2 Page 2 Public Hearings Under the Planning Act to Receive Information from the Public ZBA39/13/MD & OPA-C13/MD Part of the Augustus Jones Tract and William Curtis Grant, RP 2R-6830, Parts 1 & 2, Geographic Town of Paris (Zitia Group, 64, 70 & 72 Dundas Street East, and 8 Fair Lane) information from the public prior to staff s detailed analysis. In response to a question, M. Davidson indicated that if the applications were approved, an amendment to the existing site plan control agreement for the current Harvey s/swiss Chalet property would be required. Robert Phillips, J.H. Cohoon Engineering Limited, Agent R. Phillips explained that the subject lands are to the immediate west of the existing commercial site, with the portion facing Dundas Street East being characterized by a large retaining wall, the majority of which is proposed to be removed by the applicant. He further explained that the applicants propose to regrade the subject lands to the same level as the existing commercial site, to install a new retaining wall between the subject lands and the remaining property on Dundas Street East, and to utilize the regraded subject lands as parking until the lands are developed. In response to a question from the Committee, R. Phillips indicated that it is not envisioned that there will be a roadway connection to the commercial development from Fair Lane. Members of the Public Tom Shorney, 9 Curtis Avenue South T. Shorney inquired as to how light and noise pollution from the expanded commercial site would be mitigated. He further inquired as to the status of the wooden fence at the end of Fair Lane separating the existing commercial site from the residential area, as well as the status of the Dundas Street East retaining wall. Deanna Poechman, 60 Dundas Street East D. Poechman presented two letters, one from a local resident, and one from the former resident of 70 Dundas Street East, along with a verbal submission of her own. Jolene Timon, 63 Curtis Avenue South (Letter read by D. Poechman) J. Timon advised that her children meet their bus at the corner of Fair Lane and Curtis Avenue South, and are dropped off at Dundas Street East, with several other children utilizing this route. She noted that she has been active with other public meetings held regarding this area, encompassing the Sharp Road Business Park and the TCA lands at the southern end of Curtis Avenue South, but was unable to attend due to a lack of notice for this meeting. She indicated her belief that the commercial development should be physically separated from the existing residential area, and that there is no need for additional pharmacies in Paris. Deanna Poechman, 60 Dundas Street East (Personal submission) D. Poechman advised that she has lived in Paris at her current address for the past 12 years, noting that her and her husband recently completed an addition to their home. She provided a summary of events that have occurred since the applicants began purchasing residential properties on Fair Lane, and 64, 70 & 72 Dundas Street East, and expressed concern with issues that have arisen with the tenant at 8 Fair Lane, which has initiated complaints to County

3 Page 3 by-law enforcement and the O.P.P. She noted concerns with the lack of detail in the draft Site Plan, as well as with the notification provided for the meeting, and the ability to receive information from the County. She requested that the applicants provide a solid fence or sound barrier between her property and the proposed development, as well as information regarding how the existing retaining wall will be removed. As well, she requested that the applicants provide details of their plan for the subject lands should the proposal be approved, specifically noting the status of trees, the demolition of the existing structures, how construction issues will be mitigated, and how access to any remaining homes on, or abutting Fair Lane will be provided once it has been closed. She noted her agreement with the completion of a market study to determine the need for the uses that have been proposed. Staci Martin, Wilsonville, Ontario (Letter read by D. Poechman) S. Martin indicated that she is the former resident of 70 Dundas Street East, and that she agreed to sell her house to the applicants after the completion of the existing commercial site to the east, and the sales of 72 Dundas Street East and 8 Fair Lane, noting that she did not want to deal with the applicants and the proposed development further. Mayor Eddy inquired as to whether a turnaround would be constructed at the end of Fair Lane should it be closed and transferred to the applicants, and why the proposed zoning would see a zero setback from the road allowance. Robert Phillips, J.H. Cohoon Engineering Limited, Agent R. Phillips noted that many of the issues raised would be addressed during the site plan control process. He explained that the applicants do not intend to connect the commercial site to the residential area, and that the remainder of Fair Lane would be blocked off from the site. He noted that the difference in grade between 60 Dundas Street East and the expanded commercial site would be approximately 10 feet, with a new retaining wall installed. He further noted that the current homes have a zero setback from the road allowance, and the appropriateness of permitting the commercial site to do so should be discussed with planning staff. Rob Trotter, Director of Planning, noted that staff have discussed the installation of a turnaround with the proponents, which will be addressed in the next staff report on the application. In response to questions regarding application and meeting notice requirements, M. Davidson responded that as per the provisions contained in the Planning Act, 1990, notice is posted on site and circulated to residences living within 120m of the subject lands 14 days in advance of the meeting. ZBA5/09/MD & PS2/09/MD Part of Lot 11, Concession 1, County of Brant, in the geographic Township of Brantford (Riverview Highlands (Paris) Holdings, 1039 Rest Acres Road) information from the public prior to staff s detailed analysis. Brian Smith, Plansmith Urban and Rural Planning, Agent B. Smith explained that the previous matters regarding water quantity have been resolved by the Ontario Municipal Board, and that the applicant is anxious to move forward.

4 Page 4 Councillor Powell questioned whether measures of walkability have been incorporated into the final design of the subdivision, in compliance with the Southwest Paris Secondary Plan. ZBA6/09/MD & PS3/09/MD Part of Lots 11 and 12, Concession 1, County of Brant, in the geographic Township of Brantford, located on Rest Acres Road (Edgar, 239 Mill Hill Road) information from the public prior to staff s detailed analysis. Robert van Poorten, J.H. Cohoon Engineering Limited, Agent R. van Poorten explained that the application is for Phase 2 of the development, which proposes 378 total units, including 83 single detached homes, 30 semi-detached homes (15 lots), 27 townhouse units, 190 apartment units in 3-4 storey building, and approximately 2000m² of commercial space. He noted that the plan is consistent with the Official Plan and the Southwest Paris Secondary Plan, and that it is intended to create a walkable community. Applicant Not Present Committee Consideration Seconded by Councillor Gatward That Application ZBA35/13/RA from Anita Cogger, owner of Part of the Phelps Tract, RP 1964, Part 1, County of Brant, in the geographic of Township of Brantford, located at 185 Tutela Heights Road, to rezone the subject lands from Agricultural (A) to special provision Agricultural to allow for a kennel as an additional use to the existing agricultural use, BE APPROVED. ZBA38/13/RA Part of Lots 3 and 4, Range 1, East of Mt. Pleasant Road, geographic Township of Brantford (Ryder, 770 Mt. Pleasant Road) Ruchika Angrish, Senior Planner reviewed the application.

Brant Heritage Committee Report and Minutes November 4, 2013 Seconded by Councillor Simons That the following recommendation of the Brant Heritage Committee be approved: 1. That consideration be given to adopting a by-law similar to City of Brampton By-law , which regulates vacant buildings; And further that the Legal and Property Services Division, Fire Services, the Building Division, and the Planning Division be forwarded a copy of City of Brampton By-law ; And that the Brant Heritage Committee be involved in the drafting of the any potential bylaw to provide further recommendations.
