1 CONDITIONAL USE PERMIT APPLICATION FOR ALCOHOL SALES CITY OF MONTEBELLO Community Development Department Planning Division 1600 W. Beverly Boulevard Montebello CA This checklist should be reviewed with a Planner at the public counter and must be submitted with the Conditional Use Permit (C.U.P.) application. A C.U.P. request is heard by the Planning Commission at a noticed public hearing. Any appeals of the decision will be heard by the City Council. A complete C.U.P. application submittal consists of the following materials: Filing Fees Please consult with a Planner to determine the required application fees. Conditional Use Permit (C.U.P.) Application Completed C.U.P. application. Proof of Ownership 15 copies of: Master Land Use Application Completed form (attached) that includes: a) Comprehensive description of the project and the specific entitlements (e.g. Variance, Conditional Use Permit, Site Plan Review, etc.) requested. b) Property owner signature. If application is not signed by property owner, written consent (signed) from the property owner is necessary authorizing the applicant to submit application. Environmental Information Form Attached to Master Land Use application. Development Plans folded copies of dimensioned and scaled plans that include: a) Project site address. b) Applicant, name, address, and phone number. c) North arrow, scale, and vicinity map. d) Site plan showing all property lines and distances to center line of streets/alleys. e) Date of preparation of plans and revisions (if applicable). f) Table showing development calculations (e.g. lot coverage, floor area ratio, parking, etc.). g) Clearly labeled location of all existing and proposed structures. h) Detailed and complete floor plans (to scale) with a breakdown of floor area calculations. Number of restaurant seats/bar seats. Square footage of seating/dining area. Square footage of bar area. Square footage of kitchen, bathroom, storage, office, and other support areas. Square footage and linear shelf space of alcohol display area if proposed to be sold for off-site consumption. Delineation and square footage of area devoted to dancing, music, or entertainment. Customer waiting area. i) Clearly labeled uses of all existing and proposed structures. j) Elevations of proposed building(s) with respective height dimensions. k) Clearly labeled location and uses of all existing structures on adjacent properties. l) Setback dimensions of all existing and proposed structures. m) Vehicle circulation (driveways, access, alleys, dimensions, and backup space). n) Location of all existing and proposed fences, walls, and other screening. o) Landscape plans. p) Mature trees 4 or more in trunk diameter at breast height. q) Size and location of all exterior mechanical equipment and method of screening. r) Location of existing and proposed fire hydrants and bus stops (if any). s) All easements located within or adjacent to the project site. t) Demolition plan (if applicable). Operations Plan A detailed description of the business operation, which includes, but is not limited to the aesthetic character of the establishment, proposed hours of operation, the different types of operations (e.g. dining, bar, entertainment, dancing, etc.), the method of distinguishing the different types of operations and their respective hours, and any special or unique features in which the proposed use is to be conducted. Training Plan A detailed plan of the method and frequency of employee training to ensure an adequate and well trained staff. Security Plan A security plan for the establishment approved by the Montebello Police Department. PLANNING DIVISION T F CUP App Rev. 4/13

2 Photos Photos of the interior and exterior of the establishment. Radius Maps Maps identifying the following uses within the respective distances, and a corresponding list of the name, address, and type of alcohol license (if applicable) for all uses: 300 feet a) Other alcohol related uses (both on-sale and off-sale); b) Residential uses; c) Churches or other places of worship; d) Hospitals, clinics, or other healthcare facilities; and 1,000 feet a) Schools (public or private);, b) Parks, playgrounds, recreational facility, or similar uses. Additional Items Other items as determined by a Planner (e.g. topographic map, survey, lighting plan, drainage plan, landscape plan, sign inventory, parking inventory, grading, lease agreement etc.). 2 sets of: Notification Materials Submittal items as outlined in the Public Notification Packet Instructions handout. a) Radius map, mailing list, and mailing labels of all property owners within 300 feet of the site boundaries; and b) Radius map, mailing list and mailing labels of all occupants/tenants within 500 feet of the site boundaries if the proposed use (bona-fide restaurants are exempt) is within 300 feet of another alcohol use, residential use, religious facility, or healthcare facility; or within 1,000 feet of a school (public or private), park, or playground: Photos Photos showing general conditions of site including existing structures, walls, and landscaped/paved areas. Beverly Boulevard Montebello CA Project Address: Case # NUMBER AND TYPE OF ABC LICENSE REQUESTED: DESCRIPTION OF REQUEST: A separate description and set of findings must be submitted for each Conditional Use Permit request. This Conditional Use Permit request is to: FINDINGS: The applicant must thoroughly respond to the six directives below to make the required findings for the proposed project. A separate set of responses to these findings must be submitted for each Conditional Use Permit request. Use additional sheets if more space is necessary to complete your response. The City s Zoning Code and General Plan are available at City Hall. The Zoning Code is also available at 1) Describe how the site for the proposed use would not adversely affect the general welfare of the surrounding property owners. 2) Describe how the proposed use would not result in an undesirable concentration of premises for the sale of alcoholic beverages, including beer and wine, in the area. 3) Describe how the proposed use would not detrimentally affect the nearby surrounding area after giving special consideration to the proximity and nature of the proposed use with respect to other on-sale or off-sale alcoholic beverage establishments, residential districts and uses, schools (public or private), day care centers, public parks, playgrounds and other recreational facilities, churches and other places of religious worship, hospitals, clinics or other health care facilities. 4 4) Describe how the proposed use would not aggravate existing problems created by the sale of alcohol (e.g. littering, loitering, noise, public drunkenness, calls for service, and sales to minors). 5) Describe how the proposed use is in conformance with the goals, policies, and objectives of the General Plan and the purpose and intent of this code and any applicable specific plan. 6) Describe how the proposed use serves the public convenience or necessity. This response shall only be necessary for conditional use permit application proposals that the State Department of Alcoholic Beverage Control determines are located in an area of undue concentration as defined by State law (California Business and Professions Code Section ). Factor used to determine public convenience or necessity may include: Whether the proposed use will result in a net employment gain in the City (especially of local residents); Whether the proposed use will result in a substantial increase in business taxes; Whether the proposed establishment is a unique business addition to the community; Whether the proposed use will contribute to the long-term economic development goals of the community; Whether the aesthetic character and ambiance of the proposed use will result in an overall positive upgrade in the area and community; and The viability of the business to operate profitably without alcohol sales. SUPPLEMENTARY FINDINGS: In addition to the findings listed above, the applicant must thoroughly respond to the three findings listed below if the C.U.P. application includes the establishment of any outdoor patio and/or patio seating area. Use additional sheets if more space is necessary to complete your response: 1) Describe how the proposed outdoor patio and/or patio seating area is accessory to the establishment. 2) Describe how the proposed establishment, maintenance or operation of the accessory outdoor patio and/or patio seating area will not be detrimental to the health, safety, peace, comfort and

5 general welfare of persons in the neighborhood or injurious to property or improvements in the area. 3) Describe how the proposed accessory outdoor patio and/or patio seating area will not eliminate any required on-site parking, interfere with public easements, and will comply with all applicable regulations of the Montebello Municipal Code. LIST AND MAPS OF OTHER BUSINESSES: ALL alcohol related Conditional Use Permits must provide the following information: 1) Provide a map that illustrates the location of all schools (public or private), parks, playgrounds, recreational facility, or other similar uses that are within 1,000 feet of the project site. 2) List by name and address all establishments that sell alcohol for on-site and off-site consumption within a 300-foot radius of the project site. Use additional sheets if necessary. Also, provide a map detailing the location of the following uses with respect to the subject site. Address Business Name On or Off-Site Sales
