3 Seabury Condominium Association Hampton, NH Rules and Regulations We live in a community where everyone s cooperation with, and adherence to the Rules and Regulations of the Condominium is essential to the smooth operation of our property. Compliance with these rules and regulations will maintain the property values for each Owner. In addition they provide for a comfortable, peaceful, and attractive living environment. The Board of Directors at Seabury Condominiums wishes to point out that most of the rules have been taken from the by-laws and we ask that you give them the attention and importance that they deserve. The units, common areas and limited common areas shall be occupied subject to the following restrictions. APPLICABILITY All rules and regulations apply to and are binding upon all Owners, occupants, tenants, and lessees, persons in possession, invites and guests. If a Unit is rented, the Unit Owner shall bear the responsibility for ensuring compliance by the tenant with these rules and regulations and the Declaration of Condominium. The Unit Owner shall also be responsible for any fines levied on the unit for infractions of these rules and regulations by the tenants, as well as for any damage caused by the tenant. USE OF UNITS 1. Except as herein provided, no units shall be used for any purpose except residential purposes. No building shall except as herein provided, be used for any commercial, professional or other purpose which does not comply with the provisions of the Declaration. 2. Nothing shall be done or kept in any Unit or in the Common Area which will increase the rate of insurance in the Common Area without the prior written consent of the Board of Directors. No Owner shall permit anything to be done or kept in his Unit or in the Common Area which will result in the cancellation of insurance of any Unit or any part of the Common Areas or which would be in violation of any law. There shall be no obstruction of, storage in or waste permitted in the Common Areas. 3. No advertisements or posters of any kind shall be displayed to the public view on or from any Unit without the prior consent of the Board of Directors. 3. No clothing, laundry, rugs or wash shall be hung or spread upon or from any window or exterior portion of a unit or in or upon any common area. All refuse and trash shall be placed in locations specifically designated by the Board and no garbage or trash shall be permitted to remain in public view.
4 3. Garden Unit Laundry facilities. Provided on the first floor of each Garden Unit buildings are laundry facilities.. Installation of washers and dryers are not permitted within Garden Units. Hours of operation for all washers and dryers, Garden and Townhouse, are: Not before 8am and not after 10pm. 6. No animals other than household pets of a unit owner shall be raised, bred, or kept in any Unit or in the Common Area or Limited Common Area without the express written approval of the Board of Directors or Manager, as the case may be. Pets shall not be permitted outside of Units unless they are accompanied by an adult person and carried or leashed. Each Owner shall remove excrement created by his pet. The Board of Directors may make further provisions in the rules for control and regulations of household pets in the condominium. The Owner of a Unit where a pet shall be kept shall be responsible and may be assessed by the Board of Directors for damages to the property resulting from the maintenance of said pet, and any cost incurred by the Association in enforcing the rules prescribed or to be prescribed by the Board of Directors for the control and regulation of pets in the condominium. Townhouse Units Pets are allowed in the Townhouse Units. All pets must be walked off common area property. If your pet should mess in the common areas, the Owner must clean it up immediately. No pet should be tied up outdoors or left unattended at any time. Your pet should not disturb or become a nuisance to your neighbors. If your pet causes damages to common areas, you, as the Owner, will be responsible for all repair costs. If any pet is left unattended outside in a common area, it will be considered a stray and handled accordingly. All owners must read and sign the adopted Pet Policy form. Garden Units Pets are not allowed in the Garden Units. In the event that any pets are maintained, raised, bred or kept in a Garden Unit, a fine of one-hundred ($100.00) dollars per week, or any portion of a week, per pet shall be assessed against the unit. 7. No noxious or offensive activities shall be carried on in any Unit, in the Common Area or Limited Common Area, nor shall anything be done therein which may become an annoyance or nuisance to the other Unit Owners. 8. Nothing shall be altered, constructed, removed, or replaced from the Common Area or Limited Common Area except upon the written consent of the Board of Directors. This shall include, but not limited to, windows, doors, storm doors and landscaping.
5 9. An owner shall not paint or otherwise decorate or change the outside appearance or the type of exterior siding of any portion of the exterior of any of the building(s) without the prior consent of the Board of Directors. Holiday decorations are permitted with time limits. For the Thanksgiving and Christmas holiday season, decorations will be permitted from two weeks before Thanksgiving until two weeks following Christmas. All other holiday decorations are permitted two weeks prior and two weeks beyond the given holiday. 10. No Unit Owner shall make any alterations to their unit, nor construct any new structure or appurtenance, or make any improvements to the building without the consent of all of the Unit Owners: Provided however, that any Unit Owner shall have the right to make interior decorating improvements or any interior changes which do not affect any facilities which are shared with the other Units within the building. 11. Nothing shall be stored in front of or in the rear of the units, on the decks or under the stairs. This includes personal belongings, which would create a liability to the Association. The use of Fireworks is prohibited by law; fireworks are not permitted on the premises. Occupancy Occupancy of any Garden unit is limited to four (4) persons per Hampton town Ordinance. Security For the safety of all residents the front and back doors of the Garden buildings must remain locked at all times. Please do not leave the doors ajar. LEASING OF UNITS Each unit is intended for residential use only by the owner, the owner s family, servants or guests. Units may be rented only in their entirety and occupied only by the lessee, his family, servants and guests. No rooms may be rented separately. If you are leasing your unit you, as the owner, are responsible for supplying your tenants with a copy of the rules and regulations and seeing that they comply with same. No Owner shall lease or rent their unit for a period of less than one (1) year. The Board of Directors and/or the Management Company must be provided with copies of rental forms, agreements or leases and all other rental information such as names, telephone numbers and vehicle information within thirty (30) days of the date of the lease. Failure to submit any lease or comply with this paragraph shall constitute a violation of the by-laws and shall result in a minimum fine of fifty- dollars ($50.00). Owners leasing their units, agree that they are liable for the actions of their tenants and are responsible for unpaid assessments and fines incurred by their tenants. Unit Owners will, after notification by the Board of Directors that a tenant has repeatedly violated the rules, regulations or by-laws of the Association initiate eviction proceedings against said tenants.
6 ROADS, PARKING, MOTOR VEHICLES Speed Limit The speed limit within the Condominium property is ten (10) miles per hour. Parking All units within Seabury property have an assigned parking space. Townhouse units should use their garage and their driveway for parking. The Garden units have one numbered/assigned parking space. At no time shall vehicles extend onto grass areas or extend out into roadways when parked end to end for either the Townhouses or the Garden units. All other parking spaces are provided for guests of the Unit Owners or tenants. Unit Owners/tenants are not to park in visitor spaces. Motor Vehicles Each unit Owner and or the tenants thereof shall provide the Board of Directors or the Management Company with their vehicle make, model, registration numbers and the state of issuance. No unregistered vehicles, no motorcycles or motorbikes, no recreational vehicles (i.e.: boats, trailers or trucks) or commercial vehicles shall be parked or stored externally on the condominium property; any such vehicles shall be warned by having a ticket placed on the vehicle or a letter sent to the Owner, and, if no response within 24 hours, the vehicle will be towed by the Board of Directors at the vehicle Owner s expense. Commercial vehicles shall be defined as follows: Any vehicle that advertises any type of business or entity. Dump Trucks, Utility Vans, Box Trucks, trucks to be used for hauling equipment, or any vehicle with a gross vehicle weight that exceed 7000 pounds. Traffic Pattern The traffic pattern in the loop from Building 1 around to Unit 80 is One Way. Snow Removal In the event of a storm 2 inches or greater, the plowing contractor will continue to keep open the roadways throughout the storm. The contractor will return to the property at the end of the storm to fully open the parking spaces. Please move your car from the parking areas when the snow removal contractor sounds his horn or otherwise signals you to do so. Your car must be returned to your parking space immediately after the parking area is cleared so that you do not impact anyone else or block snow removal efforts on the street. Please keep your eye on the progress of the plowing until the storm ends. Residents will be responsible for clearing snow from their decks. COMMON AREAS Buildings Please do not obstruct the front or rear entries, stairways or landings of the Garden Buildings. No trash, refuse, garbage or other debris shall be stored in the common areas. No hooks, flags, banners, hangers, racks or other fixtures shall be attached or affixed to any part of the common area.
7 Property Nothing shall be left or stored in or upon the common areas with the exception of bicycles that are to be stored only in the available bicycles racks. Lawn chairs, roller skates, skateboards or other toys or recreational items shall not be left outside of any unit day or night. Unit Owners are not allowed to store their lawn chairs, toys, umbrellas, etc. in the pool deck area. Lawn chairs will be allowed at the pool only when the Unit Owner is present to use them. When the Unit Owner leaves, the chair must be returned to the Unit as well. Chairs left unattended, specifically overnight, will be removed from the pool area and discarded. Toys, floats and other items are not allowed at the pool per the pool regulations. (See below) Satellite Dish Rules Please refer to the attached Satellite Dish Rules adopted by the Association as provided by the Federal Communications Commission (FCC) Regulations. DECKS AND BALCONIES Nothing may be stored or kept on decks or balconies. Chimeneas are not permitted. Outdoor furniture and plants are permissible. No towels, clothing, clothes lines, rugs, sports equipment, beach floats, automotive parts, garbage bags, recycling bins, etc. can be hung over or stored on the deck/balcony railings or kept on the decks or balconies. DESTRUCTION OF PROPERTY Destruction of any common property or any unit is strictly prohibited. This includes driving or parking on the grass or any other landscaped area. The unit Owner or tenant causing property damage will be the unit Owner s responsibility for the cost to repair or replace the damaged property and shall be subject to a fine. TRASH 1. Only small, residential trash is to be disposed of inside the dumpster container. Anyone leaving trash bags or items outside the dumpster will be subject to the fining process. 2. Depositing of anything but small household trash is strictly prohibited. Items such as bikes, rugs, gas grills, beach chairs, toxic materials, etc. must not be abandoned in or around the dumpster area. Anyone identified as abandoning these types of materials will be subject to the fining schedule as stated herein and will be responsible for reimbursing the Association for the cost of disposal of the item(s) as well as any disposal fees imposed by the state or local regulations. Residents who need to dispose of large objects must utilize the Town Transfer Station on Landing Road. 3. Residents of Seabury are encouraged to participate in the Hampton Recycling Program. Please place your recycling bin out on the street Monday and do not forget to pick it up after it is emptied. 8 4. Cardboard boxes must be broken down before depositing in the dumpster. This will conserve space and allow room for other s trash. 5. After depositing your trash all the way to the rear of the dumpster, please close the plastic doors so that seagulls, raccoons, squirrels, skunks and other animals may not enter the dumpster. 6. The dumpsters are emptied on Mondays, Wednesdays and Saturdays by Waste Management. To prevent messy overflow, please plan your trash deposits accordingly. SIGNS No signs of any kind can be placed in the common area. No signs of any kind can be affixed to any unit. This includes For Sale and Open House signs by Realtors. Notices may be placed on the Seabury Condominium bulletin board in the mail house and pool rules may be posted by the swimming pool area. UNIT OWNER RESPONSIBILITY Per the condominium documents the following items are deemed to be part of the Condominium UNIT. The Owner of the Unit is responsible for the maintenance and upkeep of these items: Air Conditioning Units Furnaces Appliances Heating or Air Conditioning Ducts Cable TV Interior bearing walls Carpeting Interior bearing columns Ceiling Fans Interior Partitions Ceiling Paint Light Fixtures Chimneys Paneling Chutes (Servicing your unit) Plaster Plumbing Fixtures Screens for Doors and Windows Conduits/Pipes (Servicing your unit) Tiles Front Doors Wall Board Sliders Wall Paint Wallpaper Garage Doors Windows Shed Doors(Garden balconies) Wires (servicing your unit Ducts Flues Finished Flooring INSURANCE The Seabury Condominium Association in accordance with the Condominium Documents is required to maintain a Master Policy for Insurance of the exterior of the buildings and common areas. The Master Policy will cover losses that exceed the current deductible that is held on the policy. If there is a loss to your unit, regardless of the cause, the Unit Owner is responsible to pay the deductible towards the repair of that damage. If the loss is over the deductible amount, the Condominium Association s Master Policy will provide for the remainder of the balance. If the loss is under the current deductible amount, the Unit Owner is responsible for the entire amount.
9 The Condominium Association s Master Policy does not cover any personal items, i.e. furniture, clothing, beds, bedding, jewelry, etc. It only covers the structure of the building. Owners must have insurance for their personal belongings as well as the current deductible in place. POOL RULES Please see attached and must be adhered to. CHILDREN For safety reasons, children may not play in the road and parking areas. Any damage caused by children of Owners and tenants to the common areas, personal property, buildings, pool, pool equipment and other landscaping will be the Unit Owner s expense to repair. Children may not play in the mail house, on any fences, trees or on the Seabury entrance sign. NOISE AND DISTURBANCES No unit Owner shall permit or allow unreasonable noises to be generated by any person or thing in or around the condominiums. Washing and Drying of laundry is to be limited to between the hours of 8am-10pm in all units. Unreasonably loud radios, stereos, TVs, parties, yelling, musical instruments, etc. are prohibited. Unreasonable shall mean any noise or disturbance, which can be heard by people in another unit above normal conversation. You are required to have consideration for your neighbors. FIREPLACES The Condominium Association has the townhouse chimneys inspected every two years. If, upon inspection, your chimney is found to be in need of cleaning, you must, for liability reasons, have this done and provide proof to the Board of Directors. The Association will pay for the fireplaces to be inspected. However, the cleaning fee is to be paid by the Unit Owner. SALE OF UNIT Notice must be given to the Board of Directors or the Management Company upon the signing of a purchase and sales agreement or thirty (30) days prior to the actual closing of a sale. The unit Owner must provide the name(s), mailing address and telephone number (s), of the prospective purchaser. All outstanding condominium fees and fines must be paid in full before, or at the closing, of any sale of the condominium unit. BOARD OF DIRECTORS Your Board of Directors is comprised of Unit Owners and is a five member board. Board members are elected at the Annual Meeting that is held in the fall. Unit Owners are welcome to attend the monthly board meetings. Generally, the Board meets on the third Tuesday of each month. If a unit Owner wishes to discuss a specific matter they should notify the Management Company in writing one week before a scheduled meeting so that the unit Owner/subject can be placed on the meeting s agenda. CONDOMINIUM FEES Condominium Fees are due on the first day of every month. In the event that any condominium fee is not paid by the fifteenth (15 th ) of each month, a late penalty of fifteen ($15.00) dollars shall be assessed against the unit and said penalty shall be assessed for each additional month it re-
10 mains overdue. Delinquencies for more than one month may result in the placement of a lien on the condominium and any fees or costs for applying the lien or legal fees spent in the collection of fees shall be charged to the unit Owner. It is essential to the financial health of the Seabury Condominium Association that Unit Owners pay their condominium fees on time. OCCUPANCY Garden Units There is a 4 (four) person occupancy limit in the garden units. In the event of any violation of the occupancy limitation, a fine of two-hundred ($200.00) dollars per week per person shall be assessed against the unit. ILLEGAL ACTIVITIES Any activity involving the police to be called to any unit will cause a fine to be assessed and possible eviction. SOLICITING There shall be no soliciting allowed by any person or group, resident or non-resident, on the Seabury Condominium premises. FINES The Board of Directors has the authority to assess and levy fines for any violations of the Rules and Regulations of the Condominium or any provisions of the Declaration of the Condominium. The Board may also enforce these fines by placing a lien on a unit or by taking other appropriate court action. The unit Owner is entitled to (1) one written warning. After the written warning, a penalty of a minimum of twenty-five ($25.00) dollars shall be assessed for each additional week it remains a violation and for each subsequent infraction of said or like rule. The Board of Directors reserves the right to double fines each instance due to the severity and continued abuse of the violation.
11 SEABURY CONDOMINIUM ASSOCIATION POOL RULES 1. The pool is for the use of Seabury Residents and two of their guests. No exceptions will be made. Persons using the pool may be required to show proof of residency. Residents observing non-residents using the pool are encouraged to call the police at or ProActive Property Management at Glass or anything breakable is not allowed in the pool area. 1. No horseplay, splashing, toys, floats, or ball playing, etc. is permitted in the pool or pool area. 1. Children under 14 years of age are not allowed in the pool or pool area without a supervising adult. No more than three children per adult. Children in diapers are not permitted in the pool. 1. The pool may be used from 10:00 a.m. to 9:00 p.m. 1. Please use the rubbish barrels and cigarette cans provided for the disposal of those items. 1. Seabury Condominium Association is not responsible for any lost or stolen items. 1. Diving into the pool is not permitted as its maximum depth is 6 feet deep. 1. No cooking, food or beverage is allowed in the pool area. 1. No pets are allowed in the pool area or in the pool. 1. No loud noise or music is permitted in the pool area due to the close proximity of the Condominiums. 1. Unit Owners are not allowed to store their lawn chairs, toys, umbrellas, etc. in the pool deck area. Lawn chairs will be allowed at the pool only when the Unit Owner is present to use them. When the Unit Owner leaves, the chair must be returned to the Unit as well. Chairs left unattended, specifically overnight, will be removed from the pool area and discarded. Toys, floats and other items are not allowed at the pool per the pool regulations. 1. Each unit originally received one (1) non-duplicating gate key. The keys were marked with the unit numbers on them. If you should lose your key, the cost to replace your key is $ The purpose for this charge is to make sure Unit Owners do not lose, misplace or allow renters to leave with a key. By keeping track of the keys, Seabury has drastically reduced the number of non-residents using the pool. Residents should not lend their keys out. 1. Owners are liable for their pool key. If your renter loses your key, you will have to purchase another one for $ There will not be any exceptions. If you recently bought your unit and the previous Owner did not leave the key, you will have to purchase a key. 1. Do not open the gate for residents or others who do not have a key. 1. There is no lifeguard on duty.
12 Seabury Condominium Association Pet Policy The Seabury Condominium Association Board of Directors has revised the Rules and Regulations concerning pets. The following rules must be abided by in order to house a pet on the property. Cats and Dogs are welcomed in Townhouse units, but written approval of the Board of Directors must be obtained. Pets are not allowed in the Garden Units. Please read the following policy, sign it indicating that you understand the Seabury rules and regulations regarding pets and forward it to the management company. Dog owners must also provide proof of licensing and rabies vaccination. You or a member of your household must accompany the pet at all times when outside of unit, whether carried or on a leash. The pet must be under your control. No pet is to be left unattended outside at any time. Your pet should not disturb or become a nuisance to your neighbors. Pet excrement is to be removed immediately and disposed of properly. If your pet causes any damage to common areas, you as the Owner will be responsible for all repair costs. Any dog that has exhibited ANY aggressive behavior towards a human is strictly prohibited. If a member of the Association notes any violations of this policy, you will be notified in writing of the infraction and this will serve as your first warning. If the problem is noted a second time, you will be assessed a $25.00 fine. For each additional violation, a $50.00 fine will be assessed. If the problem is not corrected within 30 days, the Board will take appropriate action for the removal of your pet. Not obtaining approval from the Board of Directors will also be subject to the fining process. AGREEMENT I/We agree to the above terms and restrictions in regards to having a pet at Seabury Condominium Association. I/We understand that the Rules and Regulations are intended to be in the best interest of the Association and Community.
