Kelly Sheri Perkins Public Meetings 1 st & 3 rd Wednesday of each month MINUTES Thornbury Township Board of Supervisors Meeting Wednesday, March 16, 2011 The Thornbury Township Board of Supervisors held a Work Session on Wednesday, March 16, 2011, at the Township Administration Building, 6 Township Drive, Cheyney, PA. Chairman Raith called the meeting to order at 7:00 p.m., with a salute to the flag. Number of Attendees: 8 PRESENT: James H. Raith, Chairman James P. Kelly, Vice Chairman Sheri L. Perkins, Supervisor Jeffrey T. Seagraves, Manager Geoffrey Carbutt, Township Secretary Lindsey Price, Roadmaster Peter Barsz, CPA, Treasurer Robert P. Anderman, Esq., Township Solicitor James McCann, PE, Township Sewer Engineer Chairman Raith announced that the Board previously held a brief Executive Session this evening regarding real estate matters. APPROVAL OF CHECK REGISTERS On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the General Fund check register in the amount of $42, for March 3, 2011 through March 16, 2011, was approved. Chairman Raith called for public comment. There was no public comment. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the Sewer Fund check register in the amount of $25, for March 3, 2011 through March 16, 2011, was approved. Chairman Raith called for public comment. There was no public comment. On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the Escrow Fund check register in the amount of $3, for March 3, 2011 through March 16, 2011, was approved. 2 Minutes Board of Supervisors Work Session 2 March 16, 2011 APPROVAL OF MINUTES On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the Wednesday, March 2, 2011 Public Meeting minutes were approved and adopted. Chairman Raith called for public comment. There was no public comment. AGENDA ITEMS On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the Paaby Agreement of Sale for 7.79 acres located at 34 Westtown Road, was approved. Chairman Raith called for public comment. There was no public comment. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the Kressly Agreement of Sale for acres located at 103 &132 Creek Road, was approved. Chairman Raith then mentioned the upcoming trail clearing on Creek Rd this weekend. Chairman Raith called for public comment. There was no public comment. On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the request to advertise for bids for the 2011 Sludge Hauling Contract to be received by April 4 th, was approved. Chairman Raith called for public comment. There was no public comment. STAFF REPORTS TOWNSHIP MANAGER'S REPORT- Jeffrey Seagraves The Township Manager s Report was submitted and is attached. There was no comment on the Manager s Report. On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the rental of a room for post- prom activities at Rustin High School, at a cost of $ was approved. Chairman Raith called for public comment. There was no public comment. On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, a study of sewer extensions to Brinton Lake Colony, Highpoint Drive and, Fox Lair for the feasibility of installing public sewer systems at a cost not to exceed $ was approved. Chairman Raith called for public comment. There was no public comment. On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, a donation to the Western Delaware Valley Lions Club for the family of Mark Kelly was approved. Chairman Raith then mentioned it was a worthy cause. Chairman Raith called for public comment. There was no public comment.
3 Minutes Board of Supervisors Work Session 3 March 16, 2011 TOWNSHIP ROADMASTER S REPORT Lindsey Price The Township Roadmaster s Report was submitted and is attached. There was no comment on the Roadmaster s Report. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the purchase of two Ex- Mark 34 HP 72 deck mowers on State Contract # from Conway Power Equipment of West Chester, at a cost of $ each, less trade of $ for a total purchase price of $13, was approved. Chairman Raith called for public comment. There was no public comment. On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the purchase of a replacement Mini Whirl with mechanical brake, from Game Time of Spring Lake, NJ, on State Contract # P-6385, for a total cost of $2,416.00, was approved. Chairman Raith called for public comment. There was no public comment. On a motion by Sheri Perkins, seconded by James Kelly and carried unanimously, the hiring of four part-time Summer Help Employees from June through August, at an hourly rate of $10.50, was approved. Chairman Raith called for public comment. There was no public comment. Chairman Raith recommended that the Board of Supervisors accompany the Roadmaster and Township Engineer on the upcoming Road Inspections April 6 th. TREASURER S REPORT Peter Barsz, CPA The Township Treasurer s Report was submitted and is attached. There was no comment on the Treasurer s Report. On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the Treasurer s report for February, 2011 was approved and adopted. Chairman Raith called for public comment. There was no public comment. TOWNSHIP SOLICITOR S REPORT Robert Anderman, Esq. The Township Solicitor s Report was submitted and is attached. There was no comment on the Solicitor s report. TOWNSHIP ENGINEER S REPORT Elizabeth Catania, PE The Township Engineer s Report was submitted and is attached. There was no comment on the Engineers report.
4 Minutes Board of Supervisors Work Session 4 March 16, 2011 SEWER ENGINEER James McCann, PE The Township Sewer Engineer s Report was submitted and is attached. There was no comment on the Sewer Engineers report. 5 MANAGER S REPORT We have scheduled a meeting with TD bank to discuss the use of their services. 2. I received several phone calls regarding a residence on glen Mills Road that was reportedly sold at Sheriffs sale. Our Code Enforcement officer is following up on concerns raised by residents. 3. I spoke with Jonathan Minniman, HOA President for Greenbriar phase V. They have questions about the dedication process. 4. Our current Sludge Hauling contract expires soon and I asked Pennoni has prepared bid specifications for an RFP. We would like permission to advertise. 5. We ve received proposals for TV camera inspections and light repairs for sewer lines and would like approval to move forward. 6. We have prepared the invoices for residents that have entered into the deferred payment agreement for WSSD-2. Those invoices will be due for payment on April 20, I ordered a new chlorine dosing pump at a cost of $860 total with shipping. The extra cost for this chemical pump is related to the flow proportional signal it accepts from the flow meter and the availability to set the chlorine for flow pacing. 8. On Monday , I attended meeting in Lansdowne regarding the Delaware County Municipal Energy Efficiency Grant Program. I would recommend that we commit to having the energy audit performed and also to applying for the $15, grant for which we are eligible. 9. On , I attended a meeting at the CCIU regarding CCTC. Our tax collections are off significantly from previous years due to the transition from Berkheimer and Keystone. Representatives from Keystone were on hand and assured us that they are working to rectify the situation and should have all issues resolved soon. 10. I received the agreement of sale from Dottie Kressly s attorney on Monday and I am recommending that we execute the agreement as presented. 11. I received the Agreement for Sale of the Paaby property, and I am recommending that the BOS approve the agreement as presented. 12. We held a Google Earth seminar on We have scheduled Local government day with Rustin High School for Thursday I will be out of the office from Thursday to through Monday
6 THORNBURY TOWNSHIP Public Works Department Report Week Ending March 11, Cleaned stormwater inlets and poor drainage areas throughout Township. 2. Commenced pothole repairs throughout Township. Project remains ongoing. 3. Completed sign replacement project throughout Thornbury Hunt development. Will begin sign replacement project throughout Thorn Hill Development upon delivery of signs. 4. Cleared down tree and debris from Locksley Road as a result of storm damage and assisted State Police and Edgmont Township Fire Department. 5. Met with contractors regarding roof repair project at Chester County Building. Waiting receipt of three Bids 6. Advertised Township Jeep For Sale Bid openings will occur at first meeting in April Preliminary list of 2011 Road Program is attached for the Board s review. The list will be provided to Township s Engineer for review.
7 Township of Thornbury Delaware County, Pennsylvania Solicitors Report March 16, 2011 The Township Solicitor, Robert P. Anderman, Esquire, reports as follows: I. WEST SIDE SEWER DISTRICT MORTGAGE RECORDING The Solicitor has now recorded fifty-three (53) mortgages which represents all of the mortgages given to the Solicitor. There are still a number of property owners who have not contacted the Township which will require the filing of a lien against the property when properly authorized by the Board of Supervisors. II. THE PERSERVE AT SQUIRE CHEYNEY SEWER PUMP STATION In this matter, MGK Industries, Inc. has a claim against the Developer for work done on the Pump Station and has indicated that litigation might be commenced against the Township, however, at this point in time the attorney for the Developer has requested we use the good offices of the Township to attempt to resolve this problem which would be in the best interest of the Township. III. PENSION PLAN ORDINANCE In this matter, the Board of Supervisors has authorized the Solicitor to advertise this matter for consideration at the public meeting on April 20, The Pennsylvania Law now only requires that this type of Ordinance be considered on the regular agenda at the public meeting and no hearing, as such, is required. Therefore, the Solicitor will advertise this matter to be considered at the public meeting but no actual hearing. IV. CANNON PROPERTY OPEN SPACE The Solicitor ordered the title search and report and has received the same from the Title Company and will forward a copy to the Seller for their information and action.

MacDade Boulevard Milmont Park, PA Phone ( ) Fax ( ) REPORT OF THE ENGINEER March Workshop Meeting March 16, 2011 Work completed for the period: Greenbriar - Phases Developer has responded and is currently replacing concrete is areas where they have agreed should be completed. The Township has received the letter concerning the basin and maintenance. Brian O Neill of Weeds, Inc. Has completed a report (attached). It does not answer the question posed and an amendment will be forthcoming. This report should be forwarded to the HOA to assist intheir maintenance responsibilities. Blantyre - Completing periodic erosion and sedimentation inspections. Mill Creek - All work has been substantially completed. Completing periodic erosion and sedimentation inspections. Grading and Encroachment Permits - Working with the Township Licenses and Inspections on several permits. Andover - Completing sedimentation and erosion control inspections. House construction is continuing. Cheyney University - The geothermal field continues. Grading plan revision has been submitted for consideration and has been reviewed. Several items must be addressed prior to approval. Joseph Gricco - Received land development plans for a combined driveway for the Locksley Road property. A waiver of the separate driveway requirement is being sought. The applicant has been asked to address this item. Collins Subdivision - PaDOT comments must be addressed. Wills - Plans have been received this week for review. The Applicant has added a driveway onto Skyline Drive. Cherry Creek - Met with representatives of the three developers to discuss sidewalk conditions. Developers to prepare a response for the Boards consideration. The Solicitor has forwarded a letter to request resolution of the matter. I am not aware of an resolution. PaDOT Liquid Fuels - Reviewed PADOT street list for accuracy. A few streets have been added. The Solicitor is researching files for deeds of dedication. Road Program - The Roadmaster has completed a list of streets. Expect to review with him within the week for road inspection by the Board.
9 THRN March 10, 2011 ENGINEER'S REPORT REGARDING WASTEWATER ISSUES March 16, TV SEWER INSPECTIONS Pennoni has requested quotes from three contractors for the TV inspection of approximately 6,450 linear feet of 8-inch sewer lines in Cobblestones and the Brinton Lake Colony (see attached Plans). Quotes are to be received by 1:00 on March 23, SLUDGE HAULING CONTRACT The current Sludge Hauling Contract expires on April 30, The Manager has requested that Pennoni compile the specifications and bidding documents for a new Sludge Hauling Contract. It is proposed to advertise for bids on March 18 th and 22 nd and then open the Bids at 10:00 am on April 1, Authorization to advertise for receipt of bids is requested. Suggested Motion: I move that the Township Sewer Engineer be authorized to advertise for receipt of bids for the 2011 Sludge Hauling Contract with bids to be received on April 1, CHAPTER 94 REPORTS Pennoni has prepared the Chapter 94 Report for the West Side Sewer District and forwarded a copy to the Township Manager for review. The Chapter 94 Report for the East Side is in progress. Both reports will be submitted to the PaDEP by March 31, SEWER DEDICATION Pennoni has received a letter requesting the preparation of a punch list for Phase V the of the Greenbriar Subdivision. The developer has proposed that Pennoni perform their inspection in conjunction with the televising of the sewer lines. Pennoni is working with the developer to coordinate the inspections, scheduled for March 18 th. NON-RESIDENTIAL SEWER REGULATIONS Pennoni is working with the Manager and the Sewer Committee to evaluate the need to update the current sewer regulations for non-residential customers. The West Side Sewer District is currently required to comply with the requirements of the Concord Township Sewer Authority s regulations (which have recently been updated and include requirements for non-residential users). However, it is recommended that Thornbury adopt a Township wide regulation that mimic the Concord Authority s regulations. It is further recommended that the Township evaluate the benefits of implementing a permitting program for non-residential customers.
