3 5.2.3 Corner lots or lots having two or 3 sides fronting the street. Only one side of the lot fronting the street is required to have an easement of three (3) meters from the building line and two (2) meters from the roof/roof eaves/roof gutter to the boundary line, the other side(s) fronting the street shall be considered as side(s) of the lot Building Height. The total height of the constructed residential house shall not be more than nine (9) meters from the highest point of the lot purchased. 5.3 Allowable Expansion Area Building expansions require OBO (Office of the Building Officials) permit and approval. Buyer shall comply with all laws of the National or City Ordinances and its implementing rules and regulations of any government agencies, such as building permit, occupancy permit, and the licenses related to such undertaking. No construction shall start without the needed permit from the government authority, from the Developer and the Homeowner s Association Allowed expansion area for House and Lot units: Single Detached- one side and rear side Duplex- rear side Clustered Type- rear side Firewall must be constructed and shall extend at least (1) one meter from the height and side of building structure Allowed expansion area for Lots only: Expansion is allowed on one side of the property and on the rear side Firewall must be constructed and shall extend a maximum of one (1) meter from the top and sides of the building structure. 4 CONSTRUCTION AND RENOVATION GUIDELINES 1. Required Documents Prior Construction/Renovation 1.1 Application Form 1.2 Fencing Application Fencing Plan 1.3 Building Expansion & New House Construction Site Development Plan Perspective and Floor Plans Front-Sides-Rear Elevation Plan Roof Framing Plan Plumbing Layout (show water supply & storm drainage line) Electrical layout Cost estimates Note: for new house construction- Minimum cost of house is Php 2.0 Million for the next (5) years. This may be adjusted as determined by the Developer or Board of Directors Survey / Lot Relocation Plan by a third (3 rd ) party surveyor commissioned by the owner shall be required prior submission of all documents listed. 2. Application Procedure 2.1 Submit complete required documents to the Developer / HOA office for approval. 2.2 Complete documents shall be processed for approval within 10 working days. 2.3 Once approved, pay the corresponding construction bond and admin fee to Developer / HOA office. AMENITY & SERVICE DIRECTORY BILLING AND COLLECTION OF SUBDIVISION DUES AND OTHER ACCOUNTS Please contact our Billing-In-Charge at telephone number (032) MULTIPURPOSE HALL Open-air hall available for rent during special events of subdivision residents on a first-come first served or advance booking at Developer/HOA office. BASKETBALL COURT Available for use with advance reservation or some day drop in use. Basketball court is Cemented floor, fence, and lightings. PLAY AREA A play area especially designed for your children to have fun. Open for all residents and children who wish to do open field activities. WATER PROVIDER Metropolitan Cebu Water District (MCWD) Tel. 5 The Homeowner s Association has the right to file an injunctive action to enforce the Rules and Regulations and the party in violation will pay costs of injunction and reasonable attorney s fee which in no case will be less than P15, Unless otherwise specified by the Board of Directors, its HOA officer or its authorized representatives in due notice sent to the unit owner and/or lessee to his unit, the unit owner and/or lessee will be liable for all violations on the Deed of Restriction, all Rules and Regulations promulgated by the Board of Directors, committed by the owner or lessee personally, his guest and employees. After the deadline or time fixed for the abatement or correction of such violations and compliance with the pertinent provision under the Deed of Restrictions or rules and regulations, the unit owner and/or lessee will pay to the Homeowners Association liquidated damages consisting of: A daily penalty which will accrue until such time that the unit owner and/or lessee has abated or corrected such violation and complied to the satisfaction of the Homeowners Association All expenses, including attorney s fees, incurred by the Homeowner Association for the enforcement of the provisions of the Deed of Restriction and the Subdivision Rules and Regulations AMENDMENTS These House Rule and Regulations may be amended from time to time by the Board of Directors of the Homeowners Association. Unit Alteration & Renovation Guidelines on Unit Alteration and Renovation are available at the Developer/HOA office. Clearly defined are the requirements on plans, fees and bonds. The Building Administrator will gladly assist you on this matter. Association Dues and Special Assessments When the homeowner s association is formed, association dues are determined by a pre-approved annual budget covering all maintenance expenditures, security and administration. These are due and payable on the day of the month. Statement will be distributed promptly. Garbage Disposal and Collection The subdivision hire garbage collector (private or government) to collect garbage in each unit. Please refer to the Subdivision Rule 5.6 Garbage Control Guidelines. Further, we advise to follow the garbage collection schedule. Kingly put all your garbage bins within your property not on common areas such as sidewalks, roads, pathways. Emergency Drills/Exercises By your Building Administrators periodic fire emergency drills are conducted in line with the subdivision s Emergency Preparedness Program. Everyone is enjoined to actively participate in the said exercises. Remember, they are for your own safety. 21 v

6 5.17 VENDORS, PEDDLERS, BEGGARS, SOLICITORS, AND SURVEY AGENTS Vendors, peddlers, beggars and solicitors are prohibited from entering the subdivision premises. ELECTRICAL BASIC SAFETY TIPS The following guidelines must be observed for food deliveries: Food deliveries will be screened by the security guards and will be required to secure supplier s ID from the guardhouse Food must be properly packed to prevent spillage within the subdivision premises Any violation of the above will warrant the cancellation of the approval to deliver food and Fast Food Company may be barred future entry by the Homeowners Association The following guidelines must be observed for product promotions and surveys: Distribution of fliers, handouts survey forms and the like within the subdivision premises is prohibited Fliers, handouts and survey forms may be handed to the Developer/HOA Office and will be deposited in the mailboxes of each unit No promotions or demonstrations for any product are allowed within the building premises, unless approved in writing by the Homeowners Association. FIRE Avoid electrical octopus connection. Unplug electrical outlet when not in use. Avoid restricted areas such as power meter bank, electrical room, pump room and the like. Keep cooking area clear of combustibles, and don t leave cooking unattended. Shut off LPG regulators when not in use (check for leaks). Make sure to have at least 10 lbs fire extinguisher inside your unit. IN GENERAL Do not allow children to lean or play at the play areas unattended Make sure to lock all doors and windows while sleeping and leaving your unit. Always subject for inspection at the entrance gate (vehicles, deliveries, packages) Violators will be required to leave the premises immediately. Avoid throwing of anything outside your residential property. 19 vii

7 5.14 DELIVERIES Delivery and hauling shall not in any manner be allowed to obstruct, restrict or cause any hindrance to the entrances, exits, sidewalks, driveways, parking areas or any other portion of the common areas Only delivery personnel who comply with the policies of the subdivision and security protocols shall be allowed to enter the premises All deliveries of food by vendors, caterers, and fast food restaurants must be done at each unit. In the event of special gathering, activity or event requiring the delivery or catering of food, the following guidelines shall be strictly observed: All catering equipment, food and drinks must be unloaded at the designated area, without causing any obstruction to the driveway The Homeowners Association Office must be given notice of activity and schedule of the caterers, service personnel and technicians, at least twenty (24) hours before the function. These personnel must register with the guard before entering the subdivision premised by signing the logbook and leaving the guard a valid ID Contract forms for the use of amenities may be secured at the Homeowners Association Office PARKING/PARKING AREAS The maximum speed limit while inside the subdivision is 10-20kph Overtaking is strictly prohibited. Drivers must always pass in the contract lane and must always give way to pedestrians. 2. CONCERNS HANDLING 2.1 Concerns arising during office hours shall be referred to the HOA Office. In the absence of HOA officers or during after office hours, concerns may be referred to the security guard for appropriate disposition. 2.2 A concern slip shall be filled-up by the receiver (HOA Office Personnel or Duty Guard) upon receipt. Relevant information pertaining to the concern will be gathered. This will be recorded and processed for appropriate resolution. 2.3 The primary scope of service of the HOA officers is to manage the operations and the services provided by the Homeowner s Association. 3. MEMBERSHIP GUIDELINES 3.1 ASSOCIATION MEMBERSHIP The Owner is required to be and is automatically a member of the Association upon acceptance of the property. The Owner shall strictly abide by the rules and regulations laid down by the Association in the interest of sanitation, security, aesthetics and the general welfare of the community The Developer/Association may require initial membership fee at the prevailing rate during move-in While the Association has not been formed, the Developer may collect monthly maintenance dues to provide services that benefit the owners such as but not limited to: security; street and vicinity lights; maintenance, repairs and cleaning of streets; garbage collection and disposal; and other similar services and facilities In all voting situation, Members shall be entitled to one (1) vote per lot only either as a House & Lot Owner or Lot Owner The Homeowners Association Office shall be properly advised whenever repairs or servicing of utilities in any of the unit shall be undertaken. 17 2

8 Unit owners, tenants and occupant s contractors shall provide the Homeowners Association Office with a list of workers who will perform any repair or work inside the unit IDENTIFICATION CARDS House- helper, drivers, medical aides, contract workers and trades people under the employment of Unit Owners or tenants must be registered with the Homeowners Association Office and must secure proper identification card Unit Owners and tenants shall provide to the Homeowners Association Office a list of regular occupants of their units Visitors shall be subject for inspection and identification. Upon entering, they shall leave any of their identification cards of the guard on duty, and will be issued with a visitor ID. Owners must confirm the exit of every visitor by calling the guard house Non-compliance of the above guidelines entitles the Homeowners Association Officer or the security Guards to deny entry to any person The Homeowner s Association, as represented by its security guards, reserved the right to refuse entry of any person deemed to pose danger or threat to the safety and security of the owners in the village Owners are encouraged to submit guest list to the guard house in case of in-house gathering for entry monitoring purposes MAILS AND PACKAGES To maintain physical security, postal service providers shall be subject for inspection 4. RESTRICTIONS ON USE AND OCCUPANCY OF LOTS 4.1 Individual Lots shall not be subdivided. However, two (2) or more Lots may be consolidated and subdivided into the same number or lesser number of Lots provided that none of the resulting Lots shall be smaller in area than the smallest Lot originally purchased before consolidation. 4.2 A consolidated Lot shall be considered a single Lot. In all cases, the consolidation/subdivision plan shall be duly approved by the Developer or its corporate successors. 4.3 No Lot shall be used in whole or in part for anything other than residential purposes, except for areas designated and declared by the Developer for commercial use, office use or mixed use. 4.4 Subletting of residential property shall be for one (1) single-family residential dwelling only with prior written notice to the Homeowner s Association. Converting a single-family residential dwelling into dormitory house(s) is not allowed. 4.5 Should the unit be leased, the following rules must be followed: Receive copy of duly notarized lease contract from Unit Owner or from Owner s authorized representative Conduct brief orientation to the tenant on: a. House Rules and Regulations (basic rules on security and housekeeping) b. Operation hours of amenities and corresponding rates c. Moved-out guidelines 15 4

9 Temporary latrines or portable toilets for the workers should be built before any construction work is allowed. The facility shall be located within the premises of the Lot All materials used in construction, i.e. gravel, sand, lumber, concrete blocks, etc. or excavated excess materials must be placed within the perimeters of the construction site. Vacant Lots, sidewalks and streets should not be used as storage areas for the construction materials Members must ensure that contractors do not leave the newly constructed house without properly cleaning the area surrounding the construction of garbage and surplus materials Future residents should advise the Association forty-eight (48) hours in advance before moving into their new house in order that proper arrangements for security and for garbage collection may be made on time Penalties- Any violation on the aforementioned regulations and restrictions shall, without prejudice to the power of the Board herein to impose, amend or increase the same, carry the penalties as indicated in Annex C ADDITIONAL GUIDE FOR NEW HOUSE CONSTRUCTION The Lot should be enclosed with a temporary or permanent fence before the actual construction begins. Rusted sheets or other similar materials that are not proper or presentable to be used for the fence, which may cause an eyesore to the subdivision, are not allowed No concrete mixing on the streets or washing of any mobile or portable cement mixers is allowed Hanging of laundry within the lot frontage of the housing unit is strictly prohibited Practice driving inside the Village is prohibited Habal-habal motorcycles have been reported as a common factor of reported burglary incidents in subdivisions. For the safety of residents, habal-habal motorcycles are not allowed to enter the subdivision at any time Tricycles and pedicab may be allowed entry from 6am to 10pm, subject to the following conditions: a. Resident passenger is with cargo. b. Resident passenger is with children. c. With resident passenger on a rainy day Vehicles coming in and going out of the Village should observe strictly the traffic signs posted on the streets inside the Village. Over-speeding and other traffic infractions is not allowed. 5. GENERAL GUIDELINES AND RESTRICTIONS The Homeowner s Association provides its residents with facilities. While these facilities are for the use of the residents, policies and guidelines must be observed to maintain order, cleanliness and the proper maintenance of the facilities. The Homeowner s Association reserves the right to the following: a. To control the number of guest availing the facilities. b. To temporarily close the common facilities and amenities on any occasion for the purpose of conducting repairs and maintenance. 13 6

10 5.7 PEST CONTROL Unit owners and tenants shall be responsible for implementing pest control programs of their respective units at their own expense. 5.8 CONSTRUCTION & POST CONSTRUCTION GUIDELINES Building expansion and new house construction require approval from the Office of the Building Official (OBO) prior start of construction. The Owner shall comply with all national laws, or city ordinances and its implementing rules and regulations of any government agents such as building permit, occupancy permit and the licenses related to such undertaking No construction shall start without the necessary permit from the government authority and from the Homeowner s Association. Plans and specifications shall be submitted to the Homeowners Association Office for initial review to ensure compliance over setback, fence, gate and carport restrictions. (Please refer to Annex B for the Construction and Renovation Guidelines for Building Expansion and New House Construction) A maximum of only three (3) persons are allowed to stay overnight inside the construction area to secure the construction materials, equipment and other valuables inside the site. All other workers are required to leave the subdivision after the allowed working period and shall be permitted to enter the subdivision only after 0600Hrs. 5.2 USE OF MULTI-PURPOSE HALL The multi-purpose hall is available for the exclusive use of Unit owners and tenants The exclusive use of the multi-purpose hall requires at least one (1) week advance booking Rental of Multi-Purpose Hall shall be collected at reasonable fees. Rental fee is Php1, /consumable for 4 hours Multi-Purpose Hall is available for use from 8:00am-10:00pm Only soft music is allowed and the volume of any sound emitted from the facility must be controlled so as not to disturb the peace and tranquility of other residents. Should there be complaints from residents arising from the use of the facility, the user of the facility shall be warned and required to lower the volume of sound emitted Guest and users should observe proper behavior while using the facility, and must not loiter around the subdivision The Homeowners Association/Officers has the right to interrupt or stop the function if the subdivision rules and regulations are violated Driver s Lounge beside the basketball court shall be use as waiting area The following guidelines shall be observed by the catering service provider. a. Catering services must have prior clearance of the administrator. 11 8
