2 MEADOWVIEW ESTATES HOMEOWNERS ASSOCIATION RULES & REGULATIONS INTRODUCTION These Rules and regulations, as enacted by the Board of Directors of the Meadowview Estates Homeowner s Association (the Board ), are established for the safety, benefit and well being of the Meadowview Estates Homeowners. These Rules and regulations apply to all unit Homeowners, lessees of units and to the families, guests and invitees of such Homeowners and lessees. NOTE: These Rules and Regulations do not supersede or amend any provisions of the Declaration or Bylaws of Meadowview Estates Homeowner s Association (the Documents ), but are to augment, detail and interpret them. Every Homeowner of Meadowview Estates is responsible for compliance with and enforcement of these Rules and Regulations. Violations should be reported to the Management Office. The Board may modify these Rules and regulations, by a majority vote of the Board when circumstances dictate the need to do so. Except in emergencies, all communications with the Meadowview Estates Board of Directors should be in writing or sent via . Should an emergency arise related to the association or association property after business hours, please call , and ask the dispatcher to contact the manager-on call. In addition to these Rules and Regulations every occupant and visitor to Meadowview Estates is required to fully comply with all township ordinances. 1

3 LIABILITY AND RESPONSIBILITY 1. The various parts of the Common Elements shall be used only for the purposes for which originally intended and in a manner consistent with the Documents. 2. Each Homeowner is responsible for the actions and conduct of all tenants or other occupants, visitors, guests and invitees for full and complete compliance with the Declaration, By-Laws and these rules and regulations of the Meadowview Estates Homeowners Association. USE, CARE AND MAINTENANCE 1. Units shall be occupied by Homeowners, their family, tenants or guests for use as a private residence only. 2. No part of the Property shall ever be used or caused to be used or allowed or authorized in any way, directly or indirectly, for any business, commercial, manufacturing, mercantile, storing, vending or other such non-residential purposes. 3. It is the duty of each Homeowner, at his/her sole cost and expense, to maintain his dwelling unit and lot in a neat, safe, sanitary and attractive condition. The Homeowner s maintenance responsibilities shall include, but not be limited to, painting, repair and upkeep of the exterior of his dwelling unit, including the roof and chimneys and all areas within the Homeowner s lot property lines. All repair work or renewal projects to the exterior of homes walls, roof, doors, windows, etc., that are in a visible state of disrepair or incomplete repair must be completed in a timely fashion, in no more than thirty (30) days, or the homeowner must notify the Board and request an extension for cause. 4. Each Homeowner shall be responsible for snow removal from his individual driveway and driveway apron, and/or de-icing of the entrance paths, walkways and steps. The Association is not responsible for any of the above. 5. Each Homeowner shall also be responsible for the repair and replacement of the driveway, entrance paths, walkways and steps. 6. The Homeowner is responsible for the maintenance of the lot s front, side and rear flowers, shrubs and trees and flower/tree/shrub beds. 2

4 7. The failure of a Homeowner to maintain his property in such condition as to prevent damage to the property of others will be deemed negligent and the Homeowner will be responsible for the resultant damage. 8. No one shall make or permit noise that unreasonably disturbs or annoys other unit residents. 9. Each Homeowner will be responsible for any damage, destruction, injury or defacement to commonly-owned property of the Association committed by members of their family, guests or invitees, resulting from the carelessness or negligence of family members, guests, invitees or pets. 10. Contractors or workmen engaged by a Homeowner may only work in any unit or on any owner s lot between the hours of 8:00 AM and 6:00 PM (except for emergency repairs.) 11. No one, including the Board or the management company representative is allowed to enter a unit without due notice and permission from the Homeowner. 12. All audio, video, and/or other electrical equipment of any kind, and all appliances of any kind, installed or used in a unit shall comply with all safety rules, requirements, regulations and recommendations of public authorities and Board of Fire Underwriters having jurisdiction. 13. Any patio/outdoor furniture or outdoor carpeting must not extend beyond the deck/patio perimeter. 14. Use of all grills, chimneas or the like shall conform to township ordinances. 15. No hazardous, combustible or dangerous materials of any kind may be kept or stored in units anywhere on the property. 16. Fireworks and firecrackers are specifically prohibited anywhere within the community. 17. Individual yard/garage sales are not permitted. Community sales must be approved by the Board. 18. No laundry may be hung on permanent or temporary clotheslines, railings or decks or on the common areas. 19. No items of personal property shall be permitted or left on the common areas or entranceways. 3

5 20. Only two moveable toy structures are permitted per home in the rear of the Unit. 21. No signs, including real estate, advertisement, flags (other than US National), banners or the like shall be inscribed or exposed on or at any window or any part of any unit, lot or common area. Open House signs are permitted the day before and the day of the Open House, which may be placed near either entrance to the community and/or Homeowner s lawn and shall be removed immediately following the Open House. Security signs are permitted in the front flowerbeds. 22. Privacy fencing between decks is allowed but must be pre-approved by the Board of Directors. EXTERNAL CHANGES 1. NO ALTERATIONS OF ANY KIND WHATSOEVER in the architecture or external appearance of any unit including grounds or new trees, shrub beds, landscape and/or hardscape designs may be undertaken without the prior approval of the Board of Directors. A fine will be levied on those who do not get prior approval from the Board of Directors or the management company. A detailed Architectural Change Request ( ACR ) form must be submitted to and approved by the Board. 2. Homeowners must follow the specifications set forth for the front door paint (Sherwin Williams, Pewter Green SW6208, exterior gloss) and garage door paint (Exterior White) colors. 3. Any plants added to the common area must first be approved by the Board of Directors and will become the property of the Association. 4. Screen doors must be full view. 5. Stucco painting or replacement must match existing color and texture. 6. Roof shingles should be GAF 3-tab Weathered Grey or GAF Timberline HD Weathered Wood. Any Homeowner wishing to use a different shingle must first submit a sample to the Board for its approval. 7. Garage doors must be white, with solid 4 panels/ 16 blocks for a single door or 4 panels/ 32 blocks for a double door. 4

6 8. Repairs or refinishing of doors, stucco, roof, etc. do not require submission of an ACR provided there is no change in color, and matching specified paints, shingles, materials, etc. are used. (If desired, samples may be submitted to the Board for confirmation of compliance.) TRAFFIC AND PARKING 1. The speed limit is not to exceed 25 miles per hour as posted by the township. 2. Parking or driving of any vehicle on lawns and/or tended grounds of the property is strictly prohibited. 3. Loading and unloading of moving vans, delivery vans, trucks or cars is restricted to the Homeowner s driveway and the indented parking areas only. The Homeowner shall pay all costs to repair any damages to common areas. 4. Parking is permitted in designated indented parking areas only and not on the street. Vehicles must be parked within the painted lines and may not park sideways across the designated parking spaces. 5. Parking across the sidewalk and/or over the driveway apron is prohibited. 6. Parking of the following vehicles is permitted on Meadowview Estates property: a. Passenger cars b. Motorcycles c. Vans d. Trucks ¾ ton pick-up trucks are the maximum size permitted. 7. Parking of the following vehicles within the community is not permitted: a. Recreational trailers or hauling trailers b. Motor Homes c. Recreational Vehicles d. Commercial Vehicles 5

7 8. The Board and the management company reserve the right to have the following vehicles removed and stored at the expense of the vehicle owner: a. Recreational trailers or hauling trailers, motor homes, recreational vehicles and commercial vehicles. b. An inoperable vehicle left or stored on the property for more than two weeks, unless it is stored in the owner s garage. c. A vehicle without a valid registration sticker, license plate or inspection/emissions stickers or left unattended on or along the premises. 8. Car repairs are prohibited in the parking areas or roadways. No oil or other fluids may be drained onto the pavement or into the sewer or storm drain systems. 10. Car washing is permitted in driveways only. 11. The use of vehicles for storage purposes is strictly prohibited. TRASH DISPOSAL 1. Upper Dublin Township recycling ordinances are in effect at Meadowview Estates. Information about items to be recycled and local recycling procedures may be obtained from Upper Dublin Township s Public Works Department. (215) ext Individual trash/garbage and recycling containers are not permitted to be put out prior to 6PM the day before trash/recycling day and must be brought in by 9 AM the day after trash pick up day. 3. All trash/recycling materials must be prepared for pick up in accordance with Upper Dublin Township Rules and Regulations. 4. Upper Dublin must be contacted concerning the disposal of bulk items. NOTE: Such items specifically include, but are not limited to, discarded appliances, carpeting, construction material and mattresses. Call the number above for more information. 6

8 PETS 1. Pennsylvania law requires dogs 6 months and older to be registered with the County. Pets must also be properly inoculated per state law and township ordinance. 2. All pets must be on leashes or tethered at all times when they are outdoors. Pets may not be left tethered in any common area. 3. No pets are permitted to roam the property and the Board may impound the pet and have it sent to the local animal shelter at the Homeowner s expense and/or fine the Homeowner. 4. Homeowners / residents are responsible for controlling their pets and for preventing them from disturbing the peace and otherwise creating a nuisance on the property. If a pet is not controlled, Upper Dublin will be notified for action and/or a fine may be assessed. 5. Homeowners / residents are responsible for immediately cleaning up after their pets and for properly disposing of the waste in a plastic container and depositing it in a trash receptacle at your residence. By law, you must clean up after your pet(s). 6. Homeowners / residents are responsible for all damages to any area caused by their pets and any injury or disturbance their pets may cause or inflict. ADDITIONAL REGULATIONS 1. Satellite Antennas /Dishes cannot be more than 18 in diameter and must be installed in the rear of the property in an inconspicuous place so as not to be visible from the street or in plain view of other homes. An Architectural Change Request form must be completed and submitted for approval to the Board BEFORE installation. 3. Retractable Awnings can be motor driven and/or manual. Acceptable fabrics / colors are from Sunbrella : Hemlock Tweed (solid dark green Style #4605), Forest Green/Beige/Natural Fancy Stripe (striped n Style #4932) or Beige Solid. The awning frame must be white, the awning trim must be scalloped and the motor switch must be inside your home. All retractable awnings must be installed over rear decks. An architectural Change Request Form must be completed and 7

9 submitted for approval by the Board BEFORE installation. Retractable awnings must also meet township approvals. 4. Driveways may only be expanded to the furthermost edge of the builder-installed walkway and may only be done on the front door side of the driveway. The driveway must be sealed to ensure that it matches the existing drive. Stone, concrete, Brick etc. are not acceptable replacements for asphalt. The apron cannot be expanded. An Architectural Change Request Form must be completed and submitted to the Board BEFORE installation. 5. Decks shall be constructed of pressure treated wood. Other alternative materials, eg. PVC (vinyl) may be acceptable, and may be used only on approval of a detailed ACR. Decks cannot extend further tha 15 from the rear of the building and the railing cannot exceed 4 in height. An Architectural Change Request form must be completed and submitted for approval by the Board of Directors BEFORE installation. 6. Any new patios or alterations to existing patios must receive prior approval by the Board. LATE FEES AND FINES The common assessment for the year is due on January 1 st of each year. A late charge of 10% will be assessed to any amount due that is not received in the management office by March 1 st. Thereafter, a late fee of 10% will be assessed every 60 days that a balance due remains. Late fees will also be applied to any special assessment that is not paid by the due date. This is in addition to other remedies as allowed by the Declaration and PA Association law. The Meadowview Estates Board of Directors has written and approved the following fine structure, which may apply, except as otherwise written in these rules, to any and all violations as deemed necessary by the Board: 1 st Offense Written warning 2 nd Offense $ fine levied 3 rd Offense $ fine levied 4 th Offense $ fine levied For each subsequent offense, an additional $ will be levied. 8

10 Continued violation may result in additional fines assessed, or the Board of Directors may choose to correct the violation and assess the owner for the cost to the Association. A late charge may be imposed for fines not paid within 30 days of notification. Failure to pay fines may also result in collection costs charged to the Unit Owner. Fines, late charges and court costs levied as a result of violations of the Declaration, By-Laws or Rules and Regulations are the responsibility of the Homeowner to pay. MISCELLANEOUS Any Homeowner leasing a unit in Meadowview Estates must submit a copy of the signed lease to the Management Office within ten days of execution. Every lease MUST include the statement that the lessee understands and agrees to abide by the Rules and Regulations and Declaration of the Association, and that in the event of a discrepancy between the lease and the governing documents of the Association, the governing documents take precedence.
