately the width of the standard high-definition (five LNB) dish commonly installed by satellite and networking companies. Federal law prohibits homeowners associations from banning satellite dishes and requires that any rule involving the placement of dishes must take into account an unobstructed view to satellites that send wireless signals. Therefore, Kingsfield homeowners need only submit an Alteration Request Form before installing a satellite dish in order to describe where they propose to locate the dish. The Covenants state: Any exterior antenna permitted by law must also comply with the requirements for the submission of a landscaping plan and receipt of approval from the Board of Directors. The spirit behind the placement restrictions is that dishes should not be installed on the street side of homes, even if more coaxial cable may be needed to reach the location where wiring goes into the house. Landscaping may be required to conceal a ground-level dish installation from the view of a road or a neighbor s front door. Installation of landscaping must be requested on an Alteration Request Form. The usual placement of dishes is on roofs or decks near the rear of homes. However, the Board may consider other locations. Residents may call Board members in advance for help and to join them during the installation process to offer placement suggestions to the dish installer. 18

19 SIGNS Home Protection and For-Sale Signs - Location Policy Only home-protection and for-sale signs are permitted. Placement of a sign shall be facing the street in the planting bed that is within the six-foot lot area. Sign size is limited to 200 square inches, one sided and no more than 24 inches in total height. Signs must not be placed on turf because that will interfere with lawn maintenance. Home-protection and for-sale signs do not need Board approval as long as the above policy is followed. Any deviation from the above policy must be submitted on an Alteration Request Form. 20 SNOW REMOVAL Specifics of snow-removal contracts may vary from year to year; however, the policies for clearing snow and ice will follow the provisions below. These guidelines are subject to the conditions of each storm. In most cases, removal of snow will commence in the following sequence: 1. Roadways 2. Fire hydrants 3. Driveways 4. Mailbox access 5. Storm drains 6. Private walkways 7. Overflow / guest parking areas 8. Sidewalks There are exceptions to this sequence. When there are fewer than four inches of snow, snow removal may be limited to driveways and the public sidewalk along Cowpath Road. However, when there is a forecast of melting and nighttime freezing that may cause black ice, driveways may be salted instead of removing snow. It is up to the board members to use their discretion in making these decisions. Homeowners must remove vehicles from their driveways prior to all snowstorms and park them in their garages or in the overflow/guest parking areas scattered throughout the community. Driveways with parked vehicles will not be cleared and private walkways will not be cleared if blocked by a vehicle. In those instances, it is the responsibility of homeowner to clear snow after the snow-removal contractor leaves the community. Piles of snow blocking vehicles in the overflow parking areas will be removed after driveways are plowed. Homeowners must return all trashcans to their garages or trashcan enclosures (corrals) in accordance with Administrative Resolution D. The contractor will repair any damage to turf and property at an appropriate time. Homeowners must report any damage (e.g. mailboxes, houses, garage doors or driveways) to the management company no later than 72 hours after a snowstorm. Revised August 31,

21 STORM DOORS Storm doors may be installed on the front or the rear of the homes. All doors must be full view and plain glass doors. Two panes of glass that provide full view with a self-storing screen are acceptable. The color of the frame may be white, black or match the color of the entrance door. Storm doors do not need Board approval as long as the above policy is followed. Any deviation from the above policy must be submitted on an Alteration Request Form. See Administrative Resolution H for more information on this topic. VENTED FIREPLACES AND HEATERS The Board will not require an Alteration Request Form for through the wall direct vent termination caps associated with natural gas space heaters or fireplaces, provided the following guidelines are followed: - The cap must be located on the back or side of the house, close to the back wall. - The homeowner is responsible for and has verified that the installing contractor is following local codes and the heater manufacturer s installation instructions. For a safe installation, these instructions must be absolutely followed. They are based on the National Fuel Gas Code, NFPA 54/ANSI Z It is recommended that the termination cap be designed for high winds and also that the appliance be approved by the American Gas Association. - It is recommended that the Franconia Township building code be checked before installing a vented fireplace or heater. 22 WALKING PATHS The walking paths are designed for use by Kingsfield residents and are maintained by the Kingsfield Community Association. The use of skateboards, bicycles, roller skates/blades, other recreational equipment and motor vehicles are prohibited on the walking paths. The walking path from Green Street to Souderton Borough (at the bridge) is part of the public trail system and is open to the general public, according to the Kingsfield Land Development agreement with Franconia Township in Board of Directors approval is required prior to allowing any vehicle onto the community s common ground. This includes the walking paths. Refer to the Alteration Request Form for procedures and homeowners responsibilities related to vehicles driven on the common ground. Following this procedure should help avoid an expense to residents for damage they did not cause or to restore the common ground that is disrupted by work that was not previously approved. These pages also provide a reference to the appropriate sections or pages of the official documents. Ownership Key: CF = Common Facility. Property owned by the Kingsfield Community Association, to which Unit Owners are members. This is a Common Element as defined under the Pennsylvania Uniform Planned Community Act. UO = Dwelling. Property owned by one or more Unit Owners. Includes the Lot under the Dwelling, six feet of land surrounding the Dwelling (including the walkway), and additional land limited to and described on a Common Space Site License. This is a Unit as defined under the Pennsylvania Uniform Planned Community Act. P = Public. Facilities owned by a public utility company. Payment Key: GCE = General Common Expenses. Fees charged and shared equally by all Unit Owners to cover Association costs included in the annual budget (e.g. trees and bushes outside each Lot, mowing, pruning, mulch, fertilization, insect and weed control, snow/ice removal). CRF = Capital Reserve Fund Expenses. 35 Page 1 of 3 KINGSFIELD COMMUNITY ASSOCIATION COMMON SPACE SITE LICENSE AGREEMENT THIS LICENSE AGREEMENT made this day of, 20 by and between KINGSFIELD COMMUNITY ASSOCIATION, a duly authorized Pennsylvania nonprofit corporation, having its principal office and place of business at Grosse and Quade Management Company, Second Floor, 762 East Main Street, Lansdale, Pennsylvania (hereinafter referred to as "Licensor") and residing at, being the titled owners of the real estate situated at (hereinafter referred to as "Licensee"). WHEREAS, Licensor is a duly formed Pennsylvania nonprofit corporation formed under the Pennsylvania Planned Communities Act (hereinafter referred to as the "Act"), whose primary purpose and duties are to regulate the common area of the Kingsfield Community Association, being an association of all record owners within Kingsfield, a Planned Community; and WHEREAS, the Act and Section 6 of the Declaration of Covenants, Conditions and Restrictions of Kingsfield, a Planned Community (hereinafter referred to as the "Declaration") establishes the Association as the governing body for all unit owners and imposes upon the Association the responsibility for the maintenance, repair, replacement, management, operation and administration of the common area; and WHEREAS, the Act and Section 17(c) of the Declaration grant authority to the Board of Directors to regulate the use of the common areas and any alteration thereof, with the express written approval of the Board: and WHEREAS, pursuant to the Act and Sections 6(e) and 19(b) of the Declaration, the Board shall have the right to impose rules and regulations governing the use and care of portions of the common area to the extent reasonably related to the community association's maintenance, repair and replacement obligations under the Declaration and pursuant to that authority, the Board has adopted rules and regulations relating to the common areas; and WHEREAS, Licensee has requested permission from the Board to install plantings and/or other materials in the common area, and Licensor is willing to do so pursuant to the terms and provisions of this License Agreement as hereinafter set forth. NOW THEREFORE, in consideration of the mutual covenants set forth herein, and intending to be legally bound hereby, the parties hereto agree as follows: 35

36 Page 2 of 3 1. Licensor shall permit Licensee, their successors and assigns, to place natural plantings and/or materials in the common area adjacent to Licensee's unit. The areas in which the natural plantings and/or materials may be installed pursuant to this License shall be in accordance with the architectural and landscape rules and regulations of the Association, as amended from time to time, and as shown on an Alteration Request Form. 2. The property of Licensor, upon which Licensee may install said natural plantings and/or materials, shall be only those adjacent portions of the common area as shown on the Final Subdivision Plan as approved by Franconia Township and recorded in the Office of the Recorder of Deeds in and for Montgomery County (hereinafter referred to as the "Plan"). 3. The exact nature of the natural plantings and/or materials and their location shall be installed exactly as shown on the Alteration Request Form submitted by Licensee. 4. Licensee shall be solely responsible for locating any underground utility lines, including, but not limited to, water, sewer, electrical and cable television. Licensee shall further be responsible to install said natural plantings or materials in such a manner as to not cause any damage to any underground utility lines or any disruption in services to any other units. 5. Licensee shall be solely responsible for the installation, maintenance and replacement of any natural plantings and materials authorized by this License Agreement. In the event that Licensee fails to comply with their responsibilities under this paragraph, Licensor reserves the right to terminate this License Agreement upon written notice to Licensee or, at Licensor's election, to maintain and/or remove any natural plantings, and any expenses incurred by Licensor in doing so shall be assessed against Licensee as though it were a limited common assessment under the Declaration. 6. Licensee shall, at all times, exercise their rights under this license in such manner as to avoid interference with, or disruption of, Licensor's normal operations and regulations of the common areas. Furthermore, Licensee hereby recognizes and acknowledges that said license is subordinate to Licensor's obligations, as owner and regulator of the property herein; therefore, Licensee, its agents, servants, successors and assigns shall comply fully and promptly with Licensor's regulations, directions and instructions, as amended from time to time. 7. Licensee shall indemnify and hold harmless Licensor, its officers, employees, agents servants, members, successors and assigns, regardless of any negligence on their part, from and against any and all loss, damages, claims, demands, actions or cause of actions, suits at law or in equity, judgments, liability or expenses, including attorney's fees for damages for personal injury, including death, to any person whatsoever, and for damage to property of any person whatsoever, including loss or destruction thereof, arising out of any accident or occurrence, however caused, in or as a result of the exercise by Licensee of the license granted herein. 36

37 Page 3 of 3 8. Licensor may, in its sole discretion, and with or without notice, terminate the license granted herein for causes beyond Licensor's control. Such causes shall include, without limitation, the laws, regulations, acts, demands or interpositions of any federal, state or local government agency, acts of God, fire, flood, weather, war, acts or terrorism or any other cause beyond Licensor's control, whether similar or dissimilar to the foregoing. In the event of any termination pursuant to this paragraph, Licensor shall have no liability for loss or damage of any kind incurred or claimed by Licensee as a result of said termination. 9. This License Agreement may not be amended, except by agreement in writing duly signed by the parties and their authorized officers hereto. 10. This License Agreement shall governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania. 11. The privileges, covenants and obligations of Licensee hereunder shall extend to and be binding upon its successors and assigns who are owners or occupiers of the property now owned by it, and all rights and remedies reserved by or otherwise belonging to Licensor herein shall accrue to and may be exercised by it successors and assigns. 12. Licensor reserves the right, in its sole discretion, to record this License Agreement the Officer of the Recorder of Deeds in and for Montgomery County, Pennsylvania without prior notice to Licensee. 41 Resolution A Site License Procedures Original Resolution May 14, 2003 Revised August 24, 2018 Page 1 of 2 The Process The homeowner must sign and submit an Alteration Request Form and a Common Space Site License Agreement for any project that extends into the common ground beyond the 6-foot property line of their house. Those documents must be reviewed and approved by the Architectural Review Committee or Landscape Committee, which submits its recommendation to the Board of Directors. Someone from the appropriate committee may visit with the homeowner and/or preview the proposed alteration so there is a clear understanding of the plan. The Board of Directors then will review the plan and, if necessary, review the plan at the resident s home to get a visual of the area. If approved by the Board, signed copies of the Alteration Request Form and the Site License Agreement will be sent to the homeowner before any work begins. They will become one document. Any change to a previously approved alteration will require another plan and subsequent approval. The homeowner will be required to maintain the area described in the alteration request. The Board has the power to grant exceptions to these procedures, where appropriate. License Areas The site license will cover only the following areas beyond the six-foot property line of the units: - 4 feet at the rear of houses (the house side opposite the garage and street) for planting beds, decks and patios. Some may consider this the side of the Coventry model.0-4 feet for planting beds on the sides of patios/decks at the rear of houses. - 2 feet around air conditioning units and generators. - 2 feet for plants only (no trees or shrubs) outside the front door for Coventry models. - 2 feet off the street-side corner of the units, where it makes sense, to support a tree or larger shrub. License Areas Specifically Excluded (not allowed) - No license is to be granted for the area between houses, except as noted above. - No alterations in the street side of houses, other than planting flowers in the street tree bed areas or landscaping between the house and sidewalk of the Coventry model. 41

42 Revocation of the License Page 2 of 2 The Site License Agreement will be signed by the homeowner and will state that he/she will follow the terms of the license, and will restore the ground to the original condition at their cost if the license is revoked. It will make clear that if the Association has to restore the licensed area, the homeowner will be charged for the restoration of the ground. The homeowner will be notified in writing if there is a violation. The procedure outlined in Resolution B of the Homeowner Manual will be used to enforce the license document, fine violators, and collect any funds due to the Association. The Board can allow the homeowner up to 45 days for the violation to be corrected before taking any action, assuming that the homeowner agrees to correct the violation. The homeowner will be notified in writing of the date that fines will begin, the amount of the fines, the date that has been scheduled to restore the common ground, and the estimate of cost to restore the common ground. The Board will collect the fines and any cost to restore the common ground. The Board may waive or extend the time and action if the homeowner has a hardship. The Board may revoke the license for any of the following reasons: - The homeowner significantly changes the initial alteration request submitted without additional approvals. Adding annual type flowers or perennial flowers to a planting bed is not considered a significant change. However, adding shrubs would require additional approval. - The homeowner fails to properly maintain the planting areas or other work described in the alteration request. The term properly maintain includes mulching, weeding, and replacing or removing any dead shrubs or flowers. Perennials must be pruned and cut back yearly by the homeowner. - Shrubs, ground cover or other invasive plants growing outside the licensed area into the unlicensed common ground. - Landscaping plans that do not adhere to these guidelines. - If these procedures are amended, previously approved licenses and alteration requests will be grandfathered. WHEREAS, Section 6(a) of the Declaration the Board of Directors shall have the power to impose rules and regulations governing the use and care of portions of the Dwelling, Lots and Common Facilities to the extent reasonably related to the Community Association s maintenance, repair and replacement obligations hereunder. NOW, THEREFORE, BE IT RESOLVED THAT the Board of Directors hereby adopts the following policy and guidelines on home protection/for sale signage and concrete paint colors on the homes. A. The stucco and concrete paint colors of homes may be replaced or repainted. Colors must closely match those originally applied by the builder. B. The home protection/for sale signs size and location policy will read as follows: Size is limited to 200 square inches, one sided and no more than 24 inches in total height. Placement of the sign shall be against the house facing the street within the six-foot bed area. Home protection signs do not need Board of Directors approval as long as this policy is followed. ALSO, BE IT RESOLVED THAT the Board of Directors hereby adopts the following policy and guidelines on storm doors, house address signage, deck stain and awnings. A. The storm door policy will read: Storm doors may be installed on the font or the back of homes within the community. All doors must be full view and plain glass doors. The color may be white, black or match the color of the entrance door of the house. Storm doors do not need Board of Directors approval as long as this policy is followed. 57

58 Page 2 of 3 B. The house address plaques policy will read: The house plaque may be installed only on the wall on either side of the garage door and at eye level. The address plaque approved for installation in the community is style Villa Nova manufactured by Whitehall Products. If necessary a similar plaque may be used. The approved background colors are only burgundy, green, tan and black. The size of the sign shall be 9.5 x 16.5 inches. All numbers and letters must be raised polished brass. House address plaques do not need Board of Directors approval as long as this policy is followed. C. The awning policy will read: Awnings can only be installed on the rear of the houses. Awnings must be retractable cloth. When the awning is fully extended the perimeter of the patio or deck can be covered, but the awning cannot extend past the perimeter. Solid colors are preferred. Request for the installation of an awning or any type of exterior sunscreen must be processed through the Board of Directors. D. The deck stain policy will read: The maintenance of deck and deck railings must be done with pressure treated wood, vinyl or composite deck material. Staining or painting decks and railings the same color as the house siding or stucco is pre-approved. Any deviation from the above policy must be submitted to the Architectural Review Committee for referral to and approval by the Board of Directors. Deck staining does not need Board of Directors approval as long as this policy is followed. If a deck is replaced or modified, an Alteration Request Form is required. The homeowner must contact Franconia Township to determine if a building permit is required and then secure a permit if it is required. ALSO, BE IT RESOLVED THAT the Board of Directors hereby adopts the following policy and guidelines on flag use, seasonal decorations and outside lighting. A. The flag use within the community policy will read: Each homeowner shall have the right to display American flags within their six-foot lot area. A flag may be flown from a pole attached to the dwelling, not to exceed a height greater than the front eave of the roof. There shall be no free standing poles allowed in the community. Flags may be 3 feet by 5 feet or smaller in size. All standards for U.S. flag display must be followed (including retiring the flag from dusk to dawn, unless lighted). A seasonal or holiday flag is permitted, but no banners or windsocks are permitted. A limit of two flags per home is allowed. Flag display does not need Board of Directors approval as long as this policy is followed. B. December Holiday and Seasonal Decorations policy will read: Homeowners who wish to decorate their homes for a holiday may do so up to thirty (30) days before and fourteen (14) days after the holiday. Main front windows may be 58

59 Page 3 of 3 decorated with clear or colored lights on the inside of the house. Front or main doors may be decorated with lighted wreaths and/or garland. Front windows, main doors and window areas over walks leading to main doors may be lighted with temporary ground mounted flood lights of clear or appropriate colors (red, blue and green). Electric window candles in each window may be used. All lights used in displays must be constant burning. No flashing lights are permitted. Holiday decorations do not need Board of Directors approval as long as this policy is followed. C. The outside lighting policy will read: Security Lighting: Security lights may be mounted on the rear of the house in locations that do not cause annoyance to the neighbors. Any flood type of lighting should be equipped with a motion detector to preclude the necessity of all-night lighting. Walkway Safety Lighting: Homeowners, especially those with the Coventry model homes, may feel a need to light the long walkways for safety. Solar low level, low voltage systems can be used along the edge of the walkway. Suggested light fixtures are Intermatic Malibu Tier lights. The approved style numbers are LXI-4W, LVI81-7W or LM5-7W. Spacing should be at least 5 feet apart. The spacing will allow good walk lighting without being obtrusive to others. The lighting is only permitted in the 6-foot bed area.
