3 III. IV. Public Comment: Mr. Mayo stated SJCOG, Inc. staff will table Item 7 Lodi White Slough Property Preserve Acquisition and Preserve Management Plan. Consent Calendar: a. Navarro Family Ranch Subdivision Project, Plan Participation It was moved/seconded (Beckman/Gifford) to approve the Consent Calendar. Motion passed 8/0. Mr. Gifford asked about the voting procedure. If an item receives a majority vote, does the item pass? Ms. Streeter stated if the majority voted yes, the item would pass. If the majority voted no, the item would not pass. V. D Alonzo Highway 4 Property Preserve Acquisition and Preserve Management Plan Mr. Mayo stated the D Alonzo Highway 4 Property parcels consist of approximately 35 acres. The land owner and SJCOG, Inc. are discussing a conservation easement of approximately 30 acres on the property. The location of the conservation easement is adjacent to an existing SJCOG, Inc. preserve in the Delta Zone. With the acquisition, SJCOG, Inc. staff has written a draft Preserve Management Plan (PMP) to reflect the existing PMPs of the row and field crop/irrigated pasture preserves in the Delta Zone for economy of scale. The PMP lists no specific enhancements on the referenced property except for keeping it as irrigated pasture land. Future enhancements can be included at a later date as long as the enhancements are consistent with on-going farming activities. The cost of the easement is valued at an average cost not to exceed $8,500 per acre with a total acquisition cost of approximately $255,000 and applicable closing costs required. SJCOG, Inc. will be providing an endowment to be set aside in a specific endowment fund for the preserve in the amount of $125, to be used for land management and enhancements as required under the SJMSCP permits. Mr. Gifford stated this is a Delta Zone preserve property used to mitigate for Central Zone or Delta Zone impacts knowing that there are not any Delta Zone impacts. Mr. Mayo stated the SJMSCP does have Delta Zone impacts here and there. For the most part, Delta Zone preserves can serve as cross over mitigation as referenced in the Plan. Mr. Gifford stated today the HTAC is approving five preserves and Preserve Management Plans (PMPs), three of which are in the Delta Zone. Mr. Gifford stated his problem is the Delta Zone. A few days ago, the Stockton Record published an

4 article projecting sea rise levels at half the time period that was originally projected. Sea level rising is occurring faster than anyone could have guessed. Some websites that deal with sea rise level, such as NOAA, state these properties are at risk. Mr. Gifford wonders how smart it is to acquire easements in the Delta Zone. Mr. Mayo stated the way the Plan is written, and what was negotiated and approved with permitting a few years back created what is known as the Delta Zone allowance under the SJMSCP. Staff and permitting agencies came up with a design that defines mean sea level and above. Staff cannot speculate where sea level will be within the 50-year permit and life of the Plan. The SJMSCP has other preserves where when drought occurs, the farmers may not be able to provide water for crops to meet the expectations of the SJMSCP. Staff cannot kick those preserves out based on what may or may not be. Under the current rules and allowances, staff is acquiring preserves under the current conservation strategy, which is exactly where these three preserves fit. Mr. Gifford stated there is language in the SJMSCP that allows Delta Zone preserves. Mr. Mayo stated staff and permitting further refined that language with permitting inwithin for, which chiseled that allowable Delta area to an actual polygon in our GIS system. Mr. Gifford stated the location of preserves is discretionary and then there is common sense where situations are changing faster than what was originally anticipated. Mr. Gifford stated he is going to vote no. Mr. Caguiat entered the meeting. It was moved/seconded (Beckman/Huecksteadt) to Approve Recommendation to SJCOG, Inc. for the 1) Approval of the Conservation Easement Acquisition and 2) Approval of the Preserve Management Plan (PMP) for the Preserve Site. Motion passed 8/1. VI. G Torlai Property Preserve Acquisition and Preserve Management Plan Mr. Mayo stated the G Torlai Property parcel under consideration consists of approximately 114 acres. The land owner and SJCOG, Inc. are discussing a conservation easement under the habitat plan of 110 acres on the property. The location of the property is south of State Route 4 and west of the San Joaquin River and City of Stockton in the Delta Zone. The potential preserve is south of existing SJCOG, Inc. preserves in the Delta Zone. Mr. Mayo continued to state with the acquisition, SJCOG, Inc. staff has written a draft Preserve Management Plan (PMP) to reflect the existing Preserve Management

5 Plans (PMP) of the row and field crop preserves in the Delta Zone for economy of scale for species under the SJMSCP. The PMP has included land owner enhancements near the existing pond for areas on the referenced property and future cooperation with the land owner to restore habitat for various species. Mr. Mayo stated SJCOG, Inc. will be acquiring an overall easement on approximately 110 acres of active agricultural habitat under the SJMSCP. The cost of the easement is valued at an average cost not to exceed $6,000 per acre with a total acquisition cost of approximately $660,000 and applicable closing costs required. SJCOG, Inc. will be providing an endowment to be set aside in a specific endowment fund for the preserve in the amount of approximately $461, The endowment funds will be used for land management and enhancements as required under the SJMSCP permits. Mr. Mayo stated staff will be looking at potentially burrowing owl habitat, which was discussed with the land owner. Mr. Gifford asked if burrowing owl habitat was going to be created on the berm. Mr. Mayo stated staff is starting to construct burrowing owl habitat on the Jacques property as a beta test for the Habitat Plan. On the G Torlai property, withsince the land owner is expanding the pond, staff would like to talk to the land owner more in depth about potentially including it. The way the property is laid out, staff is not sure this is a great property to construct burrowing owl habitat; however the land owner is willing to create the habitat. Staff s concern is the location of the pond in relation to the berm, which consists of a lot of surrounding trees. ICF and SJCOG, Inc. staff is in conversation with the landowner in terms of design and artificial burrows. Mr. Gifford asked about the Giant Garter Snake (GGS) potential within the pond. Mr. Mayo stated the pond is not aquatically connected to waterways in the delta or any of its tributaries. It was moved/seconded (Beckman/Huecksteadt) to Approve Recommendation to SJCOG, Inc. for the 1) Approval of the Conservation Easement Acquisition and 2) Approval of the Preserve Management Plan (PMP) for the Preserve Site. Motion passed 8/1. VII. Roza Howard Road Property Preserve Acquisition and Preserve Management Plan Mr. Mayo stated the Roza Howard Road Property parcel under consideration consists of approximately 72 acres. The landowner and SJCOG, Inc. are discussing a conservation easement under the habitat plan for approximately 68 acres on the

6 property. The location of the property is south of Howard Road west of the Middle River and near an existing SJCOG, Inc. preserve in the Delta Zone. Mr. Mayo continued to state with the acquisition, SJCOG, Inc. staff has written a draft Preserve Management Plan (PMP) to reflect the existing Preserve Management Plans (PMP) of the row and field crop preserves in the Delta Zone for economy of scale for species under the SJMSCP. The PMP has no specific enhancements for areas on the referenced property but future enhancements can be included later which will be compatible with on-going farming activities. Mr. Mayo stated SJCOG, Inc. will be acquiring an overall easement on approximately 68 acres of active agricultural habitat as irrigated pasture under the SJMSCP. The cost of the easement is valued at an average cost not to exceed $6,000 per acre with a total acquisition cost of approximately $408,000 and the applicable closing costs required. SJCOG, Inc. will be providing an endowment to be set aside in a specific endowment fund for the preserve in the amount of $285, The endowment funds will be used for land management and enhancements as required under the SJMSCP permits. SJCOG, Inc. staff does not anticipate enhancements on this property because the property is adjacent to Middle River, which contains enough riparian habitat for raptor species. Staff will leave the enhancements open in the PMP for a later date to be brought forward for approval by HTAC and SJCOG, Inc. Board. Mr. Gifford stated on certain preservers there are no opportunities for enhancements, however, most preserves, with agricultural ditches can be enhanced. If more preserve enhancements for Giant Garter Snake (GGS) were present on SJCOG, Inc. easements then, maybe the pond on the G Torlai Easement would have some sort of connectivity. Whereas if SJCOG, Inc. never does enhancements, there will never be connectivity. Mr. Mayo stated for this preserve, staff is not looking for enhancements; however, staff is conducting beta tests on a property south of this property. Staff is seeing a lot of interest from surrounding preserves to do more enhancements, which is one of the reasons for beta testing enhancements on conservation easements. Mr. Gifford stated years ago when the City of Stockton laid that new water pipe down Eight Mile Road, there were no Giant Garter Snakes out there until the construction crew ran over two of them. Talking about the absence or presence of GGS based on CNDDB there are no real survey efforts in the area. It s not fair to say, if you don t build it, they won t come because there is no record. Mr. Mayo stated in this area, near Wing Levee there will be multiple species that will be beneficial to enhancements of SJCOG, Inc. preserves. Not all land owners are open to have

7 enhancements on their property. The beta tests open the door for conversations about enhancements on SJMSCP preserves. It was moved/seconded (Beckman/Herman) to Approve Recommendation to SJCOG, Inc. for the 1) Approval of the Conservation Easement Acquisition and 2) Approval of the Preserve Management Plan (PMP) for the Preserve Site. Motion passed 8/1. VIII. Lodi White Slough Property Preserve Acquisition and Preserve Management Plan This item was tabled. IX. Serrano Preserve Dedication and Preserve Management Plan Mr. Mayo stated the Serrano Properties are a total of 97 acres in size. A development project is dedicating a conservation easement of approximately acres to SJCOG, Inc. for the habitat program. The location of the property is in the Old River area along Paradise and Lucerne Avenue northeast of the City of Tracy in the Central Zone. The potential preserve is adjacent to existing SJCOG, Inc. Central Zone preserves. Mr. Mayo continued to state with the dedication, SJCOG, Inc. staff has written a draft Preserve Management Plan (PMP) to reflect the existing Preserve Management Plans (PMP) of the row and field crop preserves in the Delta Zone for economy of scale for species under the SJMSCP. The PMP has minor enhancements for areas on the referenced property but future enhancements can be included later. Mr. Mayo stated SJCOG, Inc. will be provided an overall easement on approximately acres of row and field crop habitat easement land under the SJMSCP. SJCOG, Inc. will also be provided an endowment to be set for the preserve as the project proceeds in the amount of approximately $380, for land management and enhancements as required under the SJMSCP permits. It was moved/seconded (Beckman/Huecksteadt) to Approve Recommendation to SJCOG, Inc. for the 1) Approval of the Conservation Easement Dedication and 2) Approval of the Preserve Management Plan (PMP) for the Preserve Site. X. Other Matters of Business a Annual Report Amendments

8 Mr. Mayo stated one of the jurisdictions provided staff with an amended quarterly report for 2016 s 3 rd quarter. Staff has revised the tables to capture the amended quarterly report. The 2016 tables in the annual report will not affect the Habitat Plan until the 2018 Annual Report. SJCOG, Inc. staff will speak to permitting on how to process the amendment to the 2016 Annual Report. b. 2017, 1 st Quarterly Reports Mr. Mayo stated the st quarterly reports were due April 14 th to SJCOG, Inc. staff. c Financial Subcommittee Mr. Mayo stated the 2018 Financial Subcommittee meeting will be underway soon. The Financial Subcommittee consists of HTAC representatives that collectively set the fees for the next calendar year. The 2018 fees will be adopted in the fall of 2017, which will be in place by January 1, July 2017 will be our first subcommittee meeting. This item was for information/discussion only. South Lathrop Regional Outfall Project Ms. Boyd stated the South Lathrop Regional Outfall Project is seeking a motion to approve recommendation to SJCOG, Inc. to allow the project to participate in the SJMSCP and to allow a revision to the Incidental Take Minimization Measures for Giant Garter Snake and Western Pond Turtle buffers. The City of Lathrop Public Works Department is requesting coverage under the SJMSCP for the South Lathrop Regional Outfall Project. The project is located in a mapped area of the plan, however, the outside permitting requirements (e.g. 401/404 and a 1602 permits) requires the project to seek approval by HTAC and SJCOG, Inc. Board. In addition, staff is requesting a buffer reduction for GGS and WPT because the project is located on the eastern riverbank of the San Joaquin River. The project is located south of the I-5 crossing of the San Joaquin River and north of the UPRR line within the City of Lathrop city limits in the Central Zone as seen in attachments 1 & 2. If the project is approved, SJCOG, Inc. will be provided mitigation for approximately 1.0 acre of Multi-Purpose Open Space habitat land. The project consists of a storm drainage outfall that is a regional facility consistent with the City of Lathrop s Master Drainage Plan. This facility will serve the Lathrop Gateway Business Park, the South Lathrop Specific Plan, and several commercial and business developments along McKinley Avenue in the City of Lathrop. The project includes the installation of an outfall structure on the bank of the San Joaquin River and associated pipes over the existing levee, connecting to infrastructure within the adjacent industrial development (attachment 3). In order for the project to construct the required work, the project will impact potential habitat for GGS and WPT. Section of the plan in concurrence from HTAC, allows for the establishment of a setback and buffer zone to be used by a project in place of the suggested 200 feet for GGS and 300 feet for WPT. Because construction of this project will be within the suggested 200 foot and 300 foot buffer areas, the project proponent has requested a reduction in the buffer to a 0 setback. All other ITMM measures for GGS and WPT will remain standard. It was moved/second (Hoffman/Beckman) to Approve Recommendation to SJCOG, Inc. to 1) Allow the South Lathrop Regional Outfall Project to Participate in the SJMSCP; and 2) Allow a Revision to the Incidental Take Minimization Measures for Giant Garter Snake (GGS) and Western Pond Turtle (WPT) buffers. Motion passed 8/1; Jeanette Griffin, CDFW voted no. VI. Other Matters of Business: None

12 August 2017 HTAC STAFF REPORT SUBJECT: RECOMMENDED ACTION: Bozich Residence Project, Plan Participation Motion to Approve Recommendation to SJCOG, Inc. to Allow the Bozich Residence Project to Participate in the SJMSCP DISCUSSION: SUMMARY: The project applicant, Jim Bozich, is requesting coverage under the San Joaquin Multi-Species Habitat Conservation and Open Space Plan (SJMSCP) through the San Joaquin County Community Development Department because the site is in an unmapped area of the Plan. The project site is located west of Elliot Road and north of Jahant Road, near the City of Lodi in the Central Zone (attachments 1 & 2). RECOMMENDATION: SJCOG, Inc. staff recommends the HTAC make the recommendation to the SJCOG, Inc. Board to allow the project to participate under the SJMSCP to provide biological coverage for the project impacts to the habitat types under the federal and state permits. FISCAL IMPACT: SJCOG, Inc. to be provided mitigation for the project impacts as required under the SJMSCP. If project participation is approved, SJCOG, Inc. will be provided mitigation for the project impacts as required under the SJMSCP for approximately 4.57 acres. The impacts for this project would consist of 4.57 acres of Urban (U) habitat at the appropriate rate of disturbance under the Plan. BACKGROUND: The project consists of a building permit to construct a residential home site (attachment 3). The SJMSCP GIS habitat layer classifies the project site as Urban (U). If allowed to participate in the SJMSCP, the total disturbed area of 4.57 acres will consist of Urban (U) habitat impacts. The project applicant will be responsible for mitigating for the habitat impacts that are consumed by this project by either paying the appropriate fees at the time of ground disturbance or dedicating land in lieu of a fee at the appropriate SJMSCP ratio.

17 August 2017 HTAC STAFF REPORT SUBJECT: RECOMMENDED ACTION: Consentino Winery Project, Plan Participation Motion to Approve Recommendation to SJCOG, Inc. to Allow Consentino Winery Project to Participate in the SJMSCP DISCUSSION: SUMMARY: The project applicant, Northern Interior Wine Partnership,, is requesting coverage under the San Joaquin Multi-Species Habitat Conservation and Open Space Plan (SJMSCP) through the San Joaquin County Community Development Department because the site is in an unmapped area of the Plan. The project site is located south of east Harney Lane and west of Clements Road, southeast of the community of Lockeford in the Central and Vernal Pool Zones (attachment 1 & 2). RECOMMENDATION: SJCOG, Inc. staff and HTAC recommend the SJCOG, Inc. Board to allow the project to participate under the SJMSCP to provide biological coverage for the project impacts to the habitat types under the federal and state permits. FISCAL IMPACT: SJCOG, Inc. to be provided mitigation for the project impacts as required under the SJMSCP. If project participation is approved, SJCOG, Inc. will be provided mitigation for the project impacts as required under the SJMSCP for approximately 4.6 acres. The impacts for this project would consist of 2.17 acres of Agricultural (C34) and 2.43 acres of Urban (U2) habitat at the appropriate rate of disturbance under the Plan. BACKGROUND: This project consists of a Use Permit application for a large sized winery. Phase one consists of the construction of a 46,367 square foot commercial warehouse, a 3,108 square foot covered work area for the winery, grading for a retention pond, and a 1,603 square foot office. Phase two

18 consists of the construction of a 50,400 square foot warehouse. Phases three and four consist of the construction of two 35,040 square foot warehouses (attachment 3). The SJMSCP GIS habitat layer classifies the project site as Agriculture (C34) and Urban (U2). If allowed to participate in the SJMSCP, the total disturbed area of 4.6 acres will consist of 2.17 acres of Agriculture (C34) and 2.43 acres of Urban (U2) habitat impacts. The project applicant will be responsible for mitigating for the habitat impacts that are consumed by these subsequent projects by either paying the appropriate fee at the time of ground disturbance or dedicating land in lieu of a fee at the appropriate SJMSCP ratio. 22 August 2017 HTAC STAFF REPORT SUBJECT: RECOMMENDED ACTION: McManis Family Vineyards Pond Expansion Project, Plan Participation and Alteration to the Habitat Type Coverage Motion to Approve Recommendation to SJCOG, Inc. to 1) Allow the McManis Family Vineyards Pond Expansion Project to Participate in the SJMSCP and; 2) Allow an Alteration to the Habitat Type Coverage from Natural (W5) Habitat Land to Urban (U) Habitat Land DISCUSSION: SUMMARY: The project applicant, McManis Family Vineyards, is requesting coverage under the San Joaquin Multi-Species Habitat Conservation and Open Space Plan (SJMSCP) through San Joaquin County s Community Development Department because the site is in an unmapped area of the Plan. The project is located on the south side of River Road, 2,600 feet west of Carrolton Road, east of the City of Ripon in the Central Zone (attachment 1 and 2). RECOMMENDATION: SJCOG, Inc. staff recommends the HTAC make the recommendation to the SJCOG, Inc. Board to 1) allow the project to participate under the SJMSCP to provide biological coverage for project impacts to the habitat types under the federal and state permits; 2) allow an alteration to the habitat type coverage from Natural (W5) to Urban (U) habitat land. FISCAL IMPACT: SJCOG, Inc. to be provided mitigation for the project impacts as required under the SJMSCP. If the alteration to the habitat type is approved, SJCOG, Inc. will be provided mitigation for the project impacts as required under the SJMSCP for impacts to 3.81 acres. The impacts would consist of 3.11 acres of Multi-Purpose Open Space (C2) and 0.70 acres of Urban (U) habitat impacts at the appropriate rate of disturbance under the Plan.

23 BACKGROUND: The project applicant intends to infill the northern existing pond and add two process water ponds to the west of the southern existing pond (attachment 3). In accordance with the SJMSCP Planned Land Use Map, the project site is located in the unmapped land use area of the plan. Because it is not located on a SJMSCP Compensation Map, the project can request an alteration to the SJMSCP vegetation map habitat classification on a case by case review. The project is seeking an alteration to the habitat classification on the SJMSCP vegetation map based on the SJMSCP Section for a clerical change by the JPA to the habitat classification on the project site based on provided aerial photography imagery dated just prior to SJMSCP permit issuance in 2001 on a case-by-case review by the Habitat TAC for recommendation to the SJCOG, Inc. Board for approval. Based on the habitat classification by the permitting agencies and local jurisdictions prior to issuance of the SJMSCP permits in 2001 through broader review of habitat types in San Joaquin County, the SJMSCP GIS vegetation map habitat the project site as Natural (W5). However; aerial photography (attachment 4) shows portions of the land within the project footprint is actually Urban (U) consisting of existing ponds (north and south). The original SJMSCP habitat classification for this specific area would be re-classified from 0.70 acres of Natural (W5) habitat to 0.70 acres of Urban (U) habitat and the remainder 3.11 acres to stay as Multi-Purpose Open Space (C2) habitat. If allowed to alter the SJMSCP vegetation map habitat classification under the SJMSCP, the total disturbed area of 3.81 acres will consist of 0.70 acres of Urban (U) and 3.11acres of Multi-Purpose Open Space (C2) habitat impacts. The project applicant will be responsible for mitigating for the habitat impacts caused by this project by either paying the appropriate fees at the time of ground disturbance or dedicating land in lieu of a fee at the appropriate SJMSCP ratio. Paskett, is requesting coverage under the San Joaquin Multi-Species Habitat Conservation and Open Space Plan (SJMSCP) through San Joaquin County s Community Development Department because the site is in an unmapped area of the Plan. The project is located on the south side of E. Woodbridge Road, 545 feet west of Tretheway Road, Acampo and east of the City of Lodi in the Central Zone (attachment 1 & 2).
