The fourth text amendment is being proposed by Community Planning and Building Staff in coordination with the County Attorney's Office to exempt a Governmental or Quasi-Governmental Agency from the Subdivision Regulations when the agency is conveyed land that is for public use. The draft amendments were presented to the Board of County Commissioners at a work session on June 7, 2016, and to the Planning Commission (PC) on June 15, Agency comments for TA #16-01, & were presented and discussed with the PC on July 20, 2016 and for TA #16-05 on August 17, Following the review of the agency comments, the PC directed staff to schedule a joint public hearing with the BOCC. Discussion The following text amendments are being proposed to various sections of the Calvert County Zoning Ordinance to reduce and/or remove restrictions and provide more flexibility for development in the County: TA#16-01 proposes to permit Boat Dealerships in Light Industrial (I-1) Zoning District TA#16-02 proposes to create new uses on the Land Use Chart for Non-Farm Breweries, Distilleries and Wineries to permit these uses as Home Occupations TA#16-03 proposes to permit Animal Shelters in the Light Industrial (I-1) Zoning District TA#16-05 proposes to exempt a Governmental or Quasi-Governmental Agency from the Subdivision Regulations when the agency is conveyed land that is for public use Recommendation/Conclusion Recommend that the BOCC and the Planning Commission hold the public hearing, close the record and take action to adopt the text amendments. The space occupied by all the occupations on a single site shall not exceed 600 square feet including storage. Exception: The use of a tobacco barn for a home occupation is permitted, regardless of size, with the conditions that (a) the barn shall have been in existence as of the effective date of this condition (05/01/06); and (b) the barn shall be constructed of wood; and 8. Non-medical and medical offices, office support services, home studios, indoor commercial kennels, commercial kitchens, non-farm breweries, non-farm distilleries, non-farm wineries and personal service uses are permitted as home occupations. Other uses that are listed separately in the Land Use Charts shall not be permitted as home occupations (e.g., Automobile Repair, Commercial Studios, Commercial Performing Arts Studios, etc.). 9. Total signage for home occupations shall be restricted to four square feet, and all signs shall be erected at least 10 feet from the edge of the right-of-way. 22 Text Amendment Calvert County Zoning Ordinance 7-1 SUBDIVISION REGULATIONS Under the authority of Article 66B the Land Use Article of the Maryland Annotated Code of Maryland, the following regulations governing the subdivision of land are hereby established for all areas of Calvert County except those within Incorporated Towns of the County Controls and Application A. Application. These Regulations shall apply to all new subdivisions and to extensions and revisions of recorded subdivisions, except for: 1. The division of land for purposes other than building development. 2. That portion of a divided tract which is not to be used for the purpose of building development. 3. Subdivision of land by court order. 4. Conveyance to a governmental or quasi-governmental agency for public use. The Board of Appeals may grant a variance for the resulting residue parcel, from lot area, lot width, and setbacks per Section 11-1, where the hardship is created by the conveyance of land to a governmental or quasi-governmental agency. 21

BACKGROUND/PROPOSED REGULATIONS: The Zoning Ordinance currently permits boat dealerships in the Marine Commercial (MC) zoning district and some of the Town Center districts. The use requires a special exception from the Board of Appeals to be permitted in the Rural Commercial (RC) zoning district and several Town Center districts. The BOCC requested that staff draft text amendments which would permit boat dealerships within the Light Industrial (I-1) zoning district. The text amendment proposes that boat dealerships be permitted by right, without conditions, in the I-1. Section of the CCZO states the following regarding uses in the I-1: A. This Primary District is intended to provide available space for light industrial uses, free from other uses which might affect such development. Industrial Parks are encouraged in this District. B. Light industries include those which manufacture, process, store, package or distribute goods and materials and are normally dependent on raw material produced elsewhere. Uses that may have adverse impacts such as noise, odor, or dust on neighboring properties require a special exception from the Board of Appeals. This District is not intended for retail sales establishments such as department stores, general stores, home improvement stores, convenience stores, etc. However, it is the intent to permit the sale of unusually large items that require the use of heavy freight transport and generate low automobile traffic volumes. Such uses may include building materials sold in bulk, heavy machinery and equipment, and large vehicles such as farm tractors and large boats.

Community Planning and Building has permitted non-farm breweries in the County by classifying them as Light Manufacturing or Flex Space Business, which includes light manufacturing. The CCZO defines Manufacturing and/or Assembly, Light as "The production processing cleaning, testing and distribution of materials, goods, foodstuffs and products which by the nature of the materials, equipment and process utilized is to a considerable measure clean, quiet, and free of any objectionable or hazardous element." This use is currently permitted in the Light Industrial (I-1) and Employment Center (EC) Zoning Districts. Light Manufacturing, less than 5000 s.f., is conditionally permitted in Agricultural Preservation Districts (APD) and requires a special exception from the Board of Appeals to be permitted in the Farm and Forest District (FFD), Rural Community District (RCD), Residential District (RD), Historic Districts (RD) and Rural Commercial (RC).

Initially, the breweries were permitted, and are still permitted to have tastings and sell beer to a person of legal drinking age who participates in a guided tour of the facility or attends a scheduled promotional event or other organized activity at the licensed premises. The tastings are limited to not more than six samples of beer brewed at the licensed premises, with each sample consisting of not more than 3 ounces from a single style of beer. The sales of beer brewed at the brewery for off premises consumption was and is permitted to anyone who participates in a guided tour of the brewery or attends a scheduled promotional event or other organized activity at the licensed premises, with a limit of 288 ounces of beer per person. The law was updated to include language to allow on site consumption in addition to the tasting that was previously allowed. An on site consumption permit is required and entitles the holder to sell beer brewed at the brewery for on premises consumption to persons that have attained the legal drinking age. The law limits the total amount of beer sold each year for on premise consumption to a maximum of 500 barrels. The Liquor Board requires proof of zoning approval as part of the process to obtain a license for on-site consumption. The text amendments propose to permit Non-Farm Breweries, Non-Farm Distilleries and Non-Farm Wineries, as a Home Occupation. A Class I Home Occupation is conditionally permitted but does not allow on-site appointments, customers or clients. The Class II and III Home Occupations do permit customers on-site but require a special exception from the Board of Appeals in the FFD, RCD, RD, APD and HD zoning districts. The amendments also create new uses on the Use Charts for Non-Farm Breweries, Non-Farm Distilleries and Non-Farm Wineries which are proposed to be conditionally permitted in the I-1, RC, Marine Commercial (MC) and EC. The text amendment proposes to add animal shelters to the definition of veterinary hospital/clinic and make it a permitted use for livestock and a conditional use for small animals/household pets in the I-1.
