1 CITY OF MONROE Community Development Department 806 West Main Street Monroe, WA Phone: (360) Fax: (360) Land Clearing / Forest Practices Permit Requirements LAND CLEARING PERMIT (applies to land clearing of more than a half an acre, over a six-year period, unless an associated land development permit has been issued) FOREST PRACTICES PERMIT (applies to any forest practice resulting in the cutting and/or removal of more than 5,000 board feet of timber or more than a half an acre, whichever is greater, over a six-year period) All Land Clearing or Forest Practices permit applications submitted must meet applicable sections of the Monroe Municipal Code (MMC), primarily chapters SEPA, Critical Areas, and Land Clearing and Forest Practices of the Monroe Municipal Code (MMC). PARTIAL SUBMITTALS WILL NOT BE ACCEPTED. REQUIRED MATERIALS FOR A COMPLETE APPLICATION ARE: 1 original plus 9 copies of the Combined Permit Application signed by applicant(s) and owner(s) involved, including timber owner(s) if different from landowner. Provide tax reporting account number from Department of Revenue if harvesting timber. Call the Department of Revenue at (800) for tax reporting information or to receive a tax number. Fees per the current city of Monroe fees resolution. 1 original site map plus 9 copies, (survey may be required if sufficient information is not available). Items required on the site map: North arrow. Engineering scale (e.g., 1 inch = 10 feet, 1 inch = 20 feet, etc.). Legal description of subject property and parcel number. Existing boundary lines Setbacks and encumbrances, including existing structures within the affected lots. Dedication and easements - all easements must identify the location of the easement, who benefits, and who is responsible for maintenance activities. Critical areas & buffers, delineated critical areas, and other features, as applicable. Clearing limits with area(s) of land conversion and future development identified. Existing and proposed roads and other impervious surfaces on and adjacent to the property. Topography contour lines at 2-5 feet. 1 copy of current title report dated within 30 days of submittal. 1 vicinity map 8 1/2 x set of plans reduced to 8 1/2 x original signed plus 6 copies of a completed Environmental Checklist. 2 Land Clearing / Forest Practices Permit Requirements (continued) Critical areas report that complies with the Critical Areas Ordinance, if required. 1 original plus 9 copies of the completed JARPA permit (only if required to be submitted check with staff at pre-development meeting). A written narrative that identifies and describes the following (You may use Page 3 of the Land Use Permit Application Form): 1. Specific work to be accomplished that includes number of acres being cleared or timber being harvested and estimated volume of timber being harvested; 2. A time schedule for clearing activities; 3. Type of equipment to be used; and 4. Measures proposed to protect the site and adjacent properties from potential adverse impacts. Other required information specific to the application as outlined and required in the Monroe Municipal Code. Additional Information may be requested by the City of Monroe to evaluate your application. 3 Land Clearing / Forest Practices Permit INFORMATION FOR THE APPLICANT A Land Clearing permit is required for land clearing activities of more than a half an acre, over a six-year period, unless an associated land development permit has been issued. A Forest Practices permit is required for any forest practice resulting in the cutting and/or removal of more than 5,000 board feet of timber or more than a half an acre, whichever is greater, over a six-year period. Request for removal of development moratoria. Any property owner subject to a moratorium, pursuant to Chapter RCW, may request a release from the six-year moratorium by filing such request with the Community Development Department. Following such request, the Community Development Department shall set a date for an open record public hearing, per the noticing requirements of MMC , before the hearing examiner. The hearing examiner shall consider the removal of a development moratorium pursuant to MMC when the following criteria are strictly met: 1. The proponent makes application for a land clearing/ forest practices permit; 2. The proponent proposes corrective actions to bring the violation into compliance with this chapter and mitigate any existing damage through the submittal of a reforestation plan or mitigation plan, prepared by a qualified professional consistent with Chapter MMC; 3. The person requesting the release did not attempt to avoid the review or restrictions of a land clearing/ forest practices application. Criteria for removal of development moratoria. 1. The removal of the six-year development moratorium will not be detrimental to public health, safety, and general welfare. 2. The removal of the six-year development moratorium will not be injurious to the property or improvements adjacent to the proposal. 3. The removal of the six-year development moratorium will not result in significant adverse environmental impacts. 4. The removal of the six-year development moratorium is consistent and compatible with the goals, objectives, and policies of the Comprehensive Plan and the provisions of this chapter and other applicable municipal codes. 4 Land Clearing / Forest Practices Permit INFORMATION FOR THE APPLICANT (Continued) Single-family dwelling exception on lots subject to development moratoria. The Community Development Director may grant an exception to the mandatory six-year development moratorium with public notice, per the noticing requirements of MMC , to allow the construction of one single-family dwelling unit and associated accessory structures, when the following requirements are met. 1. The area that is permitted to be developed shall not exceed the minimum lot size for the underlying zoning district, in addition to the minimum area necessary to provide safe vehicular access; 2. The construction of the single-family dwelling, permitted accessory structures, landscaped area, and access road are in compliance with all applicable city regulations; 3. Corrective actions are proposed to mitigate damage caused by the non-permitted action, through the submittal of a reforestation or mitigation plan prepared by a qualified professional; 4. Upon approval of a single-family dwelling unit exception, the landowner will record the approved site plan with Snohomish County Auditor depicting the area of the parcel to be dedicated for the single-family dwelling, yard area, permitted accessory structures, and access road; and 5.
