4 Non License Management FlexiCadastre is flexible enough to not only deal with Mineral Rights but also with many other types of rights, which are directly associated with the mining business and very important to the land management process. Examples are: Water Rights Environment Permits Surface Rights

5 Water Rights: Chile Some Facts: Chile is responsible for more than 1/3 of the world copper production; biggest operation are in Northern Chile In the North of Chile Water values more than Gold!! The Atacama desert, according to NASA, is the driest desert in the world In order to guarantee the supply of water to the mines in operation, most companies found it necessary to explore for water sources and the competition for this resource is immense.

8 Water Rights: Chile Water exploration and exploitation (or use) in Chile is regulated by law and enforced by the DGA (Direccion General de Agua Application Process Includes: Water Exploration Rights Water Exploitation Rights (Derecho de Uso) Other processes, related to use of water for energy generation, agriculture, etc.

9 Water Rights: Chile Water Exploration Rights is very similar to Mineral rights process. In Chile: Application for polygons (i.e. license areas) Limited to ha of active area per company, so it s very important that tight control of active exploration permits are kept. Usually is granted for 1 year but can be granted for up to 2 years according to DGA discretion The process includes publishing the application and a waiting period during which a third party can contest When there is a discovery, company can apply to exploitation (or use) of water and the exploration right extinguishes

12 Water Rights: Chile Exploitation Right (Derecho de Uso): After exploration process, company can apply for exploitation of one or many WELLS Company will include in the application the desired water flow rate and volume (per second and annual) and protection radius. If radius is greater than 200m (the minimum and default radius), applicant must justify by presenting a report. DGA can then accept or change those parameters.

13 Water Rights: Chile Each Well are associated with one process in the DGA (called Resolucion de Derecho de Agua RDA or Water Rights Resolution). One process can have One to Many Wells. Associated License: Water Exploration License License Term is indefinite Payment must be made IF water is NOT used. *there is an advanced discussion to change the last two points

14 Water Rights: Chile Suggestion for Modeling: License Type Group = Water Rights License Type = Water Exploration (polygon type); Water Use (point type) (water use = wells) For the wells, use the Condition to: Inform granted Water Flow Rate (liters/second) (Condition=Water Flow) Inform Well buffer area (circle with radius x meter) (Condition=Protection Area; unit=meter; has shape) Create a new GROUP: Water Resolution Workflows shall be created for Exploration License and for the group Water Resolution. Not for Wells.

23 Environment Permits: Argentina For the Environmental Permits, usually companies will have Internal procedures preparation of documents and data External procedures presentation, follow up, obtain permits, comply with obligations, depending on the type of the document/process

24 Environment Permits: Argentina For the exploration and exploitation in Argentina, it is necessary by law to apply for some environment permits. Those permits have its own area, associated license (from 1 to many) and does have own tasks and deadlines During the process, company must present an IIA Informe de Impacto Ambiental Environment Impact Report) in order to get the authorization for the exploration or mining to start. Those Environment Permits were implemented as License Type Up to now, no workflow was created, but this will be the next step.

32 Surface Rights: South America Surface rights can usually be associated with different groups/departments in an organization, but it is very important that companies worry about these issues from the very beginning of the exploration process. Could include owned land (farms, real state, constructions) rented property (usually associated with a contract) as well as easements (servidumbre), be it right of way, industrial plant building, communities land, etc

33 Surface Rights: South America In some jurisdiction there exist the need to integrate the access or the use of the surface with the land management. And even when not mandatory, it would be a good practice those days to avoid future conflicts. On that case, Community relations should be working close to Exploration and Land Group to avoid unpleasant surprises In Argentina it is very important that the surface area are well defined. As part of the application process for Mineral Rights an agreement needs to be reached with the land owner(s) before the company can proceed with the work.

40 In Summary The important message is: All the information we have mentioned here are associated with every phase of the mining lifetime, from grassroots exploration up to mining closure It is very common in most organizations that this information is spread across different departments within the organization (when it is available, especially for the surface data) FlexiCadastre can be used as a very effective tool to help organizations to manage and consolidate this information in a very efficient way
