4 LOCATION MAP ANNEX A DEFINITION OF TERMS 1. Association shall mean the homeowner s association which is non-stock, non-profit corporation, registered with the Housing and Land Use Regulatory Board (HLURB), organized for the purpose of enhancing, and protecting the value, desirability and attractiveness of the subdivision, and for promoting the common interests of the homeowners. 2. Board shall mean the board of directors or trustees of the association which has primary authority to manage the affairs of the association. It is the governing body of the association, mandated to exercise such powers as expressly granted to it by law. During the period that the association has not yet been organized and functioning, all the rights, powers, and authority vested in it may be exercised, performed, and enforced by the developer. 3. Owner shall refer to the registered owner or buyer of the parcel in the subdivision or his successor in interest. 4. Member shall also refer to the owner. 5. Parcel or Lot shall mean the subdivided piece of land within the subdivision for sale, or lease, or already sold or leased. 6. Village shall refer to the subdivision. 7. Vendor shall also refer to the developer of the project. 8. Common Area shall refer to the land not available for sale as registered with the Bureau of Lands such as but not limited to the roads, path walks or alleys, sidewalks, planting strips, landscaped parks, rotundas and entrances, playground, buffer and easement areas, nature parks, clubhouse area, amenity areas, utility areas and guardhouse areas./ iv 22

5 Going on Vacation? Whenever you go on a vacation or on an extended trip elsewhere, advise the HOA Office in writing and in advance to prepare the security for any eventuality. Don t forget to switch off all electrical and water supply in your unit. Fire Extinguisher 5.18 REAL ESTATE BROKERS Only real estate brokers or agents duly accredited by the Developer or representing a unit owner will be granted access and authorized within the premises of the subdivision Authorized brokers or agents should closely coordinate their activities with the Homeowners Association Officer UNIT INSURANCE Unit Owners has the option to provide insurance coverage for his unit at his own expense. Each unit owner should have at least a 10 pounder (ABC-Type) fire extinguisher. This is in compliance with the provisions and requirements stipulated in the Fire Code of the Philippines. Select credible brand name for your own protection. Extinguisher require periodic check of its content level or even for caking. Call HOA Office for assistance. Animals and Pets 5.20 PROPERTY TAXES Unit Owners are responsible for paying the property taxes for the individual unit. The Homeowner s Association is only responsible for the taxes imposed on the Land and Building Improvements of the common areas, excluding the Individual Unit subject for special assessment when necessary ENFORCEMENTS Please refer to Subdivision Rules 5.5. Pet Control Guidelines. Energy Conservation & Safety Tips A penny saved is a penny earned- so they say. It makes a lot of sense most especially in these times of energy shortage. Turn off the lights when not needed or rationalized your air conditioners thermostat setting. vi In the event that any unit owner or resident fails or refuses to comply with any limitations, restrictions, covenant, undertaking or condition herein contained involving an obligation other than payment of money or fails or refuses to comply with any provisions or regulations contained in the House Rules, the Homeowners Association may, in accordance with its by-laws: Without prejudice to penalties specified in this House Rules, any Member their dependants, tenants or visitors violating any of the above provisions shall authorize the Homeowners Association/Developer to refuse to render any services handled or extended such as but not limited to the water connection service, among others. 20

6 INTRODUCTION RULES AND REGULATIONS This house rules manual is intended to place upon the lots or house & lots mutually beneficial rules, regulations and guidelines for the benefit of their owners and future owners. The developer hereby declares that all lots and house and lots in the subdivision shall be subject to the house rules manual for the purpose of enhancing and protecting the desirability of the subdivision and for placing order. 1. HOMEOWNERS ASSOCIATION 1.1 To ensure consistent delivery of basic services and the enforcement of subdivision house rules, Homeowner s Association is form. 1.2 The areas of responsibility of the HOA are as follows: To enforce rules, regulations, board resolutions and construction guidelines of the Homeowner s Association. To manage the operations of the common areas of the Homeowner s Association. To effectively manage third party service providers on security, cleanliness and upkeep, garbage collection, and landscaping. To manage and maintain the common areas, amenities, facilities and utilities in efficient working condition and in good repair Drivers must observed proper road courtesy Practice driving along roadways and parking areas is not allowed Vehicles should be parked only in their assigned parking slots and spaces. Parking along driveways or any other area not designated for car parking purposes is not allowed Vehicles must be parked properly to avoid blocking the road ways and the parking spaces of other owners Playing loud music while inside the subdivision premises is not allowed Common area faucets shall not be used for vehicular cleaning In case or road closure due to parties/gathering, the home owner must inform secure a permit signed by the Association President or the Vice ahead of schedule In case of visitor road parking, allowable time should be 3 days maximum only No double parking at all times First stop, first go is encouraged PRIVATE SECURITY PERSONNEL AND FIREARMS Unit owners or tenants employing or wishing to employ security personnel or guards including but not limited to closed-in-security, must seek clearance and register such security personnel or guard with the Homeowners Association Office. It is at the sole discretion of the Homeowners Association Officer to deny or approved the application, as authorized by Homeowner s Association Only security personnel duly registered with the Homeowners Association Office shall be allowed entry to the subdivision Private security personnel or guards of residents are not allowed to carry firearms within the subdivision and shall be prohibited from gambling, drinking alcoholic beverages and loitering. 1 18

7 3.2 ASSESSMENTS All lots shall be subject to monthly association dues and special assessments in order to fund the costs of fulfilling the purpose of the Association. Each owner is required to pay the monthly association dues and all other assessments No owner may waive or avoid responsibility for payment of any assessment by not using his Lot or the Common Areas or by disputing the purpose of the monthly dues and special assessments or for any other reason An Owner who has failed to pay the Association dues or any assessments, on a date determined by the Board, shall automatically, without need of declaration to that effect, be considered a delinquent member of the Association. If the dues or any assessments are not paid within thirty (30) days after the due date, the dues or assessment shall bear interest from the date of delinquency at the rate, which shall be determined by the Board. Late fee/interest rate is 5% The lien on the Lot shall be foreclosed in like manner as a mortgage of real property. No Owner may waive or otherwise escape liability for the assessment provided for herein by non-use of the Common Area or abandonment of his Lot An Owner s voting rights shall be suspended in the event that dues or any special assessments are past due for at least ninety (90) days The Association shall have the right to refuse to render any services handled or extended by the Association to a delinquent member such as garbage collection, use of amenities, etc The Homeowners Association Officer or any of the guards on duty shall not received registered mails for and on behalf of any resident. Couriers of registered mails will be advised to make delivery directly to the Unit Owner concerned Any form of statements /invoice/utility bills may be received by the guards if the home owners are not present DRIVERS, HOUSEHELPERS AND MEDICAL AIDES Drivers, house-helpers, medical aides and other people under the employment of Unit Owners of tenants must be registered with the Homeowners Association Office and must secure proper identification card They are not permitted to sleep in any portion of the common areas of the village and its grounds If they wish to exit the village with items to be brought out, they must secure a gate pass from the Homeowners Association Office or Security Guard on duty or a written authorization from the Unit Owner or tenant allowing them to bring said items outside the village VEHICLE STICKERS Vehicles of Unit Owners and Tenants must be registered with the Homeowners Association Office. Owners shall provide a photocopy of the vehicle registration, official receipt together with a filled- up application form A minimal fee for each vehicle sticker will be collected by the Homeowners Association Officer The vehicle sticker shall be posted on the vehicle s front windshield, drivers side, or as may be prescribed from time to time by the Homeowner s Association All vehicles entering the subdivision shall be subject to physical inspection when entering and exiting the gates Require tenant to fill-up the Resident Information Form and submit the following documents 3 16

8 4.5.3 Require tenant to fill-up the Resident Information Form and submit the following documents a. If tenant id Filipino-present original document and submit photocopy of at least two (2) valid ID. b. If tenant is Foreigner- present original document and submit photocopy of Passport and ACR (Alien Certificate of Residency) and at least one (1) valid ID File filled up Resident Information Form, photocopy of valid ID and documents, notarized copy of lease contract. 4.6 If the unit leased to a third party, the unit owner shall be held responsible for ensuring that the lessee shall use the unit only for the purpose(s) set forth in the Deed of Restriction. The unit owner shall be primary liable for any damage that may be caused by the lessee s actions during the use of the common areas and amenities. 4.7 Commercial or business advertising signs shall not be placed, constructed or erected on the Lots without prior consent of the Association. 4.8 Nameplates, professional signs of Homeowners and sale/leasing signs are permitted as long as they do not exceed eighty (80) by forty (40) centimeters in size. 4.9The Association reserves the right to regulate the plants and/or trees to be planted to the planting strip of the sidewalk outside the Lot. No tree outside the Lot shall be cut, removed or damaged, nor shall it be relocated or transferred without the prior written approval of the Board In case there are trees planted along the sidewalk near the construction site, it is the responsibility of the Owner to effectively protect the trees by fencing or enclosing it with plywood or any materials that will serve the purpose. 5.9 SECURITY AND SAFETY Any unusual occurrence in the village shall be reported immediately to the Homeowners Association Officer or to the security guard on duty for appropriate action Guests shall be required to show valid identification cards; to fill up needed information in the visitor s logbook; and to deposit the identification card before access is granted Furniture, fixtures, equipment, appliances and other belongings of unit owner/lessee shall not be brought in and out of the village without the appropriate gate pass or authorization from the unit owner. The gate pass must be signed by the unit owner of his authorized representative, countersigned and acknowledged by the Homeowners Association Officer. A complete list of particulars of each equipment, furniture, appliance, or device to remove from the unit shall be indicated in the gate pass. Any items not included in the list shall not be permitted to be brought in or out of the village The unit owner or tenant shall be personally liable for any damage that may cause to any facility or to any part of the common areas during hauling of the furniture or appliance. Any furniture, appliance, or device to be brought in or out of the village is encouraged to be schedule during off peak hours The Lots shall not be used for any businesses activity such as but not limited to convenience stores, bakeries, restaurants, offices, warehouse, car repair shops, inns, dormitory houses, play school or school tutorial center and the like. The Lots shall not be used for any immoral or illegal activity. 5 14

9 a. To require users of the facilities and amenities to provide proper identification. b. To make, add, amend and revoke any of the rules on the use of common facilities and amenities deemed necessary. c. To require the use of appropriate attire when using the facilities or amenities. d. When inside the subdivision premises, observe decency at all times. Wear appropriate clothing when walking around. 5.1 USE OF BASKETBALL COURT The basketball court is for the exclusive use of Unit Owners and Tenants Rental fee is Php200.00/hour should there be utilization of court spotlights. In the event that the homeowners will bring sponsored guests, entrance fee is Php20.00/pax The basketball court shall be open and available for use from 6:00am to 9:00pm daily. The key to the basketball court can be secured from the main entrance guard For safety reasons, unaccompanied minors are not allowed to use the basketball court. Users must observe safety precautions at all times Bringing in and the consumption of food, alcoholic beverages, smoking, and littering inside the court is strictly prohibited Any damage of the equipment or facilities due to gross negligence on the part of the user shall be charged accordingly Regular construction work is only between 7:00 am to 12 noon and from 1:00 pm to 5:00 pm but no heavy equipment or machinery shall be operated between 7:00 am to 8:00 am No full-scale construction work is allowed during Sundays and Holidays. Only items of concrete, masonry, plumbing, electrical, painting and landscaping works that do not create excessive noise and a maximum of three (3) workers per item of work are allowed during Sundays or Holidays upon formal prior request from, and approval by, the Homeowners Association office Overtime work is permissible for cause up to 7:00 pm only on regular working days. Applicants should specify the date, number of people and items of work to be done during overtime No burning of any materials is allowed inside the subdivision. Open flames are not allowed except for the cooking of food Construction surplus and garbage should be hauled out from the subdivision at the expense of the builder/owner Trucks delivering construction materials must not pass over the sidewalk pavement without proper measures taken to protect said sidewalk pavement and other street sections such as curbs, gutters, etc. Trucks should not litter the street with gravel, etc. in going to and from construction sites. The Association or Board may charge truck entry fees for allowing trucks of a certain size to enter the subdivision. No delivery of construction materials, equipments and supplies can be allowed during off-working hours, especially at nighttime The Developer/Association may from time to time send its authorized representative to inspect the structure on the basis of the approved plans, terms and conditions. In case of deviation, the Owner must rectify the said deviation within a reasonable time Temporary latrines or portable toilets for the workers should be built before any construction work is allowed. The facility shall be located within the premises of the Lot. 7 12

10 b. Cooking or heating of food is not allowed in any part of the common areas. c. The common comfort rooms shall not be utilized nor be used by the caterer or his personnel for washing their implements. d. Washing of utensils, plates and the likes should be done only at the designated area intended for such activity subject to approval of administrator. e. All left-over, trash, rubbish and garbage resulting from the catering services shall be disposed by the caterer at its own expense. f. Dinking of liquor is not allowed in common areas e.g. rotunda, play area, basketball court (except for parties at the clubhouse) parking of visitors must be well monitored so as not to cause inconvenience to the passing vehicles. 5.3 USE OF PLAY AREA Playing hours are from 6:00am to 8:00pm Rough playing is not allowed Excessive shouting or noise is highly discouraged Children below 13 years old shall be accompanied by an adult Garbage or food left-over should be disposed of accordingly The Homeowners Association and its Administrator assumes no liability for injuries or accidents that may occur. 5.4 NOISE CONTROL Consideration must be extended and maintained for the privacy and peace of the neighbors in the Village. The unnecessary horn tooting, loud and disturbing noise, among others, the uncontrolled operation of video karaoke sound systems and other similar sound producing devices are not allowed in compliance to the Anti- Noise Ordinance of the City Residents are advised to refrain from any noisy or disturbing activities which will interfere with the peace and comfort of their neighbors When conducting parties and other celebrations, residents are advised to inform their neighbors of the activity. Noise must be reduced after 10:00 pm to promote good night sleep of neighbors. This act of courtesy may prevent misunderstanding and improve relations among neighbors. 5.5 PET CONTROL Pets shall be limited to domesticated animals and must not be in commercial quantity Pets shall be properly vaccinated and shall not be the source of annoyance to residents Pets must be confined to the pet owners lot and must not be allowed to roam freely. Pet owners are responsible for any damage caused by their pets Pets in transit are to be carried, restrained by a leash, or placed in an animal carrier Persons who walk pets are responsible for immediately cleaning up after waste of their animals and discarding pet droppings Limit up to 3 pets only per household. 5.6 GARBAGE CONTROL Residents shall maintain their premises in a clean and sanitary condition and shall provide themselves with garbage bins with cover Garbage bins shall be placed only within the lot area of the resident Wastes must be segregated as Biodegradable (malata) and Nonbiodegradable (dimalata) Residents should follow the disposal schedule. Dumping of loose garbage along the pavements, footpath or anywhere in the common areas is strictly prohibited. 9 10
