1 NORTH CODORUS TOWNSHIP October 21, 2014 BOARD OF SUPERVISORS Page 1 of 5 Chairman Nelson Brenneman called the meeting to order at 6:30 p.m. with the following in attendance: Supervisor Dennis Luckenbaugh Supervisor Rodney Shearer Mark E. Derr, Manager Dave Jones, Solicitor Julie Maher, Recording Secretary Seven Citizens I. Minutes Motion by Shearer, second by Luckenbaugh, to approve the minutes of the regular meeting held on September 16, 2014, and the recessed meetings held on September 27, 2014 and October 14, All members II. Treasurer s Report A. Motion by Luckenbaugh, second by Shearer, to approve the Treasurer s Report for September 2014 as presented. All members III. General Public Comment A. Chris Spagnola Heindel Road Mr. Spagnola was present on the 1218 Heindel Road property. He admitted that he didn t obtain a permit before doing the work on his property and the concrete wall is in the road R-O-W. He was notified that there are some concerns about the placement of the wall. He noted that there will be dusk to dawn lighting on the ends of the wall to help alert motorists of the wall s presence. He feels that the improvements will be esthetically pleasing when completed. Is there enough sight distance for pulling out of the driveway? Yes. Mr. Derr noted that the biggest problem would be the Township s liability if someone is injured after hitting the wall. Mr. Jones can provide an Indemnification Agreement that Mr. Spagnola can sign to agree to hold the Township harmless in the event of an accident. Mr. Spagnola would be responsible for the costs associated with that Agreement. It was noted that the lights on the wall cannot shine onto the private roadway surface. Motion by Luckenbaugh, second by Shearer, to authorize the Solicitor to prepare the Agreement between Mr. Spagnola and the Township. All members B. Jon Holmes Proposed Zoning Change Mr. Holmes was present to request a zoning change for the Grace Fellowship Church property. Mr. Luckenbaugh noted that the amended zoning ordinance and subdivision and land development ordinance are scheduled to be reviewed by the YCPC on Monday. He also noted that in the new sign ordinance, churches are permitted a 20 square foot sign only. Mr. Holmes feels that if the church were to comply with the ordinance requirements, the sign would be too small to be useful, since the church sets back so far from the road. He also feels that the church property should be zoned Highway Commercial which borders the property on three sides. It was noted that the new zoning has this property listed as R-3. Mr. Luckenbaugh isn t interested in making any changes to the proposal. If the zone is changed, would the church be permitted to put up the size sign it wants? Mr. Holmes feels that they would; he said there s no definition of business in the ordinance. He feels strongly that the church s property fits the Highway Commercial zone. Mr. Jones noted that the Board members are not obligated to make any changes to the proposed ordinance. Motion by Luckenbaugh, second by Brenneman, to deny the request by Grace Fellowship. 2 Board of Supervisors October 21, 2014 Page 2 of 5 C. Scott Zeigler had a question about the trash collection contract. It was confirmed that there will be no mandatory garbage collection, and the price has increased. He believes that the Board did not make this change for the majority of the citizens of the Township and that there will be an increase in burning of unauthorized materials and dumping of garbage along the roadside. He also had a question about the removal of a tree on North Rohrbaugh Road. He believes that it s going to fall on the road. Mr. Brenneman will speak to the property owner on Friday. He asked if the Township is going to withdraw from Southwestern Regional Police Department. Mr. Shearer indicated that there has been no decision to withdraw, but the Township is certainly interested in keeping the costs down. IV. Police Report No report. V. Fire Company Report Chief Wildasin gave the report for September Discussion was held on purchasing a new brush truck and donating it to the Township. They ve decided on a Ford 550 chassis, at a base cost of $37,125. A box will be built onto the back for the tank, pump, and equipment. Total cost: $112,125.00; no loan; cash payment; donating it to the Township; gasoline engine; 5-speed automatic transmission, four-wheel drive. Motion by Shearer, second by Luckenbaugh, to approve the acceptance of the brush truck. All members Mr. Luckenbaugh requested that the two unused cell phones on the trucks be returned to the Township so they can be removed from the Township s plan. Will do. Chief Wildasin noted that the tanker/pumper truck is nearing the end of its life. He s looking ahead to purchasing another one. In some instances, the build time is nearly a year. The new one will need to seat more than two persons. Cost: $450,000 to $490,000. It would be a split so and the Township would actually be the owners of the truck. Chief Wildasin requested that the Board look at including this cost in the budget for VI. Permits, Plans, and Modules A. Clark Craumer discussion of waiver Rigging and Digging - Trinity Road Mr. Craumer presented information on the project on the Hinson Paving property on Trinity Road. Unknown if a land development plan is needed. A waiver is requested. The trailer is to be placed on the parking lot which is already an impervious surface. The Zoning Officer recommends the granting of the waiver. Motion by Luckenbaugh, second by Shearer, to grant the waiver requested by Rigging and Digging to not be required to submit a Land Development Plan. All members The $100 waiver fee will be paid. B. Jon Bare, Final Subdivision Plan #C , York Road Clark Craumer was present on this plan. Currently, there are three separate parcels which the applicant wants to combine into one parcel. The applicant would like to be permitted to use the second driveway on the property on occasion. It was noted that the Planning Commission recommended approval of the plan (subject to the satisfactory resolution of some open items), and the waivers. Motion by Shearer, second by Luckenbaugh, to approve the Planning Waiver & Non-Building Declaration, and to forward it to DEP AND to approve the waiver request for Section A (Sewer Feasibility Study); to approve the waiver request for Section B (Hydrogeological Study); to approve the waiver request for Section D (Traffic Impact Study); to approve the waiver request to Section A (Number of Driveways per lot), AND to approve Plan C , Jon A. Bare. All members

Based on the audit of the York Adams Tax Bureau, the Township will receive a refund in the amount of $4, due to the cost of collection being less than anticipated. Rodney Shearer: 1. The Stambaugh Road project to be completed within the next two weeks. Can they use a surveyor to give Mr. Jones the particulars on the description, etc.? Yes. Nelson Brenneman: No report B. SPCA 2015 Animal Care & Housing Agreement $4,453, same as 2013 & 2014 Motion by Luckenbaugh, second by Shearer, to approve the 2015 contract with the SPCA. Two members voted aye; Brenneman opposed. Motion carried. 4. Motion by Luckenbaugh, second by Sharer, to designate Mark Derr as the Voting representative and Nelson Brenneman as the alternate for Chesapeake Bay Pollution Reduction Plan Committee meetings. All members 5. The Township received an Amendment to the York County Solid Waste Authority Agreement; this modification will permit the Authority to obtain a bank loan. Motion by Shearer, second by Luckenbaugh, to approve. All members 6. Motion by Shearer, second by Brenneman, to award the manhole covers project to Stewart and Tate at a cost of approximately $1,500, NTE $2,000. All members 7. Aylesbury is planning to flush the storm sewer lines on Thursday. Someone from the Township must be present. Mr. Shearer will be there. 8. The parking lot paving was discussed. The Board members are not satisfied with the work. Mr. Brenneman will try to set up a meeting to review/discuss. 9. Budget meeting set for the conclusion of this meeting. C. Engineer s Report No report. D. Solicitor s Report 1. Helwig s Operations, Inc. WWTP Operator contract Mr. Jones noted that Helwig doesn t carry insurance, so all liability would be on the Township, and the hourly charge is $40 per hour for a part-time person. Could NCT go in with Jackson Township to share an operator? 2. Settlement on the Community Building property will likely be next week. Motion by Luckenbaugh, second by Shearer, to authorize Mr. Brenneman to sign the deed, and to authorize Mr. Jones to prepare all associated paperwork for the Community Building settlement. All members VIII. Old Business 1. SALDO/Zoning Ordinance will be reviewed by YCPC October 27, 2014, at 7:00 p.m. 2. Public Works storage building land development/site plan Is the Township required to submit a Land Development Plan for the pole building? Consensus: proceed with the design of the pole building, the LDP for the building, and submit the project for engineer bidding. IX. New Business Nothing at this time. X. Announcements A. Rec Board October 7 p.m. B. Planning Commission October 6 p.m. C. Southwestern Regional Police Board November 7 Police Headquarters D. Next Board of Supervisors meeting November 6:30 p.m.

The Board returned from Executive Session at 8:50 p.m. Motion by Shearer, second by Luckenbaugh to have Stock and Leader assist the Township in opposing the unemployment compensation claim filed by Russell Fuhrman. All members Mark Derr reviewed the proposed budget and responded to questions of the Board of Supervisors. Motion by Brenneman, second by Shearer, to recess the meeting to Thursday, October 30, 2014 at 8:00 a.m. to continue review and discussion of the budget and any other business that may come before the Board.
