BACKGROUND: Snohomish County received approximately 146 acres of property from the Washington State Department of Natural Resources ("DNR") for park purposes in 21, this property titled "Sky Valley Sportsman's Park" is very limited for a shooting range design due to onsite wetlands. By application letter, the parks department is requesting reconveyance of approximately 64 acres to Snohomish County for re-siting the shooting range. This process is initiated by the attached application letter. The DNR will move forward with a timber sale named "Lugnut" on a portion of the property being proposed for reconveyance. This area is identified on the attached map. The cost for the reconveyance (survey) and associated fees (including closing costs) is approximately One Hundred Thousand Dollars ($1,) and will be addressed at a later date by an lnteragency Agreement. If the reconveyance initiation is supported by the County Executive and Council, the Department of Parks and Recreation will submit an intent to reconvey letter to the Washington State Recreation and Conservation Office requesting a letter of compliance from this agency; per RCW

3 SNOHOMISH COUNTY COUNCIL Snohomish County, Washington MOTION NO MOTION TO INITIATE RECONVEYANCE OF STATE FOREST LANDS MANAGED BY THE WASHINGTON STATE DEPARTMENT OF NATURAL RESOURCES TO SNOHOMISH COUNTY FOR PARK PURPOSES BY AN APPLICATION LETTER WHEREAS, the adopted Snohomish County Park and Recreation Element, which became effective in 215, includes a goal to provide open space and natural areas with appropriate public access to promote understanding and support of the natural environment and the benefits these lands provide (Goal PR 5); and WHEREAS, Snohomish County requested a reconveyance of 146 acres of Washington State Department of Natural Resource land in 21 O; and WHEREAS, this property was transferred to Snohomish County by deed for the purpose of a shooting range facility; and WHEREAS, during the design phase it was determined that the site did not support the shooting range master plan due to on-site wetlands; and WHEREAS, the DNR desires the 146 acre property to satisfy its natural heritage program; and WHEREAS, Snohomish County, through its Parks and Recreation Department, has identified an approximately 64 acre DNR site that will provide a more suitable location for a shooting range (the "Property"), as identified on Exhibit A, attached hereto and incorporated herein by reference; and WHEREAS, if the 64 reconveyance is approved by the DNR, the 146 acre site will be a future surplus action and transferred back to the DNR by deed; and WHEREAS, to initiate the reconveyance process the county must file an application letter, with the Board of Natural Resources, requesting the reconveyance of the identified 64 acre Property by a quitclaim deed; and WHEREAS, the Washington State Department of Natural Resources (the "DNR") proposes a timber harvest on a portion of the Property, titled "Lugnut", as identified on Exhibit B, attached hereto and incorporated herein by reference; and WHEREAS, this forest practice permit activity does not interfere with proposed park uses; and Motion No Motion to initiate reconveyance of State forest lands managed by the Washington State Department of Natural Resources to Snohomish County for park purposes by an application letter Page 1 of 2

4 WHEREAS, future costs for the reconveyance include paying the DNR for survey costs incurred and DNR administrative fees as well as typical closing costs such as recording fees, filing the excise tax affidavit, the Short Subdivision Exemption form and all other typical closing costs to effectuate this transaction is estimated to be approximately One Hundred Thousand Dollars ($1,.) and will be outlined in an lnteragency Agreement to be submitted as a separate action; and WHEREAS, the Snohomish County Council and County Executive consider it in the best public interest to proceed with the transfer of the Property by reconveyance; NOW, THEREFORE, ON MOTION the County Council of Snohomish County resolves the following: Section 1. The County Council approves the application letter substantially in the form attached hereto as Schedule 1, and authories the County Executive, on behalf of the County, to execute the application letter. The County desires that an approximately 64 acre area be reconveyed to the county by deed for public park purposes. The legal description of the area to be reconveyed is being prepared by the Washington State Department of Natural Resources ("DNR"), being tax account No and including necessary access easements, as located in Sections 15, 16 and 1, Township 28 North Range 8 East, W.M., containing 64 acres more or less, situated in the County of Snohomish, State of Washington. A location map of the proposed reconveyance area is attached as Exhibit A. We understand that the DNR plans to proceed with a timber sale which has been named "Lugnut," FPA/N # partially adjacent to the area described above. The County supports DNR proceeding with this timber sale while the reconveyance process is pursued in the area shown on the map attached, Exhibit B. No delay of the timber sale is requested. We understand that all reconveyances are subject to the approval of the Board of Natural Resources and if the reconveyance is approved, conveyance of title will be by a quitclaim deed, which includes provisions for the Department of Natural Resources to retain management of timber and mineral resources, if any. This request for reconveyance has been approved by the Snohomish County Council by Motion No. 17-, dated, 217. The Executive of Snohomish County 1
