1 Charter Township of Canton Board Proceedings September 12, 2017 A regular meeting of the Board of Trustees of the Charter Township of Canton was held Tuesday September 12, 2017 at 1150 Canton Center S., Canton, Michigan. Supervisor Williams called the meeting to order at 7:00 p.m. and led the Pledge of Allegiance to the Flag. 2 PUBLIC HEARING: 701 TRUST & AGENCY FUND 4, CONSTRUCTION ESCROW 5, POST EMPLOYMENT BENEFITS 144, TOTAL - ALL FUNDS 2,199, PH-1: Public Hearing and Approval of Millage Rates for December 1, 2017 Tax Levy. Motion by Siegrist, supported by Sneideman to open the Public Hearing at 7:04 p.m. on millage rates for the December 1, 2017 tax levy. Motion carried by all members present. Trustee Sneideman commented in favor of approval of this levy. He is in favor of a separate millage increase that would be designated specifically for roads. Motion by Graham-Hudak, supported by Slavens close the Public Hearing at 7:06 p.m. close the Public Hearing on millage rates for the December 1, 2017 tax levy. Motion carried by all members present. Motion by Siegrist, supported by Sneideman that the millage rates to be levied by Canton Township on December 1, 2017 be set as follows: Charter Mills (General Fund) Fire Protection Special Assessment Police Protection Special Assessment Total Motion carried by all members present. The Township Board is required to hold a Public Hearing on the proposed December 1, 2017 millage rates. The 2017 millage rates must be certified to Wayne County by October 1, These millage rates are required to balance the FY2018 budget. The combined millage rates of 10.9 mills for the December 1, 2017 levy would be the same millage total of 10.9 mills that was levied on December 1, The proposed millage rates for 2017 are as follows: 2017 Millage Rate 2016 Millage Rate Increase (Decrease) Charter Millage Fire Special Assessment Millage Police Special Assessment Millage Total As a Charter Township, Canton is authorized to levy 5.00 mills for general operations. Due to the taxing limitations of the 1978 "Headlee Amendment" to the Michigan Constitution and the September 12,

3 effect of Proposal A legislation in 1994, the Charter millage limit was reduced to mills. Since 1994, the authorized millage rate has been further reduced to for the general operations of the Township, excluding Fire and Police. The proposed millage of is mills below the maximum the Township could levy without a vote of the citizens. The Fire and Police Fund are supported almost entirely by the special assessment millages that were approved by the voters in 1975 and The Charter Township s special assessment millage for Police and Fire are not restricted by the Headlee Amendment and Proposition A. The voters authorized the Township to levy the necessary funds to provide for the operation of the Public Safety Departments in addition to the general operating millage. CONSENT CALENDAR: Item C-1. Consider Second reading of an Amendment to Appendix A Zoning of the Code of Ordinances for the Singh Executive Park Rezoning. (MSD) Motion by Siegrist, supported by Sneideman to remove from the table and hold the second reading of an ordinance to amend to Appendix A Zoning of the Code of Ordinances for the rezoning of the subject area within Singh Executive Park, Wayne County Subdivision Plan No. 568, as shown on the map, from C-3, Regional Commercial District to LI-R, Light Industrial Research District, as provided in the following ordinance. Motion carried by all members present. Motion by Siegrist, supported by Sneideman, adopt, and publish the second reading of an ordinance to amend Appendix A Zoning of the Code of Ordinances for the rezoning of the subject area within Singh Executive Park, Wayne County Subdivision Plan No. 568, as shown on the map, from C-3, Regional Commercial District to LI-R, Light Industrial Research District, as provided in the following ordinance with an effective date of September 28, Motion carried by all members present. PART II. Severability. Should any section, subdivision, clause, or phrase of this Ordinance be declared by the courts to be invalid, the validity of the Ordinance as a whole, or in part, shall not be affected other than the part invalidated. PART III. Savings Clause. The amendment of the Canton Code of Ordinances set forth in this Ordinance does not affect or impair any act done, offense committed, or right accruing, accrued, or acquired, or liability, penalty, forfeiture or punishment, pending or incurred prior to the amendment of the Canton Code of Ordinances set forth in this Ordinance. PART IV. Repealer. All other Ordinances or part of Ordinances in conflict herewith are hereby repealed only to the extent to give this Ordinance full force and effect. PART V. Publication. The Clerk for the Charter Township of Canton shall cause the ordinance to be published in the manner required by law. Part VI. Effective Date. A public hearing having been held hereon pursuant to the provisions of Section 103 of Act 110 of the Public Acts of 2006, as amended, the provisions of this Ordinance shall be published within fifteen (15) days of its adoption of publications of a notice in a newspaper circulated in Canton Township stating the date of enactment and effective date, a brief statement as to its regulatory effect and that a complete copy of the Ordinance is available for public purchase, use and inspection at the office of the Township Clerk during the hours of 8:30 AM to 4:30 PM, Local Time. The provision of this Ordinance shall become effective seven (7) days after its publication. 5 The applicant is proposing to rezone the subject property from C-3, Regional Commercial to LIR, Light-Industrial Research District. The property is designated Mixed Use on the Future Land Use map of the Comprehensive Plan. This allows for consideration of C-3, Regional Commercial; LI-R. Light Industrial Research; and, O-1, Office Zoning. The business park was zoned LI-R back in In 2006, the undeveloped portions of the park were rezoned to C-3 due to a down turn in industrial activity. In 2012, the western portion of the park was rezoned back to LI-R and one of the existing units on the north side of Executive Drive was rezoned to C-3 to accommodate the SkyZone Trampoline business. Singh Development feels that the market is more conducive to light industrial use and is now requesting that the remaining central portion of the site be zoned back to LI-R. -Existing Zoning: C-3, Regional Commercial District -Location: North side of Michigan Avenue in the area bounded by Executive Drive -Net Acres: 8.39 acres -Existing Land Use: vacant -Surrounding Land Use N LI-R and C-3 (part of Singh Executive Park) S - GI, vacant E LI-R, Light Industrial (part of Singh Executive Park) W- LI-R, vacant and Light Industrial (part of Singh Executive Park) -Comprehensive Plan: Mixed Use -Community Planner s Recommendation: Approval -Planning Commission Recommendation: The Planning Commission voted 6-0 to recommended approval of the rezoning to LI-R, Light Industrial research District. Item 2. Consider Request to Decrease/Increase Public Safety Blanket Purchase Orders. (PSD) Motion by Siegrist, supported by Sneideman to approve decreasing the blanket purchase order issued to Allie Brothers by $10,000, and increasing the blanket purchase order issued to Priority September 12,

6 One by $8,000 to accommodate the Fire Department s uniform purchases through the remainder of Motion carried by all members present. At the beginning of 2017, the board approved a blanket purchase orders to Allie Brothers and Priority One, for the purchase of firefighter uniforms. After analyzing the department s purchase needs for the remainder of the year, we are requesting to release the unused funds from the Allie Brothers purchase order, and increase the funds on the Priority One purchase order. This is a request for blanket purchase order changes only; no changes are being requested to the 2017 Fire budget. GENERAL CALENDAR: Item G-1. Consider Approval of the Preliminary Site Plan for Brookwood Park Detached Condominiums and Variance to the Condominium Ordinance. (MSD) Motion by Siegrist, supported by Foster to adopt the following resolution. Motion carried by all members present. RESOLUTION OF BOARD OF TRUSTEES CHARTER TOWNSHIP OF CANTON Approval of Variance to the Condominium ordinance and Preliminary Site Plan for Brookwood Park Detached Condominium WHEREAS, the Project Sponsor has requested approval a variance to the Condominium ordinance to allow 26 units on a dead end cul-de-sac and preliminary site plan for Brookwood Park Detached Condominiums, located on the north side of Cherry Hill Road between Lotz and Hannan Roads on tax parcel #s and : and, WHEREAS, the Planning Commission reviewed the site plan and made a recommendation to approve the request for the variance and preliminary site plan approval; WHEREAS, the requested variance to the Condominium Ordinance meets the general criteria pursuant to Section 82-7 of the Code of Ordinances, as provided in the background; September 12,

7 NOW THEREFORE BE IT RESOLVED, the Board of Trustees of the Charter Township of Canton, Michigan does hereby approve the request of the petitioner to approve the variance to the Condominium Ordinance to allow 26 units on a dead end cul-de-sac and preliminary site plan for Brookwood Park Detached Condominium on tax parcel #s and , subject to correction of t e cul-de-sac radius and subject to any and all applicable state and local development regulations. The project sponsors are proposing a 26 unit single-family detached condominium project on 6.66 acres. The resulting density is 4 dwelling units/acre. The storm water detention pond is located at the north end of the site. The project meets all design requirements for detached condominiums, except that the condominium ordinance limits dead end cul-de-sac streets to 20 units. The other limitation is a maximum road length of 1000 feet and the proposed road length is only 600 feet. The fire code only requires a second point of access if there are 30 or more units. The four general criteria in Section 82-7 of the code are satisfied as (1) the variance would not be detrimental to the health safety or welfare or adversely impact adjacent property; (2 and 3) the conditions of the property are unique due to the isolated nature of the parcel since it is situates between an existing apartment complex and a topsoil operation, not affording it the ability to gain another point of access; and (4) the variance would not vary the provisions with the zoning code, Comprehensive plan and Condominium Act. The proposed housing product will be two-story homes. The final design of the proposed homes will be reviewed with the final site plan. - Existing Zoning: R-4, Single-Family Residential - Location: North side of Cherry Hill Road between Lotz and Hannon Roads - Net Acres: 6.66 acres - Existing Land Use: vacant - Surrounding Land Use N - R-2, ITC electrical transmission corridor S - R-5, Brookside Village Subdivision E - R-2, Frank s Firewood (nonconforming use) W- R-6, Cinnamon Point Apartments - Comprehensive Plan: Medium-High Density residential (up to 8 dwelling units/acre) - Community Planner s Recommendation: Approval, subject to correction of the culde-sac radius per ordinance requirements. - Planning Commission Recommendation: The Planning Commission voted 4-2 to recommend approval of the variance to the Condominium ordinance to allow 26 units on a dead end cul-de-sac and the preliminary site plan for Brookwood Park Detached Condominiums. - Township Board On August 22, 2017, the Board voted 3-3 to approve the requests. 8 Trustee Graham-Hudak asked if it would be possible to construct a 2-Track access, for emergency use only, on what appears to be vacant land on Google Maps. Director Faas explained the property is privately owned by ITC Transmission Company and they do not allow access to their properties. Graham-Hudak stated she believed there was another complex in Canton with that type of access. Director Faas explained in the development she was referring to, that 2-track was in use only during the construction of the final phase and was located on property owned by the developer. Also, once the final phase is complete the 2-track will be removed. Trustee Sneideman referred to legal opinion from corporate counsel, questioning why the township s Zoning Code has higher development standards than the International Fire Code. Supervisor Williams stated that, for decades, Canton has had higher standards which is why the township has progressed the way it has. Director Faas explained the complexity of the issue is related to multiple guidelines across numerous jurisdictions. In this case the Zoning Code has specific guidelines which differ from the International Fire Code which has its own criteria for safety. It would be a monumental task to align our code (an over 400 page document) with the Maintenance and Fire Codes. This task will be taken up in the future, but will require additional staff and lots of hours to complete. Clerk Siegrist inquired if the project is in the 2019 budget. Director Faas stated it will be in the 2020 Budget and will take at least 12 months. Treasurer Slavens stated that the opinion from corporate counsel was helpful in answering her questions. Item G-2. Consider Approval of a Metro-Act Permit for Verizon Access Transmission Service. (MSD) Motion by Siegrist, supported by Slavens to approve the Metro-Act Right-of-Way Telecommunications permit to Verizon Access Transmission Service and authorize the Township Clerk to sign the permit on behalf of Canton Township. Motion carried by all members present. In 2003 Canton Township s Telecommunication Ordinance No. 157 (now known as Chapter 66 of the Township Code of Ordinances) became effective. Under this ordinance, the Township must not unreasonably withhold the issuance of a permit to occupy and use the public right-ofway for telecommunication providers provided the application is administratively complete. On August 5, 2017, we received an application from Verizon Access Transmission Service for a permit to install various underground and aboveground utilities within the Township. The application appears to be administratively complete and the applicant has paid the $500 application fee. The applicant will be required to obtain permits from Wayne County and MDOT in order to perform any construction work in the public right-of-way owned by these outside agencies. Trustee Sneideman asked if there will be any towers associated with this permit. Director Faas replied no. Item G-3. Consider Approval of Dedication of a Portion of the Right-Of-Way on September 12,

9 the West Side of Ridge Road, North of Ford Road. (MSD) Motion by Siegrist, supported by Sneideman to authorize the Township Supervisor to sign the quit claim deed for the transfer of the right-of-way on Ridge Road, north of Ford Road on behalf of Canton Township. Motion carried by all members present. The developer of the Park West Apartment development is working with Wayne County on permitting for the paving of Ridge Road, north of Ford Road. The quit claim deed and exhibit showing the dedication of 60 of property along the Patriot Park frontage has been prepared for execution. Staff is requesting that the Township Supervisor be authorized to sign the deed on behalf of Canton Township. As part of their consent judgment with the Township, the developer of the Park West Apartments is responsible for paving Ridge Road along their frontage. In order to accomplish this, Wayne County needs the final portion of the ultimate Right-of-Way along the Township owned Patriot Park on Ridge Road. This will also serve the Township in the future by having the ultimate right of way in place, and have Ridge Road paved along the park. Trustee Sneideman asked if there would be sidewalks in this right-of-way. Director Faas replied yes. Item G-4. Consider Approval to Purchase Equipment for Outfitting the Public Works Trench Rescue Trailer. (MSD) Motion by Siegrist, supported by Sneideman to approve the purchase of necessary Trench Rescue equipment from First Due Fire Supply for an amount of $11,732.59, and waive the purchase policy requirements for multiple bids since this is a sole-source provider. Motion carried by all members present. In coordination with the Township s Public Safety Department, Public Works has been coordinating the retro-fit of an existing enclosed trailer to accommodate trench rescue equipment. This Emergency Rescue equipment and trailer will be mobilized to sites around the Township where excavation activities occur. The total cost of the equipment is $11, Public Works staff frequently work in excavated trenches for emergency repairs, general utility maintenance, and installation of new services. While safe excavation practices are always used, trench failure/collapse is still a safety concern. In order to optimize the safety of our sites, and to ensure quick response times should a trench collapse ever occur, staff recommends the purchase of our own trench rescue equipment. Currently, the closest trench rescue equipment is housed at the Detroit Metro Airport. When trench collapses occur in the region, the Western Wayne Urban Search and Rescue (USAR) team is activated and deployed to the scene. Township Fire staff actively participate on this team. Additionally, Public Works staff will receive necessary training to actively deploy and start September 12,

10 operations of a trench rescue. If the Township has local rescue equipment available, response time would be drastically reduced. In order to save on costs, staff has been able to re-purpose an existing Fire Safety trailer for this purpose Item G-5. Consider Board Acceptance of Election Commission s Approved Changes to Canton Township Voting Precincts and Polling Locations. (Clerk) Motion by Siegrist, supported by Sneideman to concur with the resolution of the Election Commission approving the division of Precinct 35, resulting in the creation of one (1) new voter precinct (Precinct 10) in Canton Township, Wayne County, Michigan; the merging and elimination of Precincts 6, 10, and 34 into surrounding precincts; the realignment of boundaries to listed precincts; and the renaming of Precinct 41 and 42. This division of precincts will bring the total number of voting precincts in the Charter Township of Canton to forty (40). Motion carried by all members present. Upon taking office, Clerk Siegrist has reviewed current approved Township development and the existing voting precincts. Seeing an opportunity to create more efficiently run precincts and allocate voters in an equitable fashion, the Clerk is seeking Township Board acceptance of the precinct reconfigurations and polling location changes approved by the Election Commission. These changes will allow the Township to absorb over 5,000 new voters, streamline the cost of administering future elections, maximize location efficiency, reduce travel distance and time for voters, and decrease likelihood of lines at the polls. As a final result of implementation, the Township will see an overall reduction from 42 to 40 voter precincts and 24 to 19 polling locations, reducing the costs of future elections. Michigan Election Law requires any alterations to voter precincts for the 2018 Election Cycle be approved 210 days prior to the 2018 August Election. Additionally, the law requires each precinct must not contain more than 2,999 active registered voters. Election Law stipulates the Township Board is responsible for determining the location of polling places in the jurisdiction. In order to meet the requirement the Board of Trustees must pass a resolution establishing new polling locations and authorizing the Election Commission s alteration of voter precincts in Canton Township. 1) One additional voter precinct is being created at this time to accommodate the growth in the western portion of the township. The center-west portion of Canton, previously precinct 35 is being divided in half as a result of current and future development in the area west of Ridge, north of Cherry Hill, south of Hanford, and east of the township border. The Precinct was reaching registration numbers that indicated statutory requirement in the existing precinct could breech the statutory limit by November of ) To eliminate inefficient voting locations: - Precinct 10 to be split in half along Sheldon Center and merged into precinct 7 and precinct 24. 11 - Precinct 6 to be merged into Precinct 3 and parts of precinct 30 (West of Lotz, North of Ford, East of 275, South of Warren). - Precinct 34 to be split in three and merged into precinct 14 (North of Ford), precinct 9 (South of Ford, North of Maplewood), and precinct 30 (South of Maplewood, North of Cherry Hill). 3) To eliminate concern over Customer Service with lengthy lines and locations that have difficulty accommodating large registration numbers, the six remaining precincts with the highest density (38, 26, 42, 29, 5, 17) are being split and the partition merged with inefficient precincts (new 10, 1, 36, 30, 31, 22). 4) To accommodate the alterations of the precincts, maximize location efficiency, and reduce travel distance for voters, the Village Theater and Liberty Middle School shall be established as polling places and locations with only one precinct will be consolidated and moved (Mettetal Airport, Canton Public Works, Fire Station #1, Cherry Hill School, Canton Human Services, Hoben Elementary, and Tonda Elementary). Trustee Foster inquired how voters will be notified of the changes. Clerk Siegrist stated there will be notification letters and new voter registration cards mailed to all voters effected by this reconfiguration. He will make an effort to contact local clubs and committees. He will also be placing an article in the Canton Connection as well as local newspapers. Clerk Siegrist stated he had 5 goals for this project: 1. To absorb the estimated 5700 new voters expected to be registering by To streamline the costs of administering an election. 3. To maximize the location efficiency 4. To reduce the travel distance and time spent by the voters to polling locations. 5. To reduce the potential likelihood of lines at the precincts. Motion by Siegrist, supported by Slavens to designate Liberty Middle School and The Village Theater as the Polling Locations for additional voter precincts and altering the polling places according to the attached plan. The establishment of new Polling Places will bring to total number of locations in the Charter Township of Canton to nineteen (19). Motion carried by all members present. Item G-6. Consider Approval of a Blanket Purchase Order of $25, to Canon Solutions America, Inc. for Two High Speed Scanners and One Canon I RADV400if Printer for Use in the Clerk s Office for Elections. (Clerk) Motion by Siegrist, supported by Sneideman to approve the request for a Blanket Purchase Order to Canon Solutions America, Inc. for the purchase of election equipment in the amount of $15,000 from account _0010. Motion carried by all members present. State of Michigan is requiring all communities to purchase new election equipment. Wayne County has awarded the county contract to Dominion Voting Systems, Inc. Peripheral equipment associated with this new election equipment is the responsibility of the individual community. September 12,

12 The scanners needed to tabulate Absent Voter Ballots are part of the peripheral equipment. The Clerk s office also utilizes a very old printer HP Laserjet 8000 to print approximately 20,000 to 25,000 pages for every election. This printer is in need of replacement. Although, the Clerk s Office has solicited bids for this machine, the only company to reply so far has been Canon, offering their Canon 253dw Monochrome Printer at a cost of $2, Dominion Voting Systems, Inc. was certified as one of three election equipment providers for the State of Michigan. Wayne County awarded the county contract to Dominion Voting Systems, Inc. Dominion s pricing for the Canon DR-G1130 High Speed Scanner is $14,050 each. In an effort to reduce costs, the Clerks Office has reached out to individual vendors for their pricing on this equipment. Not only is their pricing the lowest, but it includes the printers required for reporting purposes. The individual printers are worth approximately $250 each. Clerk Siegrist explained by purchasing these scanners directly from Canon, the township is saving approximately $50,000 as opposed to purchasing them from Dominion. However, the township will still be required to purchase additional workstations, software, and low-speed scanners from Dominion. Trustee Sneideman inquired if the township has to pay for all the new election equipment required by the state. Clerk Siegrist explained there will be a state grant for most of the required new equipment. Item G-7. Consider the Purchase of Two Sets of Hurst Extrication Equipment. (PSD) Motion by Siegrist, supported by Slavens to approve the purchase of two sets of Hurst extrication equipment from Apollo Fire Equipment, in the amount of $64,950. Motion carried by all members present. The Fire Department is requesting to purchase two sets of Hurst Extrication Equipment, also known as the Jaws of Life. The first set is an electric combination tool with a cutter, spreader and ram, which will be stocked on the new ladder truck. The second is a hydraulic tool with a cutter, spreader and ram, which will replace an old, outdated set currently stocked on the heavy rescue. By owning two different operating systems, the department will have the ability to gain the best and quickest entry into vehicles under all possible scenarios. September 12,

13 This equipment is essential in situations requiring extrication of crash victims trapped in vehicles. The newer hydraulic tool set will provide a needed boost with gaining entry into some of the newer vehicles that are difficult to work on with the department s current Hurst tools. Apollo Fire Equipment is the sole-source vendor of Hurst extrication equipment in our area, and has quoted a total of $64,950 for the purchase. EXECUTIVE SUMMARY: Canton s Engineering Services has been actively working with OHM Advisors, who recently completed the initial phase of a feasibility study for significant building and site improvements to Fire Station #2, located at Warren Road. The project is ready to move into Phase II, consisting of OHM providing the following: - Site evaluation report for proposed reconstruction of Fire Station #2 - Schematic site plan with proposed features and extent of floodplain impacts - Copies of all permit applications submitted by OHM to Michigan s Department of Environmental Quality on behalf of the project OHM s proposed cost of performing all aspects of Phase II is based on a detailed outline (see Attachment A), and hourly rates/expenses incurred, not to exceed $36,922. On September 13, 2016, following a competitive bidding process, the Township Board approved RBA #G-4, awarding professional design and consultant services to OHM Advisors, Livonia, Michigan, for engineering studies pertaining to feasibility of building and site improvements to Fire Station #2, located at Warren Road. The current station was built in 1976 and, due to its close proximity to both Warren Road right-of-way and Tonquish Creek, it requires professional evaluations regarding the building envelope and the location of the floodplain and wetlands. The initial phase of the project consisted of an existing floodplain limit analysis and September 12,

14 site evaluation report, both of which have been successfully completed, moving the project into the second phase. ADDITIONAL PUBLIC COMMENT: None OTHER: Director Meier explained Michigan Task Force One a statewide FEMA Type 3 Team was activated to assist in Florida. The Township has 3 Firefighters who are assigned to that team. The township deployed the 3 firefighters to Florida on Sunday. They have been sent home as of Tuesday, September 12, Director Faas reminded the board that next week they will be meeting at 5:00 p.m. at the Landfill Lilley Road South for a one hour tour, then return to the Administration Building for their Study Session. Supervisor Williams commented the Household Hazardous Waste Day was wildly successful. This annual event was well attended and a great deal of waste was not placed in our landfill.
