7 1 Summary of External Monitoring 1.1 Object and content of monitoring 1.1.1Background of external monitoring For the reconstruction works of 4 main roads in Yining City: Chongqing Road, Shandong Road, North Xihuan Road and Dongliang Street, the cultivated land requisition and housing demolition near both sides of the roads are required; 3 villages under 3 townships, 3 neighborhood committees under 1 subdistrict office and 1 gas station are affected by road works. According to updated Resettlement Plan of Yining City, there are 520 AHs totally, of which, 244 urban HHs or 46.9%; and 276 rural HHs or 53.1%. There are 68 AHs on Chongqing Road, 94 AHs on Shandong Road, 114 AHs on North Xihuan Road and 244 AHs on Dongliang Road; and 1 gas station is affected; there are 100 small business shops are affected on Dongliang Street. The HHs on Chongqing Road and North Xihuan Road are affected in the first half of The project implementation progress is monitored in order to collect information about the reasonable compensation and resettlement of the affected AHs, business shops and enterprise in the first half of Object and scope of monitoring The monitoring objects in this monitoring report are: IAs in Resettlement Plan of Yining City; Affected villages; Affected HHs; Affected enterprise. The specific scope of monitoring objects is: The relevant functional departments implementing Resettlement Plan of Yining City; Affected villages: Hanbin Village under Hanbin Township, Bulake Village under Dadamutu Township; Affected HHs, including the HHs in Hanbin Village on Chongqing Road and the HHs in Bulake Village on North Xihuan Road; 1

8 Rural and urban HHs affected by housing demolition; the HHs in Hanbin Village on Chongqing Road and the HHs in Bulake Village on North Xihuan Road; Affected enterprise: 1 gas station of Corps Content of monitoring External monitoring follows up the implementation of Resettlement Plan of Yining City, and records the progress and effect of the project implementation. According to the project implementation, the main content of the monitoring this time includes: Structural establishment and work efficiency of the agency in charge of RP; Implementation progress of RP; Public consultation and complain. 1.2 Method of external monitoring Monitoring method Overall investigation and sample survey are combined for external monitoring of the first half of 2010; the content of overall investigation covers: resettlement progress, cash compensation and payment, operating mechanism and management of RP; the content of sample survey covers: basic information of relocating households; livelihood restoration of AHs; production and income; living expenses; satisfaction on RP. (1) Overall investigation: to look up documents and data for reference at Yining PMO and IAs, including documents and agreements related to housing demolition and resettlement, and the statistics of RP implementation etc. (2) Sample survey. To conduct follow-up survey of sample AHs. To design questionnaire and perform household survey. (3) Workshop: to hold workshops with participation of the persons from relevant units, collecting information about land requisition, housing demolition and resettlement, and to hear the opinions of IAs, relevant subdistrict office, villagers committees, neighborhood committees and the relocating households representatives about resettlement policy, subsidy standard and resettlement. 2

9 (4) Direct interview. To interview the key informants such as PMO director, director of neighborhood committee, householder of relocating household, women, poor household and the aged etc Work flow of monitoring In order to prepare the external monitoring report objectively and accurately, we establish detailed work flow after discussion with PMO and IAs: Phase 1: preparation. To complete the investigation plan and determine sample HHs. Phase 2: field investigation and processing of data. To go to the project area and find out the implementation progress and fulfillment of the Plan, public participation, and personal consumption of HHs; to summarize and analyze the survey data in accordance with the monitoring requirements. Phase 3: preparation and submission of the monitoring report. To prepare the external monitoring report in accordance with the requirement of Resettlement Plan of Yining City. 3

11 Implementing agencies (1) PMO An office is set up under the Leading Group, located at the PMO of Yining Municipal Construction Bureau. The director of PMO is held by Puerhati, the director of Yining Municipal Construction Bureau, as a concurrent post, and Su Jun, the director of PMO under Yining Municipal Construction Bureau, is in charge of the concrete works; and other members are distributed respectively at the departments concerned. 13 2.1.2 Fulfillment of RP Compensation Fund during Jan.-June 2010 RP Leading Group consists of the leaders of Yining Municipal Government and the leading officials from 11 relevant units. There are 5 workers at PMO under Construction Bureau of Yining City. PMO workers are competent and experienced in foreign capital-funded project management and high working efficiency. 14 housing demolition and land requisition as well as compensation in Hanbin Village (Chongqing Road) and Dadamutu Village (North Xihuan Road) jointly with RP Leading Group and all IAs during the first half of It is a smooth course and the compensation fund is paid in full. All IAs fulfill their respective assignment in time and in an orderly way. AHs are satisfied, and the work efficiency is high. 8

15 3 Implementation Progress of RP 3.1 Preparation for Resettlement Preparation for Resettlement Quarter Preparation of resettlement quarter There are 86 AHs totally for Chongqing Road and North Xihuan Road works, most of them choose replacement of property rights, and 18 HHs cash compensation. Yining City Government will set up a resettlement quarter in the area around Railway Station of Yining City, and the area of the buildings for replacement will be m2 for the AHs on Chongqing Road and North Xihuan Road. The resettlement quarter is 2.5km away from Elementary School of Hanbin Township, 3km from Yining Elementary School No.24, 3km from Yining Middle School No.3 and 3km from Yili Prefectural Mother and Child Health Care, which makes education and medical service convenient for the residents. At present, the resettlement quarter is under construction, and it is estimated to be completed in the first half of According to the planning, the rebuilt Shandong Road is still in Hanbin Township, and the resettlement quarter for the relocating HHs for Chongqing Road and North Xihuan Road works is located on the boundary between Hanbin Township and Dadamutu Township; comparing with the originally-planned resettlement quarter on Lane I of Gongyuan Street, current resettlement quarter favors more the convenience of production and maintenance of original social relation, and line with ADB s philosophy for maintaining the relocating HHs original production and living style as much as possible. Comparing with the residential quarters in urban area, the households here have a much larger floor space for their house and courtyard, and the villagers enjoy much higher living level than before Preparation for relocating gas station The concrete plan for rebuilding the gas station of Corps Petroleum Company is: to demolish 1 single-story building of business purpose at east side of the gas station, and rebuild the office and refueling unit of the gas station there. 9

16 3.1.2 Timeliness and Sufficiency of Resettlement Compensation Fund Preparation Types of compensation funds According to Resettlement Plan of Yining City, cash compensation and restoration are required for the village collectively-owned land requisition and housing demolition as well as the ground public utilities in the affected villages. The types of compensation funds are: compensation fund for the village collectively-owned land requisition, compensation fund for housing demolition, and compensation fund for accessory structure in the affected villages (or neighborhood committee) Timeliness and sufficiency of resettlement compensation fund preparation According to RP fund utilization plan, the actually fulfilled and utilized fund is million yuan during Jan.-June 2010, or 43.4% of the RP; million yuan for land compensation or 46.2%; million yuan for housing (Hanbin Township and Dadamutu Township) or 40.1%. The compensation fund source is the special account for RP fund of Finance Bureau of Yining City which is paid based on the payment schedule as required; see details in Table 3-1. Actual data during Jan.-June 2010 is provided by PMO. 3.2 Monitoring of Land Requisition & Resettlement Mobilization Progress 3.2.1Progress of Land Requisition The planned collectively-own land requisition for the Project is 598.3mu (updated in 2010), of which, Hanbin Village 251.9mu, Bulake Village 346.4mu (see 10

17 Table 3-2); total cultivated land of 251.9mu is required in the first half of 2010 for Chongqing Road (Hanbin Village) road works (updated in 2010), total cultivated land of mu for North Xihuan Road (Dadamutu Township) road works (updated in 2010), and the percent of land requisition fulfillment is 100%. 18 For rural collective land compensation, the compensation standard is determined based on current market price level and area during actual implementation; see detailed types and standard of compensation fund in Table 3-3. The standard to be executed is from RP PMO of Yining City Payment of land compensation fund mu cultivated land contracted by the farmers in Hanbin Village on Chongqing Road and mu cultivated land contracted by the farmers in Bulake Village on North Xihuan Road are expropriated. According to resettlement compensation policy, land compensation fund, resettlement compensation fund and crops compensation fund shall be paid. By the end of June 2010, million yuan or 100% has been paid to the farmer HHs in Hanbin Village as land compensation fund, and million yuan or 100% to Bulake Village. See payment schedule in Table

See details in Table 3-5. Comparing with the original standard, the new one reduces compensation fund for cultivated land and garden plot but there is no change to the compensation fund for woodland and wasteland. See details in Table 3-5. The basis for the new standard is: the original compensation standard for cultivated land is calculated based on the output value of special-type crops, but actually planted crops are grain crops, thus the basis for original compensation standard is not correct and the calculated compensation amount is on the high side and inconsistent with the actuality. Besides, in the explanation of land compensation standard plan issued by Land Resource Bureau of Yining City in March 2007 specifies further that the original standard of RP is a tentative standard. For the actual land requisition in 2010, according to the actual living level and land use practice in the affected area, Land Resource Bureau of Yining City negotiated with AHs and determines that the updated output value standard is: cultivated land at yuan/mu, garden plot at yuan/mu, woodland at 3600 yuan/mu, and wasteland at 3600 yuan/mu. Therefore, the actual compensation standard for the first half of 2010 is calculated on the basis of updated output value and compensation multiple in the project area, and the land compensation standard of different land types is determined, 13

20 i.e. the actual compensation is 10 times of the updated annual output value. Total cultivated land garden plot woodland wasteland Data source: Yining City PMO 3.3 Monitoring of Housing Demolition Progress 3.3.1Progress of Compensation for Housing and Accessory Structure RP is updated at the beginning of 2010, new standard in 2010 RP is followed for land requisition for North Xihuan Road works and housing demolition for Chongqing Road works. According to the demand of actual road works, the number of HHs suffering from relocation on Chongqing Road and North Xihuan Road is increased to 104 HHs. During the Jan.-June 2010, 36 HHs on Chongqing Road and 68 HHs on North Xihuan Road, or 100% are resettled. 14

According to Resettlement Plan the housing compensation standard for resettlement will be determined during the actual implementation process with the reference to the appraisal of real estate and replacement price of local houses of the same kind in 2007; the compensation price of house demolition will be finally made after a local valuation by a real estate appraisal and mapping company. The final compensation price will be negotiated between the relocating agency and the relocated and agreed with each affected household on the basis of such prices and the assessment standard of 2007 provided by Real Estate Bureau of Yining City; the specific compensation 17

24 standard is: brick-concrete structure at 700 yuan/m 2, brick-wood structure at 600 yuan/m 2, and earth-wood structure at 450 yuan/m 2. In order to keep in line with the housing compensation for local houses of the same kind during the project implementation in 2010, after a local valuation by a real estate appraisal and mapping company, the final compensation price is negotiated and agreed between the relocating agency and the relocated and agreed with each affected household, i.e. brick-concrete structure at 560 yuan/m 2, brick-wood structure at 500 yuan/m 2, and earth-wood structure at 415 yuan/m 2. No small business shop is involved in Chongqing Road and North Xihuan Road 18

25 4 Public participation, Complain and Grievance 4.1 Public participation According to the policies, laws and regulations of the state, the Autonomous Region and Yining City about land requisition, housing demolition and resettlement, the Project attaches importance to public participation and negotiation during the establishment of RP policies and the preparation of action plan, protecting the lawful rights and interests of the relocating HHs and enterprise and hearing the opinions of the affected sample HHs in order to reduce complain and dispute. As regards the implementation of the Project in the first half of 2010, 103 sample HHs are investigated in the form of household investigation with questionnaire, and 78 valid questionnaires or 75.73% are collected. See Tables 4-1 for the summary: (1) 98.77% of sample HHs confirm: the sample HHs themselves verify the quantity of the house to be demolished and the land to be expropriated. (2) 52.29% of sample HHs know the information about RP and EMDP when someone came to my house for investigation, and some other sample HHs know that through bulletin and the publicity of neighborhood committee etc. (3) As regards income restoration measures in RP, 98.11% of sample HHs know cash compensation measures, and 16.42% knows training measures. Since the restoration measures such as adjustment of industrial structure, developing animal husbandry and tourism etc. are governmental behavior without little direct impact on the sample HHs, the residents pay little attention to them. (4) 35% of AHs know the policy about EM participation into the project construction, 16% EM training and 16% subsidies for EM vulnerable groups. (5) 77.61% of sample HHs did not participate in technical or skill trainings, and only small part of them participate in training for 1-3 times. Due to difference in the household income types of sample HHs, the residents having similar training demand could participate into the relevant trainings. (6) As regards training content, Chinese language training sees the highest percent up to 49.41%, and the trainings like breeding, planting and hospitality skills all are 19

26 about 20%. 4.2 Complain and Grievance (1) Channels of public express an opinion % of sample HHs have a habit of reflecting any problem to neighborhood committee, village leader, town or the City. Only 7.89% reflect the problem to the employer of the Project. Because the sample HHs think it is convenient to reflect the problem to the village, town or city. (2) Complain about RP implementation. More than 90% of sample HHs never complain; there is little complain about land requisition, compensation or housing demolition, and the complain occurs when there is any difference between the actual compensation amount and the compensation expected by the sample HHs. 4.3 Public Satisfaction (1) Satisfaction on registration and measurement of kind (housing and land area). With the findings, 15.19% of sample HHs are satisfied, 68.2% so-so, 15.19% not satisfied for the difference from the expectation value of AHs. (2) Satisfaction on compensation policies % of sample HHs are satisfied with compensation policies (land and housing compensation standard, subsidy for vulnerable groups), 31.6% so-so, and 6.67% not satisfied for the same reason stated in Item 1. (3) Satisfaction on fulfillment of compensation policies % of sample HHs are satisfied, 33.33% so-so, and only 4.94% not satisfied for the same reason stated in Item 1. (4) Satisfaction on living environment % of sample HHs are satisfied or so-so, and only 1.88% not satisfied. (5) Satisfaction on current living status. 60% of sample HHs are satisfied; but 33.33% not satisfied with current living status; the sample HHs desire to improve remarkably living conditions, but it cannot be fulfilled soon. (6) Satisfaction on current income level % of sample HHs are very satisfied with current income status; 42.31% so-so; and 46.15% not satisfied for the reasons like: local income level is low, less employment opportunities, more family members and so forth. 20

27 (7) Satisfaction on traffic and road conditions. 85% of sample HHs are satisfied, 12.35% so-so and 2.65% not satisfied because the vehicle flow rate is high after road works, and the cars run at high speed, which causes certain hidden trouble of traffic. (8) 77.61% of sample HHs did not participate in technical or skill trainings, and only small part of them participate in training for 1-3 times. 30 5 Conclusion and Suggestion 5.1 Conclusion (1) Comparing with 2009, PMO and the relevant IAs such as Land Resource Bureau and Construction Bureau are of high work efficiency in project management, land requisition, housing demolition and compensation etc. (2) The procedures of land requisition and housing demolition are tested and evaluated, and the implementation procedures are reasonable and lawful. (3) The compensation fund for housing demolition and land requisition is fulfilled in time and satisfies the requirements of RP on funds. In the first half of 2010, the relocating HHs on Chongqing Road (Hanbin Village) and North Xihuan Road (Bulake Village) received in full the compensation fund for resettlement, and the expropriated collectively-owned land on Chongqing Road (Hanbin Village) is compensated in full, too. (4) The actual compensation standard for housing demolition and land requisition is lower than that described in the original RP, but the actual one is in line with local actuality. (5) The evaluation of housing value is completed by a competent real estate consulting firm on commission by Construction Bureau of Yining City; the evaluation results are in line with local actuality, and justice, publicity and fairness are presented during the evaluation course. 5.2 Problem Found Out during Monitoring and Suggestion Problems (1) For the income restoration measures, the residents know cash compensation rather than other measures. (2) Good information communication and transmission channels are wanted. The dossier related to RP fails to be filed up in time. The investigation finds that the original data related to RP, including land requisition, housing demolition and cash compensation fail to be filed up in time; there are some data in the aggregate with a lack of some detailed data. 24

31 5.2.2 Suggestion (1) To strengthen publicity to AHs and make them understand more about the content related to their vital interest in RP: income restoration measures. (2) To establish t statistic report system of project implementation progress, and a complete set of RP route file. All data related to RP shall be submitted to the PMO by the departments concerned periodically for unified management. PMO shall classify, process and bind the data semiannually and set up electronic archive and text archive. (3) During the project implementation, PMO shall play the role of supervisor and supervise all relevant IAs to summarize and submit relevant data in time for unified management of data information related to implementation progress. 25
