The tracts have been marketed for over $300,000 with no sales. The assessor has a value of $145,000, but discounted the values for subdivision sellout to $99,557 per parcel. This value was not reflected in the Notice of Determination, but should have been. No other information was presented that would present a lower value. The property does not meet the requirements for agricultural classification, in my understanding. The recommendation of change is from $145,000 to $99,557 per parcel. The assessor s sales ranged from roughly $74 to just over $112 per square foot, with the higher end presented by a newer project. The subject location was better than most of the sales. The assessor interpreted a law in the manner that the Division of Property Taxation requires, and therefore, the appeal must be denied at this level. It involves the owners transfer of certain rights in a conservation easement, and the resulting classification of the remaining land areas in the reserved residential portion. In good times, the partial improvements don t add full value of the cost until the subdivision final plat is in place, indicating full completion, and the lots begin to sell. It is appropriate to reduce the value, (the assessor had recommended lowering the land value) with the land value at $30,000 per acre with an added value of $10,000 per lot, as opposed to $20,000 per lot at cost. The assessor had recommended lowering the value from $1,420,240 total, to $1,051,950. Lowering the site improvements as well, indicates a total value of $841,950. This is broken down per schedule. Under the theory of homogeneity, values in a neighborhood gravitate toward a central value. This home was added on and remodeled. Average values in the area are over $130,000 lower. A value at $125 per square ft considers the large size of the house in a neighborhood that consists of smaller homes, lower priced. The owner thought the ditch easement was 50 feet wide, but the plat shows 70 feet, in addition to a 25 foot easement for an overhead powerline. The value recommended is from the assessor s estimates of fair mobile home lots.
