DATE: SEPTEMBER 10, 2014 STAFF RECOMMENDATION Staff recommends approval of RZ14-033, The Pecans Wall Amendment, subject to the Conditions of Approval outlined in this report. PROPOSED MOTION 1. Move to recommend approval of RZ14-033, Amendment to the Pecans Planned Area Development (PAD) to allow a solid metal screen wall adjacent to the rear yard of 10 homes (Lots & ) along the east side of Hawes Rd. RELEVANT GENERAL PLAN AND COUNCIL GOALS General Plan Land Use Element Goals and Policies: Goal 3: Develop superior neighborhoods o Policy 3d: Ensure compatibility between new projects and existing neighborhoods by providing appropriate transitional treatments when: a. New residential subdivisions are adjacent to existing residential areas; and b. New development contains lots adjacent to an open space, a non-residential land use or an arterial street. 2 SUMMARY This application includes a request by Paul Dugas on behalf of Blandford Homes, for an Amendment to the Pecans Planned Area Development (PAD) to allow a solid metal screen wall adjacent to the rear yard of 10 homes (Lots & ) along the east side of Hawes Rd. HISTORY June 1972: June 1996: September 2001: July 2004: August 2007 Maricopa County Board of Supervisors approves a plat for Queen Creek Pecans Unit I. The Queen Creek Town Council approves a master street plan for the pecan grove area. The Queen Creek Town Council approves Ordinance for The Pecans PAD, amending the adopted street plan for the Pecan Grove area, and S08-00, a preliminary plat for a 258-lot subdivision to be constructed in seven (7) phases. The Queen Creek Town Council approves Ordinance for the Pecans PAD, modifying some of the conditions of Ordinance regarding lot coverage, tree retention, accessory structures, building heights and others. Town Council approved Ordinance allowing gates to be installed on the private streets in the Pecans Subdivision. DISCUSSION The applicant is requesting to modify Stipulation #15 of the Conditions of Approval of Ordinance No (Pecans PAD) to allow a 6 foot tall solid metal screen wall adjacent to the rear yard of 10 homes (Lots & ) along the east side of Hawes Road. Stipulation #15 of the Conditions of Approval states: All fencing and signage shall be in conformance with the Subdivision and Zoning Ordinances of the Town of Queen Creek. Fencing plan proposed shall be revised accordingly. Developer shall receive staff approval of all perimeter and open space area fence types along with the submittal of the first final plat. All perimeter fencing and walls in the residential and open space areas shall have view fencing as specified by Town ordinances. If solid 6-foot fencing is approved for the lands adjacent to the Queen Creek Landfill site, then said fencing shall be decorative fencing on the south side facing the landfill and future park. 3 Blandford Homes purchased the 10 subject lots from the original Pecans developer, and the current homeowners requested that Blandford Homes consider providing screening of the existing wrought iron fencing on the west side of their properties adjacent to Haws Road to provide a reasonable level of privacy for their home sites. Blandford Homes was willing to install metal screening complementary in materials and color for the residents and presented it to The Pecans Home Owners Association, which was subsequently approved and then installed. It was brought to the Town s attention that the metal screening had been installed without the proper review and approval through the Town Council. Due to the previous approval of Condition #15 of the amended Planned Area Development (PAD) staff determined that an amendment to the approved Pecans PAD was required to allow a solid perimeter wall. Upon review of the applicant s submittal, and multiple site visits; Town Staff supports the applicant s request, and believes the proposed metal screening is appropriate for the specified lots as it is painted and constructed with high quality metal materials that are complementary to the originally approved wrought iron fencing. In addition, the proposed metal screening blends in with the existing landscaping planted directly in front while providing the homeowners the privacy they have requested, which will enhance the quality of life of the effected residents. Staff further supports this request due to the fact that Town Code regulations updated in 2007 allow solid fencing for lots adjacent to streets in the R1-18 Zoning District. Town Code Section a states: Fences adjacent to streets may be solid fences, regardless of the landscape tract width separating the lots from the street. 4 ANALYSIS General Plan Review: The project is located in the Low Density Residential designation on the General Plan. There is no conflict with the General Plan. Zoning Review: The zoning designation of the properties is R1-18 PAD. Public Comments: Staff has not received any public comment to date. Public Participation: One neighborhood meeting was conducted by the applicant on August 20, 2014 to solicit initial thoughts and comments about the proposal which were incorporated into the formal submittal package. All participants were in support of the project. Further public outreach included the notification of the Planning Commission and Council Public Hearings dates via mailing to adjacent residents as well as sign postings. CONDITIONS OF APPROVAL Staff recommends approval of RZ14-033, The Pecans Wall Amendment, subject to the following Condition of Approval: 1.
