2 Terms & conditions of Public Auction in brief: 1. Each intending bidder will have to submit Caution Money Deposit (CMD) of Rs. 5,00,000/- (for Machineries) / Rs. 50,000/- (for Cars)& Tender Cost of Rs. 500/- per head in the form of Bankers Pay Order or D.D. of a National Bank in favour of REGIONAL PROVIDENT FUND COMMISSIONER, KOTA on or before 28/10/2013 upto AM with the Recovery Officer, EPFO, Kota at Sub Regional Office, EPFO, Bhavishya Nidhi Bhawan, Vigyan Nagar, Kota (Rajasthan). 2. The highest bid quoted during the auction process may be accepted or rejected by the Recovery Officer, EPFO, Kota without assigning any reason subject to the provisions of the EPF & MP Act, 1952 read with Second Schedule to the Income Tax Act, The successful bidder shall have to pay Earnest Money Deposit (EMD) of 25% (of the accepted bid value exclusive of taxes etc.) immediately or on the next working day failing which CMD of Rs. 5,00,000/- (or Rs. 50,000/-) paid by the defaulting bidder will stand forfeited (along with all rights on the purchased property) in favour of the Recovery Officer, EPFO, Kota. Balance amount (along with taxes etc. as applicable) shall be required to be paid by the successful bidders to EPFO within 07 days. After payment of full amount, the successful bidders shall take delivery of the purchased property at their own cost/arrangements without affecting/damaging the existing structures & entire delivery to be effected during office hours/days within 15 days from the date of auction. 3. Before participation in the auction process, each bidder shall declare in writing its (of a third party on whose behalf he/she is bidding) correct name, detailed postal address, telephone/fax numbers, PAN number & other relevant details. No name once given at the time of paying EMD can be changed in the bidding-sheet. The Certificate of Sale (EPFCP-14)/Delivery Order will be issued by the EPFO in the name as given in the bidding-sheet & will be received by the person who signs the bidding-sheet at the time of auction. Any bidder if he is bidding on behalf of a third party should exhibit an authority-letter issued to him by the owner or responsible officer of said third party. 4. All statutory taxes/levies/duties or any other charges shall be borne by the successful bidder. 5. All the goods will be sold as various lots as decided by the Recovery Officer, EPFO, Kota in the same condition as they stand i.e. As Is Where Is Basis subject to reserve price fixed by the EPFO. Any lot can be withdrawn from the auction by the Recovery Officer, EPFO, Kota without assigning any reason. 6. The goods will be sold on the assumption that the bidders have inspected the lots and have known that they are buying whether they have actually inspected them or not, and no complaints as to the quality, quantity, size, measurements, breakage, number, weights etc., of the goods will be entertained from the buyers by weight or number. The Auctioneer/Recovery Officer, EPFO, Kota do not give any guarantee or warrantee or undertake any responsibility for the make, manufacture, description, quality, condition, size, weight, grade, accuracy, soundness & completeness etc. of the goods. He shall not be entitled to claim any damage, loss or profit, interest or compensation, on any account. 7. No sale shall be invalidated by reasons of any defect or fault in any of the goods or lots by reasons of any defect or fault in description thereof in the catalogues or particulars or faults in or error in description. 8. All bidders and purchasers shall be deemed to have read and acquainted with these terms & conditions of the sale and have given their bids subject to these conditions. Presence in the auction or participation in the bid shall be deemed to be an acceptance of the conditions specified here. 9. The amount by which each bidding is to be increased shall be determined by the Auctioneer conducting the sale. In the event of any dispute arising as to the amount of bid, or as to the bidder, the lot shall at once be again put to auction.

All the bidders should note that in case the full amount arrears due for which the proclamation of sale has been given is paid before the conclusion of the auction, the auction will automatically become cancelled. On no account the bidders can claim any costs, expenses or other compensation for their having attended and participated in the auction. Similarly, in case there is any stay from any authority including the Court, the auction will be postponed or cancelled without any further notice and the persons participating in the auction can not claim any damages etc., for such postponement. 11. The Recovery Officer, EPFO, Kota conducting the auction reserves the right to prevent any individual from participating in the bid if he is satisfied that such an individual s presence may impede the progress of the auction. 12. The goods once sold, shall remain in every respect at the risk of the buyer from the date of auction onwards and the EPFO shall not be under any liability for the safe custody or preservation thereof from that date. 13. Decision of the Recovery Officer, EPFO, Kota conducting the auction will be final & conclusive in the matter of sale/auction of property subject to the provisions of the EPF & MP Act, 1952 read with Second Schedule to the Income Tax Act, Any legal dispute may be attended in Kota (Rajasthan) jurisdiction only. 14. No employee or person employed or connected with the EPFO, Kota or the Auctioneer is entitled to participate in the auction process either directly or indirectly. 15. The particulars mentioned in the auction document have been stated to the best of the information of Recovery Officer, EPFO, Kota who shall not be answerable for any error, misstatement or omission in it. 16. Any other special condition which will be announced by the Auctioneer, under the instruction of Asst. provident Fund Commissioner & Recovery Officer E.P.F.O, Kota at the time of auction.
